Dear Mr. Elrod:
The U.S. Army Corps of Engineers, Nashville District (USACE) is proposing to install septic facilities at Obey River Campground in Pickett County, Tennessee to replace an existing sand filter system which is currently failing. Center coordinates for the project are 36.527745, -85.173477 (NAD 83). The project would require the installation of 420’ of four-inch PVC pipe, a septic tank and septic lateral field lines in an upland, wooded hillside (approximately 30% gradient). The septic field is approximately 2.12 acres in size and is located in the far western portion of the campground, up-gradient of existing campsites. A project vicinity map is included with this letter as Figure 1. To facilitate construction of the septic facilities, the applicant proposes to perform extensive tree removal within the septic field. The action area for the project is identified as the footprint of the construction site as shown in Figure 2 of this letter.
A review of the action area on the U.S. Fish and Wildlife Service (USFWS) IPAC website indicated that the Indiana bat (Myotis sodalis), northern long-eared bat (Myotis septentrionalis), and gray bat (Myotis grisescens) have the potential to occur within the proposed project vicinity. In fact, the action area for the project is located within an area designated as “Swarming 2” habitat for northern long-eared bat.
A site inspection on May 21, 2021 by Travis Wiley, USACE Biologist revealed 12 trees within and in the vicinity of the project footprint that have characteristics that Indiana and northern long-eared bats may utilize as summer roost habitat.
Characteristics of suitable habitat trees, including snags, are those greater than 3 inches diameter breast height (dbh) with exfoliating bark, cracks, crevices and cavities.
In order to capture the overall tree communities, a quantitative listing of all trees over 3 inches dbh was recorded in five plots, 30’ in diameter throughout the proposed septic field, with the center of the plots approximately 100’ feet apart as shown in Figure 2.
Photographs of the plots are shown in Figures 3-7 and plot results are listed in Table 1 of this letter. Tree communities are primarily comprised of sugar maple (Acer saccharum), American beech (Fagus grandifolia), hickory (Carya) species and American elm (Ulmus americana) with common understory plants being seedlings of the same species. In addition to the plots, the entire septic field was inspected for presence of potential summer roosting habitat trees. The location of trees determined to be suitable habitat are shown in Figure 8. Photographs of the suitable habitat trees are attached as Figures 9-21 and recorded with species, diameter, GPS coordinates and rationale for habitat suitability. USACE proposes to remove five (5) of the 13 trees that were determined to be marginal habitat, along with other trees in the action area between November 15, 2021 and March 31, 2022. Eight (8) trees within and in the vicinity of the septic field, determined to be higher quality suitable habitat, would be avoided during construction of the septic facilities.
After considering the presence of twelve suitable habitat at the project site, avoidance of eight of the potential summer roosting habitat trees and the timeframe of tree clearing within the action area, USACE has determined the project “may affect but is not likely to adversely affect” the Indiana bat and northern long-eared bat. Per this letter, the Corps requests concurrence with these determinations from USFWS.
The May 21, 2021 USACE inspection of the project action area indicated there were no caves, sinkholes or portals were found on the proposed construction site that would be suitable habitat for the gray bat. Therefore, USACE has determined the project would have “no effect” on the gray bat.
