PERFORMANCE WORK STATEMENT (PWS)
Aerial Services
Yakima Training Center, Washington
7 August 2019 13 August 2019
3 September 2019 Part 1
General Information
1 Purpose: The purpose of this Indefinite Delivery Indefinite Quantity (IDIQ) Single Award Task Order Contract (SATOC) is for the Contractor to provide Aerial Support Services (e.g., aerial spraying and aerial seeding) to the Joint Base Lewis-McChord Yakima Training Center (JBLM YTC) Directorate of Public Works (DPW) Environmental Division (ED) through application of Government provided herbicides and seed materials. The Government shall not exercise any supervision or control over the Contractor performing the services herein.
Background: JBLM YTC, DPW Yakima, Washington, is responsible for planning, management, and accomplishment of all facility operation and maintenance functions at the installation. This includes programs to aerially apply herbicides with rotary wing aircraft (helicopter) to accomplish maintenance of firebreaks and other block treatment sites, and to aerially apply grass and shrub seed mixes.
Objectives: Provide helicopter support necessary to apply Government furnished herbicides and seed materials at JBLM YTC.
Scope: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, supervision, and other items necessary to perform the aerial support as defined in this Performance Work Statement (PWS), except for those items specified as Government furnished property and services. The Contractor shall perform to the standards in this contract and in accordance with all applicable regulatory requirements.
Period of Service: The base period of service will be one (1) year from the date of Contract award. The Contract will include four (4) option periods (not-to-exceed one year each) in addition to the Base Period. The maximum value of the Contract's Base Period plus the four option periods is $989,000. Notwithstanding the above, the ordering period shall automatically end upon the termination of each year period unless the option is exercised for the next period of performance via contract modification. The expiration or termination of the ordering period shall not affect any order issued during the effective period of this agreement.
Service Contract Act Wage Decisions: Applicable wage determinations shall be updated at the Task Order level.
Required Insurance: The Contractor shall procure and manage during the entire period of performance under this contract the following minimum insurance and provide a copy to the COR within five business days after award of any Task Order:
Worker's Compensation and Employer's Liability Insurance. As legally required by the state wherein the work is being performed, employer's liability coverage of at least $100,000.00 shall be required, except in states with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers. If occupational diseases are not compensable under the Federal or State Workers' compensation and occupational disease statutes, they shall be covered under the employer's liability section of the insurance policy except when Contract operations are so commingled with a contractor's commercial operations that it would not be practical to require this coverage.
General Liability Insurance. Bodily injury liability insurance, in the minimum limits of $500,000 per occurrence, shall be required on the comprehensive form of policy; however, property damage liability insurance ordinarily shall not be required.
Automobile Liability Insurance. This insurance shall be required on the comprehensive form of policy and shall provide bodily injury liability and property damage liability covering the operation of all automobiles used in connection with the performance of the Contract. At least the minimum limits of $200,000 per person and $500,000 comprehensive coverage.
Aircraft public and passenger liability. When aircraft are used in connection with performing the Contract, the Contracting Officer shall require aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger liability, and $200,000 per occurrence for property damage. Coverage for passenger liability bodily injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.
Environmental Liability. If this Contract includes the transport, treatment, storage, or disposal of hazardous material waste the following coverage is required. The Contractor shall ensure the transporter and disposal facility have liability insurance if effect for claims arising out of the death or bodily injury and property damage from hazardous material/waste transport, treatment, storage and disposal, including vehicle liability and legal defense costs in the amount of $1,000,000.00 as evidenced by a certificate of insurance for General, Automobile, and Environmental Liability Coverage. Proof of this insurance shall be provided to the Contracting Officer.
General Information
Place of Performance: The work described in this PWS is to occur on JBLM YTC. Office locations for JBLM YTC staff are found at the Director of Public Works, Building 810, Yakima Training Center, Washington. JBLM YTC is approximately 327,000 acres of land. The terrain is undulating and dominated by four east-west parallel ridges, the Saddle Mountains, Manastash Ridge, Umtanum Ridge, and Yakima Ridge anticlines, which are part of the Yakima Fold Belt near the western edge of the Columbia River Plateau. Treatment areas will include drainage channels which can include steep and narrow flight pathways.
1.7.1.1 Terrain: The terrain at JBLM YTC is highly variable. It ranges from relatively flat valley bottoms to extremely rugged ridges flanked with steep lateral slopes that extend between ridge tops and valley bottoms.
Throughout all areas of the installation the terrain varies and includes very sharp and irregularly occurring undulating terrain. Firebreaks (linear features) occur throughout the installation on the full range of terrain features (e.g., ridge tops, valley bottoms and flanks of ridges). A common critical feature associated with such firebreaks includes sharp “Vee” shaped drainage bottoms with varying angles and slope distances that intersect firebreaks at varying locations (Note – these features are often very tightly confining in nature). The approach and departure angles at these sites are often oriented perpendicular to such steep slopes. Typical approach and departure angles into and out of such drainage crossings is also highly variable ranging from less than 20% to over 60%. Additional terrain conditions include firebreaks with short and tight turns immediately adjacent to steep terrain features, high voltage power lines that are either in close proximity or intersect firebreaks, public highways, and sites adjacent to the installation boundary. Tight turn areas necessitate hard and immediate starts, stops, and sharp changes of direction within very short distances. At sites near the installation boundary, applications must not result in any pesticides being applied to, or allowed to drift to off-post lands. While applying pesticides to the wide variety of sites on JBLM YTC, the Contractor shall conduct such treatments in full compliance with all operational constraints (e.g., maintain the required elevation above ground throughout all points along treatment routes/sites) to ensure even and consistent applications.
Quality Assurance: The Government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
Recognized Holidays: The Contractor is not required to perform duty on the following recognized holidays:
New Year’s Day Labor Day Martin Luther King Jr.’s Birthday Columbus Day President’s Day Veteran’s Day Memorial Day Thanksgiving Day Independence Day Christmas Day
Hours of Operation: Normal business hours for JBLM YTC staff is 0730 to 1600, Monday through Friday, except Federal holidays, or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. Work included in this performance work statement often requires extended hours of operation (e.g., begin or end work 2 to 3 hours early or late) to utilize optimum daily windows when climatic conditions are best suited for aerial application.
Extended hours are permissible for this contract, provided the contractor coordinates such extensions in advance with JBLM YTC staff. The contractor must at all times maintain an adequate workforce for uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons.
Security Requirements: The Contractor shall comply with the following Security, Antiterrorism, and Network access Training:
Anti-terrorism (AT) Level I Training. All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, controlled access areas, or require network access, shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. Upon request, the contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training by all employees and subcontractor personnel. AT Level I awareness training is available at the following website: http://jko.jten.mil/courses/atl1/launch.html; or it can be provided by the RA ATO in presentation form which will be documented via memorandum.

All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.
For Contractors who do not require CAC, but require access to a DoD facility or installation.
Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
iWATCH Training. The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager (PM), security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR No later than (NLT) 5 calendar days after the completion of the training.

At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.
Contracting Officer Representative: The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the contract and any resulting task order.
Quality Control and Operational Hazard/Safety Plans: The Contractor shall be responsible for quality control for the services provided under this contract. The Contractor shall provide any preexisting company Quality Control and/or Health/Safety plan.
Key Personnel: The functional personnel identified in this section are considered key personnel by the Government. Based on the level of effort required to meet performance objectives, the Contractor may assign more than one individual to a single Key Personnel functional role. The Contractor shall identify individual(s) assigned to each Key Personnel functional role and the individual(s) shall meet the experience and qualification requirements of this section: The following personnel are considered key personnel by the Government:
Contract Manager: The Contractor shall provide a contract manager who shall be responsible for the performance of each task order. The name of this person and an alternate who shall act for the Contractor when the manager is absent shall be designated in writing to the Contracting Officer. The contract manager or alternate shall have full authority to act for the Contractor on all contract matters relating to execution of each task order. The contract manager or alternate shall be available between 0730 and 1600 during execution of task order services, Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons.

These documents and materials may not be used or sold by the Contractor without written permission from the Contracting Officer.
Payments and Supporting Documentation: The Contractor shall invoice the Government after completion of task order requirements. The invoice, including supporting documentation for work performed and a summary table of expenditures in accordance with the CLIN structure, shall be submitted not later than 30 days following completion of task order requirements. Submit the invoice and supporting documents electronically to the USACE PM and COR.
Operational Constraints: The following describes operational constraints that the contractor must work within to accomplish the work contained in this contract.
Sage Grouse Protection Areas: JBLM YTC contains habitat for Western Sage Grouse, a threatened species in the State of Washington. Areas designated for sage grouse protection are called Sage Grouse Protection Areas (SGPAs), and the areas may be partially or completely off limits between 01 February and 15 June. Partial restrictions include prohibition of occupying or working within SGPAs until after 9:00 a.m. JBLM YTC Public Works staff will coordinate access to these areas.
Identification of Persons or Root Gatherers: Native Americans gather root crops on JBLM YTC from plants that flower during the late winter through spring months. The Contractor shall cease treatment in the area if any persons, to include root gatherers, are encountered and shall inform the COR via daily report when this occurs (treatment may be shifted to other contract areas where gatherers are not present). Specific treatment areas may need to be scheduled around known root gathering activities and events. JBLM YTC Public Works staff will coordinate access to areas where root gatherers may be found.
Military Training Activities: The Contractor shall coordinate daily with Range Operations to ensure that spray operations do not conflict with military training activities during execution of task order requirements. Military maneuvers, live fire exercises, and bivouac activities shall be avoided. Occasionally, military activity will close a range area or access road outside of the established training area or range safety fan boundaries. A daily coordination meeting (Monday – Friday) occurs at Range Control to de-conflict the next day/weekend activities. The Contractor shall attend these meetings as needed to coordinate access to areas where military trainers may be conducting operations.
Restricted airspace: Aircraft pilots must follow JBLM YTC airspace entry procedure of contacting Range Control desk at 509-577-3280 to request permission prior to entering airspace, conducting radio/communication checks at an interval specified by the Range Operations Desk; and notifying the Range Operations Desk when exiting airspace.
Ground Support Daily Sign-In/Sign-Out: Daily sign-in/sign-out at JBLM YTC Range Operations is required of each contractor vehicle operator. Work crews are required to check in and out daily at the Range Operations desk at Building 1805. They will be issued a daily range pass and must return the pass upon exit from the range area each day. Non-compliance with sign in and sign out procedures will result in the offender(s) being permanently barred from the installation. Failure to comply with sign in and sign out procedures is a dangerous (i.e., life safety) safety violation, hence there is a zero tolerance policy for such non-compliance.
System calibration: The helicopter aircraft spray/seeding system shall be calibrated. (e.g., letter report submitted electronically) prior to beginning work on any Task Orders issued for this base contract.
Spray/Seeding Pattern testing: A minimum of one deposition pattern test shall be performed per helicopter aircraft annually prior to commencing spray/seeding operations. Deposition pattern tests shall be performed at JBLM YTC or at a nearby location agreed to by the COR. Additional pattern tests may be required if the initial test is inconclusive, has an unacceptable pattern (due to rotor wash, improper nozzle selection, etc.), or if the seeding equipment, spray boom or nozzles are reconfigured over the course of the spray operation. The spray/seeding pattern test shall be performed in the presence of the COR or JBLM YTC Quality Assurance Evaluator (QAE). The COR or QAE will be available to assist with conducting the test.
One letter report (e.g., submitted electronically) documenting the results of system calibration (1.17.6) and spray/seeding pattern testing (1.17.7) shall be provided to the COR at least one business day before beginning application of herbicides or seeding.
Method of Aerial Application of Herbicides and Seeding: Herbicides shall be applied by helicopter aircraft flying at an altitude not to exceed 15 feet above the ground level in order to minimize drift of the spray solution. Aerial seeding shall be at a safe altitude that provides for safe operations, and is consistent with elevation flown during calibration/pattern testing. Aerial equipment designed to minimize spray drift shall be used. Orientation of the spray nozzles shall be consistent with the herbicide label instructions for drift reduction. A flow control system shall be utilized to ensure even and uniform application of herbicides and seeding under varying air speeds.
Riparian areas: The contractor shall not apply herbicides any closer than within 200 feet of any open body of water. Riparian zones crossing firebreaks shall not be sprayed.
Aircraft operation: Spray operations shall commence only when the COR or JBLM YTC QAE is on site at JBLM YTC, to monitor and document all aerial application operations each day. The Government Representative will be available during daylight hours, seven (7) days a week until the project is complete.
The Contractor shall coordinate with the Government Representative regarding all installation access (ingress and egress to the installation), air space, and airfield use for the duration of each project.
Weather: Application of herbicide and seeding shall not occur when the soil is frozen or covered with snow, (except for sagebrush seeding which must occur on snow), when the wind velocity exceeds ten
(10) mph, when the ambient air temperature is below 36 degrees F or above 80 degrees F, or during temperature inversions. The Contractor shall not apply herbicide or seed if rain is expected within one hour.
The COR or KO may require the contractor to restrict spray or seeding operation if wind conditions below the above threshold causes excessive drift. In all cases, when applications are adjacent to the boundary, the prevailing wind shall be in a direction that ensures any drift is carried onto JBLM YTC lands.
Navigation and tracking: The Contractor shall use a real time GPS electronic swath navigation aid. The Contractor shall follow Government supplied Geographic Information System (GIS) guide files to apply herbicides and seed mixes. The files are guide files only. Application shall be to the ground feature indicated by the guide. Contractor shall ensure that only aircraft that are equipped with (and properly functioning) constant flow controls are used to apply herbicides (and similar flow control system for seeding) on JBLM YTC lands to ensure that application rates are correctly adjusted to compensate for changes in airspeed over uneven ground. The Contractor shall record (track) locations for “spray on” or “seed on”, and provide tracking information to the COR along with a complete electronic file of the areas treated within five business days following completion of work on each delivery order.
Communication: Aircraft pilot must be able to directly communicate at all times via headset with JBLM YTC Range Control Desk on FM 40.20, or cellular telephone, or with personnel on ground by radio.
The pilot and ground personnel must have programmable FM radio capability. Unscheduled landings and emergencies shall be immediately reported to Range Control. The radio frequency shall be monitored at all times for range activity that may affect the safety of the contractor crew. (Range schedules are subject to change). Cellular telephone communication shall be operational in the pilot headset. A civilian frequency aircraft radio shall also be operational in the pilot headset.
Material Handling: The Contractor shall adhere to all safety requirements as specified by Federal and State Laws, regulations and herbicide label requirements, as appropriate. Hazardous wastes and spilled materials generated in performance of the contract shall be the responsibility of the Contractor to be properly (legally) disposed of at an off post location. The Contractor shall be responsible for any disposal costs. The Contractor shall include a copy of all chemical Safety Data Sheets (SDS) and product labels for the products being applied in or on all vehicles being used to apply herbicides. Upon request by Government representative, the Contractor shall provide access to such documents at any time.
Spill Prevention: The Contractor shall maintain a spill kit on each mix truck used in support of this contract. Contents of the spill kit shall be appropriate for the type and volume of material that could potentially spill during mixing and loading operations.
Cleanup: Any refuse generated in the performance of this contract shall be disposed of by the Contractor in an approved disposal site off the installation. All spills of herbicide shall be immediately reported to the on-site JBLM YTC inspector and affected soils shall be immediately excavated and disposed of by the Contractor at an approved disposal site off the installation. The Contractor shall incur all costs associated with cleanup. Disposal of containers for chemicals supplied by the Government will be disposed by the Contractor at an appropriate off-post location.

PART 3
GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES
3 GOVERNMENT FURNISHED ITEMS AND SERVICES:
Utilities: Water from designated locations on the installation. Use of such water shall be in accordance with the following.
Use of Government Furnished Water: Water supply points are located within reasonable travel distance of areas where aerial application will occur under the terms of this base contract. Many of these fill points are potable water quality, and every effort must be made to avoid contamination of these facilities by herbicides. If a clean (uncontaminated) nurse tank is not installed and utilized on each mix truck or spray vehicle, then a separate vehicle with an uncontaminated nurse tank must be provided and used by the contractor at the water fill point locations. Direct filling of spray tanks (tanks that have been contaminated with herbicides) from these water sources shall not be permitted. An air gap of six (6) inches minimum must be maintained between the hose end at each water point and the tank top fill hole on the nurse tank. Mixing of chemicals shall not occur where spills can drain to, or storm water may flush chemicals to, the water fill point or well source.
Within the above use guidelines, these water sources will be available for use by the contractor. Any failure to comply with the above requirements will result in the contractor obtaining water from an off-post water source at contractor expense. Water furnished is delivered at an estimated 110 gallons per minute (GPM) at approximately 60 psi pressure.
Materials: The Government will provide all seed materials, seed carriers/additives (e.g., rice hulls), herbicides, surfactants, and adjuvants that are to be applied to designated sites on JBLM YTC prior to execution of task order requirements. Delivery of materials will be made at JBLM YTC or to a local, off-site location. The Government will also determine the amount of each product to be applied on a per unit basis (e.g., ounces, pints, quarts, gallons, or pounds of product and gallons of water to be applied per acre). The Contractor shall comply with all label requirements pertaining to the amount of diluents (e.g., gallons of water per acre) to be applied for each herbicide. Examples of herbicides that may be applied include, but is not limited to Frequency®, Piper®, 2,4-D, Dicamba®, and Glyphosate.
Guide Files: The Government will provide electronic guide files to the Contractor for areas where treatments are to occur. Format of such guide files will be ArcGIS® Shape files.
PART 4
CONTRACTOR FURNISHED ITEMS AND SERVICES
4 CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:
General: Except as described in Part 3 of this PWS, the Contractor shall furnish all labor, facilities, vehicles, equipment, fuel, and services to accomplish all work in this contract. The Contractor shall repair or replace at its expense any Government property which has been damaged or destroyed as a consequence of its performance of work under this contract.
4.2 Vehicles and Equipment: The Contractor shall provide to the COR a list of vehicles and equipment that will be accessing JBLM YTC to execute work against this contract. In addition, the Contractor shall ensure that all vehicles are properly licensed, registered, insured, and proof of such is carried in each vehicle at all times. Contractor employees entering post in privately-owned vehicles shall also provide information to the COR to register those vehicles prior to entering JBLM YTC. Copies of contract documents, proof of Liability Insurance, state vehicle registration, and a current REAL ID driver’s license are required for access to JBLM YTC. The Contractor shall provide and maintain vehicles and equipment required to fulfill the terms of the contract. Vehicles and equipment shall be in operable condition and meet all Federal, State, and local safety requirements. The Contractor shall immediately remove from service and JBLM YTC, any non-acceptable vehicles and equipment identified as not meeting the above safety requirements. Repair or replacement of contractor-furnished vehicles and equipment shall be at Contractor's expense.
The Contractor shall not utilize Government property or Government equipment to perform maintenance or repair on Contractor-furnished vehicles or equipment unless authorized in writing by the Contracting Officer. In the event a Contractor-furnished vehicle becomes inoperable and cannot be repaired within 48 hours, the vehicle shall be removed from JBLM YTC at the Contractor’s expense. If the vehicle is not removed within the designated time frame, the Government may have the vehicle removed at the Contractor’s expense. No secure storage location is available for Contractor supplied equipment. Contractor supplied vehicles may be left on the job site provided equipment does not block roadways. The Government is not responsible for any theft or damage that may occur as a result.
4.2.1 Aerial Herbicide Application Equipment Requirements: The Contractor shall ensure that all aerial equipment applying herbicides on JBLM YTC lands are equipped with constant volume flow controls to ensure uniform application at varying air speeds. Each aircraft shall be equipped with GPS guidance and “spray-on” tracking and recording capability. See paragraph 1.17 for additional details about herbicide/seeding application equipment requirements.
4.2.2 Identification of Vehicles and Equipment: The Contractor shall maintain legible markings (logo) located on both sides of all contractor-furnished vehicles and equipment, which shall include, as a minimum, the Contractor's name, the Contractor's local telephone number, and contractor assigned vehicle identification number. Markings shall be large enough to be read at 20 feet by a person with 20/20 vision.
4.2.3 Vehicle and Equipment Contamination Signage: The Contractor shall maintain signage on all vehicles and equipment (e.g., mix trucks, batch tanks, and spray tank on helicopter) used for the mixing and application of herbicides denoting that they are contaminated with herbicides. Suggested verbiage for such signage is: “Vehicle Contaminated With Herbicides”. Lettering shall be large enough to be read at 20 feet by a person with 20/20 vision.
4.2.4 Aerial Seeding Application Equipment Requirements: Seeding Equipment shall consist of suitable tanks/buckets for carrying seed with a distribution mechanism complete with release, shutoff, and spreading device which can be calibrated for spreading seed at the required pure live seed (PLS) lbs per acre rate in a uniform pattern across all treatment sites. Seed hoppers or buckets shall include lids which fasten securely to prevent seed from blowing out during operation. Sagebrush seed in particular presents unique problems due to its bulkiness and tendency to bridge in the seed tank/bucket. In addition, it is anticipated that a majority of the sagebrush seed will have a high moisture content which causes seed to compact, clump, and bridge even more severely. Therefore, seed tanks/buckets shall include an appropriate agitation system to prevent the seed from bridging in the tank/bucket to allow for continuous flow of seed for even distribution.
4. 3 Tools and Personal Protective Clothing: The Contractor shall provide all tools and clothing (including personal protective clothing and equipment for contractor employees when required by OSHA regulations and product labels) required to meet the terms of the contract.
4.4. Personnel: All contractor personnel shall possess a valid operator’s license appropriate for the work being performed and equipment being used.
