Award will be made as a whole to one bidder.
NOTE 1: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE UNIT PRICE AND THE EXTENDED
TOTAL OR ESTIMATED AMOUNT FOR ANY ITEM, ITS BID SHALL BE
DECLARED NON-RESPONSIVE AND THEREFORE INELIGIBLE FOR
AWARD.
NOTE 2: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See FAR 14.404-2, Rejection of Individual Bids).
NOTE 3: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within ten (10) days after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Plan, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.
NOTE 4: RAPID VENDOR PAYMENT: Web based instructions for the submission of invoices;
http://www.mvn.usace.army.mil/BusinessWithUs/Contracting/RapidVendorPayment.aspx
NOTE 5: OPTIONAL WORK ITEMS. The Government may require the delivery of the numbered line item(s), identified in the schedule as OPTIONAL WORK Items, in the quantities and prices stated in the schedule. The Contracting Officer may exercise the OPTIONAL WORK Items by written notice to the Contractor. Bidders shall bid on all items including optional items (see “Evaluation of Options” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid.
NOTE 6: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for this basic requirement.
Evaluation of options will not obligate the Government to exercise the option(s).
NOTE 7: TIME ADJUSTMENT IN THE EVENT OF THE EXERCISE OF
OPTIONAL WORK. In the event that Optional Work is exercised under the terms of the contract, the time required for completion of the contract will be as follows:
http://www.mvn.usace.army.mil/BusinessWithUs/Contracting/RapidVendorPayment.aspx
00010-5 Ed 19-007
OW1 – 274 calendar days in addition to the original contract duration of 345 calendar days established for the BASE WORK items specified in the Contract Clause entitled “COMMENCEMENT, PROSECUTION, AND
COMPLETION OF WORK (FAR 52-211-10 – APR 1984)”.
OW2 – will not be adjusted but will be performed concurrently with the original contract duration of 345 calendar days established for the BASE WORK items specified in the Contract Clause entitled
“COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK
(FAR 52-211-10 – APR 1984)”.
NOTE 8: The Government will determine the total quantity to be acquired for any unit priced item under either the Base Work or Optional Work Items.
00010-6 Ed 19-007
EVALUATION OF SUBLINE ITEMS (Dec 2019 - AFARS 5152.211-9000).
Item Nos. 0002 are subdivided into two or more estimated quantities and are to be separately priced. The Government will evaluate each of these items on the basis of total price of its subline items.
(End of Clause)
VARIATIONS IN ESTIMATED QUANTITIES - SUBLINE ITEMS (Dec 2019) - AFARS 5152.211-9001).
This variation in estimated quantities clause is applicable only to item Nos. 0002.
(a) Variation from the estimated quantity in the actual work performed under any second or subsequent subline item or elimination of all work under such a second or subsequent subline item will not be the basis for an adjustment in contract unit price.
(b) Where the actual quantity of work performed for item Nos. 0002 is less than 85% of the quantity of the first subline item listed under such item, the contractor will be paid at the contract unit price for that subline item for the actual quantity of work performed and, in addition, an equitable adjustment shall be made in accordance with the clause at Federal Acquisition Regulation (FAR) 52.211-18, VARIATION IN ESTIMATED QUANTITY.
(c) If the actual quantity of work performed under item Nos. 0002 exceeds 115% or is less than 85% of the total estimated quantity of the subline item under that item and/or if the quantity of the work performed under the second subline item or any subsequent subline item under item Nos. NONE exceeds 115% or is less than 85% of the estimated quantity of any such subline item, and if such variation causes an increase or a decrease in the time required for performance of this contract the contract completion time will be adjusted in accordance with the clause FAR 52.211-18, VARIATION IN ESTIMATED QUANTITY.

PART 3 EXECUTION
3.1 GEOTEXTILE INSTALLATION
The geotextile shall be placed in the manner and at the locations shown on the drawings. The Contractor shall prepare the surface to receive the geotextile to insure that the surface is relatively smooth and free of obstructions, depressions, debris, soft or low density pockets of material, or stone which could damage the geotextile during placement. At the time of installation, the geotextile shall be rejected if it has defects, rips, holes, flaws, deterioration or damage incurred during manufacture, transportation or storage. The geotextile shall be protected at all times during construction to insure that the geotextile's original chemical and physical properties are not changed. The work shall be scheduled so that all of the geotextile that is placed is covered with a layer of the specified material by the end of each workday. Failure to comply shall require replacement of geotextile. All wrinkles and sags shall be stretched out immediately before stone is placed on the geotextile. The geotextile shall be protected from damage during placement of stone. This shall be accomplished by limiting the height of drop to less than 1 foot, or the water surface, whichever is greater. In the event that this damages the geotextile, the subbase shall be placed directly on the geotextile with zero height of drop. Before placement of subbase, the Contractor shall demonstrate that the placement technique will not damage the geotextile.
The Contractor at no additional cost to the Government shall replace any geotextile that is rejected or damaged.
3.2 SEAMS AND LAPS
Seams or laps may be utilized to produce panels of geotextile large enough to cover the area shown on the drawings. Seams or laps shall be perpendicular to the centerline of the structure. Seams or laps shall not run parallel with the direction of the centerline.
3.2.1 Seams
All seams shall be sewn using thread meeting the requirements for plastic yarn specified in paragraph "GEOTEXTILE REQUIREMENTS." The sheets of geotextile shall be sewn at the factory or other approved location. Seam strengths shall meet the requirements of Table 1.
3.2.2 Laps
Geotextile panels placed along the ramp centerline shall be overlapped a minimum of (2 feet).

PART 3 EXECUTION
3.1 EXCAVATION IN BORROW AREAS
3.1.1 General
In order to fully utilize available borrow areas, the borrow pit shall be excavated to full depth and width starting along the north side of the pit and working in a southerly direction. Any bench, shelf or partial excavation in the borrow area shall be limited to 100 feet of the full depth of the pit excavation. All excavations shall be performed in an unwatered borrow pit. Sand or silt removal from the ground surface is not limited by the 100 foot bench limitation.
3.1.2 Criteria
The bottom of the clay borrow area excavated under this contract shall be left relatively smooth and sloped to provide surface drainage to the low side of borrow areas as soon as all satisfactory materials have been removed or the Contractor has completed use of the borrow area. Abrupt changes in grade shall be avoided. Material wastes in the borrow area shall be sloped to drain. Any excavation below the depths and slopes shown on the drawings shall be backfilled by the Contractor, at his/her expense.
The clay borrow area shall be drained and kept dry during excavation.
Excavation will not be permitted in water nor shall excavated material be scraped, dragged, or otherwise moved through water. Drainage of the borrow areas shall be accomplished by ditching, sump pumping, or other approved methods. The borrow areas which are flooded from high river stages or rain events shall be drained and allowed to dry after the high river stage or rain event has passed. Any existing pockets of standing water shall be drained prior to excavation.
3.1.3 Use of Bonnet Carre Floodway Borrow Area
Government-furnished borrow and stockpile areas for the exclusive use in the performance of this contract work have been established in the Bonnet Carre Floodway at the location and within the respective limits shown on
SECTION 31 23 00.00 12 Page 3 the drawings. Borrow and stockpiling from this source shall be performed in accordance with applicable notations on the drawings and as provided in these specifications. This Government-furnished source of borrow material may be overlain by alluvial sand and silt, deposited by the river, of varying thicknesses as a result of Floodway operation and the removal of sand under the terms of annually issued and renewable Federally granted sand hauling permits for specific tracts. Permit tracts may overlay portions of the designated borrow and stockpile area. The permits for this tract, as well as other tracts, grant a permittee 20 calendar days in which to vacate the tract, remove its equipment and any stockpiled sand from its tract after it receives notice from the Government to vacate the tract.
Therefore, the Contractor must give written notice to the Contracting Officer that will allow at least 30 calendar days for notification to the affected sand hauler. This notice will allow the sand hauler adequate time to terminate its operations and grant unobstructed occupancy of the borrow and stockpile areas to the contractor. River water may seep through the Bonnet Carre' Spillway structure when the river stage at Bonnet Carre' is at or above elevation 15.0 feet N.G.V.D.. Delays to the Contractor's borrow, stockpiling, and hauling operation from water flowing through the unopened structure when the floodway is not being operated will be subject to the provisions of Section 00700 Contract Clause entitled "DEFAULT (FIXED-PRICE CONSTRUCTION) (FAR 52.249-10)". The Government may need to operate the Bonnet Carre Floodway, which may adversely affect the availability of borrow. The operation of the floodway will only occur after the President of the Mississippi River Commission has determined that the river has reached a stage or flow that threatens the Federal flood control system downstream of the Spillway. The Government will, in all anticipatory circumstances, give written notice to the Contractor of the potential need or intent to operate the floodway, granting 10 calendar days to cease borrow operations and remove equipment. This notice shall not relieve the Contractor from taking whatever steps necessary to protect its equipment and operations from rising river stages. The Contractor shall cooperate and coordinate its use of mutual haul roads with others. Any changes or delays to the Contractor's operations due to opening the Bonnet Carre Floodway will be made pursuant to Contract Clause in Section 00700, entitled "CHANGES (FAR 52.243-4)".
3.1.4 Stripping and Stockpiling Operations in Bonnet Carre Floodway Borrow Areas
The Contractor shall remove the sand and any materials specified to be wasted encountered in the borrow area overlying the clay material. The stripped material shall be stockpiled in the areas provided as shown on the contract drawings.
