Questions and Answers

48. Question: Are there to your knowledge any Engineering or Consulting firms or individuals that the bidder/constructor is precluded from working with on prebid designs, specifically the precast element design for the Cofferdam wall?

Answer: No.

49. Question: As this was designed or developed 10-12 years ago, please provide all available precast element drawings developed by Gerwick or ____ Construction.

Answer: The precast element drawings developed by Gerwick over 13 years ago have subsequently undergone significant revisions by the Corps of Engineers, including the deletion of all drawings related to a specific construction method. Therefore, such drawings have not been included in the Solicitation.

50. Question: Will the US Army Corp of Engineers allow foundation elements associated with temporary supports/bracing below the final excavated elevation of the cofferbox?

Answer: Yes, but their location must obtain approval of the Contracting Officer to ensure they do not conflict with future features in this area (eg., grouting and possible shear resistance elements).

51. Question: Will the US Army Corp of Engineers allow foundation elements associated with temporary supports/bracing below the final excavated elevations of future lock work locations?

52. Question: Where does the US Army Corp of Engineers allow the Contractor to unload dredge spoils and rock from the wet excavation considering Disposal Area D does not show any direct water access, reference sheet 510N102A?

Answer: The East Bank River Access Ramp as shown in sheet 510N102A will be available to the Contractor throughout the contract for this purpose. Sheet 510N102A is being revised in Amendment 0003 to include this ramp in the construction work limits for this contract.

53. Question: Sheet 510N102A shows the Construction Limits and Temporary Exploratory Work Area. Note 4 of 6 on the same sheet indicates that this area is to be utilized from NTP until March 2018 for the purpose of subsurface investigation. Would the US Army Corp of Engineers allow the Contractor to have construction vehicle/equipment access throughout this area during the entire performance period?

Answer: No. However, the Contractor will have use of this area after March 2018 until such time as the future contractor requires its use.

54. Question: If there are temporary supports/bracing utilized in the design and construction of the cofferbox, will these elements be allowed to remain embedded in the subsequent concrete placements?

55. Question: Section 3.7 of Section 31 23 06 states “no moving river traffic will be allowed within 1500 feet of the blast area.” Because the existing lock is within 1500’ of the blast area, will the time required to load and shoot each blast be counted as a lock closure period?

Answer: Yes.

56. Question: Will the Contractor be permitted to temporarily fill the area between the proposed cofferdam alignment and the east shore line?

Answer: It is expected that temporary fill in this area will be acceptable if it conforms with all environmental requirements. All fill below water may be required to be clean rock to minimize the development of plumes and a modification to the 401 Water Quality permit may be required through the Kentucky Division of Water. A large quantity of shot rock is located in Disposal Area D and will be available for the Contractor’s use.

57. Question: If the USACE does not receive sufficient funding authorization to award all

Options contained in the Bid Schedule by the 28 April, 2017 deadline, will the order of award be in numeric sequence or some other sequence?

Answer: The deadline for exercise of the options has been revised to May 31, 2017 in Amendment 0003. There is no particular order for the award of the options.

58. Question: Can the deadline for questions be extended for two weeks?

Answer: Amendment 0002 extended the question deadline to July 18, 2016. The deadline for the submission of Questions has passed and will not be further extended.

59. Question: Will the Contractor be required to provide Builder’s Risk insurance? If so, will any part of the existing facility be required to be covered by this insurance?

60. Question: What is the expected duration for monitoring both new and existing instrumentation?

Answer: New instrumentation is being removed from the contract with the exception of five alignment pins. Instrumentation monitoring shall cover the entire contract duration. These revisions have been incorporated in Amendment 0002.

61. Question: Existing Instrumentation references 8 Inclinometers. Currently Inclinometer 5 and

8 (IN-5/IN-8) are not automated like the others. What is reading frequency for these two manual Inclinometers? (I don’t believe IN-8 even exists any more).

Answer: Manual inclinometers IN-5 and IN-8 have been read by Government personnel during the ongoing work, and that will be the case during this contract as well. The Contractor will not be responsible for reading IN-5 and IN-8 unless specifically directed to do so by the COR.

62. Question: Alignment Pins (new and existing) and RBMDs (existing) are read manually. a.

Drawing Sheet 61N852-10 says new AP to be read daily. b. What is frequency for existing AP and RBMDs?

Answer: The contractor is responsible for reading all instrumentation onsite, both manual and automated. Specification section 13 50 00 has been updated to clarify reading requirements as part of Amendment 0002.

63. Question: Piezometers- Specification requires 7 multiple depth Piezometers and 3 single-total of 17 Piezometers in 10 holes. Piezometer sensing zone (typ) is shown on Drawing 61N852-11 for only CCP 30. What are depths for all new Piezometers?

Answer: New piezometers are being removed from the contract, no new piezometers shall be installed. This revision has been incorporated in Amendment 0002.

64. Question: Inclinometers- Specification Drawing requires 8 ‘inclinometers with multiple sensors’. How many is multiple? What depths?

Answer: New inclinometers are being removed from the contract, no new inclinometers shall be installed. This revision has been incorporated in Amendment 0002.

65. Question: Drawing – Drawing 61N852-10, Note 1 references to Drawing 61N852 – 12.

Download does not include this drawing. Could this have Piezometers and Inclinometer layouts?

Answer: Drawing 61N852-10 has been revised and Drawing 61N852-11 has been removed from folio. Drawing 61N852-12 is not part of the folio and reference to it has been removed from the drawings. These revisions have been incorporated as part of Amendment 0002.

66. Question: Is permanent AC power provided for new instrumentation? Cofferdam Cell 1?

Current Instrumentation is solar powered.

Answer: New instrumentation is being removed from the contract. No revisions to the electrical requirements of the contract have been made, AC power is still to be supplied by the Contractor for lighting.

67. Question: Specification section 3.13 Ownership. This is basically requiring the Contractor to decommission ALL instrumentation, get it re-calibrated and send back to the COE. Really?

Buying all new equipment may be cheaper.

Answer: The intent of this section is covering the manual reading equipment, i.e.

inclinometer probes, water level indicators, etc. This does not require the Contractor to pull every sensor on the project and have it recalibrated. This has been updated in 13 50 00 for clarification in Amendment 0002.

68. Question: At the pre-bid conference, we were told that unless the west boat basin was to be used by the contractor, that all mussel relocation work is covered by an existing Corps contract. But if the west boat basin was to be used, then mussel relocation from that area will be the contractors responsibility. If this is so, then we need to know a bit about the West Boat Basin. Such as: 1-Does the Corps have existing information about mussel presence/densities in the west boat basin? 2-If so can you forward a copy of that report to us? 3-Also how deep is the water in the basin?

Answer: A survey report of mussel density in the contract area, including the West Bank Boat Basin, was included in Amendment 0002. Approximate contours for the bottom of the boat basin and information on the remnant H-piles are included in For Information Only Sheet 23N217. Additional information and requirements for this boat basin are in Paragraph

1.5.1.1 of Section 01 00 00 of the Specifications.

69. Question: The design of any precast structure requires significant upfront preliminary engineering. Cost for the general contractor as well as potential subcontractors and designers is also quite significant. Will the Owner reconsider providing a stipend to contractors who turn in price? It has been difficult to find contractors to provide pricing due to the challenging nature of this project as well as its significant risk.

70. Question: May Bergman Associates Engineering participate as a design partner for the project?

Answer: Yes.

71. Question: Will the Owner allow any variance in the Drilling and Blasting specifications as it pertains to the loading of holes?

Answer: It is not clear what kind of variance is being requested. Variances will be evaluated by the COR and design team and are subject to approval of the Contracting Officer after award of the contract.

72. Question: Is there a list of alternative sections that are allowed for the job in regards to the sheet piling? We have sections that have properties as good or better than the ones listed below and we would like to offer these.

Answer: Alternate materials will be evaluated by the Contracting Officer upon the request of the Contractor after award of the contract. Any proposed changes in materials must be proposed as a credit change to the Government or as a Value Engineering Proposal and they must adhere to all the design and performance criteria considered for the original design. All bidders are encouraged to submit bids based on the materials specified in the Solicitation.

73. Question: Is there a process to get our alternatives approved before the bid / award date and what do we need to do to get our material substitutes approved?

Answer: No. Alternate materials will be evaluated by the Contracting Officer upon the request of the Contractor after award of the contract.

74. Question: Is the cargo preference act in place on this job?

Answer: The Cargo Preference Act has not been incorporated into this contract.

75. Question: Drawings for the alignment pins show three (3) on the cells to be placed and two

(2) more on the existing sheet pile wall by the existing tower. The payment item for Survey pins only has three (3) for quantity. Is it correct we need to plan to install and price five (5) total alignment pins?

Answer: Five alignment pins shall be installed. The original bid schedule was incorrect. The bid schedule was updated as part of Amendment 0002 to reflect the correct quantity of alignment pins.

76. Question: The piezometer payment quantity is 17 but the drawings and specs each show ten

(10). Is it correct to assume that there are only ten (10) we need to price?

Answer: New piezometers have been removed from the contract, no new piezometers shall be installed. This revision has been incorporated in Amendment 0002.

77. Question: The specs imply that the “X” shaped weepholes will also be burned into the Tied

Z pile wall on the inside portion of the cofferdam. This work is not shown on the plans. Are the weepholes required on the tied Z pile wall?

Answer: See note no. 9 on drawing 510N106 that states the weepholes shall be placed on the entire cofferdam. This includes the Z-pile wall.

78. Question: Please provide more information on the Helper Boat- What size (hp) is required?

How will payment be handled if utilized for a partial day?

Answer: Information on the required Helper Boat is provided in Paragraph 1.6.2 of Section 01 00 00 of the Specifications. This information includes the minimum required horsepower.

Based on the requirements for the Helper Boat, it is anticipated that it will be required to be on-station and available for its sole purpose 24 hours per day over extended periods of time.

Therefore, partial day requirements are not anticipated.

79. Question: Drawing 61N651-8 has cut sections that refer to drawings 61N651-12, 61N651-

13, 61N651-14, and 61N651-15 that do not exist in the drawing set. Will these drawings come out in a later addendum?

Answer. These drawings have been eliminated and the cut section references will be removed from this drawing in Amendment 0003.

80. Question: Given the amount of construction engineering work required for this proposal, could the bid period be extended by 3 weeks.

Answer: Amendment 0002 extended the bid opening date to August 16, 2016 at 1:00 pm CDT. No additional extension will be considered.

81. Question: Can the period for questions be extended for a similar duration?

Answer: Amendment 0002 extended the question deadline to July 18, 2016. The deadline for the submission of Questions has passed and will not be further extended.

82. Question: Because the different Means and Methods that contractors may select for the construction of the concrete cofferdam, there may be differing life cycle and maintenance costs associated with each contractor’s approach. How does the government intend to evaluate these differences in this Solicitation format?

Answer. A final design and configuration has been provided in this Solicitation using prescribed materials. Therefore, there should not be any differences in life cycle costs for the final product. Means and Methods are typically short duration construction activities that also should not have life cycle costs associated with them. Life cycle costs will not be evaluated in this Solicitation.

83. Question: Could the Corps please provide the original design memorandum for the project?

84. Question: Could the Corps please provide the previously completed design documents for the concrete cofferdam?

Answer: The latest Design Documentation Report is being included as part of Amendment 0003.

85. Question: One approach to the concrete cofferdam would include placing the precast box on drilled piers. This would leave the potential for parts of the concrete wall to be unsupported in the event of scour or washout. Will this be acceptable to the Corps, or will a retention system be required to ensure continuous support f of the wall perimeter?

Answer. Changes to the design will not be considered during this Solicitation period but will be considered and evaluated post-award through the Value Engineering process. Because the concrete cofferdam is expected to be a water barrier structure, any proposed alternate designs would obviously need to consider this basic function. Because the existing channel bottom is near top of rock in the foot print of this cofferdam, scour in itself is not expected to be a design concern.

86. Question: At the areas to receive wall armor, is there a minimum thickness required to provide support of the wall armor anchorage?

Answer: Wall armor strap anchors should extend beyond the first line of the wall face rebar reinforcement.

87. Question: Could the wall armor be cast in to the walls after placement of all other concrete?

Answer: The Government does not intend to direct the contractor's Means and Methods of construction, but casting the wall armor after placement of all other concrete could be problematic, especially below tailwater.

88. Question: If a contractor’s Means and Methods included an onsite batch plant, would the

Corps provide space onsite for this?

Answer. The Government anticipates there is adequate space within the Construction Limits for an onsite batch plant.

89. Question: Sheets 61N650-2 and 61N650-3, Note 1 states that “Contractor shall submit their concrete cofferdam construction proposal detailing locations of all reinforcement, cast-in-place concrete, precast concrete, and tremie concrete mix designs and plans.” When does this submission occur? With the Bid? Could the evaluation criteria for these plans be provided? If post bid, how does the Corps ensure that the pricing received on bid day is compliant and executable for the bid price?

Answer: This submission would be post-award of this contract. The evaluation criteria for the submittals is to ensure the construction plan meets all the requirements of the contract.

This includes but is not limited to safety, environmental, and quality control requirements.

The bid price should reflect all the requirements contained in the Solicitation.

90. Question: Where is the dental concrete line item anticipated to be installed?

Answer. Refer to Specification Section 31 60 00, Paragraph 1.2.3: "Dental concrete is defined as tremie concrete used to fill/backfill depressed areas in the rock surface and discontinuities in the rock surface and discontinuities in the rock mass as specified herein."

91. Question: Can we get a location map and GPS coordinates for each seismograph monitoring location?

Answer: The approximate location for the seismographs is provided in Paragraph 3.15 of Section 31 23 06. Their exact location will be determined in the field in concert with the COR after contract award; therefore, GPS coordinates cannot be provided at this time.

92. Question: Will electronic/digital detonators be allowed?

93. Question: Please consider revising the 4-hour lock closure time for blasting; revising specifications to allow loading holes, exclusive of final wiring of the shot, prior to closure;

and/or significantly increasing the time of performance for the project. It is simply not possible to safely load and detonate more than a few blast holes in the current 4-hour window. Given the maximum 3x3 drill pattern, production blasting, exclusive of the test blasting program, will require drilling in excess of 5,000 holes or approximately 24 blast holes per LF of the excavation area as measured along the construction baseline. Even assuming the project can be staffed with sufficient qualified personnel to load and shoot these 24 holes in the 4-hour window, it will require an estimated 167 work days (500 LF at 3 lf per day) to blast the approximately 500’ long excavation area. Additionally only blasting one row of holes at a time will seriously compromise blasting efficiency, require the use of more explosives than would otherwise be necessary, and dramatically increase the chance for poor breakage results. The required 167 work days performance period is the duration after completion of the test blast program, and likely represents more than one entire construction season given seasonal limitations. Effectively, no other work on the project can proceed until completion of the rock excavation.

As mentioned above, an alternative to increasing the daily closure time is allowing loading of the holes, exclusive of completion of the wiring process, prior to commencing a lock closure period. Loading could be accomplished safely while maintaining river traffic thereby allowing time to shoot several rows of holes per shot. This method would reduce both the total amount of explosives needed and the duration of the blasting operation.

Answer. The 4-hour restriction for lock closure during blasting is being removed from Paragraph 3.7 of Section 31 23 06 of the Specifications in Amendment 0003. It is the Government's intention to allow flexibility to the contractor in determining how to best utilize the limited lock closure time allowed in this contract. However, the Government did utilize 4 hours of lock closure per blast in determining this contract's period of performance and in determining the allowed maximum lock closure period. For the blasting activity, the Government assumed a specialized floating plant that would accommodate multiple drilling rigs operating simultaneously and designed to accommodate the 3x3 drilling pattern. It was assumed that multiple rows of holes would be loaded per blast using PVC pipe extending from the hole to above the waterline. This method has been utilized successfully for previous underwater blasting operations. However, it is not the Government's intent to direct Means and Methods for this activity and more efficient methods would be encouraged. Methods to minimize lock closure impacts may require more resources to be applied to this element of work than in more common underwater blasting sites. Because of OSHA requirements, it is not expected that loading holes while vessels are transiting the site will be feasible or allowed.

94. Question: Why is there not a complete set of "for construction" documents issued with the Solicitation?

Answer: The Plans and Specifications constitute a complete set of construction documents.

All features of work have complete dimensions and materials specified necessary for construction. In addition, all other requirements necessary to meet the Government's intent during construction have been incorporated into the Plans and Specifications. This includes, but is not limited to, safety aspects, environmental aspects, and limitations on the negative impacts to the operation of the existing Kentucky Lock. The Government has not prescribed the Means and Methods "for construction" techniques to afford the bidders latitude to select those Means and Methods best suited to their expertise and resources.

95. Question: Why were the design criteria necessary to engineer the concrete cofferdam sections excluded from the Solicitation?

Answer: From the Government’s perspective, the design criteria is not necessary to develop Means and Methods. However, upon request, the latest Design Documentation Report describing the design criteria and computations for the concrete cofferdam is being provided as part of Amendment 0003.

96. Question: Because of the unknown pre-award activity schedule, it is possible the contractor could miss an entire construction season during preconstruction activities and submittals.

Why don't the Solicitation documents contemplate an alternative completion date for the time spent in the pre-award phase?

Answer. All substantive submittals and Value Engineering Proposals will be developed post-award. The Government anticipated significant time and effort in the development and approval of submittals for the Means and Methods for the concrete cofferdam sections in the development of the Period of Performance. The submittal development and approval process is not on the critical path because the Government's schedule does not anticipate marine construction activities to commence until 1 May 2017 - to allow for the two month window of fish spawning restrictions. The first marine activity assumed would be demonstration of underwater blasting techniques.

97. Question: Why are there no documents detailing the bearing surface of the stay-in-place concrete forms?

Answer: The Government is not directing or advocating the use of stay-in-place forms - a Means and Methods for the concrete cofferdam sections. For example, a coffer box type method may be feasible that would not require stay-in-place forms. If stay-in-place forms are chosen by the Contractor, then there are a multitude of techniques that could be applied for use as bearing surfaces. Constraints that could affect those Means and Methods have been incorporated into the Solicitation such as the requirement not allowing permanent intrusions above elevation 288.0 in the navigation channel.

98. Question: Why don't the design documents provide design details on the acceptable means for the connection between precast concrete and cast-in-place concrete?

Answer: While precast stay-in-place forms are not being directed by the Government, criteria or constraints pertinent to this Means and Methods or others have been included in the Solicitation as deemed appropriate to facilitate the development of bids and work plans.

The connection between a possible precast form and the cast-in-place concrete falls in that category so details and criteria for this connection will be included in a future amendment.

99. Question: Why don't the design documents provide details or criteria on the joint treatment at the monolith construction joints?

Answer: Details on the joint treatment are provided in Drawing Numbers 61N650-4 and 61N650-6. Criteria for these joints, including tolerances, is included in Section 03 30 00 of the Specifications.

100. Question: There are no Marine work rates in the bid documents. What labor rates should be used?

Answer: As listed in the "Highway" Davis Bacon Wage Decision included in Amendment 0003 the following rates should be used: Group 1 Operator for "tow or pushboat" operator and Group 2 Laborer for "deckhand scow man".

101. Question: There is a contrast in wording in the specs;" minimize overbreak to the extent possible" vs the very restrictive horizontal and vertical tolerances on overbreak- which is controlling?

Answer: The more restrictive Vertical and Horizontal tolerances will govern.

252.236-7001 CONTRACT DRAWINGS AND SPECIFICATIONS (AUG 2000)

(a) The Government will provide to the Contractor, without charge, one set of contract drawings and specifications, except publications incorporated into the technical provisions by reference, in electronic or paper media as chosen by the Contracting Officer.

(b) The Contractor shall--

(1) Check all drawings furnished immediately upon receipt;

(2) Compare all drawings and verify the figures before laying out the work;

(3) Promptly notify the Contracting Officer of any discrepancies;

(4) Be responsible for any errors that might have been avoided by complying with this paragraph (b); and

(5) Reproduce and print contract drawings and specifications as needed.

(c) In general--

(1) Large-scale drawings shall govern small-scale drawings; and

(2) The Contractor shall follow figures marked on drawings in preference to scale measurements.

(d) Omissions from the drawings or specifications or the misdescription of details of work that are manifestly necessary to carry out the intent of the drawings and specifications, or that are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work. ORDER OF PRECEDENCE

The prospective bidder’s bid is incorporated into the contract in full effect and in accordance with the established order of precedence.

(a) The contract includes the standard contract clauses, schedule and specifications current at the time of award. It also entails: (1) the solicitation in its entirety, including all drawings, cuts and illustrations, and any amendments during bid process, and (2) the successful Contractor’s accepted bid. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7).

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
