Far 52.204-4 - Printed or Copied Double-Sided on Postconsumer Fiber Content Paper (May 2011) (b) The Contractor is asked to submit paper documents, such as offers, letters, or reports that are printed or copied double-sided on paper containing at least 30 percent postconsumer fiber, whenever practicable, when not using electronic commerce methods to submit information or data to the Government.

10. ATTENTION: Due to heightened security, the method of Hand Delivery has changed and takes longer than the previous method of arriving at the Federal Center South building lobby to deliver your Offer, Bid or Proposal.

Please allow sufficient time to allow for heightened security at Government installations and to get to Building #1202. Allow time to park, pass through a metal detector, sign in, and receive a building pass at the Federal Center South Building. From there, you will be directed to the USACE Oxbow Building (#1202) which sits behind the Federal Center South Building. Allow additional time.

Report to the Security Desk in the lobby of the USACE Oxbow Building (#1202) and call Sonia Frees, Procurement Technician, at 206-764-3516. A Contracting representative will come down and accept your Offer, Bid or Proposal.

A proposal is not received by the Government until it is in the physical possession of a representative of the Contracting office. Security guards and other non-contracting personnel are NOT authorized to accept proposals on behalf of the Government. Note that official receipt of a proposal shall be in accordance with FAR 52.215-1.

Note: If delivery is by any means other than Hand Delivery, please check prior to the due date and time to ensure that your Offer, Bid, or Proposal has arrived on time.

11. IMPORTANT NOTE FOR OTHER THAN U.S. SMALL BUSINESSES ONLY:

Small Business Sub-Contracting Plan is Required: Please see FAR Clause 52.219-9. In accordance with FAR 19.702(a)(1), the offeror selected for award shall submit a sub-contracting plan to be eligible for award. The sub-contracting plan does not need to be submitted with your offer, but is required to be completed prior to award. If the selected offeror fails to submit a plan, the offeror will be ineligible for award. 52.216-1 TYPE OF CONTRACT (APR 1984)

The Government contemplates award of a firm fixed price contract resulting from this solicitation.

52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS--SECONDARY SITE OF THE WORK (MAY

2014)

(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements,of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

52.225-12 NOTICE OF BUY AMERICAN REQUIREMENT-- CONSTRUCTION MATERIALS UNDER

TRADE AGREEMENTS (MAY 2014)

(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “designated country construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American -- Construction Materials Under Trade Agreements” (Federal Acquisition Regulation (FAR) clause 52.225-11).

(b) Requests for determination of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of FAR clause 52.225-11 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction materials, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(4)(i) of FAR clause 52.225-11.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers. (1) When an offer includes foreign construction material, other than designated country construction material, that is not listed by the Government in this solicitation in paragraph (b)(3) of FAR clause 52.225-11, the offeror also may submit an alternate offer based on use of equivalent domestic or designated country construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of FAR clause 52.225-11 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of FAR clause 52.225-11 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic or designated country construction material, and the offeror shall be required to furnish such domestic or designated country construction material. An offer based on use of the foreign construction material for which an exception was requested-- (i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.

The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000.00, whichever is less.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

52.233-2 SERVICE OF PROTEST (SEP 2006)

(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from:

(b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO.

Upon request, the Contracting Officer will make their full text available. 1.0 GENERAL INFORMATION

1.1 GENERAL DESCRIPTION OF WORK:

The scope of project includes all work required for the construction of Tactical Response Force Alert Facility at Malmstrom AFB, MT.

The work shall be in accordance with Request for Proposal documents.

General description of work:

The USACE Seattle District has a requirement for the construction of a 3,839 square meter (SM) (41,312 square feet) for a Tactical Alert Force Facility (TRF) with an 809 square meter (SM) space for a flight simulator.

Supporting facilities include pavements, utilities, and site improvements. The purpose of the newly constructed TRF is to provide an adequately sized and configured facility that will co-locate squadron operations facility and the sleeping quarters of the alert crew with aircraft to minimize crew response times for 24-hour a day/7-days per week/365 days per year readiness. The facility will support planning, briefing, administration, alert response, life support, maintenance, and crew equipment storage and issue tasks.

1.2 MAGNITUDE OF CONSTRUCTION:

In accordance with DFARS 236.204, Disclosure of Magnitude of Construction Projects, the Magnitude of Construction is between $10,000,000.00 and $25,000,000.00.

1.3 SUBJECT TO AVAILABILITY OF FUNDS:

FAR Clause 52.232-18 “Availability of Funds,” (APR 1984) Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.

1.4 GOVERNMENT SECURITY REQUIREMENTS:

The Offeror(s) must ensure that ALL mail sent to the Seattle District, U.S. Army Corps of Engineers, either pre-contract or post-contract award, has a return mailing address on the outside of the envelope, package, box, etc. ANY MAIL addressed to the U.S. Army Corps of Engineers, including but not limited to; bids, modifications to bids, proposals, revised proposals, bonds, correspondence, etc., will be REJECTED by the US Army Corps of Engineers mail room facility located in Building 1202, at 4735 East Marginal Way South, Seattle, WA 98134 if it does not contain a return mailing address. PROPOSAL SUBMISSION REQUIREMENTS EVALUATION CRITERIA AND BASIS OF AWARD

ONE STEP - -TRADE-OFF PROCUREMENT, DESIGN BID BUILD (SINGLE AWARD)

1. EVALUATION PROCEDURES:

The objective of this evaluation is to evaluate the proposals in accordance with the criteria described herein and award a firm fixed price construction contract to the responsible Offeror whose proposal conforms to the terms and conditions of the solicitation and whose proposal is determined to represent the overall “Best Value Trade-off” to the Government. All evaluation factors, other than price, when combined, are considered significantly more important than the price. After the Government individually evaluates and rates each proposal, the Government will compare proposals to determine which proposal represents the best value. The Government reserves the right to accept other than the lowest priced offer or to reject all offers. If there is a lower priced, conforming offer(s), the Government must determine that the added value of a more expensive proposal would justify award to that Offeror.

The Offeror’s proposal shall contain a response to all Factors (Company Experience, Past Performance, Management, Small Business, and Price); shall be in the form prescribed herein; and shall meet the minimum submittal requirements stated.

In accordance with FAR 15.306(a)(3) the Government intends to evaluate proposals and make award without discussions. An Offeror’s initial proposal should contain the Offeror’s best terms from a technical and price standpoint. The Government reserves the right to accept other than the lowest priced offer or to reject all offers.

The Government will not award a contract to an Offeror whose proposal contains a deficiency, as defined in FAR

15.0001. Penalty for making false statements in proposals is prescribed in 18 U.S.C. 1001.

As part of the evaluation, the Government will evaluate betterments in proposals relative to the minimum standards in the solicitation to determine if they offer additional value to the Government. In addition, innovations in proposals will be evaluated to determine if creative ideas of the Offeror are a better value to the Government compared to the minimum criteria.

Submit proposals in tabbed, three-ring binders. Note that the Government will not evaluate any material that exceeds the page limits, where indicated below.

2. DEFINITIONS:

Deficiency: A material failure of a proposal to meet a Government requirement or a combination of weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.

Relevant: “Relevant” means having a logical connection with the requirements in this solicitation; that is, featuring work that involved similar scope, magnitude of effort, and complexity to the current requirement.

Risk: The potential for unsuccessful contract performance. The consideration of risk assesses the degree to which an Offeror’s proposed approach to achieving the technical factor or criterion may involve risk of disruption of schedule, increased cost or degradation of performance, the need for increased Government oversight, and the likelihood of unsuccessful contract performance.

Shall: Indicates mandatory solicitation requirements. If not included in the Offeror’s proposal the proposal may be deemed to not meet solicitation requirements and may be rejected.

Should: Indicates solicitation requirements that are highly recommended to be included in the Offeror’s proposal.

Significant Strength: An aspect of an Offeror's proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.

Significant Weakness: A flaw in the proposal that appreciably increases the risk of unsuccessful contract performance.

Strength: An aspect of a proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.

Team: The Offeror’s “team” is the Key Personnel and any subcontracting firms, taken as a whole.

Weakness: A flaw in the proposal that increases the risk of unsuccessful contract performance.

3. TECHNICAL MERIT RATINGS:

The technical rating reflects the degree to which the proposed approach meets, or does not meet, the minimum performance or capability requirements through an assessment of the strengths, weaknesses, deficiencies, and risks of a proposal. Proposals will receive ratings in accordance with the adjectival descriptions below. The combined technical/risk rating includes consideration of risk in conjunction with the strengths, weaknesses, and deficiencies.

Combined technical/risk evaluations shall utilize the combined technical/risk ratings listed in Table 1 below.

Marginal

Proposal does not clearly meet requirements and has not clearly demonstrated adequate approach and understanding of the requirements. The proposal has one or more weaknesses that are not offset by strengths. Risk of unsuccessful performance is high.

Unacceptable Proposal does not meet requirements and contains one or more deficiencies. Proposal is non-awardable.

The basis of contract award will be the Tradeoff Process in accordance with Federal Acquisition Regulation (FAR) 15.101-1. Award will be made to the Offeror whose proposal is most advantageous to the Government based upon an integrated assessment of evaluation Factors described below. 5.0 FACTOR 1 (TAB A) – COMPANY EXPERIENCE

5.1 SUBMISSION REQUIREMENTS:

For this Factor, the Offeror shall submit six (6) projects using Attachment 1 (no more than one (1) form for each project), Offeror or Key Subcontractor Experience Form, or using no more than three (3) type written pages for each project (minimum 10 point font and double spaced) that include at a minimum the same information as Attachment

1. Offeror should describe each project with enough detail to ensure that the Government can meaningfully assess whether the projects submitted are recent and relevant to this project. If more than six (6) projects are submitted, only the first six will be evaluated, starting with the most recent and working backwards in time. If submitting a project performed by a Key Subcontractor Attachment 2, Letter of Commitment for Key Subcontractor, shall also be provided.

Submitted projects shall be at least 100% construction progress completed and accepted by the client or have been completed within seven (7) years of the date this RFP was issued. Four (4) of the six (6) projects shall have been performed by the Offeror acting as the Prime Contractor. The other two (2) may have been performed by the Offeror acting as a Subcontractor or performed by a Key Subcontractor. Submit projects with characteristics matching the following, all are of equal importance:

1. At least one (1) project should be construction of a new Military Operations Facility valued over (>)

$10M on a Military Installation where the Offeror was the general/prime contractor.

2. At least one (1) project should be construction of a Risk Category IV facility valued over (>) $5M where the Offeror was the general/prime contractor.

3. At least one (1) project shall be construction of a facility valued over (>) $10M that required Building Information Modeling (BIM), the Offeror shall have been the general/prime contractor.

4. At least one (1) project should be construction of a facility that required Construction Operations Building Information Exchange (COBIE) Deliverables where the Offeror was the general/prime contractor.

5. At least one (1) project shall be construction of a facility valued over $10M in a Similar Geographic Location, the Offeror shall have been the general/prime contractor.

6. At least one (1) project shall be construction of a facility valued over $5M that included a Concrete Grade Beam Supported by Drilled Concrete Pier Foundation.

For the purposed of this project, the following definitions will apply:

1. Military Operations Facility: A facility such as or similar to a “Security Forces Facility,” “Air Operations Center,” “Joint Operations Center” and/or “Tactical Operations Center.”

2. Risk Category IV Facility: Experience constructing a Risk Category IV or higher facility as defined by the International Building Code 2015 Table 1604.5 or UFC 3-301-01 Table 2-2 Risk Category of Buildings and Other Structures.

3. Building Information Modeling (BIM): Experience constructing a facility that required BIM modeling, coordinating and resolving conflicts in the work prior to fabrication and installation of the work similar to the requirements of Specification Sections 01 78 25 of this solicitation.

4. Construction Operations Building Information Exchange (COBIE): Experience constructing a facility that required COBIE deliverables similar to the requirements of Specification Sections 01 79 00 of this solicitation.
