NOTES:

1. Bidders are required to bid on all items on the Bid Schedule or their bid will be rejected.

2. The low bidder for the purpose of award will be the confirming responsible bidder offering the lowest price for the Total Base Bid and Optional Bid Amount for all Items. The Government is under no obligation to award the optional items.

3. Any bid which is materially unbalanced as to prices for the Base Bid and Optional Items may be rejected. An unbalanced bid is one in which the price of one or more contract line items is significantly over or understated as indicated by the application of cost or price analysis techniques.

4. Bidders are reminded that they must bid on the issued plans and specifications as amended. Any deviations, conditions or attachments made by the bidders thereto may render the bid non‐responsive and be cause for its rejection.

5. The estimated quantity of piles in the unit price schedule are given for bidding purposes only.

6. The Options may be exercised at the discretion of the Government and are not mandatory.

7. If Option #1 is exercised, Bid Item No. 0013 shall be exercised within 210 calendar days of issuance of the

Base Bid NTP. No additional time shall be added to the contract duration.

9. If Option #3 is exercised, Bid Item No. 0015 shall be exercised within 700 calendar days of issuance of the

Revise Clause

52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.

The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-

(c) The amount of the bid guarantee shall be twenty (20%) percent of the bid price or $3,000,000.00, whichever is less.-

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

3‐Section 00 73 00

a. Delete the following in paragraph 43:

All work involving re-routing Verizon’s fiber optic cable shall be performed by the respective utility company except for the installation of the two (2) four (4) inch conduits.

b. Replace in its entirety in paragraph 43 with the following:

All work involving re-routing Verizon’s fiber optic cable shall be performed by the respective utility company except for the installation of the following: Conduits shall be two (2) - 4" PVC Schedule 40 with one (1) 4" conduit having three (3) - 1.25" smooth wall inner ducts, each with its own drag line. The second 4" conduit shall be equipped with only a drag line. Hand holes shall be Armorcast 30" x 60" x 48" polymer concrete 20k load rating or approved equal. One (1) 6' Polydome or approved equal shall be installed at each hand hole to identify its location.

2) DRAWINGS:

1‐Drawings have been amended and reissued G‐002, C‐103, C‐104, C‐105, C‐106, C‐302, C‐303, C‐307, C‐308, C‐309, C‐310, C‐311, S‐501, S‐505, ES‐101.

3) QUESTIONS AND ANSWERS:

(Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only ”and do not revise the solicitation, plans or specifications.)

Question 1: G‐101 indicates that we are to establish (4) new NSRS Benchmark Monuments, please indicate which Bid Item pertains to this work.

Answer: The Bid Schedule has been revised to reflect the NSRS benchmark Implementation.

Question 2: Sheet Pile Cutoff wall. C‐105 detail shows the proposed final grade terminating below the top of the proposed cutoff wall. We are concerned that this will create a drainage issue – no drainage system is shown behind the wall, no grading is provided showing a swale or otherwise to direct the runoff.

Answer: Detail on sheet C‐105 has been revised.

Question 3: The leading end of the sheet pile cutoff wall includes a temporary concrete cutoff to transition grade. The downstream end does not include any treatment to provide for a grade transition. Please clarify how we are to final grade this area.

Answer: Plan view has been revised to show the grading around the sheetpile cutoff wall. See sheet C-105.

Question 4: Pile cap call for a ½” bent steel plate application – is this required or can we use a typical cap as provided by the manufacturer

Answer: Pile cap detail has been revised.

Question 5: S‐201 indicates that the steel pipe piles are to extend 10’ minimum into bedrock. Due to a lack of subsurface information the contractor is required to perform (3) borings to verify bedrock elevation and confirm design analysis with engineer. Because this is a LS bid item and not a unit bid item, are we to assume piles depths as presented on the dwgs and if actual bedrock conditions are different – it will be considered a change?

Answer: Item is now unit price. A differing site conditions change would be considered if the piles depths as presented on the drawings are different than actual bedrock conditions.

Question 6: C‐106 Refers to a chain‐link fence barrier “as appropriate”. Is this up to the contractor’s discretion?

Answer: Note on Sheet C‐106 has been revised.

Question 7: Fence and Gate Details. C‐507 through C‐509 include multiple fence and gate details however we see no new fencing proposed for the project. Are these details related to the remove and replacement of property owner fences adjacent to the project?

Answer: Fencing details are affiliated with establishing a barrier between the project and the public. The fences of the property owners to be removed and replaced will be done on a case‐ by‐case basis depending on the type of fence that has to be removed and replaced.

Question 8: C‐507 depicts a single leaf gate. Are we to install this new gate at the site entrance upon completion for work or are we re‐installing the existing gate that was removed.

Answer: If the existing gate is still viable and undamaged when removed, then it can be re‐installed. Otherwise, a new site entrance gate will need to be installed. The COR must approve any decisions regarding the gate.

Question 9: The proposed levee grading calls for 2.5:1 side slopes. Is erosion control matting required for slope exceeding 3:1 slopes – it does not appear to be required by the E&S plans?

Answer: Please refer to Sheet CG001. The Contractor is required to obtain certification from the Soil Conservation District.

Question 10: The earthwork spec (31 00 00) paragraph 1.5.1 indicates that all excavation for the project shall be considered “unclassified” however paragraph 1.5.1.2 describes a procedure for notification and classification of rock and payment claim by contractor. Please confirm if rock will be considered a change of condition and paid on a unit based on classification and volume removed.

Answer: All excavation shall be unclassified.

Question 11: The earthwork spec (31 00 00) paragraph 3.3 Borrow Material indicates that borrow material may be obtained from approved sources on Government controlled land without the payment of royalties.

Have any such sites been identified for this project?

Answer: No sources have been identified by the Government.

Question 12: Bid Item 0007 is for haul and dispose of unsatisfactory material (10,000 CY). We do not anticipate excavating anywhere near this volume of material – please clarify how this volume of material was generated?

Answer: Volume of material is anticipated.

Question 13: Bid Item 0008 Borrow Materials (40,400 CY) This is significantly more material then we anticipate being required to build the proposed project as presented – please clarify how this volume of material was generated?

Answer: Backfill material quantity is based on existing conditions and the proposed design.

Question 14: Bid Item 0010 Remove Contaminated Material (4000 CY) Similar to Item 0007 ‐ we do not anticipate excavating this volume of material – please clarify how this volume of material was generated?

Answer: Volume of material is anticipated.

Question 15: We simply don’t see the volume of cuts and fills required to build this job to warrant the quantities of material identified by these bid items.

Answer: Backfill material quantity is based on existing conditions and the proposed design.

Question 16: Bid Item 0015 ACBs indicates that we are to reset approx. 5055 SF – the specs, plans and details appear to be for new installation. Are we to remove the old and install new in the same location or are we attempting to pick up and reset what is already there? Please further clarify the scope of this bid item.

Answer: The articulated concrete blocks will be reinstalled depending on the need to repair the existing concrete blocks during the course of construction.

Question 17: C‐104 discusses the location and relocation of the MCI/Vz FOC. Note 1 indicates that the conduits will be relocated by others prior to construction – relocated alignment is shown on the dwg. However note 3. Indicates that the contractor shall install (2) 4” conduits that will pass through the proposed floodwall.

Note 3 references section 00 73 00 – based on the table of contents this is for Special Contract Requirements however the spec included is actually the project sign.

Answer: Section 00 73 00 is included as part of the Solicitation, Offer and Award Standard Form 1442.

Question 18: Bid Item 0013 appears to be for the (2) 4” conduits as noted on C‐104

Please note that based on the proposed alignment there will be no conflict with the proposed flood wall. See sheet C‐201, wall begins at STA 30+31 while the MCI line appears to cross at 30+25 and back over after the end of the wall.

Answer: Contractor to hand dig test pit to determine precise location of the MCI line.

Question 22: C‐103 related to the Weir raising includes notes in the details indicating conduit relocation but no other information is provided? Please clarify scope.

Answer: Sheet C‐103 has been revised.

Question 23: We have discovered an apparent conflict in the drawings. Please refer to C‐105, left side, middle which has a note “Grassed Top of Levee Sta 28+00 to Sta 34+49”. Refer to C‐302 which shows a 10’ wide paved top in the cross sections. Also refer to C‐303 which also shows a 10’wide paved top. Please clarify as there is a considerable cost difference between the paving section and grass.

Answer: Cross sections on Sheets C‐302 and C‐303 have been revised.

Question 24: In regards to the project mentioned above, are there any union requirements?

Answer: Construction Wage Rate Requirements, formerly Davis‐Bacon Act, are applicable to this project. There is no regulation / law that governs the use of union or non‐union employees.

Question 25: Item 0007 – Load and Dispose of Unsatisfactory Material at Offsite Location – Please explain where the 4000 CY of material will be derived from, since the removal of the existing B‐1 Berm is to be paid under line item 0004 and the overall onsite excavation is approximately less than 2000 CY?

Answer: The author of the question may be confusing the topsoil with the embankment material.

Question 26: Item 0008 – Borrow Material – The total volume of onsite fill including raising the existing spillway, the levee extension, general fill at new swales, floodwall and behind the sheet pile cut‐off wall amounts to approximately less than 10,000 CY. With the understanding that borrow fill will not be utilized for levee embankment, please explain where 40,400 CY will be utilized on the project site and for what reason.

Answer: Includes the weir raising, embankment material and regrading of the area. We believe that the 40,400 CY is appropriate.

Question 27: Item 0010 – Contaminated Non‐Hazardous Material Removal ‐ Please provide soil analytical reports for contaminated material and also explain where the 4000 CY of material will be derived from? Please note that soil analytical reports are necessary to properly determine disposal costs, which vary based on level of contamination, constituents and facility acceptance criteria.

Answer: Soil analytical report was submitted with Amendment #001. Volume is based up experience with Contract B1, and calculations based upon the survey and the design template.

Question 28: Bid Item 0015 calls for resetting approximately 5050 SF of Articulated Concrete Block.

The specifications allude to providing new ACB for this item. Is the intent for this item for resetting the existing ACM on site in the event it needs to removed and replaced?

Answer: The articulated concrete blocks will be reinstalled depending on the need to repair the existing concrete blocks during the course of construction.

Question 29: What is the intent for the material in Bid Item 0008 – Borrow Material since it just meets the backfill spec and not the levee material spec?

Answer: The plans show areas of the project other than the levee that require borrow materials for backfill such as the floodwall excavations, the area between the floodwall and sheetpile retaining wall in the brook, the areas to be raised between the levee and the back of the houses (i.e. Plan C‐302), etc.

Question 30: Page 62 of 162 of the solicitation states that “The bid guarantee shall be 20% of the offeror’s price or $3,000.00, whichever is less.” Is the $3000.00 a typo? We want to provide the proper bond.

Answer: Correct amount is $3,000,000

Question 31: The specifications state that no excavation work can be performed between May 1 and July 31. Can sheeting and concrete work be performed during that timeframe?

Answer: Portions within the 50ft riparian zone will be subject to the prohibition.

Question 32: There is no paint spec provided other than for black Coal Tar epoxy in Section 09 97 02.

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. Union Average Rate Identifiers

EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:
