1.0 INTRODUCTION

Winzler & Kelly (W&K) performed a hazardous materials survey at Pier 36, San Francisco California in support of the Brannan Street Wharf Project. The intent of this survey was to visually inspect, identify, sample, and/or test for asbestos, lead, other existing suspect hazardous building materials, and biological hazards that might be expected to be impacted by demolition and other construction activities associated with the project.

Winzler & Kelly’s on-site survey was conducted by Mr. Chris Smith and Ms. Erica Alvarez on March 31st and April 1st, 2009. Mr. Smith is a Certified Asbestos Consultant (CAC) and CDPH- Certified Lead consultant and Ms. Alvarez is a Certified Site Surveillance Technician (CSST). The project was planned and overseen by Mr. Lionel (Butch) Reynolds, a Certified Industrial Hygienist (CIH), Certified Asbestos Consultant (CAC), and Certified Lead consultant. Site access was provided by Port of San Francisco.

2.0 BUILDING DESCRIPTION

Pier 36 is a two-story concrete structure originally constructed in the early 1940’s. The building is a large warehouse type structure and comprises of approximately 35,000 square feet. Structural steel, wood beams and columns support the building frame. The mechanical room adjacent to room 3 was not accessible and was not surveyed because the exterior metal door has been welded shut preventing access. The roof access ladder was unsafe making the roof inaccessible at the time of the survey. Therefore the roof must be presumed to be asbestos containing unless further testing proves it to be otherwise. The planned work for the Brannan Street Wharf Project includes demolition and removal of the entire structure. The building has been deemed deteriorated and unsafe by the City of San Francisco, thus was unoccupied at the time of the survey, with the exception of homeless transients who currently occupy the building.

Arbitrary room numbers were assigned by Winzler & Kelly (W&K) to various rooms and spaces to allow identification of hazardous materials and sample locations in the building. See diagram below.

3.0 SURVEY METHODOLOGY

3.1 GENERAL SURVEY APPROACH

Winzler & Kelly’s survey was conducted according to the approach described in our proposal and this report. Unsafe conditions prevent roof access for sampling, thus pending safe access for sampling, all roof materials must be assumed to be asbestos containing materials and it is recommended all roofing materials be sampled prior to demolition when safe access is made available.

Winzler & Kelly’s survey included sampling of suspect asbestos-containing materials (ACM) identified during a visual survey of the buildings, a screening survey of representative painted surfaces and coatings for lead-based paint (LBP), and a visual inspection for other possible hazardous materials, as well as biological hazards that might be impacted by the project. Specific survey procedures are provided in the following paragraphs.

Laboratory reports for asbestos bulk samples and lead paint chips samples collected are included in Attachments A and B respectively.

3.2 ASBESTOS SURVEY METHODOLOGY

Identification of suspect or presumed present asbestos-containing material (ACM) was performed by visually surveying structural, architectural, and mechanical components and finishes on building exteriors and interiors. The survey was conducted in a limited destructive manner to ensure all potentially present ACM was exposed and revealed beneath or behind a surface material or finish.

No hard demolition of concrete and steel was conducted. No excavation was conducted to discover buried insulated piping and/or asbestos cement pipes concealed below the surface.

Suspect ACM identified during this survey was bulk sampled using sampling guidelines established by the Environmental Protection Agency (EPA) and by generally following the methods described in Appendix K of title 8, CCR, Section 1529 of the California Code of Regulations for sample collection. The following summarizes the sampling procedures utilized.

• Visually identified suspect ACMs were categorized into homogeneous material areas. A homogeneous material is defined as being a surfacing material, thermal system insulation, or miscellaneous material which is uniform in color and texture.

• A sampling scheme was developed based upon the location and quantity of the various homogeneous materials.

• Trained and certified personnel, using appropriate sampling tools and leak-tight containers, collected bulk samples.

• Bulk sample collection tools were decontaminated after the collection of each bulk sample to prevent the spread of secondary contamination to subsequent bulk samples.

• Each bulk sample was labeled with a unique sample identification number and recorded on a bulk sample log.

• Hand drawn floor plan drawings were used to record the location of each sample collected.

These drawings are located in the Figures attached to this report.

• Bulk samples collected were then submitted to a laboratory with a chain of custody record.

All findings, conclusions, and analytical data presented in this report are based on our own visual inspection of building areas and the results of the sampling and analysis of suspected ACM observed by W&K during the survey.

The information provided in this report should be used in conjunction with construction documents and the construction contractor’s own field verification of the abatement scope of work including location and extent of asbestos removal required for the demolition project being undertaken at the site. In the event that suspect ACM materials not previously identified are discovered, the contractor is obligated to stop and notify the owner immediately in compliance with applicable regulations.

3.3 ASBESTOS ANALYTICAL METHODOLOGY

Bulk samples of suspect ACM were sent to Forensic Analytical in Hayward, California. Forensic Analytical Laboratory is an accredited laboratory under the National Institute of Standards and Technology (NIST)/National Voluntary Laboratory Accreditation Program (NVLAP) and the California Environmental Laboratory Accreditation Program (Cal-ELAP) for bulk asbestos sample analysis. The samples were submitted for analysis by Polarized Light Microscopy (PLM) utilizing dispersion staining techniques in accordance with the EPA’s “Method for the Determination of Asbestos in Bulk Building Materials” U.S. EPA/600/R-93/116, dated July 1993 and adopted by the NVLAP as Test Method Code 18/A01.

3.4 LEAD SURVEY APPROACH

Lead-Based Paint (LBP) is defined as any painted surface with lead levels exceeding 5,000 parts per million (ppm), 1.0 milligrams per square centimeter (mg/cm²) or greater than 0.5 percent (%) by weight, as set forth in the federal Environmental Protection Agency (EPA), Dangerous Levels of Lead, Final Rule and also adopted by Department of Housing and Urban Development (HUD) in rules for federally owned housing, and by California Department of Public Health (CDPH) regulations for residential and public buildings. Lead-Containing Paints (LCPs) are paints and coatings that contain detectable lead as defined by Cal/OSHA. Most paints and coatings on pre- 1978 buildings contain some detectable lead subject to Cal/OSHA regulation. Since it is not practical or cost-effective to conduct the exhaustive testing required to prove painted coatings do not contain detectable levels of lead, it is prudent to consider that all paints and architectural coatings contain some detectable levels of lead unless proven otherwise by laboratory analysis.

Screening level LBP testing using a NITON XLp 300A direct read lead testing instrument was used to survey of lead in paint coatings. The NITON instrument uses x-ray fluorescence (XRF) spectrometry to test for the presence of lead based paint non-destructively on a surface to surface basis. This testing was supplemented by limited paint chip sampling and laboratory analysis. The test results and sampling for lead presented herein is representative of typical conditions but are not inclusive of all painted/coated surfaces present at this building. However, the results can be used to assist with compliance to the California Occupational Safety and Health Administration (Cal/OSHA) lead construction standard and preliminary evaluation of potential construction waste streams. However, while providing a cost effective, non-destructive test method, the XRF instrument is calibrated to detect LBP but cannot detect lead at the lowest levels regulated Cal/OSHA and Cal/EPA. Therefore, all painted/coated surfaces including untested surfaces, should

SAC IH- Hazmat Projects\ 1180809001.33012 5 be assumed to contain some detectable level of lead in the absence of representative paint chip analytical results demonstrating that lead levels are below analytical detection limits.

3.5 OTHER SUSPECTED HAZARDOUS MATERIALS & BIOLOGICAL HAZARDS

The structure was visually surveyed for other hazardous materials and biological hazards that could impact planned demolition work. These suspect hazardous materials included fluorescent lighting fixtures manufactured prior to 1979 that have the potential to contain Polychlorinated Biphenyl (PCB) ballasts, mercury containing lighting tubes, and other components considered to be “universal wastes” upon disposal. “Universal wastes” include mercury-containing non-incandescent lamps, batteries and other hazardous wastes commonly found in building components and equipment.

This building has been unoccupied for some time therefore many fluorescent lighting fixtures are not secured; lighting tubes have been broken and can be found on the floor throughout the building.

4.0 SURVEY RESULTS

4.1 ASBESTOS CONTAINING MATERIALS

Winzler & Kelly collected 59 bulk samples with a total of 138 layers of suspect ACM. Suspect asbestos-containing materials (ACM’s) sampled during this survey are listed in Table 1 – Suspect Asbestos-Containing Materials. Table 3 – Identified Hazardous Materials provides a summary listing of known asbestos containing materials as well as other contaminants. Winzler & Kelly’s laboratory analytical results for sampled suspect ACMs provided in Attachment A – Analytical Laboratory Reports-Asbestos.

Refer to Table 1 for full list of suspect materials sampled by W&K including those with no detectable asbestos content and refer Attachment A for a complete set of the laboratory results.

4.2 LEAD CONTAINING PAINTS AND COATINGS

Winzler & Kelly performed a total of approximately 186 XRF lead tests of interior and exterior building surfaces and collected twelve (12) paint chip samples. In addition, six (6) bulk resilient sheet flooring samples were collected for analysis of lead content. The results of the lead based paint screening survey are provided in Table 3 – Lead Test Results. A review of the results indicates 50 XRF test results and five (5) paint chip samples exceed the lead-based paint criteria.

The remaining tests and samples reported lower levels of lead. Of the six (6) bulk resilient sheet flooring samples analyzed for lead content, all samples reported levels well below the hazardous waste threshold of 5,000 milligrams per kilogram (mg/kg) with results ranging from 8-2, 100 mg/kg.

Attachment B provides the laboratory results for lead analysis including paint chip results summarized above.

Paint Condition Findings:

The painted building components at this site were generally in poor condition. Over time, paint tends to deteriorate so condition assessment should be reviewed just before or at the time the project is to be bid. Since even low level of paint just over 50 ppm may exhibit hazardous waste characteristics, care must be taken to eliminate loose and peeling paint prior to selective demolition, surface preparation, patching/repairing or other activities likely to disturb painted surfaces.

4.3 OTHER POTENTIAL HAZARDOUS MATERIALS

Winzler & Kelly has visually inspected readily accessible areas of the buildings for other hazardous materials including potential PCB lighting ballasts, Universal Wastes (such as mercury containing lighting tubes, thermostats, and batteries), and other suspect hazardous waste and contamination.

No attempt was made to disassemble equipment or sample any additionally discovered suspect materials; however some light fixtures were partially disassembled and visually accessible, Winzler & Kelly inspected a limited amount of light ballasts and did not find the “NO PCBs” or “PCB FREE” labels on the ballasts. Therefore all fluorescent lighting fixtures must be presumed to contain PCB ballasts pending removal and disassembly of each unit to determine ballast type and/or labeling in the absence of other explicit product specific information to the contrary. As expected, we found fluorescent lighting systems in many areas. Where ever fluorescent lighting systems and emergence egress lighting systems are present and impacted, the associated suspect PCB ballasts and universal waste items will require special handing and disposal or recycling.

Also, human and animal fecal matter was observed throughout the building.

5.0 CONCLUSIONS & RECOMMENDATIONS

5.1 ASBESTOS-CONTAINING CONSTRUCTION MATERIALS

Prior to maintenance, repair, renovation or demolition construction activities, known or assumed ACMs that are likely to be disturbed by those activities, must be removed and disposed of in accordance all applicable regulations including federal National Emissions Standard for Hazardous Air Pollutants (NESHAPS) and Cal/OSHA regulations. A Cal-OSHA registered and State licensed, registered asbestos contractor (abatement/demolition/roofing) is required for removal of ACM prior to general demolition.

At minimum, the contractor’s abatement sub-contactor should remove friable ACM under OSHA Class I removal rules and all non-friable ACM in a manner that does not unnecessarily produce friable ACM under OSHA Class II removal requirements. All friable asbestos waste must be disposed of as hazardous asbestos wastes and all non-friable asbestos wastes should be disposed of as non-hazardous asbestos waste at a landfill permitted for asbestos waste disposal.

The following additional requirements should be adhered to for any maintenance, renovation, or demolition projects requiring asbestos disturbance and/or removal:

♦ All asbestos-containing wastes shall be manifested as either hazardous or non-hazardous based on asbestos content, friability, and actual waste stream classification.

♦ All asbestos removal should be overseen a qualified owner’s representative or by a qualified independent third party retained by the owner to ensure proper removal, clean up, work area clearance, and review waste shipping and disposal documentation.

♦ Contractor should perform all work in compliance with contract documents and the most recent edition of all applicable Federal, State, and local regulations, standards, and codes governing abatement, transport, and disposal of asbestos.

5.2 LEAD CONTAINING PAINTS AND COATINGS

The painted components tested at Pier 36, typically had high levels of lead and should be considered LBP on surfaces and components tested throughout the building to be demolished. The disturbance of these components during demolition activities will require use of personnel trained in lead hazards for construction and will require compliance with applicable Cal/OSHA and Cal/EPA regulation.

At present there is no state or federal regulation requiring mandatory lead removal or abatement prior to disturbance or demolition of structures with identified lead materials. However, there are applicable Cal/OSHA worker protection requirements and Cal/EPA waste disposal requirements that do apply to lead-related construction activities and associated wastes:

♦ Cal/OSHA: The Cal/OSHA regulation, Title 8, CCR, Section 1532.1 Lead governs occupation exposure to lead. This regulation requires that any task that may potentially expose workers to any concentration of lead, be monitored to determine workers eight-hour time weighted average (TWA) exposure to lead. Prior to initiation of certain activities, referred to as “trigger tasks”, that are believed to have the capability of creating an excessive lead exposure, such workers must be properly fitted with respiratory protection and protective clothing until personal eight-hour TWA results reveal exposures within acceptable levels. Pertinent examples of trigger tasks are manual demolition, manual paint scraping and power tool removal, and hot work involving lead-containing coatings or materials. Cal/OSHA also has agency pre-start notification requirements and worker training and certification depending on exposure levels. Clearly these requirements will apply to demolition, patch and repair, paint removal, and surface preparation work at this site.

♦ Cal/EPA: Cal/EPA regulates disposal of lead hazardous waste (22 CCR Division 4.5 Chapter 30, Minimum Standards for Management of Hazardous and Extremely Hazardous Wastes). The Cal/EPA Department of Toxic Substance Control (DTSC) has issued guidance indicating that architectural debris with intact lead paint is normally anticipated to be handled as general construction waste. However, all paint containing waste streams should be considered potentially lead hazardous pending waste testing. Further, all surface preparation and paint removal wastes must be considered hazardous wastes due to the likelihood of paint chip lead levels exceeding 1,000 total lead or 5 ppm soluble lead.

♦ San Francisco Lead Ordinance: San Francisco Building Code, Chapter 36: Sections 3602-3606: This ordinance applies to buildings constructed before 1979 and contains notification, containment standards, prohibitions and other performance standards for work that disturbs exterior lead-based paint

Where ever construction activities impact LCP, the contractor should perform the work in compliance with the most recent edition of all applicable Federal, State, and local regulations, standards, and codes governing abatement, transport, and disposal of lead containing/contaminated materials. Demolition, maintenance or repair of interior and exterior painted components may involve disturbing lead and creating lead hazardous wastes. These construction activities must be controlled to prevent uncontrolled release of lead contamination and for environmental protection.

The contractor conducting building demolition controls the means and methods used and therefore should be required by the contract document to ensure that the demolition process is conducted in a manner that creates the minimum amount of hazardous waste and leaves the site free of lead contamination exceeding regulatory levels.

Types of construction work impacting lead containing paints and coatings on this project include:

SAC IH- Hazmat Projects\ 1180809001.33012 10 o General building demolition including; some selected demolition of walls, structural steel, windows, roll-up doors and the other painted architectural, plumbing, mechanical, and electrical equipment and components present.

5.3 OTHER KNOWN & PRESUMED HAZARDOUS MATERIALS

PCB Lighting Ballasts: Winzler & Kelly’s limited visual inspection indicated fluorescent light fixtures containing PCB ballasts are present in the building. Winzler & Kelly recommends that all light fixtures be visually inspected upon removal to determine if they contain PCB’s. Electronic ballasts and ballasts marked “No PCB’s” or “PCB Free” should be considered non-hazardous and recycled or disposed of accordingly. However, ballasts that are unmarked must be considered PCB-containing and properly handled, collected, stored, transported and recycled or disposed of by an approved recycling or disposal facility in accordance with the requirements of 22 CCR, Section

67426.1 and the contract.

Universal Wastes: All potential and identified mercury-containing light tubes and other universal wastes should be removed and recycled or disposed of in accordance with the guidelines established by the California Department of Toxic Substance Control Universal Waste Rule, as stated in 22 CCR Sections 66261.9 and 66273.1 thru 66273.90.

6.0 CLOSING

Winzler & Kelly performed these hazardous materials survey services in a manner consistent with that degree of care and skill ordinarily exercised by members of the same profession currently practicing under similar circumstances.

Conclusions and recommendations made regarding hazardous materials were based upon information obtained from samples and tests taken at specific locations, and professional judgment.

Where variation in results cannot be conclusively explained by clearly delineated differences in materials or components, the highest results will apply to untested areas or components.

This report is intended as an informational resource for the Port of San Francisco, Brannan Street Wharf Project and any contractor using this document assumes all responsibility for reviewing all available information including contract documents and for verifying existing site conditions including location and extent of hazardous materials present at the site. As the project develops, new information may arise and be incorporated into construction documents without change to this document.

Should any significant discrepancy between this report and existing conditions be discovered, the contractor shall notify the owner’s construction manager or inspector immediately.
