An offeror that obtains an “Acceptable” rating on all non-price factors (Factor 1, Experience and Factor 2, Past Performance) will be technically acceptable. Award will be made to the lowest priced responsible offeror that is technically acceptable.
2.2.1 Offerors are advised the Government intends to make an award on the basis of initial proposals without conducting discussions with the offerors. However, the Government reserves the right to discuss aspects of proposals with Offerors in the competitive range, if one is determined to be necessary, upon completion of the evaluation. Offerors are advised that the Government may make award without discussions, clarifications, or any contact concerning the proposals received. Therefore, proposals should be submitted initially on the most favorable terms from a price and technical standpoint. Offerors shall not assume that they will be contacted or afforded an opportunity to clarify, discuss or revise their proposals.
2.3 Proposals received by the Government after the date and time set for receipt of proposals will be handled in accordance with the requirements of Provision “52.215-1, Instructions to Offerors – Competitive Acquisition”. Note: When hand-carrying proposal, offerors are advised they must process through the base security and should be aware of possible delays.
2.4 Offerors are required to provide information addressing all stated factors in a clear and understandable format. If an offeror does not have information relating to a specific factor, the offeror shall clearly state so in the proposal. Proposals that do not clearly address all factors may be considered unacceptable and may not receive further consideration.
3.0 PROPOSAL REQUIREMENTS AND SUBMISSION FORMAT
3.1 General Requirements: The proposal shall be clear, concise and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal shall not simply rephrase or restate the Government’s requirements, but rather provide convincing rationale to address how the Offeror intends to meet the requirements. Offerors shall assume that the Government has no prior knowledge of their facilities or experience and will base its evaluation on the information presented in the offeror’s proposal.
3.2 General Format
3.2.1 Proposals shall be submitted in two (2) separate envelopes as indicated below:
3.2.1.1 Volume I shall contain the Technical Proposal and shall be clearly marked Volume I – Technical Proposal. In addition, follow instructions in Paragraph (c)(1) of Section 00 21 00, 52.215-1, INSTRUCTIONS TO OFFERORS--COMPETITIVE ACQUISITION.
3.2.1.2 Volume II shall contain the Price Proposal and shall be clearly marked Volume II – Price Proposal. In addition, follow instructions in Paragraph (c)(1) of Section 00 21 00, 52.215-1, INSTRUCTIONS TO OFFERORS--COMPETITIVE ACQUISITION.
3.2.3 Each volume shall be separate and complete in itself so that evaluation of one may be accomplished independently from evaluation of the other. It is recommended that the pages be standard 8-1/2” x 11” or A4 white bond paper using 12 characters per linear inch or equivalent as the minimum size standard for text. Volume I, Technical, shall not contain any reference to cost for this project. The total pages submitted for Volume I, Technical Proposal shall not exceed 45 pages. Any pages over the prescribed limit will not be considered for evaluation.
Each volume shall include page numbers on each page
3.2.4 The Government recognizes that offerors go to considerable expense to prepare proposals for this solicitation, so the Government prefers that proposals be practical. Elaborate format, special binders, special reproduction techniques, and the like are not necessary or desired. In short, the proposal shall completely and adequately address the requirements stated in solicitation. Proposal legibility, clarity, coherence, and contents are important. The technical proposal, Volume I of the Offeror’s proposal shall be bound and shall not exceed 45 single-spaced single sided sheets. Do not include the front and back cover of the technical proposal in the 45 sheet count. However, all other sheets, including Past Performance Questionnaire, will be included in the count. Since only the first 45 sheets of the offeror’s technical proposal will be evaluated by the Government, it is highly recommended that the offeror number each page of the proposal. Proposal legibility, clarity, coherence, and contents are important.
3.2.5 Revised Proposal. Revised proposals will not be accepted unless specifically requested by the Contracting Officer. If the Contracting Officer decides to conduct discussions and requests revised proposals from the offerors; offerors shall ensure that all replacement pages are clearly marked “REVISED”, shall show the date of revision, shall be submitted in the appropriate number of copies (e.g., if two copies of the original page was required, then two copies of the revised page will also be required). All proposal revisions shall be submitted as page replacements with revised text readily identifiable, e.g. bold face print or underlining.

b. Evaluation Criteria: The Government will evaluate the offeror’s experience on recent and relevant projects.
1. This Factor evaluates the offeror’s experience. The Government will evaluate the experience an offeror displays on relevant projects. Projects not meeting all the relevancy criteria listed below will be considered not relevant for this factor evaluation. For purposes of evaluation of this Factor, a relevant project is a project that meets the following criteria:
i. Project was one of the following:
A. New construction, repair, or renovation of a Hydrant Fueling
System with a contract award value which equaled or exceeded ¥1,000,000;
B. New construction, repair, or renovation of a Fuel Offloading and Loading Facility with a contract award value which equaled or exceeded ¥1,000,000;
C. New construction of a pier with a contract award value which equaled or exceeded ¥500,000,000; OR
D. New construction of a wharf with a contract award value which equaled or exceeded ¥500,000,000;
ii. Project must be either currently well underway (at least 50% construction progress completed) or was completed and turned over no longer than ten (10) years preceding the issuance date of this solicitation; AND
iii. Project was performed by the Offeror as the prime contractor (see below notes).
Note (1):
The Government will also consider prime contractor experience of the offeror's parent/subsidiary/affiliate firm as experience attributable to the offeror for evaluation purposes if the offeror can establish that the parent/subsidiary/affiliate firm will have a significant involvement in performance of this contract and describe the resources of the parent/subsidiary/affiliate firm that will be utilized on project that is the subject of this procurement.
If submitting a parent/subsidiary/affiliate firm’s project for experience, it is the offeror's responsibility to effectively demonstrate and describe how the parent/subsidiary/affiliate firm's resources (such as workforce, management, facilities, or other resources) will significantly contribute to the execution of the project which is the subject of this procurement; failure to effectively demonstrate and describe the planned contribution of the parent/subsidiary/affiliate firm’s involvement in the subject project of this procurement will cause the past experience of the parent/subsidiary/affiliate firms to be considered not relevant for evaluation purposes in this procurement. Further, any project in which the parent/subsidiary/affiliate firm performed the role of a subcontractor will not be considered relevant when evaluating the experience of the offeror.
Note (2):
A Single Award Task Order Contract (SATOC) or Multiple Award Task Order Contract (MATOC) alone is not considered a relevant construction project, but an individual task order project against its SATOC or MATOC may be submitted if it meets the requirements for a relevant construction project set forth above.
Note (3):
(a) If a Joint Venture (JV) is identified in Block 14 of the SF 1442, then a signed joint venture agreement must be submitted with the proposal.
(b) If offeror identified in Block 14 is a JV, a project currently well underway (at least 50% construction progress completed) or completed by a JV may be submitted for purposes of demonstrating prime contractor experience, so long as at least one member of the offeror JV was a member of the JV on the project. Offeror must demonstrate evidence that at least one member of the offeror JV was a member of the JV on the project, such as a signed joint venture agreement or similar documentation.
(i) Example: Offeror for this solicitation is Joint Venture A-B. JV A-B is comprised of Company A and Company B. Past projects completed by JV A-C, comprised of Company A and Company C may be used to demonstrate prime contractor experience for this solicitation, as Company A, a member of the offeror JV, was a member of JV A-C.
(c) Projects currently well underway (at least 50% construction progress completed) or completed by a joint venture where the offeror was a member of the JV may be submitted for the purpose of demonstrating prime contractor experience. Offeror must demonstrate evidence of JV membership on the project, such as a signed joint venture agreement or similar documentation.
(i) Example: Offeror for this solicitation is Company A. Past projects currently well underway or completed by JV A-C, comprised of Company A and Company C may be used to demonstrate prime contractor experience for this solicitation, as Company A, the offeror, was a member of JV A-C.
(d) Projects currently well underway (at least 50% construction progress completed) or completed by a member of a joint venture for this solicitation (as demonstrated by a signed joint venture agreement for this effort) may be submitted for the purpose of demonstrating prime contractor experience.
(i) Example: Offeror for this solicitation is JV A-B. Past projects currently well underway or completed by Company A may be used to demonstrate prime contractor experience for this solicitation, as Company A is a member of the offeror JV A-B.
2. The minimum requirement for this evaluation factor has been met when the offeror demonstrates minimally acceptable construction experience through at least one (1) but not more than three (3) relevant construction projects. To be considered acceptable, relevant project(s) must demonstrate the proposal meets all of the below acceptability criteria:
i. Demonstrates experience in at least one (1) project for the new construction, repair, or renovation of either a Hydrant Fueling System or Fuel Offloading and Loading Facility; AND
ii. Demonstrates experience in at least one (1) project for the new construction of either a pier or a wharf.
3. Construction Experience will be rated on an “Acceptable” or “Unacceptable” basis using the ratings and descriptions shown below:
Acceptable – Proposal clearly meets the minimum requirements and indicates an adequate approach and understanding of the requirement.
Unacceptable – Proposal does not meet the requirements and contains one or more deficiencies and is unawardable.
FACTOR 2 – PAST PERFORMANCE
a. Submission Requirements: Each offeror’s past performance will be reviewed to determine relevancy and confidence assessment.
1. The Government will evaluate the relative merits of each Offeror’s past performance on the same relevant projects submitted and evaluated under Factor 1 – Experience. Please keep in mind that “Past Experience” measures “what you have done” while “Past Performance” measures “how well you have done it.” A completed Past Performance Questionnaire should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ (Attachment B), which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contacts listed below via email prior to proposal closing date and time.

2. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.
3. In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS) and any other known sources not provided by the offeror.
4. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
b. Evaluation Criteria: The past performance evaluation is an assessment of the offeror’s probability of meeting the solicitation requirements. The past performance evaluation determines how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. The evaluation also assesses the degree of confidence the Government has in an offeror’s ability to supply products and services that meet the user’s needs, based on a demonstrated record of performance. See FAR 15.305.
1. Past performance shall be evaluated for each offeror. Evaluation of past performance will be based upon consideration of all facts and circumstances. As a minimum, the offeror shall demonstrate overall satisfactory performance (to include a showing of adequate corrective action on adverse past performance information) on contracts that are of size and complexity similar to the requirements in the subject RFP. The Government will evaluate the breadth and depth of an offeror’s past performance on relevant projects. The Government will evaluate each offeror’s past performance to determine how well it conforms to specifications and standards of good workmanship, adheres to contract schedules including administrative aspects of the performance, exhibits reasonable and cooperative behavior and a commitment to customer satisfaction and has a businesslike concern for the interests of the customer. The Government may contact some of the offeror’s customers to determine whether the offeror conforms to the terms and conditions of its contract; obeys the law; is reasonable and cooperative; maintains good labor relations; manages its subcontractors effectively; and is committed to customer satisfaction.
