NON-REGULATED SPECIAL CONTRACT REQUIREMENTS

PART 1 GENERAL

1.1 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER (ER 415-1-15)

1.1.1 General

This provision specifies the procedure for determination of time extensions for unusually severe weather in accordance with the Contract clause entitled "Default: (Fixed Price Construction)". In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

1.1.1.1 Unusually Severe Weather

The weather experienced at the project site during the Contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

1.1.1.2 Completion Delay

The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

1.2 HARBOR MAINTENANCE FEE (1 SEP 1995)(EAL 88-1)

Offerors contemplating use of U.S. ports in the performance of this Contract are subject to paying a harbor maintenance fee on cargo. Federal law establishes an ad valorem port use fee on commercial cargo imported into or exported from various U.S. ports. The fee is 0.125 percent (.00125). Cargo to be used in performing work under Contracts with the U.S. Government is not exempt from the fee, although certain exemptions do exist. Offerors are responsible for ensuring that the applicable fee and associated costs are taken into consideration in the preparation of their offers. Failure to pay the harbor maintenance fee may result in assessment of penalties by the U.S. Customs and Border Protection.

The statute is at Title 26 U.S. Code sections 4461 and 4462. Department of Treasury U.S. Customs and Border Protection regulations implementing the statute, including a list of ports subject to the fee, are found at 19 CFR Section 24.24, Harbor Maintenance Fee. Additional information may be obtained from local U.S. Customs and Border Protection offices or by writing to the Director, Budget Division, Office of Finance, Room 6328, U.S. Customs and Border Protection, 1301 Constitution Avenue, N.W., Washington, D.C. 20229.

1.3 QUANTITY SURVEYS

(a) Quantity surveys will be conducted, and the data derived from these surveys must be used in computing the quantities of work performed and the actual construction completed and in place.

SECTION 01 10 00.01 45 Page 3

(b) The Government will conduct the original (Before Dredging (BD)) and final surveys (After Dredging (AD)) and make the computations based on them. The Contractor must conduct the surveys for any periods for which progress payments are requested and make the computations based on these surveys. All surveys conducted by the Contractor must be conducted under the direction of the Contracting Officer, unless the Contracting Officer waives this requirement in a specific instance.

(c) For ODMDS monitoring the Contractor must conduct the original and final surveys, and monthly monitoring surveys for any period for which the ODMDS is being actively used for placement of dredged material.

All surveys must be conducted under the direction of a representative of the Contracting Officer, unless the Contracting Officer waives this requirement in a specific instance.

(d) Promptly upon completing a survey, the Contractor must furnish the originals of all field notes and all other records relating to the survey or to the layout of the work to the Contracting officer, who will use them as necessary to determine the amount of progress payments. The Contractor must retain copies of all such material furnished to the Contracting Officer.

SECTION 01 20 00.00 45 Page 5

1.4.1 Debris Removal

1.4.1.1 Payment

1) Payment for the following debris removal items will be made at the Contract unit price for costs associated with materials, labor, and equipment for removal and disposal of debris from the dredging template, as specified in SECTION 35 20 23.12 45 HOPPER DREDGING and

35 20 23.17 45 PIPELINE AND MECHANICAL DREDGING:

a. "Debris Removal-Section No. 1" in Schedule No. 1

b. "Debris Removal-Section No. 6" in Option No. 4

(2) Debris removal during construction will include all of the debris encountered within the dredging template during the course of work that cannot be removed through ordinary dredging. Debris removed from channel sections not listed in paragraph 1.4.1.1 will be considered incidental and will not be included in this pay item.

Removal of incidental debris will be considered subsidiary to dredging.

(3) Appendix B "Geophysical Surveys" contains information on channel debris that may have been removed during previous work. This information is being provided for informational purposes only to give an indication of the amount of debris that may exist at this site.

For additional information refer to Section 02 00 10 EXISTING

CONDITIONS SURVEY INVESTIGATIONS.

(4) The Contract Price for Debris Removal will include relocating the debris to a disposal facility in accordance with applicable laws and ordinances. Contractor will be responsible for any disposal fees charged by the disposal facility.

1.4.1.2 Measurement

Measurement for Debris Removal will be per short ton of 2000 pounds based on the Contractor's submittal of either Certified Barge Displacement Tickets or Certified Weight Tickets for Debris actually removed. Sediment will not be included in the debris weight. Unless prior approval is obtained from COR, weights of less than 5 tons will not be measured through barge displacement; only Certified Weight Tickets will be accepted. Contractor is required to provide photographs of the debris as measured.

1.4.1.2.1 Debris Transported by Rail or Truck

Measure the debris in tons (2,000 pounds). Certified railroad or truck weight scale tickets will be accepted for determination of the weight of debris removed. Have the debris weighed on standard railroad track scales by a certified Weighmaster. A copy of the Weight Scale Certification from the regulation agency attesting to the scale's accuracy must be submitted with the weigh scale tickets. The Contractor must have the scales tested in the presence of a Government Inspector at any time the Contracting Officer may require.

The report of weight for each carload or truckload must show the gross, tare, and net weights, and measures or changes on a report must be explained by a memorandum made on, or attached to, the report and be signed by the Weighmaster. If deemed advisable, the Government will employ an Inspector at the scales, in which event, necessary facilities

SECTION 01 20 00.00 45 Page 6 must be furnished for the Inspector for observing the weighing and for recording the scale weights and stenciled light weight on the cars or trucks. Expense of weighing debris and testing scales will be borne by the Contractor. Other methods of measurement may be used when approved by Contracting Officer.

1.4.1.2.1.1 Debris Transported by Barge

1.4.1.2.1.1.1 Gauges

The barge carrier for debris transport must be fitted by the Contractor at their own expense with gauges or other facilities for accurately determining displacement. Six gauges graduated to 0.1 ft or other suitable units must be placed near the ends and midpoints of both sides.

1.4.1.2.1.1.2 Gauging Tables

A Gauging table must be prepared for each carrier by an accredited agent satisfactory to the Conracting Officer. The table must show the cargo weight in tons for each linear unit of draft. If the lines of the carrier are such that displacement in cubic feet for each unit of draft can be accurately measured, then the gauge table will be based on the water density where the measurement occurs; 62.4 lb/cu ft in fresh water and 64 lb/cu ft in salt water. These gauging tables will serve as the "Barge Displacement Tables" that will be used to measure pay tonnage.

1.4.1.2.1.1.3 Reading Gauges

The Contracting Officer must have the opportunity to be present at all draft readings. All measurements for determining gauging tables and for calculating loads must be made in still water close to the work. The Contractor must place the carrier where such measurement can be accurately made. If deemed advisable, the Government will employ an Inspector to be present when these draft readings are taken, in which event, necessary facilities must be furnished for the Inspector for observing the draft readings. The expense of performing draft reading will be borne by the Contractor.

1.4.2.2 Dredging Partial Payment

Partial payment will be based on estimated quantities determined by Contractor Surveys. The Contractor may use its own hydrographic surveys to determine quantities for pay requests, but final quantities will be based on Government Before-Dredging and After-Dredging surveys.

1.4.2.3 Measurement

The material removed will be measured by cubic yard in place, by means of soundings taken before and after dredging. The total quantity of dredged material will be the theoretical quantity between the bottom surface shown by fathometer soundings of the last survey made "before-dredging" and the bottom surface shown by the fathometer soundings of a survey made "after-dredging," within the limits of the required depth, overdepth, and side and end slopes, as defined by template and depicted in the cross-sectional views and within, less deductions that may be required for misplaced material.

1.4.2.4 Reference Control Data

The horizontal control points shown on the drawings are the control points the Government will reference to perform electronic surveys on the waterway. The Government does not guarantee permanent access to these control points; therefore, it may be necessary for the Contractor to establish its own network of survey points from these survey points or from other U.S. National Geodetic Survey (NGS) monuments. Location and description of the horizontal control points which the Government plans to reference to perform electronic surveys on the channels are available from the Contracting Officer.

Horizontal data will be tied to the State Plane Texas South Central Coordinate System using North American Datum of 1983 U.S. survey feet (NAD83 U.S. ft). Vertical positions will be derived from NAVD 88 and rectified to MLLW with a Government supplied KTD file for the project area. Tide staffs shown will be used to verify vertical control.

SECTION 01 20 00.00 45 Page 8

Vertical positions will be referenced to MLLW in US Survey Feet.

Horizonal and vertical positioning may be obtained from one of the following methods: Real Time Extended or RTX (Trimble satellite transmitted corrections). The Government will be using the real-time RTX methodology.

Time Variable Transformations must be set correctly in HYPACK when using RTX. The target year settings will be provided by the Government after award upon request.

1.4.2.5 Surveys During Progress of Work

Contract depth will be determined by progress surveys taken behind the dredge as work progresses. The Contractor must take progress surveys and submit the volumes and cross sections of the surveys.

At the request of the Government, the Contractor may be required to submit additional backup documentation for their progress surveys.

1.4.2.6 BD and AD Surveys

Guidance as provided in Hydrographic Survey Engineering Manual EM-1110-2-1003 Chapter 10 will apply for scheduling of BD and AD surveys.

Pre-dredge/Before-Dredging surveys are performed by the Government over the Contract area as close to the start of dredging as possible -generally within 14 days prior to commencement of work in a defined reach to be dredged.

After-Dredging (AD) surveys are performed by the Government as soon as possible after dredging of an acceptance section is completed - generally within five days.

1.4.2.7 Survey Requests

The Government will perform post dredging surveys for each acceptance section. The Contractor must request acceptance surveys at least three work days in advance of the date for each survey (Saturdays, Sundays, and Federal Holidays are excluded). Survey requests should be sent to the COR and CESWG-ECC-N-HydrographicSurveyRequests@USACE.army.mil. The Contractor must call the Survey POC between 0630 and 0730 on the morning of the survey to confirm. POC phone number will be provided by the Government after award.

1.4.2.8 Government Performed Survey

The Government will perform electronic surveys of the channel. Multibeam (200kHz) surveys will be used for acceptance and to determine pay quantities.

If the Government determines that accurate data cannot be obtained from multibeam sonar technology due to the presence of unconsolidated material in the channel, the Government may choose to utilize dual frequency single beam sonar technology. Single beam surveys will be performed within five days of the original survey and these low-frequency (28kHz) surveys will be used for both acceptance and payment purposes.

All sounding equipment will be calibrated following procedures outlined in

EM-1110-2-1003 (2013).

SECTION 01 20 00.00 45 Page 9

The Contractor will not be required to furnish facilities for the Government's surveys specified in Section 35 20 23.12 45 HOPPER DREDGING, Paragraph 1.18, final examination and acceptance. The Government will apply the vertical and horizontal survey control indicated on the drawings.

Processing the survey data will be performed with the most recent version of HYPACK software available at the time of award, using the relevant method below for each type of survey.

The performance of this Survey work by the Government and presence of the inspector will not relieve the Contractor of responsibility for the proper execution of the work in accordance with the Contract Drawings and Specifications.

1.4.2.9 Multibeam Survey

a) Type of System: R2Sonic 2024 Multibeam Echosounder

b) Acoustic Frequency: 200 - 400 kHz

c) Volume Computation: Survey Surface TIN vs. Channel (Standard TIN to Channel)

1. Data will be post-processed using POSpac to perform quality checks when necessary

2. Survey lines will be run longitudinal along the channel and will provide full coverage from edge to edge of the template with a minimum of 20% overlap of swaths.

When accepting and paying based on multibeam survey, acceptance will be based on minimum depth and payment will be based on average depth. The cell size used will be 3 feet by 3 feet. Shoals above grade must be assessed based on multiple hits, a minimum of three hits, over successive passes. A single high spot unsupported by other data will be disregarded. This data will follow guidance described in Table F-2 of EM 1110-2-1003.

1.4.2.10 Single Beam Survey

a) Type of System: Applanix POS MV V5, Odom Echotrac CV200 Echosounder, or E20

PART 3 EXECUTION

3.1 GENERAL REQUIREMENTS

Prepare for approval a Project Schedule , as specified herein, pursuant to FAR Clause 52.236-15 SCHEDULE FOR CONSTRUCTION CONTRACTS. Show in the schedule the proposed sequence to perform the work and dates contemplated for starting and completing all schedule activities. The scheduling of the entire project , including the construction sequences, the critical path(s) and any offsite activities clearly identified is required. The scheduling of construction is the responsibility of the Contractor.

Contractor management personnel must actively participate in its development. Subcontractors, and suppliers working on the project must

SECTION 01 32 01.00 45 Page 4 also contribute in developing and maintaining an accurate Project Schedule. Provide a schedule that is a forward planning as well as a project monitoring tool. Use the Critical Path Method (CPM) of network calculation to generate all Project Schedules. Prepare each Project Schedule using the Precedence Diagram Method (PDM).

3.1.1 Scheduling Expectations Kickoff Meeting(SEKO)

In conjunction with the post award conference or pre construction conference the Government and the Contractor will hold a separate and distinct Scheduling Expectations Kickoff Meeting(SEKO). The intent of this meeting is for the Government to review with the Contractor the requirements of the scheduling specification, communicate the Government’s expectations regarding schedule development and management, and answer any questions the Contractor may have regarding the schedule requirements.

3.1.2 Approved Project Schedule

Approved Project Schedule will be used to measure the progress of the work and to aid in evaluating time extensions. The Schedule must depict activity durations, be based on the percentage of physical completion, and provide the basis for progress payments. Use ENG Form 2454 or equivalent produced by a scheduling program to depict the Progress Schedule and ensure that the Schedule conforms with the requirements outlined in the FAR Clause 52.236-15 Schedules for Construction Contracts. Schedule will show anticipated earnings per Contract Line Item Number (CLIN) for each pay period, and total earnings per pay period. If the Contractor fails to submit a schedule within the time prescribed, the Contracting Officer may withhold approval of progress payments until the Contractor submits the required Schedule. Once approved, the Contractor may not change the schedule for any reason without permission from the Contracting Officer or the ACO.

3.1.3 Updated Progress Schedule

Provide an updated Progress Schedule on at least a monthly basis and submit this updated Schedule along with the monthly pay request. The Government may request the Contractor to provide the Government with an updated Schedule as a result of a change in order of work, activity sequences, or activity duration prior to the monthly pay request. If, in the opinion of the Contracting Officer, the Contractor falls behind the approved Schedule, the Contractor must take steps necessary to improve its progress including those that may be required by the Contracting Officer, without additional cost to the Government and submit an updated Progress Schedule to the Government. In this circumstance, the Contracting Officer may require the Contractor to increase the number of shifts, overtime operations, days of work, or the amount of construction plant, and to submit for approval supplementary Schedule or Schedules as the Contracting Officer deems necessary to demonstrate how the approved rate of progress will be regained.

3.1.4 Default Terms

Failure of the Contractor to comply with the requirements of the Contract will be grounds for a determination, by the Contracting Officer, that the Contractor is not prosecuting the work with sufficient diligence to ensure completion within the time specified in this Contract. Upon making this determination, the Contracting Officer may terminate the Contractor's right to proceed with the work, or separable parts of it, in accordance

SECTION 01 32 01.00 45 Page 5 with the default terms of the Contract.

3.2 BASIS FOR PAYMENT AND COST LOADING

The schedule is the basis for determining Contract earnings during each update period and therefore the amount of each progress payment. The aggregate value of all activities coded to a Contract CLIN must equal the value of the CLIN. Lack of an approved Schedule update, or qualified scheduling personnel, will result in the inability of the Contracting Officer to evaluate Contract earned value for the purposes of payment.

Failure of the Contractor to provide required information will result in the disapproval of the preliminary, initial, and subsequent Schedule updates. Match the progress payment "Pay Period Thru" date in RMS to the schedule data date.

3.2.1 Activity Cost Loading

Activity cost loading must be reasonable and without front-end loading.

Activities with a negative cost loading is not allowed. Provide additional documentation to demonstrate reasonableness if requested by the Contracting Officer.

3.2.2 Withholdings / Payment Rejection

Failure to meet the requirements of this specification may result in the disapproval of the preliminary, initial, or periodic schedule updates and subsequent rejection of payment requests until compliance is met.

In the event that the Contracting Officer directs schedule revisions and those revisions have not been included in subsequent Project Schedule revisions or updates, the Contracting Officer may withhold 10 percent of pay request amount from each payment period until such revisions to the project schedule have been made.

3.3 PROJECT SCHEDULE DETAILED REQUIREMENTS

3.3.1 Level of Detail Required

Develop the Project Schedule to the appropriate level of detail to address major milestones and to allow for satisfactory project planning and execution. Failure to develop the Project Schedule to an appropriate level of detail will result in its disapproval. The Contracting Officer will consider, but is not limited to, the following characteristics and requirements to determine appropriate level of detail:

3.3.2 Activity Durations

Reasonable activity durations are those that allow the progress of ongoing activities to be accurately determined between update periods. Less than 2 percent of all non-procurement activities may have Original Durations (OD) greater than 20 work days or 30 Calendar days.

3.3.3 Procurement Activities

Include in the schedule activities associated with the critical submittals and their approvals, procurement, fabrication, and delivery of long lead materials, equipment, fabricated assemblies, and supplies. Long lead procurement activities are those with an anticipated procurement sequence of over 90 Calendar days.

SECTION 01 32 01.00 45 Page 6
