1.0 PROPOSAL OVERVIEW

This Request for Proposal (RFP) is issued utilizing a "Best Value" Trade-Off, Two-Phase Design Build competitive source selection process to support the execution of the Southwestern Division's (SWD's) horizontal construction, including horizontal construction missions associated with the American Recovery and Reinvestment Act of 2009 (ARRA) signed into law on February 17, 2009.

This acquisition will result in award of two (2) or more Firm Fixed Priced (FFP), Indefinite Quantity Indefinite Delivery (IDIQ) Multiple Award Task Order Contracts (MATOCs). The MATOC pool of contracts are for Design/Build, Design/Bid/Build construction services to meet the requirements and time constraints for Civil Works, Military, and International and Interagency Support (IIS) customers of the Southwestern Division (SWD) which includes the following: Fort Worth District, Little Rock District, Tulsa District and Galveston District. The boundaries for Southwestern Division are identified at http://www.usace.army.mil/about/Pages/Locations.aspx.

This MATOC pool of contracts is for Service-Disabled Veteran-Owned Small Business (SDVOSB) competition. The estimated shared amount between the SDVOSB MATOC pool of contracts is $80,000,000. Each contract shall contain a twelve month base period plus four twelve-month option periods. A guaranteed minimum of $3000, will be on the base year only. The Government intends to award 2 or more IDIQ MATO contracts to establish a pool of contractors. Once a pool of contracts is established, the contractors will compete for each task order in accordance with the ordering procedures set forth in SECTION 00 73 00, Ordering Procedures.

The scope of these SWD MATOCs includes construction under North American Industry Classification System (NAICS) code 237990, Other Heavy and Civil Engineering Construction. It is expected that additional work (excluding individual dredging projects), including but not limited to the following types of projects: abutment construction, asphalt and concrete paving, bridge construction, culverts, curbs, and street gutters, elevated highway construction, overpass construction, road and street surfacing, trestle construction, construction of water and sewer lines, mains, pumping stations, treatment plants and storage tanks, anchored earth retention, breakwater, spillway, floodwater, bulkhead wall or embankment, channel, canal, dams, cofferdam, dikes and other flood control structures, drainage projects, and other earth work related projects, repair, maintain, and build marine related structures, levees, flood control and jetties, as well as anti-terrorism and force protection, outdoor recreation facilities, park and recreational open space improvement and other construction activities as appropriate under NAICS code 237 will be executed under the resultant MATOC contracts. Any workload requirements associated with NAICS 237120, Oil and Gas Pipeline and Related Structures Construction, will be minimal, if not rare. Any workload associated with NAICS 237120 will first be considered for performance under one of the authorized small business set-asides, prior to consideration for award under the Unrestricted MATOC.

Any work executed under the SWD SDVOSB MATOC is limited to the geographic boundaries of the Southwestern Division, U.S. Army Corps of Engineers.

The contractor shall perform in accordance with the Scope of Work provided with each Task Order and within strict accordance of the terms and conditions specified in the resulting MATOC.

1.1 PROPOSAL SUBMISSIONS AND THE TRADE-OFF PROCESS

This is a "Best Value", Two-Phase competitive selection process for the design and construction of Horizontal Construction Services for Civil, Military, and International and Interagency Support (IIS) Projects.

The first phase consists of a process known in the commercial design-build industry as the Request for Qualifications or acronym: RFQ. (This solicitation refers to it as Phase1.) In Phase 1, interested firms or joint venture entities (referred to as Offeror's) shall submit performance capability proposals in accordance with this Section 00 22 10, demonstrating their capability to successfully execute the design-build construction IDIQ MATO contract resulting from this solicitation. The Government will evaluate the performance capability proposal in accordance Section 00 22 20 of this solicitation and will select between 2 to 10 Contractors from Phase 1, for consideration in Phase 2, in anticipation of awarding 2 or more MATOC contracts in Phase 2.

In Phase 2, the selected Offeror's will submit the remainder of the technical/ performance capability proposals and a price proposal for a seed project. The Government will evaluate the Phase 2 proposals in accordance with the criteria described for Phase 2 in the solicitation and award 2 or more MATO contracts to the responsible Offerors whose proposals conform with all terms and conditions of the solicitation and whose proposals are determined to represent the overall best value to the Government considering technical design quality, performance capability and/or cost.

Phase 2 of this process permits tradeoffs among cost or price and non-cost factors and allows the Government to accept other than the lowest priced proposal. In Phase 2, the short-listed offerors will submit the remaining technical proposal portions as required by Section 00 22 10A, to be provided by amendment for the seed project and price. The government will review, evaluate the Phase 2 proposals as set forth in Section 00 22 20A. The seed/initial task price/cost proposal will not be rated, but will be a factor in making the final best value determination for award of the MATOCs. The seed/initial task will be awarded to only one (1) of the offerors selected for MATOC awards. The other MATOC contractors selected for award of a MATOC contract during Phase 2 will be awarded the minimum guaranteed amount of $3000.00 applicable to the Base Year only. The minimum guaranteed amount $3000.00 will be paid at the end of Base Year 1 to any selected MATOC contractor who is not awarded a task order in Base Year 1.

PROPOSAL EVALUATION AND CONTRACT AWARD

BEST VALUE TRADE OFF

1.0 ELIGIBILITY FOR CONTRACT AWARD

In accordance with the Federal Acquisition Regulations (FAR), no contract shall be entered into unless the contracting officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the contracting officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must meet the general standards in FAR Part 9 and any special standards set forth in the solicitation.

2.0 SOURCE SELECTION USING THE BEST-VALUE PROCESS

The Government will select the offerors that represent the best value to the Government by using the trade-off process described in FAR Part 15. This process permits tradeoffs between cost/price and technical (“non-cost”) factors and allows the Government to accept other than the lowest priced offer. The award decision will be based on a comparative assessment of proposals against all source selection criteria in the solicitation.

3. 0 PHASE 1 RELATIVE IMPORTANCE OF PRICE TO THE TECHNICAL

EVALUATION FACTORS

For Phase 1 and Phase 2 combined, all evaluation factors other than cost or price, when combined, are more significantly more important than price. The Government is concerned with achieving the most advantageous balance between technical merit (“quality”) and price to the Government (i.e., the price). The degree of importance of price could become greater depending upon the equality of the technical proposals. If competing technical proposals are determined to be essentially equal, price could become the controlling factor.
