NOTES
NOTE 1: Bidders must bid on all items. Failure to bid on the basic work and all options will be cause for rejection of the bid as nonresponsive.
NOTE 2: Award of contract will be based on the responsible and responsive bidder with the lowest total price for the total of the CLINs 0001-0006.
NOTE 3: The unit prices for CLINs 0002, 0003, and 0006 are directly related to the estimated quantities of dredge material available for removal (all material except ledge rock lying above the plane of 38 feet below mean lower low water (MLLW), plus 1 foot allowable overdepth), in the Basic Work and Option 2 contract areas of Newark Bay, NJ, Federal Navigation Channel. The dredged material must subsequently be transported, processed and placed at a contractor furnished, state permitted, Government approved upland placement site(s).
NOTE 4: The unit price for CLIN 0005 is directly related to the estimated quantity of additional dredge material available for removal (all material except ledge rock lying above the plane of 40 feet below mean lower low water
(MLLW), plus 1 foot allowable overdepth), in the Option 1 contract area of Newark Bay, NJ, Federal Navigation Channel. The estimated quantity of 72,110 cubic yards (CY) represents the incremental increase from material available to be removed from Pt. Newark Inshore Channel lying above the plane of 38 feet below mean lower low water (MLLW), plus 1 foot allowable overdepth (CLIN 0003 - Basic Work – Dredging Area 2), to the quantity of material available to be removed from Pt. Newark Inshore Channel lying above the plane of 40 feet below mean lower low water (MLLW), plus 1 foot allowable overdepth. The dredged material must subsequently be transported, processed and placed at a contractor furnished, state permitted, Government approved upland placement site(s).
NOTE 5: All bidders are hereby advised that the execution of options are subject to the availability of funds.
NOTE 6: Exercise of options are at the discretion of the Government and may be exercised within eighty-five (85) calendar days of receipt by the contract of the Notice to Proceed (Basic Work). If exercised, the options listed above may not be exercised in numerical order. If options are exercised, their performance periods will be consecutive to that of the Basic Work. If exercised, the time for contract completion of each option will be based on the rate of one (1) additional calendar day for each 2,250 cubic yards in the option.
NOTE 7: All bidders are hereby advised that the estimated dredge quantities for placement in the price schedule are estimated and based on the survey data collected on 21, 22, and 28 December 2015 and 05 January 2016.
NOTE 8: The Government may reject a bid as non–responsive if the prices bid are materially unbalanced between line items and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Government even though it may be the low bid.
NOTE 9: Bidders are reminded that they must bid on the issued plans and specifications as amended. Any deviations, conditions or attachments made by the bidder himself may render the proposal non-responsive and may be cause for its rejection.
NOTE 10: The apparent low bidder shall submit the documents specified in Section 00 73 00, Special Contract Requirements paragraph 1.3, Contractor-Identified Offloading, Processing and Disposal Site Compliance. If the Apparent low bidder does not submit the required information within 35 calendar days from the date the apparent low bidder is notified of being the low bidder, the bidder may be considered non-responsible and his bid will no longer be considered. Information provided at the 35 day submittal will be final and any changes must be made at the discretion of the Government.

(b) (1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
