Section 00 22 00 – Supplementary Instruction
GENERAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS, EVALUATION STANDARDS
FOR CONTRACT AWARD
1. OVERVIEW
Proposals received in response to this solicitation for the Richmond Inner Harbor FY26 Maintenance Dredging Project, Contra Costa County, California will be evaluated using the Lowest Price Technically Acceptable method of selecting the contractor oƯering best value to the Government, as explained below.
2. BASIS OF AWARD
2.1. ELIGIBILITY FOR CONTRACT AWARD
In accordance with the requirements of Federal Acquisition Regulation (FAR) Part 9, no contract shall be entered into unless the Contracting OƯicer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the contracting oƯicer makes an aƯirmative determination of responsibility of the prospective awardee. To be determined responsible, a contractor must meet the general standards in FAR Part 9 and any special standards set forth in this solicitation.
2.2. SOURCE SELECTION USING THE LOWEST-PRICE, TECHNICALLY-ACCEPABLE
(LPTA) METHOD
The Government shall evaluate all proposals. The contract will be awarded to this oƯeror upon a determination of responsibility by the Contracting OƯicer (see paragraph 2.1, above).
3. GENERAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS
For purposes of this RFP, an “OƯeror” may include a group of two or more entities that have formed a “contractor team arrangement”. In the case of entities that have formed a contractor team arrangement, the experience and performance history of any member of the team, whether or not gained while working with the other member(s) of the currently-proposed contractor team arrangement, may be presented in the OƯeror’s proposal.
In the case of contractor team arrangements involving a prime contractor and subcontractor(s), where the prime contractor submits the proposal in response to this RFP, the prime contractor must have completed at least one of the projects submitted in fulfillment of Factor 1 of this RFP. If information about a subcontractor is submitted, the

Government will review the information on the presumption that this subcontractor will perform similar work in the construction of this project, should award be made to the respective oƯeror. No such awardee may substitute another subcontractor without the Government’s prior written approval.
Similarly, an OƯeror that relies on the performance history of a member or members of a proposed contractor team arrangement will be expected to maintain that arrangement during performance of any contract awarded to that OƯeror under this RFP. As a part of its proposal, the OƯeror must provide a contractor team agreement signed by all parties, identifying the legal name(s) of all entities and describing the nature of each entity’s relationship (teaming/partnering, joint venture, etc.) and its proposed role in performance of this contract. Past Performance information of other than the OƯeror will not be considered without the team agreement. In the case of joint ventures, at least one project will be submitted from each member to demonstrate past experience. This documentation must be provided in the applicable section of the OƯeror's proposal.
3.1 Media, Page Size, Margins, Fonts, and Page Limitations.
Submit only electronic files as specifically stated in this section. Do not submit excess information, to include audio-visual materials, electronic media, etc. Do not include links to information on websites in lieu of incorporating the information physically into the proposal. Except where another size is specifically authorized for a submission, use only 8 1/2” x 11” electronic pages. Use at least 1-inch margins; except headers and footers may be outside the 1-inch margins. Do not justify the right margin. Ensure that all text and graphics are clearly legible. Do not use a font size smaller than 10-point font, and do not use unusual font styles such as script, or condensed fonts. Pages furnished for organizational purposes only, such as a “Table of Contents” or divider tabs, are excluded from page limitations.
3.2 Conditional OƯers.
Do not include exceptions to the terms and conditions of the solicitation in either the technical or price proposal volumes. Inclusion of any company terms and conditions that conflict with the terms and conditions of the solicitation may result in a determination that the oƯer is unacceptable and thus ineligible for award. Resolve questions about the terms and conditions or technical requirements of the solicitation prior to submission of your oƯer; see “Special Instructions for Submitting Your Proposal”, located in Section 00 21 00.
3.3 Restrictions on OƯeror-Provided Information.
Proposals shall not contain classified data. “Confidential” projects may be submitted to demonstrate capability as long as all of the information required for evaluation as specified

herein can be provided to the Government as part of the oƯeror’s technical proposal.
OƯerors that include data in their proposals that they do not want disclosed or used except for evaluation purposes, must redact the data in accordance with FAR 52.215-1, Instructions to OƯerors - Competitive Acquisition.
4 GENERAL PROPOSAL PREPARATION.
The proposal shall be submitted as summarized below.
(1) Volume I – Technical Volume
(a) Factor 1: Past Performance
(b) Factor 2: Availability of Equipment

(c) Price Schedule
(d) Annual Representations and Certifications
(e) OƯer Guarantee
(f) Pre-Award Survey Information
Each oƯeror must submit a proposal consisting of a “technical” volume, and a “price” volume. The two volumes must be submitted as separate volumes. Both volumes must be received no later than the date and time specified in Block 13 of SF 1442, or as amended in the SF 30. The information in the two volumes is evaluated separately and independently.
Do not cross-reference material between the non-price and price volumes.
4.1 Marking of Proposal Volumes.

proposal, the Government is not obligated to search for or to consider information that belongs under a specific tab in an oƯeror’s proposal but is actually elsewhere in the proposal. Limit proposal submittals to the information specified; excess information will not be evaluated.
The term “tabs” means searchable PDF bookmarks.
4.2.2 Tab 1 of the Technical Proposal: Factor 1 Past Performance
4.2.2.1 Submission Requirements
The OƯeror shall provide past performance information on dredging projects within the last three (3) years. Experience and Capability, using the Contractor Performance Assessment Reporting System (CPARS) for any past federal projects submitted, and other sources for non-federal projects.
If CPARS evaluations are not available, the OƯeror shall submit a Past Performance Questionnaire (PPQ) for each project. OƯerors should follow-up with clients/references to ensure timely submittal of questionnaires. Completed PPQs should be submitted as part of the oƯeror’s proposal. If the OƯeror is unable to obtain a completed PPQ before the proposal closing date, the OƯeror shall complete and submit the first page of the PPQ, which provides contract and reference contact information for the project(s). The OƯeror shall ensure correct phone numbers and email addresses are provided for each point of contact.
Completed PPQs may also be submitted by the preparer directly to the Contract Specialist (lisa.i.ip@usace.army.mil) and Contracting OƯicer (nairi.freeman@usace.army.mil) via email prior to the RFP closing date.
The Government may review and consider information obtained from other sources, e.g., CPARS information using CAGE/Unique Entity ID of the teaming arrangement, Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), etc.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the OƯeror.
Each example project must start on a new page and there is no page limitation for CPARS and PPQ’s submission. Pass Performance will not count against the page limitation for this volume.
4.2.2.2 Evaluation Criteria:

The past performance evaluation is an assessment of the oƯeror’s ability to successfully perform this requirement based on the oƯeror’s record of relevant past projects, and the documented level of satisfaction of each project owner after completion of construction.
Past Performance will be determined relevant if a submitted project is similar in size, scope, and complexity to this requirement.
How well the oƯeror performed the prior contracts submitted under Factor 1 will be evaluated by reviewing CPARS evaluations, completed PPQ forms and other information available to the Government.
*NOTE: If an oƯeror does not have a record of relevant past performance or information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the oƯeror may not be evaluated favorably or unfavorably on past performance (IAW FAR 15.202(c)(1)). A neutral rating shall be considered acceptable.
Each OƯeror shall be assigned one of the two ratings listed below.
Acceptable - Based on the oƯeror’s performance record, the Government has a reasonable expectation that the oƯeror will successfully perform the required eƯort, or the oƯeror’s performance record is unknown *(See note above).
Unacceptable - Based on the oƯeror’s performance record, the Government does not have a reasonable expectation that the oƯeror will be able to successfully perform the required eƯort
4.2.3. Tab 2 of the Technical Volume: Factor 2 – Availability of Equipment
4.2.3.1 Availability of Equipment – Evaluation Factor
The OƯeror shall provide a projected timeline and supporting narrative detailing the availability of equipment. The narrative shall be task-oriented, clearly indicating the number of calendar days following pre-construction submittals and mobilization— assumed to occur approximately 30 calendar days after Notice to Proceed (NTP)—by which dredging activities are to commence and be completed.
The narrative shall also include a summary of any failures and/or successes related to equipment availability on the last five dredging projects.

Constraints:
The OƯeror must demonstrate the capability and flexibility of equipment availability to meet the proposed contract completion period. The narrative shall clearly identify any known or anticipated constraints, such as:
• Equipment or labor availability
• Weather impacts
• Other logistical or operational limitations
4.2.3.2 Submission Requirements Evaluation Criteria:
The Government will evaluate the OƯeror’s Availability of Equipment narrative to assess the likelihood that equipment will be provided in a timely and eƯective manner to ensure successful completion of the project within the specified period of performance.
Narratives that clearly demonstrate the OƯeror’s ability to complete dredging within 114 calendar days from Notice to Proceed (NTP), along with a general understanding of potential factors that could impact availability (e.g., labor, weather, logistics), will be considered acceptable.
Proposals that indicate equipment availability or project completion beyond 114 calendar days after NTP will be rated Unacceptable under this factor.
A proposal will be rated as Unacceptable if it does not meet the definition of Acceptable.
Technical Acceptable/Unacceptable Ratings:
o Acceptable - Proposal meets the minimum requirements of the solicitation o Unacceptable - Proposal does not meet the minimum requirements of the solicitation
4.3. PRICE VOLUME.
4.3.1 FORMAT, CONTENTS, AND LIST OF TABS FOR THE PRICE PROPOSAL
