Question 1:
In Amendment No. 3, Section 31 11 00.00 12 “Clearing and Grubbing”, paragraph 3.4.1 revisions have caused confusion amongst potential clearing contractors. Is it the intent of the Government to have the Contractor place all grubbed material (stumps) and existing fallen trees which lie within the 100’ clearing limits, outside the sand base and have all vegetation which exist within the 100’ clearing limits disposed of offsite or burned?
Response 1:
Yes, that is the intent.
Question 2:
In regards to the clearing and grubbing of the future levee area:
Specification section 31 11 00.00 12 paragraph 3.2.5.1 first sentence states “The entire area within the construction limits shall be cleared.” Is it the intent to clear from Right of Way to Right of Way or just in the limits of sand placement as shown on Drawing C-004 Detail H1?
Response 2:
The intent is to clear just in the limits of sand placement as shown on Drawing C-004 Detail H1.
Question 3:
Section 31 24 00.00 12 Paragraph 3.2 Sand Fill Construction states the sand fill shall be place in a bullnose configuration to minimize the amount of soft material trapped underneath the sand fill and to minimize the mud wave forming ahead of the sand fill. If a significant mud wave forms even though placement is following the bullnose construction procedure such that continued placement of sand would trap soft material trapped underneath the sand fill or overtake the sand fill, will the contractor be required to remove the mud wave forming ahead of the placement or will this be compensable by change order?
Response 3:
If a mud wave forms during sand fill placement which the COR deems to be removed, the contractor shall remove such material and place it outside the sand fill section at no additional cost to the Government.
Question 4:
Section 31 11 00.00 12 allows grubbed material to be placed outside of the footprint of the sand placement; however, above surface vegetation such as grass, bushes, weeds and down timber snags shall be removed from the project or burned. Considering most of the clearing is a substantial quantity of marsh grasses and occasional downed timber snags it is very costly to remove and dispose of the vegetation as classified by the specifications. Burning in the marsh areas with no easy access for fire control is risky, and to burn marsh grasses with attached wet roots is near impossible to burn productively. Would the government consider allowing for cutting of the marsh grass and chipping of the down timber snags and allowing cut grass and chips to displace with the muck wave.
Response 4:
No.
Question 5:
Section 01 57 20.00 paragraph 3.3 states significant work restrictions when colonial nesting wading birds or bald eagle nests are found in the vicinity of the work. In the event work restrictions are placed due to the discovery of nests with given distance and work restrictions will a change order be issued to compensate the contractor for standby and work restrictions?
Response 5:
Yes.
Question 6:
If submerged trees that are clearly from the original logging and clearing of the alignment are found disposed of below the mud surface will their relocation be compensated under change order as this would require additional effort in grubbing.
Response 6:
No.
Question 7:
Section 31 11 00.00 12 paragraph 3.3 Grubbing refers to Section 31 24 00.00 12 Sand Fill paragraph 2.1 Materials regarding what is to be removed. We just want to confirm the intent is to removed concentrated masses of unsuitable sticks, branches and roots AND the stumps.
Response 7:
Yes, that is the intent.
Question 8:
Will contractor be required to provide scales for sand measurement and payment.
Response 8:
Yes.
Question 9:
52.236-4 (c) requires the contractor to provide transportation such as an airboat or marsh buggy to Government personnel for the purpose of inspecting the work in process and documenting the progress of work for approving request for payments. Will contractor need to provide this for times the contractor will not be present, or will the government only require this piece of equipment when the contractor is present and working?
Response 9:
Required only when the Contractor is present.
Question 10:
Given the recent nature of fuel escalations can the government allow fuel escalation payments with basing fuel on a specific stated price in the bid.
Response 10:
No.
Question 11:
Section 01100 – 16 states permissible hours of work between 7am and 7pm, would the government consider adjusting the permissible work hours to daylight hours?
Response 11:
No.
Question 12:
Please provide details of the settlement plate required by the contract. A simple plate seems likely to displace with the mud wave.
Response 12:
Settlement Plate Details to be added to plans.
Question 13:
Section 32 15 00.00 12 Paragraph 1.6.2.2 states testing of surfacing material shall be performed at a minimum frequency of one set of tests per day surfacing material is placed. Given this is placed as needed for maintenance of access road J, would the government consider just one initial test of the material instead of testing every day material is placed?
Response 13:
Initial test will be required. Specifications to be changed.
Question 14:
Section 01100 paragraph 9 (d) was amended stating only one vehicle or equipment at a time will be allowed to cross over the entire width of the pipeline crossing. Please confirm the pipeline crossings allow only one truck to cross at a time over the length of the crossings and if that is what the supervision required at the pipeline crossings will be responsible for assuring beyond the axle and total weight limitations.
Response 14:
Contract only allows single vehicle traffic over all pipelines.
Question 15:
Section 01 55 26.00 12 Traffic Control and Coordination Paragraph 3.3.2 requires a traffic engineer or traffic control supervisor to inspect the project at 30-day intervals with a report issued with each inspection. Considering the minimal amount of traffic control required on the access road can the government waive this requirement.
Response 15:
Traffic Control and Coordination to be removed from solicitation.
Question 16:
Since the job is bid by the ton, what is the purpose for the settlement plates? Can they be eliminated?
Response 16:
1st part: Purpose is to determine for Government purposes the final sand thickness. 2nd part: No.
Question 17:
Since the job is bid by the ton, can the requirement for original and final cross sections be eliminated? Or does the USACE intend to verify and adjust the final delivered quantities based on the final volume measure?
Response 17:
1st part: No. 2nd part: No, quantity is measured by the ton.
Question 18:
In the question listed as number 13 in Amendment 0001 (number 6 in Amendment 0003), it is phrased “Government furnished sand” in asking the question. With that option to use sand from the USACE stockpile, does the contractor have to furnish the scales to provide sand by the ton?
What scale certification is acceptable? Plans seem to indicate use of the stockpile, as dust control is only from the sand stockpile to the levee, not from Airline Highway?
Response 18:
1st part: Yes. 2nd part: State scale certification. 3rd part: Intent is to use Government furnished sand stockpile.
Question 19:
With the scheduling of the scale certification by the local authority being beyond the control of the contractor, and with the very tight schedule for completion, will the USACE consider allowing time for any delay to the scale certification?
Response 19:
No.
Question 20:
If State scale certification is acceptable there will be scale/scanner cert fees, but will a Weighmaster License and Weighmaster be required for the scale usage?
Response 20:
No.
Question 21:
With the extreme volatility in the energy market would the USACE consider adding a fuel escalation clause to the contract for the sand deliveries and the tree disposal?
Response 21:
No.
Question 22:
There is an exclusion of off-road trucks, but with the need to keep the dump trucks from getting stuck traversing the sand, the sand must be kept wet (or add truck mats) for the possible 6000 feet of sand haul road: would the USACE allow use of an off-road water truck?
Response 22:
Yes, an off-road water truck is allowed along the levee alignment where sand is being placed. Off-road trucks are not allowed on the access road or in the stockpile area.
Question 23:
Note 2 on the Existing Condition Typical Section of sheet C-004 states “Contractor will encounter standing water along Project. Depth will vary.” Will time still be allowed for Lake Pontchartrain high tide during wind events?
Response 23:
Time extensions in accordance with the Default clause will be issued if high tides prevent sand placement.
Question 24:
Will crane mats be an acceptable alternate to the airboat or marsh buggy for USACE access required per 52.236-4(c)?
Response 24:
No.
Question 25:
Will any sand loss due to tides be considered the contractor’s responsibility?
Response 25:
No, refer to Damage to Permanent Work clause.
Question 26:
The USACE has made SWPPP measure costs incidental to other work, but have not provided any proposed plan or erosion control measures: is silt fence to be required anywhere? Note 2 on the Existing Condition Typical Section of sheet C-004 states “Contractor will encounter standing water along Project. Depth will vary.” What erosion control measures are required in the water?
Are turbidity curtains required anywhere?
Response 26:
1st part: No. 2nd part: None. 3rd part: No.
Question 27:
Section 01 57 23.00 12, part 1.8.1 states that “At the Contractor's option, the structural practices shall include either of the following devices.”, but none are listed: please advise what Structural Controls for erosion control are expected?
Response 27:
Refer to paragraph 1.8.1.1.
Question 28:
Per the answer to questions the contractor is required to clear from station 945 to 973+75 in the base bid: what erosion control measures are required for skidding trees in standing water for removal and disposal?
Response 28:
None required.
Question 29:
Is this Solicitation subject to the Executive Order 14026 minimum wage of $15 per hour?
Response 29:
Executive Order 14026 applies:
1. To solicitations issued on or after January 30, 2022, and their resulting contracts.
2. To new contracts awarded without a prior solicitation (e.g., a purchase order under part 13), on or after January 30, 2022.
3. To new contracts with a prior solicitation awarded on or after March 31, 2022.
4. To existing contracts, including procurements for recreational services, when extending, renewing, or exercising an option on the existing contract on or after the effective date of the rule. Contracting officers shall incorporate the amended clause in this rule at 52.222-55, Minimum Wages for Contractor Workers Under Executive Order 14026, in the existing contracts through bilateral modifications.
In such a circumstance, if the contracting officer is unable to incorporate the clause in an existing contract through bilateral modification, then the contracting officer shall decline to extend, renew, or exercise the option on the existing contract.
5. In accordance with FAR 1.108(d), contracting officers are strongly encouraged to include the amended clause in other contracts awarded before March 31, 2022, with appropriate consideration.
Question 30:
Is this Solicitation subject to the Executive Order 13706 accrued paid time off of 1 hour per each thirty hours worked?
Response 30:
Executive Order 13706 applies to new contracts and replacements for expiring contracts with the Federal Government that result from solicitations issued on or after January 1, 2017 (or that are awarded outside the solicitation process on or after January 1, 2017) Under the Final Rule, Executive Order 13706 applies to four major categories of contractual agreements:
1. procurement contracts for construction covered by the Davis-Bacon Act (DBA);
2. service contracts covered by the McNamara-O’Hara Service Contract Act (SCA);
3. concessions contracts, including any concessions contracts excluded from the SCA by the Department of Labor’s regulations at 29 CFR 4.133(b); and
4. contracts in connection with Federal property or lands and related to offering services for Federal employees, their dependents, or the general public.
Furthermore, any subcontract of a covered contract that (like the upper-tier contract) falls into one of these four categories is subject to the paid sick leave requirements.
Procurement Contracts for Construction Under the Final Rule, any contract covered by the DBA and its implementing regulations is subject to the Executive Order’s requirements. The Executive Order does not apply, however, to contracts that are subject only to the Davis-Bacon Related Acts, i.e., Acts under which Federal agencies provide financial and other assistance to construction projects through grants, loans, guarantees, insurance and other methods, but do not directly procure construction services.
Service Contracts Under the Final Rule, both procurement and non-procurement contracts that are subject to the SCA and its implementing regulations are subject to the Executive Order’s requirements.
Question 31:
Would the USACE provide the estimated quantity for the items they have bid on a JOB basis?
Response 31:
JOB quantities as requested:
Clearing and Grubbing: Approx 16 acres Settlement plates 21
Question 32:
Since all sand loads must cross the gas main corridor, are all loads limited to 72,000 pounds total weight (per Amendment 0003, Section 01100)?
Response 32:
Yes.
Question 33:
Does the one vehicle at a time limit apply to the entire approximate 400 foot width of the gas main corridor (per Amendment 0003, Section 01100)?
Response 33:
Limit applies only to crossing of pipelines.
Question 34:
Does one man have to be staffed at the gas main corridor at all times to limit vehicle usage (per Amendment 0003, Section 01100) for the entire 400 foot width?

NOTE 1: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE
UNIT PRICE AND THE EXTENDED TOTAL OR ESTIMATED AMOUNT FOR ANY
ITEM, ITS BID SHALL BE DECLARED NON-RESPONSIVE AND THEREFORE
INELIGIBLE FOR AWARD.
NOTE 2: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See FAR 14.404-2, Rejection of Individual Bids).
NOTE 3: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442. The Contracting Officer may exercise the OPTIONAL WORK Items by written notice to the Contractor. Bidders shall bid on all items including optional items (see “Evaluation of Options” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid.
NOTE 6: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for this basic requirement. Evaluation of options will not obligate the Government to exercise the option(s). ** If an option is to be exercised at the time of contract award FAR17.208 shall be used in place of FAR 52.217-5
NOTE 7: TIME ADJUSTMENT IN THE EVENT OF THE EXERCISE OF OPTIONAL
WORK.
(a) If OW1 is exercised under the terms of the contract, the time required for completion of the contract will be 40 calendar days in addition to the original contract duration of 145 calendar days established for the BASE WORK items specified in the Contract Clause entitled “COMMENCEMENT, PROSECUTION, AND COMPLETION
OF WORK (FAR 52-211-10 – APR 1984)”.
(b) If OW2 is exercised under the terms of the contract, the time required for completion of the contract will be 35 calendar days in addition to the original contract duration of 145 calendar days established for the BASE WORK items specified in the Contract Clause entitled “COMMENCEMENT, PROSECUTION, AND COMPLETION
OF WORK (FAR 52-211-10 – APR 1984)”.
EVALUATION OF SUBLINE ITEMS (Dec 2019 - AFARS 5152.211-9000).
Item Nos. 0004, 0006, and 0007 are subdivided into two or more estimated quantities and are to be separately priced. The Government will evaluate each of these items on the basis of total price of its subline items.
(End of Clause)
VARIATIONS IN ESTIMATED QUANTITIES - SUBLINE ITEMS (Dec 2019 -
AFARS 5152.211-9001).
This variation in estimated quantities clause is applicable only to item Nos.
0004, 0006, and 0007.
(a) Variation from the estimated quantity in the actual work performed under any second or subsequent subline item or elimination of all work under such a second or subsequent subline item will not be the basis for an adjustment in contract unit price.
(b) Where the actual quantity of work performed for item Nos. 0004, 0006, and 0007 is less than 85% of the quantity of the first subline item listed under such item, the contractor will be paid at the contract unit price for that subline item for the actual quantity of work performed and, in addition, an equitable adjustment shall be made in accordance with the clause at Federal Acquisition Regulation (FAR) 52.211-18, VARIATION IN ESTIMATED
QUANTITY.
(c) If the actual quantity of work performed under item Nos. 0004, 0006, and 0007 exceeds 115% or is less than 85% of the total estimated quantity of the subline item under that item and/or if the quantity of the work performed under the second subline item or any subsequent subline item under item Nos.
NONE exceeds 115% or is less than 85% of the estimated quantity of any such subline item, and if such variation causes an increase or a decrease in the time required for performance of this contract the contract completion time will be adjusted in accordance with the clause FAR 52.211-18, VARIATION
IN ESTIMATED QUANTITY.
