9897809 Construction Management 1a 1b 3.3 Work
Schedule Comment Classification: Controlled Unclassified Information (CUI)
Paragraphs 3.3 and 3.6 state there can be no gaps in coverage for the staff augmentation positions for any reason. Since this is not a deliverables contract and task orders are going to enumerate the number of personnel required, will the USACE issue a task order that includes developing and retaining a pool of back up candidates to fill-in temporary vacancies due to personal leave, illness etc.?
On: Aug 26 2022.
Government Response. . No, a separate Task Order will not be issued to accommodate gaps in coverage. As this is a performance-based contract, it is up to the Offer to meet contract requirements. It is not expected that every project will require daily inspections. In fact, one QA personnel may be assigned to numerous projects depending on the location and frequency of QA required as long as contract requirements are fulfilled. In the cases of leave or vacancies, it is expected that the Offeror re-allocate existing personnel accordingly as to not impact services. Additional personnel or a float pool will not be funded for this purpose. On: Aug 30 2022 Current Request Status: Request Closed

Also, the requirements of paragraphs 3.3 and 3.6 does the USACE expect the contractor to bear the cost of developing and maintaining a vetted pool of back-up candidates sufficient to cover all the anticipated 25 personal services positions?
On: Aug 26 2022.
Government Response. . It is up to the contractor to have on-hand a sufficient number of vetted candidates to backfill positions in the event of unexpected vacancies. The intent of this is to minimize impact to required services which in turn affects contractor's performance rating. The Contractor's approach to this can be addressed in the Recruitment, Promotion and Retention Plan. In response to inquiry ID #9897809, this is different than re-allocating existing personnel to cover leave; however, this can be utilized as a short-term solution until a vacancy is filled.
Vacancies will also be captured on the weekly manning document. On: Aug 30 2022 Current Request Status: Request Closed

(OT) Hours Comment Classification: Controlled Unclassified Information (CUI)
Since the task orders will be FFP, how will contractual modifications be made in a timely manner to permit unscheduled OT?
On: Aug 26 2022.
Government Response. . After further consideration, the USG concurs that a separate NTE CLIN would be best to address this. This will be included in a forthcoming amendment and added to Attachments 1 & 2. On: Aug 30 2022 Current Request Status: Request Closed
Information for this report is procurement sensitive.

If OT requirements are being filled by candidates from a back-up pool and not by the routine asset supporting the project, does the 1.50 rate still apply?
On: Aug 26 2022.
Government Response. . No overtime shall be worked unless approved by the Government in advance.

IAW PWS 3.4.2, if a contract employee is required to work more than 48 hours in any calendar week, Saturday through Thursday, OT compensation shall be provided at a rate 1.50 times the normal rate. This refers to one employee who works more than 48 hours in any calendar week. It is not the intent to re-allocate assets to avoid overtime; however, if the Offeror is able to do so without impacting contract requirements, this would be acceptable. In this case, the OT rate does not apply, assuming the additional task(s) accomplished by other personnel would also not result in overtime.
Overtime is typically associated with specific tasks or special projects that may occasionally arise that would be outside the norm of the routine day-to-day assigned tasks. For example, the QA of completion of a routine construction activity can be accomplished under routine day-to-day tasks; however, when all other routine tasks are considered, the complete turn-over of a facility or site which involves punch lists, walk-throughs, etc. may exceed what could be accomplished in that 48-hour workweek. 9899143 Construction Management 10a 10b Draft Contract
Comment Classification: Controlled Unclassified Information (CUI)
Paragraph 1.0 of the Performance Work Statement says "This contract is for Personal Services in exclusive support of TAM's missions throughout KSA." FAR 37.104 states the key question in determining personal services is "Will the Government exercise relatively continuous supervision and control over the contractor personnel performing the contract. The sporadic, unauthorized supervision of only one of a large number of contractor employees might reasonably be considered not relevant, while relatively continuous Government supervision of a substantial number of contractor employees would have to be taken strongly into account (see (d) of this section)." Does the Government intend to exercise relatively continuous supervision of staff provided under this contract? If so, what is the role of the PMO?
On: Aug 27 2022.
Government Response. . USACE has determined the services needed to assist the Saudi Area Office with its
Quality Assurance responsibilities are personal service and received appropriate approval for the award a personal service contract. USACE will provide the necessary supervision over personal service contactor personnel to achieve its mission.
What is the role of the PMO?
Offerors should understand the management requirements and their associated costs to support 20 to 30 personnel located in the KSA. Some personnel may be geographically dispersed throughout the KSA. Although this is a personal service contract the awardee will be responsible for the human resources, logistics, and contractual compliance. The awardee is responsible for tasks such as:
* hiring, paying, and replacing personnel
* compliance with Saudi labor law
* travel of personnel and life support as required
* compliance with contract deliverables, clauses, and the PRS On: Sep 17 2022

Please clarify that to facilitate a performance based concept of operations, task orders will not consist of a specified number of personnel or hours/days by labor categories.
On: Sep 02 2022.
Government Response. . Each Task Order will provide estimated funding by labor category based on the contractor's estimate to support known project requirements. Since this is an IDIQ contract, the Task Order will be funded to allow flexibility to add personnel to more frequently used labor categories to reduce the need to add funding via contract modification. Staffing vacancies and increases will be managed via the weekly manning table. Following award, the USACE PM or COR will establish a battle rhythm to discuss adequate staffing needs, shortfalls, etc. to ensure the staffing level meets USACE project quality assurance requirements.
Initial Task Order funding will be in terms of number of personnel required by labor category. Actual funding amount will be determined by that number of estimated personnel multiplied by the agreed upon daily rate and number of workdays for each Task Order Period of Performance. The Support Services CLINs (0002 & 1002) will be lump-sum funded and managed through a separate funding tracker (worksheet) by Task Order. On: Sep 15 2022

Typically, travel CLINS are not-to-exceed (NTE), and billed on a cost reimbursable basis. The solicitation travel CLINS 004, 1004, & 2004 convey a NTE arrangement, based on flat rates to be negotiated upon award, yet contract type is designated as FFP. It is believed that travel requirements (frequency of trips and location) will be based on Government direction during the performance of the contract. How will the awarded travel CLIN NTE values be developed and what is the process for contractor billing of executed travel under these CLINS?
On: Sep 02 2022.
