MEASUREMENT AND PAYMENT PROCEDURES

PART 1 GENERAL

1.1 PAYMENT GENERAL

Payment items for the work of this contract for which payments will be made are listed in the BID SCHEDULE and described below. The contract price for each item shall constitute full compensation for furnishing all plant, labor, materials, appurtenances, and incidentals and performing all operations necessary to construct and complete the items in accordance with these specifications and the applicable drawings, including surveying performed by the Contractor

1.1 All costs for items of work, which are not specifically mentioned to be included in a particular payment item, shall be included in the listed job item most closely associated with the work involved. Payment for each item shall be considered as full compensation, notwithstanding that minor features may not be mentioned herein. Work paid for under one item will not be paid for under any other item. No separate payment will be made for the work, services, or operations required by the Contractor, as specified in DIVISION 01 - GENERAL REQUIREMENTS, to complete the project in accordance with these specifications; all costs thereof shall be considered as incidental to the work.

1.2 MEASUREMENT GUIDELINES

1.2.1 Job Items

Items measured as a "job" will be measured for payment as a complete job in the locations indicated. Unless the payment item paragraph makes a specific exception of any item, incidental items will not be measured under any other item even though there is another listing for the work or material.

1.3 BASE CLINs

1.3.1 Mobilization and Demobilization, CLIN 0001

Payment will be made on a per job basis under CLIN 0001. Payment shall be made for all costs incurred prior to arriving onsite (mobilization) or immediately after departing the work site (demobilization). These costs include, but are not limited to, all preparatory work at the contractors shop, labor costs associated with travel to and from the work site, and transportation costs..

1.3.2 Remove and Dispose of Existing HPFF Oil Pipe Cable System for Unit

#1, CLIN 0002

Payment for the removal and disposal of the oil pipe cables for Unit #1 generator leads, including existing conductors and exposed conduit will be made at the job bid price under Line Item No. 0002. Price and payment will constitute full compensation for the furnishing of all material, SECTION 01 22 00.00 26 Page 3 labor, and equipment to accomplish this work.

1.3.3 Remove and Dispose of Existing HPFF Oil Pipe Cable System for Unit

#2, CLIN 0003

Payment for the removal and disposal of the oil pipe cables for Unit #2 generator leads will be made at the job bid price under Line Item No.

0003. Price and payment will constitute full compensation for the furnishing of all material, labor and equipment to accomplish this work.

1.3.4 Remove and Dispose of Existing HPFF Oil Pipe Cable System for Unit

#3, CLIN 0004

Payment for the removal and disposal of the oil pipe cables for Unit #3 generator leads will be made at the job bid price under Line Item No.

0004. Price and payment will constitute full compensation for the furnishing of all material, labor and equipment to accomplish this work.

1.3.5 Remove and Dispose of Existing HPFF Oil Pipe Cable System for Circuit #4,, CLIN 0005

Payment for the removal and disposal of the oil pipe cables for Circuit #4 (44kV switchyard feeders) will be made at the job bid price under Line Item No. 0005. Price and payment will constitute full compensation for the furnishing of all material, labor and equipment to accomplish this work.

1.3.6 Supply and Install Temporary 750kcmil Feeder System for Circuit #4, CLIN 0006

Payment for the design, supply and installation of the temporary 750kcmil feeder system for Circuit #4 (loading of 14.4 MVA) will be made at the job bid price under Line Item No. 0006. Price and payment will constitute full compensation for the furnishing of all materials, labor and equipment to accomplish this work.

1.3.7 Supply and Install Temporary 2000kcmil Feeder System for Unit #1, CLIN 0007

Payment for the design, supply, and installation of the temporary 2000kcmil feeder system for Unit #1 will be made at the job bid price under Line Item No. 0007. Price and payment will constitute full compensation for the furnishing of all material and labor to perform this work.

1.3.8 Remove and Dispose of Existing HPFF Oil Storage Tank and Oil Pump Skid, CLIN 0008

Payment for the removal and disposal of 1400 gallons of HPFF oil, the 1500-gallon oil storage tank, oil pump skid, excess oil drums, oil piping, and other associated equipment will be made at the job bid price under Line Item No. 0008. Price and payment will constitute full compensation for the furnishing of all material, labor, and equipment to accomplish this work. Payment for the removal and disposal of the HPFF oil storage tank, oil pump skid, oil drums, nitrogen blanket tanks, exposed conduit, and other associated equipment will be made at the job bid price under Line Item No. 0008. Price and payment will constitute full compensation for the furnishing of all material, labor, and equipment to accomplish this work.

1.3.9 Supply and Install New Saddle Cleats, Cleat Support Structures, and Anchors, CLIN 0009

Payment for the supply and installation of the new saddle cleats, cleat support structures (including approved design), concrete anchors, and other associated equipment will be made at the job bid price under Line Item No. 0009. Price and payment will constitute full compensation for the furnishing of all material, labor and equipment to perform this work.

Payment for the supply and installation of required length of 15kv, 2000kcmil solid dielectric cables for Unit #1, including terminations and enclosures to house terminations in switchyard will be made at the job bid price under Line Item No. 0010. Price and payment will constitute full compensation for the furnishing of all labor required to accomplish this work.

1.3.11 Supply and Install New 2000kcmil, Medium-Voltage Solid Dielectric Cables for Unit #2 Feeders, including Switchyard Enclosures and Terminations, CLIN 0011

Payment for the supply and installation of required length of 15kv, 2000kcmil solid dielectric cables for Unit #2, including terminations and enclosures to house terminations in switchyard will be made at the job bid price under Line Item No. 0011. Payment for the commissioning services and trainingsupply and installation of required length of 15kv, 2000kcmil solid dielectric cables for Unit #3, including terminations and enclosures to house terminations in switchyard will be made at the job bid price under Line Item No. 0012. 1.3.13 Supply and Install New 750kcmil, Medium-Voltage Solid Dielectric Cables for Circuit #4 Feeders, including Switchyard Enclosures and Terminations, CLIN 0013

Payment for the supply and installation of required quantity of 15kv, 750kcmil solid dielectric cables for Circuit #4, including terminations and enclosures to house terminations in switchyard will be made at the job bid price under Line Item No. 0013. 1.3.17 Supply and Install Temporary 2000kcmil Feeder System for Unit #2, CLIN 0017

Payment for the supply and installation of the temporary 2000kcmil feeder system for Unit #2 will be made at the job bid price under Line Item No.

0017. Price and payment will constitute full compensation for the furnishing of all material and labor to perform this work.

1.3.18 Supply and Install Temporary 2000kcmil Feeder System for Unit #3, CLIN 0018

Payment for the supply and installation of the temporary 2000kcmil feeder system for Unit #3 will be made at the job bid price under Line Item No.

0018. Price and payment will constitute full compensation for the furnishing of all material and labor to perform this work.

1.3.19 Supply and Install Water Coil for Cable Tunnel Cooling System, CLIN

Payment for the supply and installation of the water-cooling coil for the tunnel HVAC system will be made at the job bid price under Line Item No.

0019. Price and payment will constitute full compensation for the furnishing of all material and labor to perform this work.

PROGRESS PAYMENT INVOICE

Submit requests for payment in accordance with Federal Acquisition Regulations (FAR) Subpart 32.9, entitled "PROMPT PAYMENT", and Clauses 52.232-5 and 52.232-27, entitled "Payments Under Fixed-Price Construction Contracts", and "Prompt Payment for Construction Contracts", respectively.

In addition each request shall be submitted in the number of copies and to the designated billing office as shown in the Contract.

When submitting payment requests, complete Blocks 1 through 12 of the "PROGRESS PAYMENT INVOICE" Form as directed by the Contracting Officer (provided in QCS). The completed form shall then become the cover document to which all other support data shall be attached.

One additional copy of the entire request for payment, to include the "PROGRESS PAYMENT INVOICE" cover document, shall be forwarded to a separate address as designated by the Contracting Officer.

Submit with each pay request, a list of subcontractors that have worked during that pay period. The listing shall be broken down into weeks, SECTION 01 22 00.00 26 Page 6 identifying each subcontractor that has worked during a particular week, and indicate the total number of employees that have worked on site for each subcontractor for each week. Also indicate the total number of employees for on-site staff for each week.

ELECTRONIC SOFTWARE SYSTEM FOR SUBMITTING CERTIFIED LABO PAYROLLS AND RECORDS

The Contractor is required to use a commercially available software system to process and submit certified payrolls electronically to the Government.

The requirements for preparing, processing, and submitting certified labor payrolls are established by the requirements as stated in FAR 52.222-8 PAYROLLS AND BASIC RECORDS, and FAR 52.222-13 COMPLIANCE WITH CONSTRUCTION

WAGE RATE REQUIREMENTS AND RELATED REGULATIONS.

Provide all access, licenses, and other services required for the receipt, processing, certifying, and electronically transmitting payrolls to the Government, and storing weekly payroll and other data required to comply with Construction Wage Rate Requirements and related regulations. The payroll software system shall be capable of preserving submitted payroll documents and related records for a minimum of three years after contract completion. Provide system access to the Government for the duration of this construction contract. Government access shall include online review by the Government's contract administration office of all electronic payroll records of the Contractor.

The payroll processing software system shall also meet the following functional criteria. It shall:

a. Be compliant with appropriate Construction Wage Rate Requirement payroll provisions in applicable Federal Acquisition Regulations

b. Be able to accommodate the required number of employees and subcontractors employed under the contract,

c. Be capable of producing an MS Excel compatible spreadsheet to be uploaded into the Quality Control System (QCS), which in turn shall exported to the Resident Management System (RMS),

d. Provide demonstrated security of data storage, data entry, and data access rights,

e. Be able to produce Contractor certified electronic versions of weekly payroll data,

f. Be able to identify erroneous entries and track data/time of all versions of the Construction Wage Rate certified payrolls submitted to the Government over the life of the contract, and

g. Be capable of generating a durable record copy; that is, a CD or DVD of records in PDF format from the system database. This durable record copy shall be provided to the Government during contract closeout. All incurred costs related to the provision and use of an electronic payroll processing system shall be included in the price for the work under the contract. All costs for providing and using the electronic payroll processing system and services shall not be a separately billed or reimbursed item under the contract.

COMPLIANCE WITH CONSTRUCTION WAGE RATE REQUIREMENTS

Contractor POC

Within 14 days after award of the contract, designate a point of contact (POC) who will be responsible for the Construction Wage Rates Requirements Program for the Contractor and all subcontractors under this contract as required by the Contract Clauses and FAR 52.222.

Responsibilities

The designated Contractor POC shall be responsible for Construction Wage Rates Requirements Program activities including, but not limited to:

a. Documentation and record keeping;

b. Submittal and accuracy of certified payrolls;

c. Submittal of required labor forms including requests for additional classifications and rates, Statements and Acknowledgement, etc.;

d. Posting of the wage determination, approved additional classifications and rates, labor and EEO posters;

e. Coordination with the Contracting Officer's Labor Program POC.

Prior to submittal to the Government, payrolls shall be reviewed for compliance to all applicable labor standards, to include, but not be limited to the following items: correct wage rates, correct overtime classification and pay, misclassification of workers for work actually performed, apprentice to journeyman ratios, and registration of apprentice. Corrective actions shall be taken as necessary to ensure Contractor compliance with applicable contract and FAR clauses.

Certification

The Contractor POC shall provide a signed certification stating the following: "I certify that the submitted items being forwarded have been reviewed in detail and are correct and in strict conformance with the Labor Standards of the contract except as otherwise stated."

PROPOSED PROJECT MODIFICATIONS

Price proposals for contract modifications shall be submitted in accordance with the requirements of the Contract Clause MODIFICATION PROPOSALS - PRICE BREAKDOWNS. If change order work impacts or delays other unchanged contract work, the costs of such impacts or delays shall be included in the proposals and separately identified. The current threshold for requiring cost or pricing data is $750,000 but is subject to change (see FAR 15.403-4(a)(1)(iii)). Any modification proposal that exceeds the cost and pricing data threshold shall meet the requirements of FAR 15.403 (see instructions for Change Orders/Modification and Claims in Table 15-2 of FAR 15.408)

Removal of existing equipment shall be performed in accordance with Sections 02 82 14 ASBESTOS ABATEMENT, and 26 05 00.00 26 BASIC ELECTRICAL MATERIALS AND METHODS, paragraph 3.3 EQUIPMENT REMOVAL. Disposal and recycling of existing equipment shall be performed as described in this section.

1.3 DEFINITIONS

1.3.1 Hazardous Material

A substance or material which has been determined by the Secretary of Transportation to be capable of posing an unreasonable risk to health, safety, and property when transported in commerce, and which has been so designated pursuant to the Hazardous Materials Transportation Act, 49 U.S.C. Appendix Section 1801 et seq. The term includes materials designated as hazardous materials under the provisions of 49 CFR 172 , Sections .101 and .102 and materials which meet the defining criteria for hazard classes and divisions in 49 CFR 173 . EPA designated hazardous wastes are also hazardous materials.

1.3.2 Hazardous Waste

A waste which meets criteria established in RCRA or specified by the EPA in 40 CFR 261 or which has been designated as hazardous by a RCRA authorized state program.

1.4 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. Submit the following in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

SD-01 Preconstruction Submittals

Hazardous Waste Management Plan; G Transportation, Disposal, and Recycling Plan; G

A Hazardous Waste Management Plan and a Transportation, Disposal, and Recycling Plan shall be submitted by the Contractor. These plans shall be reviewed and accepted by the Contracting Officer prior to removal of equipment from the Center Hill Power Plant.

1.5 QUALITY ASSURANCE

1.5.1 Transportation and Disposal Coordinator

Designate, by position and title, one person to act as the Transportation and Disposal Coordinator (TDC) for this contract. The TDC shall serve as the single point of contact for all environmental regulatory matters and shall have overall responsibility for total environmental compliance at the site including, but not limited to, accurate identification and classification of hazardous waste and hazardous materials; determination of proper shipping names; identification of marking, labeling, packaging and placarding requirements; completion of waste profiles, hazardous waste manifests, asbestos waste shipment records, bill of ladings, exception and discrepancy reports; and all other environmental documentation. The TDC shall have, at a minimum, one year of specialized experience in the management and transportation of hazardous waste and have been Department of Transportation certified under 49 CFR 172 , Subpart H.

1.5.2 Training

The Contractor's employees transporting hazardous materials or preparing hazardous materials for transportation, including samples, shall be trained, tested, and certified in accordance with 49 CFR 172 , Subpart H, including security awareness and any applicable security plans.

Contractor employees making determinations that shipments do not constitute DOT regulated hazardous materials shall also be trained, tested, and certified in accordance with 49 CFR 172 , Subpart H.

1.5.3 Certification

The Contractor and/or subcontractors transporting hazardous materials shall possess a current certificate of registration issued by the Research and Special Programs Administration (RSPA), U.S. Department of Transportation, when required by 49 CFR 107 , Subpart G. Submit copies of the certificates or written statements certifying exemption from these requirements.

1.5.4 Laws and Regulations Requirements

Work shall meet or exceed the minimum requirements established by Federal, state, and local laws and regulations which are applicable. These requirements are amended frequently and compliance with amendments is required as they become effective. In the event that compliance exceeds the scope of work or conflicts with specific requirements of the contract, SECTION 02 81 13 Page 5 notify the Contracting Officer immediately.

PART 2 PRODUCTS

2.1 MATERIALS

Provide all the materials required for the packaging, labeling, marking, placarding and transportation of hazardous wastes and hazardous materials in conformance with Department of Transportation standards and EP 415-1-266 .

Details in this specification shall not be construed as establishing the limits of the Contractor's responsibility.

2.1.1 Packagings

Provide containers for packaging hazardous materials/wastes consistent with the authorizations referenced in the Hazardous Materials Table in 49 CFR 172 , Section .101, Column 8. Bulk and non-bulk packaging shall meet the corresponding specifications in 49 CFR 173 referenced in the Hazardous Materials Table, 49 CFR 172 , Section .101. Each packaging shall conform to the general packaging requirements of Subpart B of 49 CFR 173 , to the requirements of 49 CFR 178 at the specified packing group performance level, to the requirements of special provisions of column 7 of the Hazardous Materials Table in 49 CFR 172 , Section .101, and shall be compatible with the material to be packaged as required by 40 CFR 262 .

Also provide other packaging related materials such as materials used to cushion or fill voids in overpacked containers, etc. Sorbent materials shall not be capable of reacting dangerously with, being decomposed by, or being ignited by the hazardous materials being packaged. Additionally, sorbents used to treat free liquids to be disposed of in landfills shall be non-biodegradable as specified in 40 CFR 264 , Section .314. In addition, packaging notifications will be provided to the Government in accordance with 49 CFR 172 , Section .178.2(c) regarding type and dimensions of closures, including gaskets, needed to satisfy performance test requirements.

2.1.2 Markings

Provide markings for each hazardous material/waste package, freight container, and transport vehicle consistent with the requirements of 49 CFR 172 , Subpart D and 40 CFR 262 , Section .32 (for hazardous waste);

and 40 CFR 61 , Section .149(d) (for asbestos). Markings shall be capable of withstanding, without deterioration or substantial color change, a 180 day exposure to conditions reasonably expected to be encountered during container storage and transportation.

2.1.3 Labeling

Provide primary and subsidiary labels for hazardous materials/wastes consistent with the requirements in the Hazardous Materials Table in 49 CFR 172 , Section .101, Column 6. Labels shall meet design specifications required by 49 CFR 172 , Subpart E including size, shape, color, printing, and symbol requirements. Labels shall be durable and weather resistant and capable of withstanding, without deterioration or substantial color change, a 180 day exposure to conditions reasonably expected to be encountered during container storage and transportation.

2.1.4 Placards

For each offsite shipment of hazardous material/waste, provide primary and

SECTION 02 81 13 Page 6 subsidiary placards consistent with the requirements of 49 CFR 172 , Subpart F. Placards shall be provided for each side and each end of bulk packaging, freight containers, transport vehicles, and rail cars requiring such placarding. Placards may be plastic, metal, or other material capable of withstanding, without deterioration, a 30 day exposure to open weather conditions and shall meet design requirements specified in 49 CFR 172 , Subpart F.

2.1.5 Spill Response Materials

Provide spill response materials including, but not limited to, containers, adsorbent, shovels, and personal protective equipment. Spill response materials shall be available at all times in which hazardous materials/wastes are being handled or transported. Spill response materials shall be compatible with the type of material being handled.

2.2 EQUIPMENT AND TOOLS

Provide miscellaneous equipment and tools necessary to handle hazardous materials and hazardous wastes in a safe and environmentally sound manner.

PART 3 EXECUTION

3.1 DISPOSAL AND RECYCLING OF EXISTING EQUIPMENT

3.1.1 Separating Potheads from Cable

a. Potheads shall be separated from the cables.

b. The cable shall be cut and separated from the pothead as close to the pothead as possible without cutting or damaging the pothead.

c. There may be insulation oil in the cable that may drip from the cable during pothead-cable separation. The dripping insulation oil shall be contained in oil absorbent material. Chipping or fragment material from the cable shall be contained.

3.1.2 Insulation Oil

a. Dripping insulation oil shall be captured in absorbent material when the cable is cut.

b. The captured insulation oil and oil stored in reservoir tank & oil drums shall be disposed of following all laws, provisions and all federal, state, and local regulations.

c. Insulation oil has been analyzed and PCBs were not detected.

3.1.3 Medium Voltage Cable Recycling

a. The cable shall be extracted in whole if practicable.

b. The extracted cable shall be recycled as scrap metal of copper and lead as per 40 CFR 261 .6(a)(3)(ii).

c. Ensure no speculative accumulation at the scrap metal recycling center. The cable must be recycled in a reasonable amount of time which is 75% of the cable within one (1) year.

d. The metal recycler should be able to smelt insulating-oil/paper and the cable jacket.

3.1.4 Pothead Disposal

a. Potheads and connect ed l i nes are asbestos containing material (ACM).

b. Asbestos must be managed so that there are no visible emissions to the outside air during the collection, processing, packaging or transporting of the waste.

c. All ACM waste shall be collected and placed in leak-tight containers.

d. All ACM shall be disposed of following all laws, provisions and all federal, state, and local regulations. Proper manifest documentation, recordkeeping, and reporting shall be done according to 40 CFR 262 .

e. Vehicles used to transport asbestos wastes must be adequately marked.

The requirements for marking are contained in Title 49 CFR and in 40 CFR 61 .149(d)(1)(i), (ii), and (iii).

f. Disposal facilities that receive asbestos waste must meet regulatory standards outlined in 40 CFR 61 .154.

g. The original waste shipment records and manifests must be supplied to the generator and must be maintained for a period of two (2) years.

3.2 OFFSITE HAZARDOUS WASTE MANAGEMENT

Use RCRA Subtitle C permitted facilities which meet the requirements of 40 CFR 264 or facilities operating under interim status which meet the requirements of 40 CFR 265 . Offsite treatment, storage, and/or disposal facilities with significant RCRA violations or compliance problems (such as facilities known to be releasing hazardous constituents into ground water, surface water, soil, or air) shall not be used. Submit Notices of Non-Compliance and Notices of Violation by a Federal, state, or local regulatory agency issued to the Contractor in relation to any work performed under this contract. Immediately provide copies of such notices to the Contracting Officer. Also furnish all relevant documents regarding the incident and any information requested by the Contracting Officer, and coordinate its response to the notice with the Contracting Officer or the designated representative prior to submission to the notifying authority.

Also furnish a copy to the Contracting Officer of all documents submitted to the regulatory authority, including the final reply to the notice, and all other materials, until the matter is resolved.

3.2.1 Treatment, Storage, and/or Disposal Facility and Transporter

Provide the Contracting Officer with EPA ID numbers, names, locations, and telephone numbers of TSD facilities and transporters. This information shall be contained in the Hazardous Waste Management Plan and shall be approved by the Contracting Officer prior to waste disposal.

3.2.2 Status of the Facility

Facilities receiving hazardous waste shall be permitted in accordance with 40 CFR 270 or operating under interim status in accordance with 40 CFR 265 requirements, or permitted by a state authorized by the Environmental Protection Agency to administer the RCRA permit program.

3.2.3 Shipping Documents and Packagings Certification

Prior to shipment of any hazardous material offsite and a minimum of 14 days prior to anticipated pickup, provide for review written certification to the Contracting Officer that hazardous materials have been properly packaged, labeled, and marked in accordance with Department of Transportation and EPA requirements.

3.2.4 Transportation

Transportation shall comply with all requirements in the Department of Transportation referenced regulations in the 49 CFR series. Prepare hazardous waste manifests for each shipment of hazardous waste shipped offsite. Submit notifications with the manifest to the Contracting Officer for review and approval.

3.2.5 Treatment and Disposal of Hazardous Wastes

The hazardous waste shall be transported to an approved hazardous waste treatment, storage, or disposal facility within 90 days of the accumulation start date on each. Ship hazardous wastes only to facilities which are properly permitted to accept the hazardous waste or operating under interim status. Ensure wastes are treated to meet land disposal treatment standards in 40 CFR 268 prior to land disposal. Submit Certificates of Disposal documenting the ultimate disposal, destruction or placement of hazardous wastes within 180 days of initial shipment.

3.3 MATERIALS MANAGEMENT

In consultation with the Contracting Officer, evaluate, prior to shipment of any material offsite, whether the material is regulated as a hazardous waste; this shall be done for the purpose of determining proper shipping descriptions, marking requirements, etc., as described below.

3.3.1 Identification of Proper Shipping Names

Use 49 CFR 172 , Section .101 to identify proper shipping names for each hazardous material (including hazardous wastes) to be shipped offsite.

Submit proper shipping names to the Contracting Officer in the form of draft shipping documents for review and approval.

3.3.2 Packaging, Labeling, and Marking

Package, label, and mark hazardous materials/wastes using the specified materials and in accordance with the referenced authorizations. Mark each container of hazardous waste of 110 gallons or less with the following:

"HAZARDOUS WASTE - Federal Law Prohibits Improper Disposal.

If found, contact the nearest police or public safety authority or the U.S. Environmental Protection Agency.

Generator's name _____________________________________ Manifest Document Number ___________________________".

3.3.3 Shipping Documents

Ensure that each shipment of hazardous material sent offsite is accompanied by properly completed shipping documents. This includes shipments of samples that may potentially meet the definition of a

Department of Transportation regulated hazardous material.

3.3.3.1 Asbestos Waste Shipment Documents

Prepare waste shipment records, as required by 40 CFR 61 , for shipments of asbestos. Submit waste shipment records to the Contracting Officer for review and approval. Waste shipment records shall be signed by the Contractor.

3.3.3.2 Other Hazardous Material Shipment Documents

Prepare a bill of lading for each shipment of hazardous material which is not accompanied by a hazardous waste manifest or asbestos waste shipment record which fulfills the shipping paper requirements. The bill of lading shall satisfy the requirements of 49 CFR 172 , Subpart C, and 40 CFR 279 if shipping used oil and any applicable state or local law or regulation, and shall be submitted to the Contracting Officer for review and approval.

For laboratory samples and treatability study samples, prepare bills of lading and other documentation as necessary to satisfy conditions of the sample exclusions in 40 CFR 261 , Section .4(d) and (e) and any applicable state or local law or regulation.

3.4 WASTE MINIMIZATION

Minimize the generation of hazardous waste to the maximum extent practicable and take all necessary precautions to avoid mixing clean and contaminated wastes. Identify and evaluate recycling and reclamation options as alternatives to land disposal. Requirements of 40 CFR 266 shall apply to: hazardous wastes recycled in a manner constituting disposal; hazardous waste burned for energy recovery; lead recycling; and hazardous wastes with economically recoverable precious metals. Submit written certification that waste minimization efforts have been undertaken to reduce the volume and toxicity of waste to the degree economically practicable and that the method of treatment, storage, or disposal selected minimizes threats to human health and the environment.

3.5 RECORDKEEPING

Maintain adequate records to support information provided to the Contracting Officer regarding exception reports, annual reports, and biennial reports; maintain asbestos waste shipment records for a minimum of 3 years from the date of shipment or any longer period required by any applicable law or regulation or any other provision of this contract; and maintain bill of ladings for a minimum of 375 days from the date of shipment or any longer period required by any applicable law or regulation or any other provision of this contract. Submit information necessary to file state annual or EPA biennial reports for all hazardous waste transported, treated, stored, or disposed of under this contract. Do not forward these data directly to the regulatory agency but to the Contracting Officer at the specified time. The submittal shall contain all the information necessary for filing of the formal reports in the form and format required by the governing Federal or state regulatory agency.

A cover letter shall accompany the data to include the contract number, Contractor name, and project location. In the events that a manifest copy documenting receipt of hazardous waste at the treatment storage and disposal facility is not received within 35 days of shipment initiation, prepare and submit an exception report to the Contracting Officer within 37 days of shipment initiation.

3.6 SPILL RESPONSE

In the event of a spill or release of a hazardous substance (as designated in 40 CFR 302 ), or pollutant or contaminant, or oil (as governed by the Oil Pollution Act (OPA), 33 U.S.C. 2701 et seq.), notify the Contracting Officer immediately. Any direction from the Contracting Officer concerning a spill or release shall not be considered a change under the contract. If the spill exceeds a reporting threshold, follow the pre-established procedures for immediate reporting to the Contracting Officer. Comply with all applicable requirements of Federal, state, or local laws or regulations regarding any spill incident.

ASBESTOS ABATEMENT

PART 1 GENERAL

1.1 GENERAL INFORMATION

This section covers sampling and testing, and removal and disposal of all Asbestos-Containing Materials (ACM) encountered during the execution of this contract. The Contractor may encounter asbestos-containing materials in the potheads and connected lines during the removal of existing medium voltage cables. There may be ACM present in areas not identified by the contract. The Contractor shall sample all suspected materials to determine the presence of ACM. When ACM are encountered, then the requirements of this section shall be enforced. In addition, during the performance of this contract, the laws, ordinances, rules, and regulations of Federal, State, Regional, and local authorities shall be complied with regarding the removal, storage, transportation, and disposal of ACM.

40 CFR 763 , EPA 340/1-90/018 , EPA 340/1-90/019 , and EPA 560/5-85-024 apply to this job. Where the requirements of these specifications and Federal, State, Regional or local regulations vary, the most stringent requirements shall be enforced.

1.3 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only or as otherwise designated. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section

01 33 00 SUBMITTAL PROCEDURES:

Initial Submittals (except where otherwise stated as "Subsequent Submittals". Prior to the commencement of any work involving asbestos containing materials:

Daily Narrative Log;

A copy of the daily narrative log submitted daily for the previous work day. The entries in the log shall be consistent

SD-07 Certificates

Sampling Plan; G This plan shall include a list of the trained personnel which will be used to collect bulk samples and include a description of the methods to be used to collect, transport, and analyze the sample materials. The bulk sampling plan shall conform to the requirement of paragraph 3.2 "BULK SAMPLING FOR ASBESTOS-

CONTAINING MATERIALS (ACM)".

Asbestos Plan; G A detailed asbestos plan, approved and signed by the certified Industrial Hygienist, of the containment and work procedures to be used in the removal and demolition of asbestos containing materials. The plan shall include a sketch showing the location, size, and details of the asbestos control areas, location, layout, and details of the decontamination areas, and the locations of negative pressure equipment and pressure differential monitoring devices. The plan shall also include interface of trades involved in the construction, sequencing of asbestos related work, disposal plan, type of wetting agent to be used, air monitoring, respirators, protective equipment, pressure differential monitoring device, and a detailed description of the method to be employed in order to control pollution. Prior to the start of any abatement work, a representative of the asbestos abatement Contractor, as well as their onsite supervisory and air monitoring personnel, shall meet with the Government to discuss in detail the asbestos plan, including work procedures and safety precautions.

Asbestos Abatement Contractor; G The name, address, and telephone number of the asbestos abatement Contractor selected to perform the abatement activities for this contract. Certification shall also be submitted to verify that the Contractor is licensed to perform abatement activities at the project location.

Testing Laboratory and Air Monitoring Personnel; G The name, address, and telephone number of the testing laboratory selected to perform the analysis of the bulk samples and the air monitoring for airborne concentrations of asbestos fibers shall be submitted. Certification shall also be submitted to verify that the persons counting the air samples have met the

SECTION 02 82 14 Page 5 requirements as set forth in paragraph 1.13 "AIR MONITORING

PERSONNEL".

Industrial Hygienist; G The name, address, and telephone number of the industrial hygienist selected to review and approve the asbestos abatement plan. In addition, a copy of certification from the American Board of Industrial Hygiene for the Industrial Hygienist shall also be submitted.

Permits and Notifications;

A copy of all permits and notifications as required by Federal, State, and local agencies.

Waste Disposal Site (WDS);

Prior to disposal, written evidence stating that the State and local regulatory agencies approve the landfill for disposal for asbestos disposal.

Previous Citations;

A list of any citation and their resulting penalties issued by Federal, State, or Local regulatory agencies relating to asbestos abatement activities. This list shall include the name of the project, dates, and resolutions. In addition, a list of any asbestos related contract that has been terminated prior to its completion shall also be submitted. This list shall include the project's name, date, and reasons for termination.

Pressure Differential Recordings;

If required by the approved abatement plan, pressure differential recordings of the negative pressure system for each workday shall be reviewed by the industrial hygienist, or his designee, and submitted to the Government on site within 24 hours from the end of each workday.

Personnel and Area Air Monitoring Results;

Analysis of air samples shall be completed and results reviewed by the approved air monitoring personnel within 1 hour of the time the samples were taken. Monitoring results shall be signed by the person performing the air monitoring and copies of the results shall be submitted to the Government within 3 working days after the sample was taken.
