Question # Question Response 1 For the project referenced above, we have reviewed the contract documents and do not see reference to the Department of War 2026 Class Deviations incorporating the Revolutionary FAR Overhaul. Please advise whether the RFO is applicable to this contract.
Yes, RFO provisions and clauses are used for this solicitation. Link to the RFO are provided under FAR 52.252- 1 and 52.252-2.
2 Section 35 20 23 3.5.1 states: "The Contractor is to satisfy itself as to conditions of the dredged material placement sites, including all dikes, during a site inspection. After NTP, the contractor shall coordinate with the Government about the inspection dates. "
Please specify whether the contractor can expect this site visit prior to the bid to determine level of effort, or consider a bid allowance for this effort.
The first sentence of Specification Section 35 20 23, Paragraph 3.5.1—“The Contractor is to satisfy itself as to conditions of the dredged material placement sites, including all dikes, during a site inspection.”—has been deleted from the Solicitation with amendment 0002.
Due to resource constraints, a pre-bid site visit will not be provided, nor will a bid allowance be included.
3 1.In reviewing the SolicitaƟon, we note that:
a.FAR 52.225-9 “(DeviaƟon) 2026-02” is included in full text.
b.FAR 52.225-10 (2014-05) is included.
c.FAR 52.225-11 is not included as prescribed in 25.602 for contracts awarded at $6,683,000 or more.
d.FAR 52.225-12 is not included for contracts awarded at $6,683,000 or more.
Since the estimated cost range for this contract is $5,000,000 – $10,000,000 the Solicitation should include the three possibly applicable combinations of clause and provision with their applicable alternates. Please modify the Solicitation to comply with the prescriptive language at 25.602 to include:
a.52.225-9 and 52.225-10 if the contract is awarded at less than $6,683,000;
b. 52.225-11 and 52.225-12 if the contract is awarded at $6,683,000 or more; and c.52.225-11 with Alt I and 52.225-12 with Alt II if the contract is awarded at $6,683,000 or more but less than $13,749,689.
FAR 52.225-11, 52.225-11 Alt 1, 52.225-12, and 52.225-12 Alt II are added with amendment 0003.
4 FAR 52.204-21 is not included in the solicitation.
