About this file

This file is a Questions and Answers document addressing contractor inquiries regarding the UMSB HEC Asphalt Replacement solicitation (W912HQ26QA032). The document clarifies key bonding, staffing, and subcontracting requirements for this $500K to $1M construction project with the U.S. Army Corps of Engineers.

Regarding bonding and performance requirements, the Government confirmed that no bid guarantee or bid bond is required; however, both Performance Bond and Payment Bond are mandatory at 100% of the contract price, effective from project commencement through one year after project completion. Bonds must be submitted no later than 10 days after contract award but before work commences. For staffing and subcontracting, the prime contractor is required to perform at least 25% of the work and must maintain a superintendent on-site who is satisfactory to the Contracting Officer, regardless of subcontractor involvement. While a subcontractor's representative may attend the mandatory site visit, a prime contractor representative is also required. Additionally, any firm performing 25% or more of the required work—including the prime contractor and any major subcontractors—must submit a Past Performance Questionnaire (PPQ) with at least two references for same or similar work completed within the last two years.

Text version

PROJECT SIZE: $500K to $1M (per FAR Part 36)

Q: Please confirm whether a bid guarantee/bid bond is required for this project.

A: No, bid guarantee/bid bond is not required.

Q: Please confirm whether both a Performance Bond and Payment Bond are required.

A: Yes, performance and payment bonds are required.

Q: If Performance Bond and Payment Bond are required, please confirm the required amount for each bond and the period for which the bonds must remain in effect, including any required period following project completion and acceptance.

A: Required amount is 100% of contract price. The bonds must be in effect from project commencement to a year after project competition. The bond is required no later than 10 days after contract award, but before project commences.

Q: The solicitation states that a representative from the firm must attend the site visit. As we intend to perform the work through a subcontractor, please confirm whether attendance by the subcontractor’s representative would satisfy this requirement, or whether a representative of the prime contractor must also attend.

A: The prime contractor required is to have a representative at the site visit. The prime contractor must perform at least 25% of the work.

Q: FAR 52.236-6 requires the Contractor to directly superintend the work or assign a competent superintendent who is satisfactory to the Contracting Officer and has authority to act for the Contractor. If the prime contractor uses a subcontractor to perform the work, please confirm whether the subcontractor’s superintendent may satisfy this requirement, or whether the prime contractor must provide its own superintendent.

A: The prime must have a superintendent on site.

Q: The solicitation requires the Offeror to provide at least two references for same or similar work performed within the last two years. Please confirm whether the Government will consider the relevant past performance of a proposed major subcontractor under the Past Performance evaluation factor, particularly when that subcontractor will be performing a significant portion of the asphalt paving, roadway reconstruction, concrete, and related sitework.

A: Any firm performing at least 25% or more of the needed work must provide a PPQ. The prime is required to perform at least 25% of the work, so a PPQ for the prime is required. Any subcontractor performing 25% or more of the needed work will be required to submit a PPQ.
