PRICE AND PAYMENT PROCEDURES

08/15

PART 1 GENERAL

1.1 REFERENCES

The publications listed below form a part of this specification to the extent referenced. The publications are referred to within the text by the basic designation only.

ASTM INTERNATIONAL (ASTM)

ASTM C138/C138M (2014) Standard Test Method for Density ("Unit Weight"), Yield, and Air Content (Gravimetric) of Concrete

1.2 SINGLE JOB PAYMENT ITEMS

Payment items for the work of this contract for which contract job payments will be made are listed in the BIDDING SCHEDULE and described below. All costs for items of work, which are not specifically mentioned to be included in a particular job or unit price payment item, are included in the listed job item most closely associated with the work involved. The job price and payment made for each item listed constitutes full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.

1.2.1 LEVEE

1.2.1.1 Payment

Payment will be made for costs associated with constructing approximately 295 LF of earthen embankment levee between stations 27+90 and 30+85, including but not limited to embankment and swale, seeding and landscaping, removal and disposal of riprap, removal and disposal of pavement and guiderail, establishment of two (2) NSRS benchmarks, and erosion control measures in accordance with drawings and specifications.

1.2.1.2 Unit of Measure

Unit of measure: Job.

1.2.2 FLOODWALL

1.2.2.1 Payment

Payment will be made for costs associated with constructing approximately 418 LF of floodwall between stations 30+31 and 34+49, including but not limited to excavation, shoring, dewatering, backfill, cutoff wall, pile tests, concrete cap, sheet pile, swales, seeding and other landscaping, establishment of two (2) NSRS benchmarks, and erosion control measures in

1.2.2.2 Unit of Measure

Unit of measure: Job.

1.2.3 LEVEE WEIR RAISING

1.2.3.1 Payment

Payment will be made for costs associated with constructing approximately 190 LF levee raising between stations 22+40 to 24+30, including but not limited to excavation, embankment and swale, seeding and landscaping, removal and disposal of riprap and geotextile, removal and disposal of pavement, new pavement, and erosion control measures in accordance with drawings and specifications.

1.2.3.2 Unit of Measure

Unit of measure: Job.

1.2.4 REMOVAL OF EXISTING B-1 BERM

1.2.4.1 Payment

Payment will be made for costs associated with work necessary to haul and dispose of the existing berm, Including but not limited to excavation, seeding and landscaping, removal and disposal of riprap and fabric, and removal and disposal of gabion wiring, in accordance with the drawings and specifications.

1.2.4.2 Unit of Measure

Unit of measure: Job.

1.2.5 MISCELLAENOUS REMOVAL AND REPLACEMENT

1.2.5.1 Payment

Payment will be made for costs associated with work necessary to remove and replace fences, sheds, and other small structures in accordance with drawings and specifications.

1.2.5.2 Unit of Measure

Unit of measure: Job.

1.2.6 LIABILITY INSURANCE

1.2.6.1 Payment

Payment will be made for costs associated with New Jersey Department of Environmental Protection (NJDEP), Middlesex County, and the Borough of Middlesex Liability Insurance. The amount bid will be the maximum amount payable. Actual payment will be based on actual costs.

1.2.7 SHEETPILE CUTOFF AND TRM

1.2.7.1 Payment

Payment will be made for costs associated with work to construct approximately 154 LF of sheetpile cutoff and to install TRM (turf reinforcement mat) , including but not limited to excavation, shoring, dewatering, backfill, seeding and other landscaping, and erosion control measures in accordance with drawings and specifications.

1.2.7.2 Unit of Measure

Unit of measure: Job.

1.2.8 SANITARY SEWER REMOVAL

1.2.8.1 Payment

Payment will be made for costs associated with work to remove the abandoned manhole and sanitary sewer at floodwall alignment and cap the remaining 8" sanitary sewer line- including excavation, shoring, dewatering and backfill.

1.2.8.2 Unit of Measure

Unit of measure: Job.

1.2.9 GRASS CUTTING AND MAINTENANCE FOR ALL EASEMENTS FOR 730 CALENDAR DAYS

1.2.9.1 Payment

Payment will be made for costs associated with labor, materials, and equipment necessary to perform the maintenance of grass, which shall include but not be limited to application of fertilizers, herbicides and pesticides, watering, weeding, loose trash removal, leaf removal, spring and fall cleanup. Mowing and trimming of grass shall be at a minimum of two (2) inches. All clippings, weeds, etc. shall be removed at the time of cutting.

1.2.9.2 Unit of Measure

Unit of measure: Job.

1.2.10 BID OPTION 1

1.2.10.1 CONDUITS

1.2.10.1.1 Payment

Payment will be made for costs associated with work for the installation of two (2), four (4) inch conduits, inner ducts, hand holes, drag lines, polydome and (2) pipe penetrations including clearing, excavation, shoring, dewatering and backfill.

1.2.11 BID OPTION 2

1.2.11.1 FIBER OPTIC CABLE

1.2.11.1.1 Payment

Payment will be made for costs associated with Design, disconnect, remove, install and reconnect permanent Verizon fiber optic lines and service connections, providing all labor, equipment and material for this work.

Allowance amount of $200,000 to be included in bid as shown and not changed. Actual payment will be based on actual costs.

1.2.11.2 Unit of Measure

Unit of measure: Job.

1.2.12 BID OPTION 3

1.2.12.1 ARTICULATED CONCRETE BLOCK

1.2.12.1.1 Payment

Payment will be made for costs associated with work to reset approximately 5055 SF of existing articulated concrete block including but not limited to geotextile, excavation, backfill, seeding and other landscaping, and erosion control measures in accordance with drawings and specifications.

1.2.12.2 Unit of Measure

Unit of measure: Job.

1.3 UNIT PRICE PAYMENT ITEMS

Payment items for the work of this contract on which the contract unit price payments will be made are listed in the BIDDING SCHEDULE and described below. The unit price and payment made for each item listed constitutes full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for each of the unit price items.

1.3.1 CONCRETE FILLED PIPE PILE FOUNDATION - 20" ERW Straight Seam

1.3.1.1 Payment

Payment will be made for costs associated with ERW for concrete filled pipe pile foundation.

1.3.1.2 Unit of Measure

Unit of measure: lineal foot

1.3.2 CONCRETE FILLED PIPE PILE FOUNDATION - 6,000 PSI Concrete Fill

1.3.2.1 Payment

Payment will be made for costs associated with concrete for concrete filled pipe pile foundation.

1.3.2.2 Measurement

The measured weight of concrete will be based on ASTM C138/C138M

1.3.2.3 Unit of Measure

Unit of measure: cubic yard

1.3.3 BORROW MATERIAL

1.3.3.1 Payment

Payment will be made for costs associated with work necessary to obtain borrow material satisfactory for backfill, meeting all state residential requirements, and transport it to the project site in accordance with the drawings and specifications. "Estimated Quantities."

1.3.3.2 Measurement

The total quantity of borrow material for which payment will be made will be measured by certified haul weight tickets divided by a representative unit weight of the material. The unit weight will be determined through a USACE certified laboratory analysis of the soil removed from the project site. The USACE certified laboratory, used for this purpose, will be hired and paid for by the Contractor.

1.3.3.3 Unit of Measure

Unit of measure: cubic yard

1.3.4 TOP SOIL

1.3.4.1 Payment

Payment will be made for costs associated with work necessary to obtain top soil, meeting all state residential requirements, and transport it to the project site in accordance with the drawings and specifications.

"Estimated Quantities."

1.3.4.2 Measurement

The total quantity of top soil material for which payment will be made will be measured by certified haul weight tickets divided by a representative unit weight of the material. The unit weight will be determined through a USACE certified laboratory analysis of the soil removed from the project site. The USACE certified laboratory, used for this purpose, will be hired and paid for by the Contractor.

1.3.4.3 Unit of Measure

Unit of measure: cubic yard

1.3.5 BID OPTION 4

1.3.5.1 HAUL AND DISPOSE OF UNSATISFACTORY MATERIAL AT OFFSITE LOCATION

1.3.5.1.1 Payment

Payment will be made for costs associated with work necessary to haul and

SECTION 01 22 00.00 10 Page 5 dispose of unsatisfactory material at an approved off-site location in accordance with the drawings and specifications, but not including any work in Bid Item 0008. "Estimated Quantities."

1.3.5.1.2 Measurement

The total quantity of unsatisfactory material for which payment will be made will be measured by certified haul weight tickets divided by a representative unit weight of the material removed. The unit weight will be determined through a USACE certified laboratory analysis of the soil removed from the project site. The USACE certified laboratory, used for this purpose, will be hired and paid for by the Contractor.

1.3.5.1.3 Unit of Measure

Unit of measure: cubic yard

1.3.6 BID OPTION 5

1.3.6.1 CONTAMINATED NON-HAZARDOUS MATERIAL REMOVAL

1.3.6.1.1 Payment

Payment will be made for costs associated with work for handling, transport, treatment and off-site disposal of material exceeding NJDEP residential soil cleanup criteria and classified as contaminated non-hazardous (ID27 WASTE), suitable for landfill cover, roadway subbase and recycling facilities, complete. "Estimated Quantities"

1.3.6.1.2 Measurement

The total quantity of contaminated material for which payment will be made will be measured by certified haul weight tickets divided by a representative unit weight of the material removed. The unit weight will be determined through a USACE certified laboratory analysis of the soil removed from the project site. The USACE certified laboratory, used for this purpose, will be hired and paid for by the Contractor.

1.3.6.1.3 Unit of Measure

Unit of measure: cubic yard

1.3.7 BID OPTION 6

1.3.7.1 CONTAMINATED NON-HAZARDOUS TOPSOIL REMOVAL

1.3.7.1.1 Payment

Payment will be made for costs associated work for handling, transport, treatment and off-site disposal of topsoil material exceeding NJDEP residential soil cleanup criteria and classified as contaminated non-hazardous (ID27 WASTE), suitable for landfill cover, roadway subbase and recycling facilities, complete. 1.3.7.1.2 Measurement

The total quantity of contaminated material for which payment will be made will be measured by certified haul weight tickets divided by a representative unit weight of the material removed. The unit weight will
