About this file
This is Amendment 04 to solicitation W912DS24B0015 for the Spring Creek North Ecosystem Restoration Project in Queens & Brooklyn, New York, issued by the US Army Corps of Engineers New York District. The amendment makes several changes to drawings and specifications, including revisions to multiple drawings (LP-100 through LP-108, GC-100 through GC-108, GC-401, GC-501, GC-601, and CG-101 through CG-108) and specifications sections (01 20 00, 31 00 00, 31 00 10, and 32 93 00).
The amendment provides responses to 37 bidder inquiries covering topics such as material specifications, disposal requirements, planting maintenance, thin layer placement methods, and herbicide application requirements. Key clarifications include: all excavated materials are to remain on-site and be reused pursuant to Part 360.12(c)(1)(iv)(a); asphalt is to be scarified and covered with fill rather than removed; and plant maintenance must occur weekly during construction. The bid opening date has been extended to January 16, 2024, with bidder inquiries accepted through December 20th. The amendment also clarifies that no pre-bid site visit will be permitted, and drone flights over the project area during bidding are not allowed.

BIDDER’S QUESTIONS AND GOVERNMENT REPLY
(Questions that may be of general interest to all Bidders and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s).
Questions and answers are issued to the bidders “For Information Only” and do not revise the solicitation, plans or specifications.)
Bidder Inquiry 06 from Amendment 0001: Will there be a Pre-Bid onsite meeting or conference for this project?
Revised Government Response: Yes. No.
Bidder Inquiry 01: Can you please provide job descriptions for the Biologist, Environmental Engineer, and Wetland Scientist that are called out in the CQC Personnel?
Government Response: Refer to 01 45 00 3.4.3 Experience Matrix table for job qualifications.
Bidder Inquiry 02: Can you please provide as-built drawings and information of the existing utilities and crossings for the temporary bridges?
Government Response: Refer to the V-series for existing utility information.
Bidder Inquiry 03: For the thin layer fill, can the contractor choose to do the whole area by mechanical means, and not use the hydraulic methods?
Government Response: No, refer to 35 20 24 for Thin Layer Placement requirements.
Bidder Inquiry 04: Does USACE know which areas will generate the contaminated soil?
Government Response: All areas proposed for excavation are anticipated to generate material suitable for on-site reuse pursuant to Part 360.12(c)(1)(iv)(a).
Bidder Inquiry 05: The specifications are conflicting as to whether we are to haul off and dispose of the contaminated soil. Is it USACE’s intent to dispose of the contaminated soil, or bury it onsite?
Government Response: The contaminated material, also referred to as historic fill on the plans, will be relocated to the upland placement areas and capped with clean material as detailed on the CG Series.
Bidder Inquiry 06: Will there be an organized site visit scheduled for this project?
Government Response: Not during the bidding phase.
Bidder Inquiry 07: We are wondering if there is any volume calcs on how much total excavation and tons of disposal on this project.
Government Response: Refer to CG-401 for Cut Fill overview.
Bidder Inquiry 08: Please consider a 2-week extension for the bid due date to allow more time to evaluate the answers to questions a make sound plan for a complex project.
Government Response: The bid opening has been extended to January 16th, 2025.
Bidder Inquiry 09: Detail 3 for the tidal water control structure calls for 12 each 18” corrugated pipes to be installed. Can you provide a length and material spec for this material? Can you confirm that this is to be paid as 1 Lump Sum under payment item 6?
Government Response: Provide HDPE pipe and a minimum length of 10’. Confirmed this is to be paid under bid item #6.
Bidder Inquiry 10: Detail 2 – Channel Block Detail shown on drawing GC-503. Can you confirm that these are to paid as part of bid item 9 - Channel Modification & Stabilization Channel Blocks; Channel Grading; Earthwork;
Shoreline Stabilization?
Government Response: Confirmed, channel blocks are to be paid as part of bid item #9.
Bidder Inquiry 11: There is dredging called out in Ralphs Creek. The cross section for Ralphs Creek shows a cut from approximately station 90+50 – 40+50. Can you clarify if this is indeed the only section of the project to be dredged? Can you confirm that this dredge material is to be taken to the upland area and left on-site or is the material to be used to fill in other areas of the marsh. If we can use for fill material in the marsh can you specify the location?
Government Response: The extents of earthwork within the channel are best illustrated on CG-201 - Channel Profiles Sheet 1. There is excavation within the channel between stations 1+75 and 2+50 and also between stations 4+50 and 9+50. There are segments of existing channels that are proposed to be filled, shown on CG-106, behind the proposed channel blocks. It was envisioned that the material excavated from the primary channel would be used to fill those channels to avoid the need to haul material in/out of the primary channel.
Bidder Inquiry 12: Note 5 on drawing CG-101 requires 2 weeks of tidal flushing and then re-grade. How are we to quantify the volume of sand that will need to be re-graded? Is this a one time event or will the 2 week tidal flushing need to be re-valuated after each re-grade?
Government Response: See updated Note 5 on CG-101.
Bidder Inquiry 13: Spec Section 01 20 00 – Price and Payment. 1.2 speaks to unit price payment items. The bid/bid item schedule currently does not have any unit prices, Everything is Lump Sum. Can you clarify how unit prices would apply? If there are no unit pricing items based on owners quantities are we to assume that a quantity underrun/overrun is the risk of the contractor? Item/Bid item 5 “Earthwork - Clean Material Import & Placement for Wetlands. Sand Import; Clean Sand Placement (Wetland Conversion Areas); Thin Layer Place (Wetland Restoration Areas); Wetland Access Matting has a quantity of 1 LS. Is contractor at risk for any additional material not shown in the plans or is the owners intent to create unit price payment items after award? There are items like dredging and capping that are based off quantities shown in the plans. If the dredge quantity shown in 1,000 CY and it ends up being 2,000 CY with the contractor receive additional compensation?
Government Response: All bid items have a bid unit of JOB as detailed in the bid schedule. The contractor is responsible for meeting final acceptance as required per 01 45 00. If there are deviations in the field conditions that were not reflected in the contract documents a modification will be required. See updated specification section 01 20 00.
Bidder Inquiry 14: 01 20 00 1.2.1 speaks to “Cost Share Activities”, Can you further define “Sharing?” Is contractor responsible for all cost or are there certain items that the owner is sharing cost? Can you define how this would work?
Government Response: Cost share activities refer to items paid by the government and sponsor.
Contractor is responsible for all costs associated with the contract documents.
Bidder Inquiry 15: What are the minority participation requirements for the project?
Government Response: See FAR Provision 52.222-23 on Pg.35 of 68.
Bidder Inquiry 16: Can you provide CAD files for the project for the earthwork?
Government Response: No, refer to the contract documents for earthwork details. CAD drawings can be requested after award, refer to specification section 01 78 00 1.3 for details.
Bidder Inquiry 17: Spec Section 31 00 00 1.2.3 Clean Cap Material Import states that “Payment for the above item shall be based on the delivery slips.” Currently the bid item for performance of this work is one lump sum. Can you clarify how the contractor will be paid by the Unit (ton) when the bid item is a lump sum item? Can we assume that estimate shall be based on thin layer placement volume show in table on plan sheet CG-401?
Government Response: See the updated specification language for section 31 00 00.
Bidder Inquiry 18: Will the Contractor be allowed to fly a drone over the project during the bidding process?
Government Response: No this will not be permitted.
Bidder Inquiry 19: Plant schedule calls for 182 Rhus Typhina Staghorn Sumac’s at sizes 10 gal, 3 - 3.5 cal & 4 –
4.5 cal. This species is not readily available at these sizes. Please provide standard industry sizes for this species.
Government Response: The COR will review and approve appropriate substitutions in species and/or size class, as needed.
Bidder Inquiry 20: Specification section 31 00 10 states in subsection 2.1.3 that the NYC Soil recycle facility will provide the clean sand and clean sandy loam material for free pending availability. How much material should we assume is available for bid leveling purposes?
Government Response: Assume no material is available.
Bidder Inquiry 21: The stormwater BMP Seed says it will be "agency procured". Can you please clarify if the entire scope is done by the agency or only the material will be provided for the contractor to install?
Government Response: The material will be provided for the contractor to install. The contractor is responsible for transporting the material from the Parks facility at Greenbelt Native Plant Center, 3808 Victory Blvd. Staten Island, NY 10314 to the Site.
Bidder Inquiry 22: Thin Layer Placement is a very specialized application of material. No placement contractors were listed in the specifications. Could the Army Corp please provide a list of contractors that might be willing to perform this work, as there are no local companies with this experience.
Government Response: No, the government cannot specify a placement contractor.
Bidder Inquiry 23: Specification 02 61 13, section 3.9 DISPOSAL REQUIREMENTS states "All excavated materials shall remain on site and shall not be exported. " Please clarify if all excavated materials are to remain onsite and be turned over the Government, or are to be temporarily stored on-site, tested, and then properly disposed.
Government Response: All excavated materials are anticipated to be suitable for on-site reuse pursuant to Part 360.12(c)(1)(iv)(a).
Bidder Inquiry 24: Specification 31 00 00, Section 1.2 MEASUREMENT PROCEDURES, lists various pay items for excavated material. None of these pay items are included in the Bid Form in the Invitation to Bid. Please clarify.
Government Response: See updated Specification 31 00 00.
Bidder Inquiry 25: Specification 31 00 10, CLEAN SAND, IMPORTED, section 1.2 states "The Contractor shall expect substantial loss due to settlement and soft substrate conditions. The Contractor will receive no additional compensation for such conditions as the clean sand quantities will be measured in-place after settlement."
a. What is the time limit for the final measurement to determine the in-place quantities?
b. How much settlement is anticipated?
c. Will the Contractor have to wait for payment until in-place quantities can be surveyed?
Government Response: (a) A minimum of 2 weeks of tidal flushing until grading has been met and a maximum of 2 rounds of hand grading (See Bidder Inquiry #12).
(b) Bidder should make their own estimate/calculation for additional volume needed for settlement. Note, settlement is not a concern within the upland areas or the wetland conversion areas. Settlement is proportional to the thickness/depth of the fill placed.
Therefore, the bidder should expect settlement in the areas of Thin Layer Placement with the greatest settlement in the tidal channels that are to be filled.
(c) Interim payments will be made based on % complete progress. Furthermore, the contractor will be paid the job price to meet final grades as shown in the plans.
Bidder Inquiry 26: The “Pavement Scarifying” in the two lots on the northwest side of the project, is it to be assumed the millings are to be left in place or disposed of?
Government Response: Refer to specification section 02 41 00 1.3.1.3 Scarification.
Bidder Inquiry 27: Amendment #1, Bidder Inquiry #6, mentions that there will be a pre-bid meeting/walkthrough, but we cannot locate any information on the date or time of the walkthrough. Please clarify.
Government Response: Please see above revised Government Response to Bidder Inquiry 06 from Amendment 0001.
Bidder Inquiry 28: We request a three (3) week extension of the bid date.
Government Response: Bid opening is extended to 16 January 2025.
Bidder Inquiry 29: There are some areas that require invasives removal and planting where no heavy earthwork is being performed? Is it to be assumed that the new plants will be placed amongst the mowed and sprayed root system of the invasives?
Government Response: Yes, to both inquiries.
Bidder Inquiry 30: Can you please break up the planting lists into the optional and base contract?
Government Response: Bidder should utilize acreage, plant spacing and planting list to calculate the take offs for trees and shrubs for both the base and option.
Bidder Inquiry 31: Does the herbicide applicator really need a 6A license? What are the right away concerns for this project?
Government Response: Refer to Section 31 11 00. The applications and certifications are required based on the type of work outlined. We are not aware of any applications needed in a Right of Way. Category 6a was acknowledged due to the presence of underground utilities that pass through the site. We defer to the applicator for the appropriate credentials.
Bidder Inquiry 32: Please confirm the cut and spray means and methods do not require their own specification section and the clear and grub spec should be followed.
Government Response: Correct. Confirmed. Please refer to Section 31 11 00 Clearing and Grubbing Specification which includes all methods of invasives removal. Note that the area hatched as Invasive Species Removal - Cut and Spray on the CD series plans should follow the Invasive Removal - Cut Stump Method summarized in 31 11 00, Part 3. Similarly, the Invasive Species Removal - Mowing hatch should follow the Invasive Species Removal - Repeat Mow and Spray Method.
Bidder Inquiry 33: Can you please clarify the maintenance for the plantings? Is it weekly until final acceptance? Or is it weekly only during construction, and then as needed until final acceptance?
Government Response: Maintenance of plants must occur weekly during construction. Mechanical weed removal and seasonal spraying occurs as necessary during the plant guarantee period until final acceptance. Refer to updated Section 32 93 00, 3.6.4 for Maintenance.
Bidder Inquiry 34: Is the intent for the Optional – Additional Insurance CLIN to be for any costs associated with the work for the Optional CLINS and not to be included in the other Optional CLIN items?
Government Response: The Optional additional insurance included in 1.2.3.3 Section 01 20 00, is a separate Option and is not ONLY associated with Optional -Non-Federal Enhancement Activities. The insurance applies to all activities.
Bidder Inquiry 35: Amendment No. 1 has a “DRAFT” watermark on it. As this needs to be signed and acknowledged can you please provide one without the watermark?
Government Response: Contractors can provide amendment acknowledgements on block 18 located on page 2 of the Solicitation (SF 1442).
Bidder Inquiry 36: The specs are unclear as to whether the asphalt is to be scarified and removed or scarified and covered with fill. Is it the USACE’s intent to fill over the scarified asphalt, or is the scarification a strategy for demolition and removal?
Government Response: The asphalt is to be scarified and covered with fill. Refer to specification section 02 41 00 1.3.1.3 Scarification which indicates the “scarification shall be conducted to a depth of 6 inches and create a ridge in the pavement surface and not create any pavement millings or surplus materials for disposal.”
Bidder Inquiry 37: Based on the existing and final grade for the Thin Layer Placement area there are existing high spots that don’t meet the final grade? Will these areas have to be cut down and graded?
Government Response: Yes.
NOTE TO BIDDERS
All bids are due on January 16th, 2024, bidder inquires up to December 20th will be accepted.
