Comment Classification: Controlled Unclassified Information (CUI) Paragraphs 3.3 and 3.6 state there can be no gaps in coverage for the staff augmentation positions for any reason. Since this is not a deliverables contract and task orders are going to enumerate the number of personnel required, will the USACE issue a task order that includes developing and retaining a pool of back up candidates to fill-in temporary vacancies due to personal leave, illness etc.?

On: Aug 26 2022. Forward request by email.

1-0 Evaluation Concurred. No, a separate Task Order will not be issued to accommodate gaps in coverage. As this is a performance-based contract, it is up to the Offer to meet contract requirements. It is not expected that every project will require daily inspections. In fact, one QA personnel may be assigned to numerous projects depending on the location and frequency of QA required as long as contract requirements are fulfilled. In the cases of leave or vacancies, it is expected that the Offeror re-allocate existing personnel accordingly as to not impact services. Additional personnel or a float pool will not be funded for this purpose. By: DeEtra Warchola; TAM Project Managers (DP-PM); (540-665- 1239) On: Aug 29 2022

Schedule

Comment Classification: Controlled Unclassified Information (CUI) Also, the requirements of paragraphs 3.3 and 3.6 does the USACE expect the contractor to bear the cost of developing and maintaining a vetted pool of back-up candidates sufficient to cover all the anticipated 25 personal services positions?

On: Aug 26 2022. Forward request by email.

1-0 Evaluation Concurred. It is up to the contractor to have on-hand a sufficient number of vetted candidates to backfill positions in the event of unexpected vacancies. The intent of this is to minimize impact to required services which in turn affects contractor's performance rating. The Contractor's approach to this can be addressed in the Recruitment, Promotion and Retention Plan. In response to inquiry ID #9897809, this is different than re-allocating existing personnel to cover leave; however, this can be utilized as a short-term solution until a vacancy is filled.

Vacancies will also be captured on the weekly manning document. By: DeEtra Warchola; TAM Project Managers (DP- PM); (540-665-1239) On: Aug 29 2022

9897822 Construction Management 2a 2b 2c 3.4.2 Overtime

(OT) Hours

Comment Classification: Controlled Unclassified Information (CUI) If OT requirements are being filled by candidates from a back-up pool and not by the routine asset supporting the project, does the 1.50 rate still apply?

On: Aug 26 2022. Forward request by email.

1-0 Evaluation Concurred. IAW PWS 3.4.2, if a contract employee is required to work more than 48 hours in any calendar week, Saturday through Thursday, OT compensation shall be provided at a rate 1.50 times the normal rate.

This refers to one employee who works more than 48 hours in any calendar week. It is not the intent to re-allocate assets to avoid overtime; however, if the Offeror is able to do so without impacting contract requirements, this would be acceptable. In this case, the OT rate does not apply, assuming the additional task(s) accomplished by other personnel would also not result in overtime. Overtime is typically associated with specific tasks or special projects that may occasionally arise that would be outside the norm of the routine day-to-day assigned tasks. For example, the QA of completion of a routine construction activity can be accomplished under routine day-to-day tasks; however, when all other routine tasks are considered, the complete turn-over of a facility or site which involves punch lists, walk-throughs, etc. may exceed what could be accomplished in that 48-hour workweek. By: DeEtra Warchola; TAM Project Managers (DP-PM); (540-665-1239) On: Aug 29 2022

2-0 Evaluation Check and Resolve. No overtime shall be worked unless approved by the Government in advance.
