REGARDING THE STATUS OF A CATEGORY

OF UNITED STATES FORCES PERSONNEL

THE UNITED STATES OF AMERICA

AND

hereinafter referred to as the Contracting Parties;

CONSIDERING the Agreement between the Parties to the North Atlantic Treaty regarding the Status of their Forces, signed at London on 19 June 1951, hereinafter referred to as the NATO SOFA;

CONSIDERING the Protocol on the Status of International Military Headquarters set up pursuant to the North Atlantic Treaty, signed in Paris on 28 August 1952, hereinafter referred to as the Paris Protocol;

CONSIDERING the Agreement between the Kingdom of Belgium and the Supreme Headquarters Allied Powers Europe on the special conditions applicable to the establishment and operation of this Headquarter on the territory of the Kingdom of Belgium, signed at Brussels on 12 May 1967, ./ hereinafter referred to as the Belgium SHAPE Agreement;

CONSIDERING the Agreement between the United States of America and the Kingdom of Belgium on social security, signed at Washington, on 19 February 1982, hereinafter referred to as the social security agreement between USA and Belgium;

CONSIDERING the Convention between the Government of the United States of America and the Government of the Kingdom of Belgium for the avoidance of double taxation and the prevention of fiscal evasion with respect to taxes on income, signed at Brussels, on 27 November 2006;

CONSIDERING that special provisions should be determined regarding the regime and status applicable to a category of contractor personnel of the United States of America forces (hereinafter referred to as United States forces), who are paid directly or indirectly from United States of America Government funds, who are temporarily detached from commercial and non-commercial organizations, and who are exclusively in the service of the United States forces and its civilian component in Belgium;

HAVE AGREED as follows:

1.

Article 1

With regard to the implementation of the NATO SOFA and of the Belgium-SHAP~ Agreement in Belgium, certain temporarily assigned contractor personnel from commercial a~d non commercial organizations, who are United States of America nationals or permanent residents of the United States of America paid directly or indirectly from United States Government funds and who are accompanying the United States forces in Belgium shall be treated as members of the civilian component accompanying the United States forces in the sense of Article I paragraph 1b of the NATO SOFA, by means of an administrative arrangement between t~e Contracting Parties represented by the concerned authorities, prior to their employment In Belgium and as far as their employment meets the conditions mentioned in paragraph 3 and 4 of this Article.

Nevertheless, Article X of the NATO SOFA is applicable to these personnel only insofar as they are effectively subject to income tax in the United States.

2. With regard to social security, the contractor personnel referred to in paragraph 1, as well as the members of their family shall be subject to the provisions of the social security agreement between USA and Belgium.

3. The personnel temporarily detached from commercial or non-commercial organizations who can benefit from the provisions of paragraph 1 include United States of America nationals and permanent residents of the United States of America who are exclusively performing services by accompanying the United States forces and its civilian component in Belgium, employed by the United States forces or employed by United States contractors under contracts allocated and managed by the United States forces under the management responsibility of these forces and who are temporarily detached:

a) by a United States non-commercial organization and who are accompanying the United States forces in Belgium, solely for the purpose of contributing to their health, welfare, morale, and education. Non-commercial organizations include, but are not limited to, youth movements or universities.

b) by a United States commercial organization and who are accompanying the United States forces as persons involved in analytical support services or as technical experts or as troop care providers:

persons involved in analytical support services are persons providing analytical services who support activities in the area of military planning and intelligence analysis, as well as activities in support of various commands through strategic and war planning.

technical experts are persons necessary for the military needs of the United States forces either in fields requiring advanced technical knowledge or for the accomplishment of complex technical tasks of a military or scientific nature. These technical experts are persons with the skills and knowledge necessary for the accomplishment of tasks of a technical military nature, or of a technical scientific nature, and meet the security clearance requirements of the United States forces.

These persons must have acquired the skill and knowledge through a process of higher education or through a period of specialized training and experience. It may also include highly skilled workers in trades or in private sector occupations, such as:

(i) Computer software engineers;

(ii)

(iii)

Technicians responsible for the maintenance of aircraft (including aircraft used for the transport of Supreme Allied Commander Europe/Commander United States European Command), combat vehicles and weapons systems;

Persons who as former officers or non-commissioned officers have technical military skills or the technical military knowledge· required for the performance of their work in addition to their other technical skills.

troop care providers are persons who provide medical, social and career related services to members of the force, members of the civilian component or dependents under the NATO SOFA.

4. In order to benefit from the provisions of Article 1, paragraph 1, of this Agreement contractor personnel must meet the following conditions:

a) they must work in Belgium exclusively under the direct authority, management and administration of the United States military authorities and;

b) they cannot be temporarily detached from a Belgian or European Union establishment of a private company and they cannot have any other professional activity in the European Union and;

c) they cannot have the power to act in Belgium for their company of origin and to conclude contracts which obligate the company from which they are temporarily detached, inasmuch as this leads to the existence of permanent establishment of their company in Belgium, as provided for in Article 5, paragraph 5 of the Convention of 27 November 2006 between the Government of the United States of America and the Government of the Kingdom of Belgium for the avoidance of double taxation and the prevention of fiscal evasion with respect to taxes on income and;

d) they must be considered by the United States forces utilizing them as being part of the personnel of the forces and subject to the disciplinary authority thereof and;

e) the contract with their employer of origin must expressly provide for the granting of the status of members of the civilian component for the duration of their employment by the forces and;

f) the personnel concerned cannot be hired to perform tasks that relate to the local needs of the United States forces in the sense of Article IX, paragraph 4 of the NATO SOFA and;

g) the positions must be limited to those which cannot be performed by commercial or non commercial organizations established within the European Union without prejudice to the military and security needs of the United States forces.

5. The number of members of that category of the civilian component of the United States forces on duty on Belgian territory who may enjoy the treatment described in paragraph 1 of this Article cannot exceed 7 5.

In exceptional cases, upon request of the United States forces, that number may be increased by decision of the Belgian Minister of Foreign Affairs.

Article 2

The personnel who may enjoy the treatment described in Article 1, paragraph 1, of this Agreement may not include:

stateless persons;

nationals of a State which is not a Party to the North Atlantic Treaty;

nationals of, or persons who are ordinarily resident in, Belgium or a European Union State.

Article 3

1. Prior to arrival in Belgium and prior to any designation as members of the civilian component as provided for in Article 1, paragraph 1 of this Agreement, the United States National Military Representative at SHAPE shall submit documentation to the President of the Inter-Ministerial Committee for the Hosting Policy (CIPS) sufficient to verify that such persons meet the criteria and conditions provided for in this Agreement.

The exchanges of letters as well as the exchanges of information and other necessary contacts related to that category of personnel, constitute the administrative arrangement provided for in Article 1, paragraph 1 of this Agreement and shall be carried out through the Belgian National Military Representative at SHAPE.

The Belgian authorities shall process such submissions in an expeditious manner, providing written approval or disapproval, normally within 30 days.

2. The employment contracts of the members of temporarily assigned contractor personnel from non-commercial and commercial organizations referred to in Article 1, paragraph 1 of this Agreement, shall include a statement that the individual will exclusively serve the needs of the United States forces and will not engage in any local employment activities in the European Union. The contract shall also include a description of the specific functions that the individual will perform and the length of the contract period.

3. Before the arrival in Belgium of the persons referred to in Article 1, paragraph 1 of this Agreement, all formal requirements for the application of the social security agreement between USA and Belgium, must be fulfilled and all requested forms delivered.

4. To provide the Belgian authorities concerned with the information necessary for the correct implementation of this Agreement, the United States National Military Representative at SHAPE shall submit to the Inter-Ministerial Committee for the Hosting Policy (CIPS), through the Belgian National Military Representation at SHAPE, before 31 March each year, an annual report listing the incumbents of the category of personnel designated under Article 1, paragraph 1, of this Agreement who worked the previous year, the approval date of Belgian authorities as well as the total number and functions of these personnel.

Article 4

Belgian authorities or their representatives may make occasional visits to the United States forces-controlled workplaces of contractor employees who are treated as members of the civilian component pursuant to Article 1, paragraph 1 of this Agreement, to monitor their status and the implementation of this Agreement.

Such visits shall take place after coordination with the appropriate United States for~es authorities, and shall be conducted with due regard for the operational needs and service requirements of the United States forces and in such a way as to minimize disruption to activities of the United States forces.

In the case of facilities located on SHAPE, in addition to coordination with United States forces authorities, such visits shall take place after coordination with SHAPE authorities.

2. The paragraph above applies without prejudice to the application of Article XI, paragraph 1, and Article Xll of the NATO SOFA and the arrangements that customs and tax authorities consider necessary to prevent abuses.

Article 5

In case of employment in Belgium, contractor personnel who are treated as members of the civilian component pursuant to Article 1 of this Agreement enjoy the privileges and immunities granted under the NATO SOFA, the Paris Protocol, and the SHAPE Agreement to other members of the civilian component under the same modalities and conditions applicable to the civilian component.

Article 6

This Agreement shall enter into force upon the date of the later of the written notifications through diplomatic channels whereby the Parties inform each other that all their internal procedures necessary to bring this Agreement into force have been fulfilled.

Article 7

Each Contracting Party may send to the other Contracting Party any proposal to amend the present Agreement. This Agreement shall be amended by mutual written consent of the Contracting Parties.

Any amending Agreement so adopted shall enter into force upon the date of the later of the written notifications through diplomatic channels whereby the Parties inform each other that all their internal procedures necessary to bring the amendment into force have been fulfilled.

Article 8

All disputes between the Contracting Parties relating to the interpretation or application of this Agreement shall be settled by negotiations between them.

The present Agreement shall be of unlimited duration. Either Contracting Party may terminate this Agreement by providing written notice through diplomatic channels to the other Party. Termination shall take effect 6 months after the date notice was sent.

IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective governments, have signed this Agreement.

ci-apres denommes les Parties contractantes;

CONSIDERANT la Convention entre les Etats parties au Traite de !'Atlantique Nord sur le statut de leurs forces, signee a Londres le 19 juin 1951, ci-apres denommee le SOFAOTAN;

CONSIDERANT le Protocole sur le statut des quartiers generaux militaires internationaux crees en vertu du Traite de 1' Atlantique Nord, signe a Paris le 28 aout 1952, ci-apres denomme le Protocole de Paris;

CONSIDERANT 1' Accord entre le Royaume de Belgique et le Quartier General Supreme des Forces Alliees en Europe concernant les conditions particulieres d'installation et de fonctionnement de ce Quartier General sur le territoire du Royaume de Belgique, signe a Bruxelles le 12 mai 1967, ci-apres denomme 1 'Accord Belgique-SHAPE;

CONSIDERANT la Convention entre les Etats-Unis d' Amerique et le Royaume de Belgique sur la securite sociale, signee a Washington le 19 fevrier 1982, ci-apres denommee Convention de securite sociale belgo-americaine;

CONSIDERANT la Convention entre le Gouvernement des Etats-Unis d' Amerique et le Gouvernement du Royaume de Belgique tendant a eviter la double imposition eta prevenir !'evasion fiscale en matiere d'impots sur le revenu, signee a Bruxelles le 27 novembre 2006;

CONSIDERANT la necessite d'etablir des dispositions particulieres concernant le regime et le statut applicables a une categorie de personnel contractuel des Forces des Etats-Unis d' Amerique ( ci apres denommee Forces des Etats-Unis), remunere directement ou indirectement par des fonds du gouvernement des Etats-Unis d'Amerique et detache temporairement d'organisations commerciales et non commerciales et exclusivement au service des Forces des Etats-Unis et de !'element civil de ces Forces en Belgique;

SONT CONVENUS de ce qui suit:

Article ler

1. Pour !'application en Belgique du SOFA OTAN et de l'Accord Belgique-SHAPE, certains membres du personnel contractuel temporairement detaches d'organisations commerciales et non commerciales, qui sont des ressortissants des Etats-Unis d' Amerique ou des residents permanents des Etats-Unis d' Amerique, remuneres directement ou indirectement par des fonds du gouvemement des Etats-Unis d' Amerique et qui accompagnent les Forces des Etats-Unis en Belgique, sont assimiles a des membres de !'element civil accompagnant les Forces des Etats Unis au sens de !'article I, §ler, b, du SOFA OTAN, moyennant un arrangement administratif entre les Parties contractantes representees par les autorites concemees, prealablement a 1' exercice de leurs fonctions en Belgique et pour autant que celles-ci repondent aux conditions mentionnees au troisieme et quatrieme paragraphes du present article.

Toutefois !'article X du SOFA OTAN ne s'applique aux membres de ce personnel que pour autant qu'ils soient soumis effectivement a l'impot sur le revenu aux Etats-Unis.

2. En ce qui conceme la securite sociale, le personnel contractuel vise au ler paragraphe, ainsi que les membres de leur famille, seront soumis aux dispositions de la Convention de securite sociale belgo-americaine.

3. Les membres du personnel detaches temporairement d'organisations commerciales ou non commerciales qui peuvent beneficier des dispositions du paragraphe premier du present article comprennent les nationaux des Etats-Unis d' Amerique et les residents permanents des Etats Unis d' Amerique qui sont exclusivement en service en accompagnement des Forces des Etats Unis et de leur element civil en Belgique, employes par les Forces des Etats-Unis ou employes par des contractants des Etats-Unis sous contrats attribues et geres par les Forces des Etats-Unis sous la responsabilite de gestion de ces Forces et qui sont detaches temporairement:

a) d'une organisation des Etats-Unis non commerciale et qui accompagnent les Forces des Etats-Unis en Belgique dans le seul but de contribuer a leur sante, leur bien-etre, leur moral et leur formation. Les organisations non-commerciales comprennent, sans toutefois y etre limitees, les mouvements de jeunesse ou les universites.

b) d'une organisation des Etats-Unis commerciale et qui accompagnent les Forces des Etats Unis en tant que personnes assurant des services de soutien analytique ou en tant qu'experts techniques ou en tant que personnes chargees de !'assistance medicale et sociale aux troupes:

par personnes assurant des services de soutien analytique, on entend les personnes prestant des services de soutien analytique qui apportent leur soutien dans le domaine de la planification militaire et de !'analyse du renseignement et des activites qui soutiennent divers commandements via la planification strategique et de guerre;

par experts techniques, on entend les personnes qui sont necessaires pour les besoins militaires des Forces des Etats-Unis soit dans des matieres exigeant des connaissances techniques de pointe ou pour l'accomplissement de taches complexes de nature militaire ou de nature scientifique. Lesdits experts techniques sont des personnes ayant les competences et les connaissances necessaires pour l'accomplissement de taches techniques de nature militaire ou scientifique et repondant aux exigences d'autorisation de securite des Forces des Etats-Unis.

Ces personnes doivent avoir acquis cette competence et ces connaissances de par leur niveau d'etudes superieures ou par une periode d'experience et de formation specialisee. Parmi elles, on peut aussi compter des travailleurs hautement qualifies dans des metiers manuels ou des fonctions relevant du secteur prive, notamment:

(i) des ingenieurs en logiciels informatiques;

(ii) des techniciens responsables de la maintenance des aeronefs (en ce compris les aeronefs utilises pour les deplacements du Commandant supreme des forces alliees en Europe/Commandant du Commandement des forces des Etats-Unis en Europe), des vehicules de combat et des systemes d'armes;

(iii) des personnes a qui leur qualite d'ancien officier ou d'ancien sous-officier conf'ere des aptitudes techniques militaires ou les connaissances militaires techniques requises pour !'execution de leur travail en plus de leurs autres competences techniques.

par personnes chargees de !'assistance medicale et sociale aux troupes, on entend celles qui prestent des services medicaux, sociaux et d'orientation professionnelle aux membres de Ia Force, de !'element civil ou aux personnes a charge au sens du

SOFAOTAN.

4. Pour pouvoir beneficier des dispositions de I' article 1 er, paragraphe 1 er du present Accord, le personnel contractuel devra remplir les conditions suivantes

a) ils doivent travailler en Belgique exclusivement sous l'autorite, la direction et la gestion directes des autorites rnilitaires des Forces des Etats-Unis et;

b) ils ne peuvent etre detaches temporairement d'un etablissement d'une frrme privee, etabli en Belgique ou dans l'Union europeenne, et ils ne peuvent exercer aucune autre activite professionnelle dans I 'Union europeenne et;

c) ils ne peuvent disposer en Belgique du pouvoir d'agir pour lecompte de leur entreprise d'origine et de conclure des contrats qui obligent l'entreprise dont ils sont detaches temporairement, dans la mesure ou cela entraine 1 'existence d 'un etablissement stable de leur firme en Belgique, telle que determine dans !'article 5, §5 de la Convention du 27 novembre 2006 entre le Gouvemement du Royaume de Belgique et le Gouvemement des Etats-Unis d' Amerique tendant a eviter Ia double imposition et a prevenir !'evasion fiscale en matiere d'impots sur le revenu et;

d) ils doivent etre consideres par les Forces des Etats-Unis qui les utilisent comme faisant partie du personnel des Forces et soumis a l'autorite disciplinaire de celles-ci et;

e) le contrat des membres de ce personnel avec leur employeur d'origine doit prevoir explicitement I' attribution du statut de membre de 1' element civil pour Ia duree de leur emploi par les Forces et;

f) les membres vises de ce personnel ne peuvent etre engages pour des taches qui relevent des besoins locaux des Forces des Etats-Unis au sens de !'article IX, §4 du SOFA OTAN et;

g) les activites exercees doivent etre limitees a celles qui ne peuvent etre fournies par des organisations commerciales ou non commerciales etablies dans l'Union Europeenne sans prejudice des besoins militaires et de securite des Forces des Etats-Unis.

5 Le nombre des membres de cette categorie de personnel civil des Forces des Etats-Unis en service sur le territoire belge qui peut beneficier de !'assimilation visee au paragraphe 1er du present article ne peut depasser 75.

Ce nombre peut, par mesure exceptionnelle, etre releve par decision du Ministre beige des Affaires etrangeres ala demande des Forces des Etats-Unis.

Article 2

Le personnel vise par 1 'assimilation decrite a 1'article 1 er, paragraphe 1 er du present Accord, ne peut comprendre:

des apatrides;

des ressortissants d'un Etat qui n'est pas partie au Traite de 1' Atlantique Nord;

des ressortissants et residents habituels de la Belgique ou d'un Etat de l'Union europeenne.

Article 3

1. Avant l'arrivee en Belgique et avant toute assimilation comme membre de !'element civil comme prevu a I' article 1 er, paragraphe 1 er du present Accord, le representant militaire national des Etats-Unis aupres du SHAPE soumettra au President du Comite Interrninisteriel pour la Politique de Siege (CIPS) les documents necessaires afin de pouvoir verifier que ces personnes remplissent les criteres et conditions determines par le present Accord.

Les echanges de lettres ainsi que les echanges d'inforrnations et autres contacts necessaires relatifs a cette categorie de personnel constituent !'arrangement administratif vise a !'article 1er, paragraphe 1er du present Accord, et s'effectueront par l'interrnediaire de la Representation militaire nationale beige aupres du SHAPE.

Les autorites belges traiteront ces demandes dans les meilleurs delais et comrnuniqueront leur approbation ou leur desapprobation ecrite, norrnalement dans un delai de 30 jours.

2. Les contrats de travail du personnel contractuel temporairement detache d'organisations commerciales et non commerciales, vises a I' article 1 er, paragraphe 1 er du present Accord, comprendront une declaration stipulant que le membre de ce personnel travaillera exclusivement pour les besoins des Forces des Etats-Unis et ne s'engagera dans aucune autre activite professionnelle locale dans l'Union europeenne. Le contrat comprendra egalement une description des fonctions specifiques que le membre de ce personnel remplira et stipulera la duree du contrat.

3. Avant l'arrivee en Belgique du personnel vise a !'article 1er, paragraphe 1er du present Accord, toutes Ies forrnalites prevues pour !'application des dispositions de la convention bilaterale de securite sociale belgo-americaine auront ete accomplies et les forrnulaires requis delivres.

4 Afin de fournir aux autorites belges concernees les renseignements necessaires a la bonne application du present Accord, le Representant militaire national des Etats-Unis aupres du SHAPE enverra au Comite Interministeriel pour la Politique de Siege, par l'intermediaire de la Representation militaire nationale belge aupres du SHAPE, avant le 31 mars de chaque annee, un rapport annuel indiquant la liste des titulaires de cette categorie de personnel vise a l'article ler, paragraphe ler du present Accord, en service l'annee precedente, Ia date d'agrement des autorites belges ainsi que le nombre total de personnes et les fonctions occupees par ce personnel detache.

Article 4

1. Les autorites belges ou leurs representants peuvent faire des visites occasionnelles sur les lieux de travail controles par les Forces des Etats-Unis des employes contractuels qui ont ete assimiles comme membres de l'element civil conformement a l'article 1er, paragraphe 1er du present Accord, afin de verifier leur statut et Ia bonne execution du present Accord.

2.

Ces visites se derouleront en concertation avec les autorites competentes des Forces des Etats Unis et seront menees dans le respect des necessites operationnelles et des necessites du service des Forces des Etats-Unis de maniere a perturber le mains possible les activites des Forces des Etats-Unis.

Dans le cas d'installations situees sur le site du SHAPE, ces visites se derouleront en concertation avec les autorites du SHAPE, en plus de la concertation avec les autorites des Forces des Etats-Unis.

Le paragraphe ci-dessus s'applique sans prejudice de }'application des articles XI, § 1 er, et XII du SOFA OTAN, et des dispositions que les autorites douanieres et fiscales peuvent estimer necessaires pour prevenir les abus.

Article 5

En cas de prise de fonctions en Belgique, les membres du personnel contractuel vises a !'article 1er du present Accord, qui ont fait l'objet d'une assimilation en tant que membres de !'element civil, beneficie des privileges et immunites accordes aux autres membres de l'element civil, en vertu du SOFA OTAN, du Protocole de Paris et de 1' Accord Belgique-SHAPE selon les memes modalites et conditions que celles qui s'appliquent a l'element civil.

Article 6

Le present Accord entrera en vigueur le jour de la derniere des notifications ecrites adressee par Ia voie diplomatique par lesquelles les Parties s'informent mutuellement de ce que toutes leurs procedures

) nationales necessaires a la mise en vigueur du present Accord ont ete accomplies.

Article 7

Chaque Partie contractante peut envoyer a l'autre Partie contractante une proposition d'amendement au present Accord. Le present Accord sera amende par accord mutuel ecrit des Parties contractantes.

Tout Accord d'amendement ainsi approuve entrera en vigueur le jour de la demiere des notifications ecrites adressee par la voie diplomatique par lesquelles les Parties s'informent mutuellement de ce que toutes leurs procedures nationales necessaires a la mise en vigueur de l'amendement ont ete accomplies.

Article 8

Tout differend entre les Parties contractantes en ce qui conceme !'interpretation ou !'application du present Accord sera regle par negociations entre elles.

Le present Accord aura une duree illimitee. Chaque Partie contractante peut mettre fin au present Accord par notification ecrite adressee par Ia voie diplomatique a I' autre Partie. L' extinction sera effective six mois apres Ia date d'envoi de la notification.

EN FOI DE QUOI, les soussignes, dfunent habilites par leurs gouvemements respectifs, ont signe le present Accord.

hiema te noemen de Verdragsluitende Partijen;

GELET OP het Verdrag tussen de Partijen bij het Noord-Atlantisch Verdrag nopens de rechtspositie van hun krijgsmachten, ondertekend te London op 19 juni 1951, hiema te noemen Navo Status Verdrag;

GELET OP het Protocol nopens de rechtspositie van intemationale hoofdkwartieren, ingesteld uit hoofde van het Noord-Atlantisch Verdrag, ondertekend te Parijs op 28 augustus 1952, hiema te noemen Protocol van Parijs;

GELET OP de Overeenkomst tussen het Koninkrijk Belgie en het Algemeen Hoofdkwartier van de Geallieerde Strijdkrachten in Europa inzake de bijzondere voorwaarden voor de vestiging en het functioneren van dit Hoofdkwartier op het grondgebied van het Koninkrijk Belgie, ondertekend te Brussel op 12 mei 1967, hiema te noemen Overeenkomst Belgie-SHAPE;

GELET OP de Overeenkomst over de sociale zekerheid tussen de Verenigde Staten van Amerika en het Koninkrijk Belgie, ondertekend te Washington op 19 februari 1982, hiema te noemen Belgisch Amerikaanse Overeenkomst over de sociale zekerheid;

GELET OP de Overeenkomst tussen de Regering van de Verenigde Staten van Amerika en de Regering van het Koninkrijk Belgie tot het vermijden van dubbele belasting en het voorkomen van het ontgaan van belasting met betrekking tot belastingen naar het inkomen, ondertekend te Brussel op 27 november 2006;

GELET OP de noodzaak om bijzondere bepalingen vast te leggen betreffende het stelsel en de rechtspositie waaronder een categorie van het contractuele personeel van de Strijdkrachten van de Verenigde Staten van Amerika valt ( hiema te noemen de Strijdkrachten van de Verenigde Staten), dat rechtstreeks of onrechtstreeks wordt betaald met Amerikaans overheidsgeld en dat tijdelijk door commerciele en niet-commerciele organisaties en uitsluitend in dienst van de Strijdkrachten van de Verenigde Staten en van de civiele dienst van die Strijdkrachten in Belgie is gedetacheerd;

ZIJN OVEREENGEKOMEN als volgt:

Artikell

1. Voor de toepassing in Belgie van het Navo Status-Verdrag en de Overeenkomst Belgie-SHAPE, zijn bepaalde contractuele personeelsleden die tijdelijk door commerciele dan wei niet commerciele organisaties gedetacheerd zijn en die onderdanen van de Verenigde Staten van Amerika of permanent ingezetenen van de Verenigde Staten van Amerika zijn, die rechtstreeks of onrechtstreeks met Amerikaans overheidsgeld worden betaald en die de Strijdkrachten van de Verenigde Staten in Belgie begeleiden, gelijkgesteld met leden van het burgerlijk element die de Strijdkrachten van de Verenigde Staten begeleiden in de zin van artikel I, § 1 er, b, van de Navo Status-Verdrag, mits een administratieve regeling werd getroffen tussen de Verdragsluitende Partijen die door de betrokken overheden zijn vertegenwoordigd voorafgaand aan de uitoefening van hun functie in Belgie, en voor zover deze aan de voorwaarden voldoen zoals vermeld in de derde en vierde alinea van dit artikel.

Artikel X van de Navo Status-Verdrag is evenwel slechts van toepassing op deze personeelsleden voor zover ze in de Verenigde Staten daadwerkelijk onderworpen zijn aan de belasting naar het inkomen.

2. Wat de sociale zekerheid betreft, zullen het in paragraaf 1 bedoelde contractuele personeel en hun gezinsleden onderworpen zijn aan de bepalingen van de Belgisch-Amerikaanse Overeenkomst over de sociale zekerheid.

3. Maken deel uit van de tijdelijk door commerciele dan wei niet-commerciele organisaties gedetacheerde personeelsleden die aanspraak kunnen maken op de bepalingen in de eerste paragraaf van dit artikel, de onderdanen van de Verenigde Staten van Amerika en de permanent ingezetenen van de Verenigde Staten van Amerika die uitsluitend in dienst zijn in begeleiding van de Strijdkrachten van de Verenigde Staten en van het burgerlijk element ervan in Belgie, die onder de beheersverantwoordelijkheid van de Strijdkrachten van de Verenigde Staten tewerkgesteld zijn door deze Strijdkrachten of door contractanten van de Verenigde Staten die met de Strijdkrachten van de Verenigde Staten een goedgekeurde en beheerde overeenkomst hebben, en die tijdelijk gedetacheerd zijn:

a) door een niet-commerciele organisatie van de Verenigde Staten en die de Strijdkrachten van de Verenigde Staten in Belgie begeleiden enkel en alleen om bij te dragen aan hun gezondheid, hun welzijn, hun moreel en hun opleiding. Onder niet commerciele organisaties vallen ondermeer jeugdbewegingen en universiteiten.

b) door een commerciele organisatie van de Verenigde Staten en die de Strijdkrachten van de Verenigde Staten begeleiden als verlener van analytische steun of als technisch deskundige dan wei als persoon die belast is met de medische en sociale bijstand aan de troepen:

onder verleners van analytische steun dient te worden verstaan personen die analytische diensten verrichten ter ondersteuning op het vlak van de militaire planning en van de analyse van inlichtingen dan wei van de activiteiten ter ondersteuning van de verschillende commando's via strategische planning en oorlogsplanning;

onder technisch deskundigen dient te worden verstaan personen die nodig zijn voor de militaire behoeften van de Strijdkrachten van de Verenigde Staten hetzij in domeinen waar hoogstaande technische kennis vereist is hetzij voor het uitvoeren van complexe taken van militaire of wetenschappelijke aard. De technisch deskundigen zijn personen die beschikken over de nodige vaardigheden en kennis voor het uitvoeren van technische taken van militaire of wetenschappelijke aard en voldoen aan de eisen inzake veiligheidsmachtiging van de Strijdkrachten van de Verenigde Staten. Deze personen moeten deze vaardigheden en kennis hebben verworven via hogere studies of tijdens een periode waar ervaring werd opgedaan of via een gespecialiseerde opleiding. Tot deze categorie personen behoren oak hooggekwalificeerde werknemers in praktische beroepen of functies uit de privesector, met name:

(i) software ingenieurs;

(ii) technici verantwoordelijk voor het onderhoud van de vliegtuigen ( daaronder begrepen de vliegtuigen voor de verplaatsingen van de Opperbevelhebber van de Geallieerde Strijdkrachten in Europa/Bevelhebber van het Commando van de Strijdkrachten van de Verenigde Staten in Europa), de gevechtswagens en de wapensystemen;

(iii) personen die als voormalig officier of voormalig onderofficier de vereiste technische militaire vaardigheden of technische militaire kennis hebben verworven voor de uitvoering van hun werk, hoven op hun andere technische kennis.

onder personen die belast zijn met de medische en sociale bijstand aan de troepen dient te worden verstaan personen die medische en sociale diensten of diensten inzake beroepskeuzevoorlichting verlenen aan de leden van de Strijdkrachten, van het burgerlijk element of aan de personen ten laste in de zin van het Navo Status Verdrag.

4. Om aanspraak te kunnen maken op de bepalingen in artikel 1, paragraaf 1, van deze Overeenkomst moeten de contractuele personeelsleden voldoen aan de volgende voorwaarden:

a) ze moeten in Belgie werken uitsluitend onder het rechtstreekse gezag, de rechtstreekse Ieiding en het rechtstreekse beheer van de militaire autoriteiten van de Strijdkrachten van de Verenigde Staten en;

b) ze kunnen niet tijdelijk gedetacheerd zijn door een vestiging van een privefirma, die in Belgie dan wel in de Europese Unie gevestigd is, en ze mogen geen enkele andere beroepsactiviteit in de Europese Unie uitoefenen en;

c) ze mogen in Belgie niet beschikken over de machtiging om namens hun firma van herkomst te handelen en overeenkomsten af te sluiten die de firma die ze tijdelijk heeft gedetacheerd, binden, voor zover dit leidt tot een vaste inrichting van hun firma in Belgie zoals bepaald in artikel 5, §5 van de Overeenkomst van 27 november 2006 tussen de Regering van het Koninkrijk Belgie en de Regering van de Verenigde Staten van Amerika tot het vermijden van dubbele belasting en het ontgaan van belasting inzake belastingen naar het inkomen en;

d) ze moeten door de Strijdkrachten van de Verenigde Staten die een beroep op hen doen, worden beschouwd als personeelsleden van de Strijdkrachten en ze moeten onderworpen zijn aan de tuchtoverheid van deze Strijdkrachten en;

e) de arbeidsovereenkomst die deze personeelsleden met hun werkgever van herkomst hebben gesloten, moet uitdrukkelijk vermelden dat hen voor de duur van hun tewerkstelling door de Strijdkrachten de status van lid van het burgerlijk element wordt toegekend en;

f) bedoelde personeelsleden kunnen niet worden ingezet voor taken die verband houden met de plaatselijke behoeften van de Strijdkrachten van de Verenigde Staten overeenkomstig artikel IX , §4 van de Navo Status-Verdrag en;

g) de uitgeoefende activiteiten moeten beperkt zijn tot de activiteiten die commerciele dan wel niet-commerciele organisaties in de Europese Unie niet kunnen verrichten, onverminderd de militaire behoeften en veiligheidsbehoeften van de Strijdkrachten van de Verenigde Staten.

5. Het aantal leden van deze categorie burgerpersoneel van de Strijdkrachten van de Verenigde Staten die op het Belgische grondgebied in dienst zijn en in aanmerking komen voor de gelijkstelling zoals bedoeld in paragraaf 1 van dit artikel, mag niet hager zijn dan 75.

Dit aantal kan bij wijze van uitzondering op vraag van de Strijdkrachten van de Verenigde Staten worden verhoogd bij beslissing van de Belgische Minister van Buitenlandse Zaken.

Artikel2

Van het personeel dat onder de in artikel 1, paragraaf 1, van deze Overeenkomst beschreven gelijkstelling valt, maken geen deel uit:

staatlozen;

onderdanen van een Staat die geen partij is bij het Noord-Atlantisch Verdrag;

onderdanen en gewone ingezetenen van Belgie of van een Staat van de Europese Unie.

Artikel3

1. Voor de komst naar Belgie en voor de gelijkstelling als lid van het burgerlijk element zoals bepaald in artikel 1, paragraaf 1, van deze Overeenkomst moet de nationale militaire vertegenwoordiger van de Verenigde Staten bij SHAPE de Voorzitter van het Interministerieel Comite voor het Zetelbeleid (ICZ) in het bezit stellen van de nodige documenten opdat deze kan nagaan of deze personen voldoen aan de criteria en voorwaarden zoals bepaald in deze Overeenkomst.

De briefwisselingen en de uitwisselingen van gegevens en andere nodige contacten met betrekking tot deze personeelscategorie vormen de administratieve regeling zoals bedoeld in artikel 1, paragraaf 1, van deze Overeenkomst en zullen lopen via de Belgische nationale militaire Vertegenwoordiging bij SHAPE.

De Belgische autoriteiten zullen deze aanvragen zo snel mogelijk behandelen en zullen hun goedkeuring of afkeuring schriftelijk meedelen, normaliter binnen een termijn van 30 dagen.

2. De arbeidsovereenkomsten van het contractueel personeel dat tijdelijk gedetacheerd is door commerciele dan wel niet-commerciele organisaties zoals bedoeld in artikel 1, paragraaf 1, van deze Overeenkomst, zullen een verklaring bevatten die bepaalt dat het lid van dit personeel uitsluitend voor de behoeften van de Strijdkrachten van de Verenigde Staten zal werken en geen enkele andere lokale beroepsactiviteit in de Europese Unie zal uitoefenen. De arbeidsovereenkomst zal ook een beschrijving bevatten van de specifieke functies die bedoeld personeelslid zal vervullen en zal ook de duur van de overeenkomst bepalen.

3. Voor de komst van het onder artikel 1, paragraaf 1, van deze Overeenkomst bedoelde personeel naar Belgie zullen alle formaliteiten waarin de toepassing van het bepaalde in de bilaterale Belgisch-Amerikaanse Overeenkomst over sociale zekerheid voorziet, vervuld zijn en zijn de vereiste formulieren overhandigd.

4. Teneinde de betrokken Belgische autonte1ten de voor de goede toepassing van deze Overeenkomst nodige inlichtingen te verstrekken, zal de nationale militaire vertegenwoordiger van de Verenigde Staten bij SHAPE het Interministeriee1 Comite voor het Zetelbeleid via de Belgische nationale militaire Vertegenwoordiging bij SHAPE elkjaar voor 31 maart in het bezit stellen van eenjaarverslag met de lijst van personen die onder de in artikel1, paragraaf 1, van deze Overeenkomst bedoelde personeelscategorie vallen en die het voorafgaande jaar in dienst waren, met opgave van de datum van goedkeuring door de Belgische autoriteiten evenals het totale aantal personen en de functies die door dit gedetacheerd personeel worden waargenomen.

Artikel4

1. De Belgische autoriteiten of hun vertegenwoordigers kunnen incidenteel de werkplaatsen onder toezicht van de Strijdkrachten van de Verenigde Staten bezoeken waar de contractuele personeelsleden werkzaam zijn die zijn gelijkgesteld met leden van het burgerlijk element overeenkomstig artikel 1, paragraaf 1, van deze Overeenkomst teneinde het statuut van die personeelsleden en de goede uitvoering van deze Overeenkomst te controleren.

Deze bezoeken zullen plaatsvinden in overleg met de bevoegde autonte1ten van de Strijdkrachten van de Verenigde Staten en zullen worden verricht met inachtneming van de operationele en dienstgerelateerde noden van de Strijdkrachten van de Verenigde Staten teneinde de activiteiten van de Strijdkrachten van de Verenigde Staten zo weinig mogelijk te verstoren.

Indien het om installaties op de site van SHAPE gaat, zullen deze bezoeken plaatsvinden in overleg met de autoriteiten van SHAPE bovenop het overleg met de autoriteiten van de Strijdkrachten van de Verenigde Staten.

2. Bovenstaande alinea is van toepassing, onverminderd de artikelen XI, § 1 e, en XII van de Navo Status-Verdrag en de bepalingen die de douaneautoriteiten en de belastingsautoriteiten nodig kunnen achten om misbruik te voorkomen.

Artikel5

Wanneer de contractuele personeelsleden bedoeld in artikel 1 van deze Overeenkomst, die werden gelijkgesteld met leden van bet burgerlijk element hun functie in Belgie opnemen, genieten ze de voorrechten en immuniteiten die worden toegekend aan de leden van bet burgerlijk element krachtens bet Navo Status-Verdrag, bet Procotol van Parijs en de Overeenkomst Belgie-SHAPE volgens dezelfde modaliteiten en voorwaarden als die welke van toepassing zijn op bet burgerlijk element.

Artikel6

Deze Overeenkomst zal in werking treden op de dag van de laatste schriftelijke kennisgeving waarmee de Partijen elkaar langs diplomatieke weg meedelen dat aan al hun nationale procedures voor de inwerkingtreding van deze Overeenkomst is voldaan.

Artikel7

Elke Verdragsluitende Partij kan een voorstel tot wijziging van deze Overeenkomst sturen naar de andere Verdragsluitende Partij. Deze Overeenkomst wordt bij schriftelijke wederzijdse instemming van de Verdragsluitende Partijen gewijzigd. Elke Overeenkomst tot wijziging die zo werd goedgekeurd treedt in werking op de dag van de laatste schriftelijke kennisgeving waarmee de Partijen elkaar langs diplomatieke weg meedelen dat aan al hun nationale procedures voor de inwerkingtreding van deze wijziging is voldaan.

Artikel8

Geschillen tussen de Verdragsluitende Partijen betreffende de uitlegging of de toepassing van deze Overeenkomst zal worden beslecht door middel van onderhandelingen tussen de Partijen.

Deze Overeenkomst is van onbepaalde duur. Elke Verdragsluitende Partij kan deze Overeenkomst opzeggen door middel van een schriftelijke kennisgeving aan de andere Partij langs diplomatieke weg.

De opzegging zal in werking treden zes maanden na de datum waarop de kennisgeving werd verstuurd.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd door hun respectieve regeringen, deze overeenkomst hebben ondertekend.
