About this file

This document provides an amendment to a solicitation for a federal construction contract. The solicitation is for excavating, processing, and stockpiling clay materials within the Bonnet Carre Spillway in Louisiana, with an option to stockpile at an alternate site up to 6 miles away. The work includes clearing, grubbing, and reconstructing an asphalt ramp. The magnitude of the acquisition is estimated between $25 million to $100 million. Bidders must submit a bid bond and the awardee will be required to provide payment and performance bonds within three days of award. The amendment provides responses to industry questions, revises estimated quantities, and makes changes to specifications regarding overburden removal, permitted work hours, and stockpile locations and measurements.

Industry Questions and Government Responses for Bonnet Carre Stockpile Contract 1:

1. In the event that overburden is deposited in the borrow pits thru the life of the contract by water seeping thru the spillway structure, will the contractor be compensated for the removal of this additional overburden?

Government Response: No.

2. In the event that overburden is deposited in the borrow pits thru the life of the contract by opening of the spillway structure, will the contractor be compensated for the removal of this additional overburden?

Government Response: Yes.

3. Please provide the Government’s estimated quantities for “Job” items.

Government Response: Borrow Pit 1: 23 acres clearing 4,200 LF perimeter dike Borrow Pit 2:

27 acres clearing 4,250 LF perimeter dike Borrow Pit 3; 25 acres clearing 4,200 LF perimeter dike.

Clearing Stockpile Area 1: 25 acres Clearing Stockpile Area 2: 20 acres

Ramp reconstruction:

Asphalt Wearing Course: 346.6 SY Asphalt Binder Course: 346.6 SY Base Course: 86.7 CY Embankment: 105 CY

4. The Government’s estimated quantity of overburden was provided prior to bid time on the Bonnet Carre Stockpile Contract 2, Solicitation W912P8200020. Please provide the Government’s estimated quantity of overburden for this solicitation.

Government Response: Sand Overburden of Borrow Areas: 170,000 CY

5. Since this is only a stockpile job, with third party testing, can the Superintendent be the Quality Control Manager provided he has the proper training?

Government Response: No.

6. With over triple the quantities of sand overburden to remove compared to Stockpile Contract 2, would the Corps consider increasing the base bid days, which are the same quantity of 370 Calendar Days for both jobs?

Government Response: The Government will verify the existing overburden. At this time, the duration will not be changed.

7. Note 7 provides that 240 Calendar Days will be added for both CLIN 0006 and 0007: is this concurrent if both Optional Work Items are exercised? Or is it consecutive, meaning 240 days added for each, or a total of 480 days? Only 240 calendar days less the weather days that must be allowed, would require moving, processing, and stockpiling 1,000,000 cy in approximately 190 - 200 days.

Government Response: Time extensions for exercise of Optional Work Bid Items 0006 and 0007 are not additive. An amendment will be issued to stipulate Optional Work Items 0006 and 007 will not be exercised concurrently. One or the other will be exercised, not both.

8. Section 9. PERMISSIBLE HOURS OF WORK provides only daylight hours can be worked within the spillway. Can the contractor work multiple shifts with proper lighting?

Government Response: Work is limited to daylight hours for safety concerns and consideration for adjacent residents.

9. The sand overburden is reportedly fifteen feet deep along the tree line in Borrow Pits 1 and 2:

is there a maximum amount of overburden removal that must be completed for the Job price? Is there a depth where exploration may cease?

Government Response: All overburden must be removed to the depth of suitable materials as shown on the plans.

10. Could the Corps provide their anticipated quantities as with the Stockpile 2 job?

Government Response: Quantities for "Job" bid items will be forthcoming.

11. Is the anticipated maximum cumulative volume of clay to be removed from the three pits 1,500,000 cy? Or is it until the pits are exhausted? If the quantity is extended how will the time be adjusted?

Government Response: The stockpile quantity is 1,000,000 CY maximum if Optional Work Items are exercised. Pits shall be excavated until such stockpile fill is obtained.

12. Will there be an Office Trailer requirement for this project that the USACE will share with the contractor? There are no utilities in the spillway that I am aware of so it would be difficult to put one in there. If there is a requirement for this is there an alternate location preferred by the

USACE?

Government Response: No to all questions.

13. Can the Safety Officer and Superintendent be the same person for this project?

Government Response: No.

14. Can clearing and grubbing be burned within the spillway?

Government Response: Yes, provided all local, state and federal requirements are met for such burning.

15. Where is the alternate location for stockpile in the optional work on the bid form. Is this the same location on HWY 61 that was in the previous solicitation. The drawings for that location are not in the new solicitation.

Government Response: Alternate site is located as described in the plans and specs, which is approximately 12 miles away from the borrow areas.

16. The contract is in basic award and option award. If we were awarded this contract, our bonding company would provide a payment and performance bond for the base work. Once the optional work is awarded, a separate payment and performance bond would be provided. Is this acceptable?

Government Response: Yes

“(e) Estimates of quantities involved in certain items of work for which bids are being solicited on a job basis have been made for the use of the Government. “3.1.3 Use of Bonnet Carre Floodway Borrow Area

Government-furnished borrow and stockpile areas for the exclusive use in the performance of this contract work have been established in the Bonnet Carre Floodway at the location and within the respective limits shown on the drawings.

Borrow and stockpiling from this source shall be performed in accordance with applicable notations on the drawings and as provided in these specifications. This Government-furnished source of borrow material may be overlain by alluvial sand and silt, deposited by the river, of varying thicknesses as a result of Floodway operation and the removal of sand under the terms of annually issued and renewable Federally granted sand hauling permits for specific tracts. Permit tracts may overlay portions of the designated borrow and stockpile area. The permits for this tract, as well as other tracts, grant a permittee 20 calendar days in which to vacate the tract, remove its equipment and any stockpiled sand from its tract after it receives notice from the Government to vacate the tract. Therefore, the Contractor must give written notice to the Contracting Officer that will allow at least 30 calendar days for notification to the affected sand hauler. This notice will allow the sand hauler adequate time to terminate its operations and grant unobstructed occupancy of the borrow and stockpile areas to the contractor. River water may seep through the Bonnet Carre' Spillway structure when the river stage at Bonnet Carre' is at or above elevation 15.0 feet N.G.V.D. Delays to the Contractor's borrow, stockpiling, and hauling operation from water flowing through the unopened structure when the floodway is not being operated will be subject to the provisions of Section 00700 Contract Clause entitled "DEFAULT (FIXED- PRICE CONSTRUCTION) (FAR 52.249-10)". The Government may need to operate the

Bonnet Carre Floodway, which may adversely affect the availability of borrow. The operation of the floodway will only occur after the President of the Mississippi River Commission has determined that the river has reached a stage or flow that threatens the Federal flood control system downstream of the Spillway. The Government will, in all anticipatory circumstances, give written notice to the Contractor of the potential need or intent to operate the floodway, granting 10 calendar days to cease borrow operations and remove equipment. This notice shall not relieve the Contractor from taking whatever steps necessary to protect its equipment and operations from rising river stages. The Contractor shall cooperate and coordinate its use of mutual haul roads with others. Any changes or delays to the Contractor's operations due to opening the Bonnet Carre Floodway will be made pursuant to Contract Clause in Section 00700, entitled "CHANGES (FAR 52.243-4)".”
