We are a WOSB highly interested to bid on this solicitation. As the solicitation involves working overseas, we would like to request considering Bank Letter of Guaranty from acceptable banks internationally as alternative form of bonding as most defense agencies allow for overseas projects. Normally for overseas projects a bank letter of assurance for 10%-30% of the project value is acceptable as alternative bonding.Alternative bonds are not being accepted for this procurement.

Section 1.11.1.2, General Instructions states "Under this solicitation, no company or business entity may be awarded more than one contract as a prime Contractor." Does that mean all reserved pools combined within the MATOC or within each reserve pool: UR, SB & 8(a)? If a large business is pursuing the UR pool and has a SBA 8(a) Mentor-Protégé JV with another company can 2 awards occur, one to the large business in UR pool and one to the 8(a) reserve JV pool since it's likely they will not be competing against each other?A prime contractor that is also acting as a mentor in an 8(a) mentor protégé joint venture may submit a proposal seeking a MATOC contract award as well as the joint venture with that prime contractor as an SBA recognized mentor. However, because of the mentor's role to advise and assist the joint venture, the joint venture and the mentor prime contractor if both are awarded a MATOC contract should not propose on the same task order solicitation in the future. This restriction is necessary due to the risk of anti-competitive pricing issues and collusive bidding as addressed in FAR Subparts 3.1 and 3.3.

Comment Classification: Unclassified\\For Official Use Only (U\\FOUO)It is the Company's decision for its business strategy on which regions or countries that it desires to seek contract awards. A desired regional or country preference would not be considered a Government restriction on its ability to seek a base MATOC contract award. If awarded a base MATOC contract award, a company could decide at its own discretion whether to propose on any solicited order and could decide to limit its participation to propose on orders only for specific regions or countries. However, solicited orders in the future are not guaranteed for certain areas or countries and a MATOC awardee may experience very few or no orders solicited in their desired area or country.

The first paragraph of Section 5.1 says that "The Offeror shall provide letters of commitment for all proposed key subcontractors." Key subcontractors are defined in Section 5.1 "as any subcontractor that will perform a major portion (more than 15% of the total job) of the project." Considering that this IDIQ contract covers such a broad scope of work and such a large geographical area, it is likely that many prime contractors would have no subcontractors that would perform more than 15% of the cumulative efforts on all their MATOC task orders. Please confirm that it would be acceptable to not identify any key subcontractors if an offeror does not anticipate using any subcontractor(s) to the extent that the specific subcontractor(s) would execute more than 15% of the work on the prime offeror's contract.Offerors are to list subcontractors when applicable

6.1.1 asks for a statement as to whether a contractor has been "terminated for default of convenience on any project." It is our understanding that terminated for "convenience" is not an indication of performance as it is at the convenience of the government (e.g., termination of a contract due to a merger/acquisition providing a firm multiple contracts). Please confirm the applicability of a convenience termination by the Government in the evaluation of this factor as it is not consistent with the other elements requested. The RFP has been updated for clarity.

There is language that states "Contractor should list and prioritize major risk items in areas that may cause the PROJECT to not be completed on time (proposed execution schedule will be evaluated as part of the technical factor). Not finished within budget, generate change orders or that may be a source of dissatisfaction for the owner." In the context of developing the risk management plan, the offeror shall refer to the Project as a general project meeting the description of the anticipated scope of task orders with discipline requirements described in paragraph 6 on page 37 of 106 of the solicitation.

Would the Government clarify the language? There is no project required and therefore no execution schedule included as part of Phase I evaluation of the Technical and Management Approach.
