REFERENCE STANDARDS AND DEFINITIONS 02/09
PART 1 GENERAL
1.1 DESCRIPTION
Related Documents:
a. Drawings and general provisions of the Contract, including General and Supplementary Conditions and other Division 1 Specification Sections, apply to this Section.
b. Specific naming of codes or standards occurs on the drawings and in other sections of these specifications.
Work Included
a. Throughout the Contract Documents, reference is made to codes and standards which establish qualities and types of workmanship and materials, and which establish methods for testing and reporting on the pertinent characteristics.
b. Where materials or workmanship are required by these Contract Documents to meet or exceed the specifically named code or standard, it is the Contractor's responsibility to provide materials and workmanship which meet or exceed the specifically named code or standard.
c. It is also the Contractor's responsibility, when so required by the Contract Documents or by written request from the Contracting Officer, to deliver to the Contracting Officer all required proof that the materials or workmanship, or both, meet or exceed the requirements of the specifically named code or standard. Such proof shall be in the form requested in writing by the Contracting Officer, and generally will be required to be copies of a certified report of tests conducted by a testing agency approved for that purpose by the Contracting Officer.
1.2 QUALITY ASSURANCE
Familiarity With Pertinent Codes and Standards: In procuring all items used in this work, it is the Contractor's responsibility to verify the detailed requirements of the specifically named codes and standards and to verify that the items procured for use in this work meet or exceed the specified requirements.
Rejection of Non-Complying Items: The Contracting Officer reserves the right to reject items incorporated into the Work which fail to meet the specified minimum requirements. The Contracting Officer further reserves the right, and without prejudice to other recourse the Contracting Officer may take, to accept non-complying items subject to an adjustment in the Contract Amount as reviewed by the Contracting Officer and approved by the Government.
Definitions
a. Contracting Officer: The term "Contracting Officer" refers to
SECTION 01 09 50 Page 1 persons in the United States Property and Fiscal Office authorized to obligate the government for the expenditure of funds. The Contracting Officer(s) is the only person authorized to make changes to the contract. Any reference on the drawings or specifications to "Contracting Officer" shall mean "The Contracting Officer or his duly Authorized Representative".
b. General: Basic Contract definitions are included in the General Conditions.
c. Indicated: The term "indicated" refers to graphic representations, notes, or schedules on the Drawings, other paragraphs or schedules in the Specifications, and similar requirements in the Contract Documents. Where terms such as "shown, " "noted," "scheduled," and "specified" are used, it is to help the reader locate the reference; no limitation on location is intended.
d. Directed: Terms such as "directed," "requested," "authorized," "selected," "approved," "required," and "permitted" mean "directed by the Construction Manager," "requested by the Construction Manager," and similar phrases.
e. Reviewed: The term "reviewed," where used in conjunction with the Construction Manager's action on the Contractor's submittals, applications, and requests, is limited to the Construction Manager's duties and responsibilities as stated in General and Supplementary Conditions.
f. Regulation: The term "Regulations" includes laws, ordinances, statutes, and lawful orders issued by authorities having jurisdiction, as well as rules, conventions, and agreements within the construction industry that control performance of the Work.
g. Furnish: The term "furnish" is used to mean "supply and deliver to the Project site, ready for unloading, unpacking, assembly, installation, and similar operations."
h. Install: The term "install" is used to describe operations at project site including the actual "unloading, unpacking, assembly, erection, placing, anchoring, applying, working to dimension, finishing, curing, protecting, cleaning, and similar operations."
i. Provide: The term "provide" means "to furnish and install, complete and ready for the intended use."
j. Installer: An "Installer" is the Contractor or an entity engaged by the Contractor, either as an employee, subcontractor, or sub-subcontractor, for performance of a particular construction activity, including installation, erection, application, and similar operations. Installers are required to be experienced in the operations they are engaged to perform. The term "experienced" when used with the term "installer" means having a minimum of 5 previous Projects similar in size and scope to this Project, being familiar with the precautions required, and having complied with requirements of the authority having jurisdiction.
k. Trades: Use of titles such as "carpentry" is not intended to imply that certain construction activities must be performed by accredited or unionized individuals of a corresponding generic name, SECTION 01 09 50 Page 2 such as "carpenter." It also does not imply that requirements specified apply exclusively to trades persons of the corresponding generic name.
l. Assignment of Specialists: Certain Sections of the Specifications require that specific construction activities shall be performed by specialists who are recognized experts in the operations to be performed. The specialists must be engaged for those activities, and assignments are requirements over which the Contractor has no choice or option. Nevertheless, the ultimate responsibility for fulfilling Contract requirements remains with the Contractor. This requirement shall not be interpreted to conflict with enforcement of building codes and similar regulations governing the Work. It is also not intended to interfere with local trade union jurisdictional settlements and similar conventions.
m. Project Site: The space available to the Contractor for performance of construction activities, either exclusively or in conjunction with others performing other work as part of the Project.
The extent of the Project Site is shown on the Drawings and may or may not be identical with the description of the land upon which the Project is to be built.
n. Testing Laboratories: A "testing laboratory" is an independent entity engaged to perform specific inspections or tests, either at the Project Site or elsewhere, and to report on and, if required, to interpret results of those inspections or tests.
Industry Standards
a. Applicability of Standards: Except where the Contract Documents include more stringent requirements, applicable construction industry standards have the same force and effect as if bound or copied directly into the Contract Documents. Such standards are made a part of the Contract Documents by reference.
b. Publication Dates: Where the date of issue of a referenced standard is not specified, comply with the standard in effect as of date of Contract Documents.
c. Conflicting Requirements: Where compliance with two or more standards is specified, and the standards establish different or conflicting requirements for minimum quantities or quality levels, refer requirements that are different, but apparently equal, and uncertainties to the Contracting Officer for a decision before proceeding. Generally, the most stringent requirement will govern.
d. Minimum Quantity or Quality Levels: The quantity or quality level shown or specified shall be the minimum provided or performed. The actual installation may comply exactly with the minimum quantity or quality specified, or it may exceed the minimum within reasonable limits. In complying with these requirements indicated numeric values are minimum or maximum, as appropriate for the context of the requirements. Refer uncertainties to the Contracting Officer for a decision before proceeding.
e. Copies of Standards: Each entity engaged in construction on the Project is required to be familiar with industry standards applicable to that entity's construction activity. Copies of applicable standards
SECTION 01 09 50 Page 3 are not bound with the Contract Documents. Where copies of standards are needed for performance of a required construction activity, the Contractor shall obtain copies directly from the publication source.
f. Abbreviations and Names: Trade association names and titles of general standards are frequently abbreviated. The following acronyms or abbreviations as referenced in Contract Documents are defined to mean the associated names. Names and addresses are subject to change and are believed to be but are not assured to be accurate and up to date as of date of Contract Documents.
