About this file
This document provides an amendment to a solicitation for the construction of erosion control features along the Atlantic Coast of New York City. The amendment extends the bid opening date to April 2, 2020, includes a question submission deadline of March 23, 2020, and revises the bid schedule, specifications, and drawings.
The original solicitation sought bids for a coastal storm risk reduction project including fourteen new stone groin structures, five groin rehabilitations, and related excavation and stone placement work. Revisions include updated quantities and pricing for tasks like stone sorting, disposal, and excavation across multiple groin sites. The work will be performed along Rockaway Beach between East Rockaway Inlet and Rockaway Inlet for the U.S. Army Corps of Engineers, New York District. The total project value is estimated between $100-250 million and will have a performance period of 1460 calendar days from notice to proceed.

AMENDMENT 0001
Questions and Answers:
The following questions and answers are provided for information only. Nothing contained below amends or revises any provision of the solicitation.
This is for bidder’s reference only, and is not to be considered as a part of the Contract Documents.
Contract award will be based on what is contained in the printed Plans and Specifications in a hard copy format or Electronic Bid Set if provided and as posted in the FBO.
RFI SET #1:
Question #1: Referencing the drawing package, Drawing C-202, Note 1 states "Mixture of Armor Type A and B is allowed in the armor transition zone from EL. +8 to +5." The drawing shows the transition zone going as deep as EL -5. Please clarify the specification regarding the Transition Zone.
Answer #1: Yes, transition zone goes as deep as EL -5 on the crest, and also as deep as EL -10 on the side slopes (reference sheet C-303). Drawing C-202 Note 1 also states that the larger type A armor shall be used as transitioning seaward.
Question #2: Referencing the drawing package, Drawing C-101, Note 8, is excess sand to remain in stockpile, or removed from site and disposed.
Answer #2: Excess sand to remain in stockpile, then backfilled to pre-construction condition.
Question #3: Referencing the drawing package, Drawing C-217 groin profile, under the bedding stone at the seaward end, the bedding layer is higher than existing grade. Is the intend to add additional bedding stone to fill in this area, or level the sand out to achieve grade?
Answer #3: Additional bedding stone will fill the area.
Question #4: Referencing the drawing package, Drawing C-501, Note 3, is Each groin 300ft in length, or is that the combined length?
Answer #4: Total length of each groin is approximately 300ft in length.
Question #5: Referencing the drawing package, Drawing C-501, Note 2; Does "below design grade" mean below the bedding layer?
Answer #5: Yes, “below design grade” means below the bottom elevation of the bedding layer.
Question #6: Referencing the drawing package, Drawing C-501, Note 2; Does "landward of design grade" mean beyond the limits of the new groin on the landward side?
Answer #6: Yes.
Question #7: Referencing Section 00 90 05 Biological Opinion, 2.6, where are the specific limits for "Mid- Rockaway" and what does NNBF stand for? Also, what does HFFRRF stand for?
Answer #7: NNBF – Natural Nature Based Feature
HFFRRF – High Frequency Flooding Risk Reduction Features
These features are only located in the Jamaica Bay portion of the project and are not a part of the groin work.
The BO attached in section 00 90 05 is a reference document for section 01 57 19 par. 3.5, which highlights the contractor’s roles and responsibilities.
Question #8: Referencing Section 00 90 05 Biological Opinion, 3.5, is the Contractor or the Corps responsible for the seed collection and transplanting of Seabeach Amaranth? Referencing Section 01 57 19, 3.5.2, if transplanting or hiring a qualified greenhouse for germination is required, is this the responsibility of the Contractor or will the Owner perform this scope?
Answer #8: The Contractor is responsible for the seed collection and transplanting of Sea Beach Amaranth under the guidance and direction of the Corps. The contractor is responsible for hiring a qualified greenhouse if needed.
Question #9: Referencing Section 00 90 05 Biological Opinion, page 66, is the cost to attend the piping plover and seabeach amaranth training to be included in the bid price?
Answer #9: YES, the cost to watch the training video should be included in the bid cost, the Corps will provide a CD containing the information and the contractor will have their employees watch the 15 minute video. Here is the link to the video https://sandyhookfoundation.com/piping-plover/
Question #10: Referencing Section 01 22 00.00, Section 1.3.1, the section says both excavated sand and rock are payed by the CY per pre-and post-survey, however the bid form only has the sand shown as paid for by the CY, and the excavated rock by the ton. Further - If the bid form is correct and the rock is paid for by the ton when excavated, how will the client calculate the excavation area and determine how much sand versus rock is excavated based on pre/post survey, or how will they subtract the tonnage of stone from the total volume to calculate volume of sand?
Answer #10: Bid schedule was revised.
Question: #11: Referencing Section 01 57 19, 3.2.1, please confirm the contractor is to obtain a Construction General Permit.
Answer #11: Removed paragraphs 3.2.1, 3.2.1.1, 3.2.1.2, 3.2.1.3, 3.2.1.4, 3.2.1.5 from Section 01 57 19; contractor does not have to obtain a Construction General Permit.
Question: #12: Referencing Section 01 50 00, 3.6.1, is this Quality Field office to be separate from the Owner's resident engineer's field office? This office for the Owner's Quality Manager, or for the Contractor's Quality Manger with access given to the Owner's representative?
Answer #12: Yes, the quality field office is separate from the Owner's/USACE’s resident engineer's field office. This office is for the Contractor's quality manager with access given to the Owner's/USACE’s representative.
Question: #13: Referencing Section 01 45 00.00 10, 3.4.3, the language states that these specialized people are to be present at the site during work on the specialized personnel's areas of responsibility. It is not clear then for how long a wetland scientist, biologist, environmental Engineer, etc. would be required on site and for what specific purposes. Most contractors don't have people meeting these qualifications on their staff so please indicate the specific issue or reason for these people so we can determine the amount of involvement required should we need to hire consultants for this scope.
Answer #13: Wetland Scientist – to ensure protection of sensitive areas during construction or for access if contractor plans on working in environmentally sensitive areas.
Question: #14: Referencing Section 01 57 19, 3.5.1.1, the language says that we are to use the piping plover TOY restriction to also protect the red knot. Does this still mean that only the area from Beach 6th street to Beach 85 Street is closed to construction during March 21 - September 1? We can work there between September 2 - November 30 except for within 500 meters of a red knot and we can work the remainder of the project between March 21 - September 1, again, except for within 500 m of a red knot?
Answer #14: Yes, that is correct.
From March 21 to September 1 no work can occur between Beach 6th St and Beach 85th St.
These geographic boundaries include the 1,000 m buffer for piping plover breeding areas.
From March 21 to September 1 no work can occur within 1,000 m of any plover breeding area (throughout the entire project area).
A distance of 500 m of any red knot must be maintained between March 21 and November 30 throughout the entire project area.
Question: #15: Referencing Section 01 57 19, 3.5.1.1, 4), are the approved environmental monitors to be supplied by the Contractor? If so, we don't see any qualifications provided and can these be existing project staff people?
Answer #15: Yes, approved environmental monitors are to be supplied by the Contractor. The monitors must have experience with birding and have experience monitoring plovers and red knot.
Question: #16: Referencing Section 01 57 19, 3.5.1.1, 3), is the qualified project biologist referenced here to be supplied by the Contractor?
Answer #16: Yes, this is the bird biologist who will monitor for plovers and red knot.
RFI SET #2:
Question #1: Regarding Specification 00 90 00, which are the applicable wage rates to be used?
Answer #1: The applicable wage rates can be found in the SF1442 solicitation.
Question #4: Regarding Specification 01 45 00 00.10, would you be able to provide a list with approved testing laboratories in accordance with the USACE requirements?
Answer #4: For more information on laboratory validation visit https://mtc.erdc.dren.mil/
Question #5: Regarding Specification 35 31 29.40, the Percent lighter by Weight table under paragraphs 2.3.1, 2.3.2 and 2.3.3 shows 100 and 0 as respectively Extreme Upper (EUL) and Extreme Lower Limit (ELL). Industry standards normally are:
a. For Armor Stone - an ELL of <5% and EUL of >97%
b. For Core/Bedding Stone - an ELL of <2 to 5% and EUL of >97 to 98%
Could this be adapted to these limits?
Answer #5: Yes for armor stone and core/bedding EUL standards, but the ELL for core/bedding stone cannot be greater than 2%.
Question #6: Regarding Specification 35 31 29.40 – Under paragraphs 2.3.3, is it possible to have the passing requirements instead of the weight, as this bedding stone will probably be screened by the quarry?
Answer #6: No.
Question #7: Regarding Specification 35 31 29.40 – Paragraph 3.15.2 references that the survey needs to be conducted by a licensed surveyor. However, no methodology is specified. Is the contractor free to choose any method, such as prescribed in the CIRIA rock manual or similar industry standard?
Answer #7: Contractor may use the industry standard for survey methodology that is conducted by a licensed surveyor to ensure accuracy standard for construction requirements.
Question #8: Can the geotechnical information be provided?
Answer #8: There is no geotechnical information available in the footprint of the proposed groins.
Question #9: Can the wave action basin (mockup) test report and its results/conclusions be provided?
Answer #9: No.
Question #10: When do you anticipate NTP? Does the contractor assume that all permits which are the responsibility of the client are in place before NTP, or will they be obtained afterwards?
Answer #10: NTP is anticipated approximately 2 weeks after award, dependent upon the Contractor’s submissions of Bonds and Insurance. All permits that are the responsibility of the USACE will be in place before NTP.
Question #11: Could we have a more detailed table of stone quantities per breakwater? Especially the quantities on the recovery and reuse of the existing stone material, as different layers could require different types of equipment. If more details on the relocation quantities cannot be provided, please provide us with the as-builts or the original design drawings.
Answer #11: See attached for groin surveys; as-builts of the original design drawings are not available.
Question #12: Can you provide the latest bathymetric survey?
Answer #12: Yes, surveys are from 2018 as noted on plans, see attached xyz data.
Question #13: We respectfully request a one-week extension of the bid due date.
Answer #13: Bid due date is postponed to April 2, 2020.
RFI SET #3:
Question #1: Due to the size and complexity of the project, we respectfully request a 3-week bid extension to April 13, 2020.
Answer #1: Bid due date is postponed to April 2, 2020.
RFI SET #4:
Question #1: What is the final day to submit questions/requests for information?
Answer #1: March 23, 2020
Question #2: Please clarify what existing structures need to be monitored in accordance with Specification Section 02 01 51, Vibration Monitoring of Structures, or provide a distance/zone of influence where existing structures need to be monitored.
Answer #2: The contractor is to provide a Vibration Monitoring Plan (at least 15 days prior to the preconstruction conference) to monitor vibration producing activities (e.g. excavation, stone offloading and placement, construction related vehicular traffic, or operation of heavy construction equipment) for construction of this project. The list of structures that are susceptible to vibration damage plus any vulnerable structures along access routes and the construction site are to be determined by the seismic specialist included in the vibration monitoring plan.
Question #3: The attachment to 00 90 05, Biological Opinion, is missing pages 1 through 13 and 19 though 59. Please provide.
Answer #3: The relevant parts of the BO pertaining to this contract were provided. Pages 1-13 are a summary of the project description provided to USFWS and do not provide additional details necessary for the submittal of a bid. Pages 19-59 provides a summary background on the research for best methods of protection for the species listed. It does not provide additional details necessary to submit a bid.
Question #4: Sections 00 21 16, 00 45 00, 00 72 00, and 00 90 00 state "To be provided by Contract Division." Please forward these sections for review.
Answer #4: The applicable sections are found in the SF1442 Solicitation.
Question #5: On page 61 of the attachment to Section 00 90 05, Biological Opinion, paragraph 1.6 states "Exposed composite seawall or groin rocks above spring hide tide must be covered between Beach 9th Street and Beach 82nd Street prior to April 1 of any given year over the life of the project." Please clarify this paragraph - are completed groins to be covered? What material shall be used for the cover?
Answer #5: Exposed seawall or groins shall be covered above the high tide line and landward with sand to ensure there are no gaps that plovers or red knots could potentially become entrapped in.
Question #6: Will a bid bond be required for this project?
Answer #6: Yes
Question #7: On page 32 of 50, Clause 52.211-12 (a) says:
If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $5,544.00 for each calendar day of delay until the work is completed or accepted for the first tier and $1,386.00/or each calendar day of delay until the work is completed or accepted for the first tier.
On page 18 of Specification Section 01 30 00, paragraph 1.30 FAR 52.211-12, Liquidated Damages - Construction, states that:
(a) ... If the Contractor fails to complete the work within the time specified in the contract, or any extension, the Contractor shall pay to the Government as liquidated damages, the sum of$ 5,544. 00 for each day of delay.
( d) ... In this case the contractor shall pay liquidated damages for punchlist items not completed in the daily amount of $1,386 per day commencing after 30 days of project transfer or after date required for project completion (including all extensions), whichever occurs later.
