2. RESPONSES TO QUESTIONS SUBMITTED BY PROSPECTIVE OFFERORS:
Reference MATOC Solicitation:
1. Question: Has this TO1 and T02 Projects been Pre-Registered with USGBC to ensure that the project can utilize the LEED On Line Website for LEED NCv2.2 due to the dead line of June 26, 2009? It would be required if TO2 CDC is to be actually certified and to allow the use of the NCv2.2 website to document LEED points for both TO1 and TO2.
Answer: Correct, both projects have been pre-registered with USGBC as NCv2.2. The USGBC account information shall be provided after award.
Reference Task Order 0001 Fire Station:
2. Question: Section 01 10 00 Section 5.13 requires the design to meet UFC 4-010-01.
2The plans have 10 typical dorm rooms with the understanding that only one bed is occupied and the chief’s dorm combined for a total of 11. Because UFC 4-010-01 would require setbacks or 45 m if the building included billeting (11 or more), are we correct to assume that the chief is not to be considered routinely housed so that the total routinely housed is 10.
Answer: See Amendment 3 drawing C-100 for the required standoff distances.
3. Question: The RFP for Fire Station in paragraph 6.10.1.8.3 says: “The main distribution panel/switchboard shall have a minimum of two spaces suitable for future 400 A, 3 pole circuit breakers. In addition, provide one spare 225 A. 3 pole and one spare 100 A 3 pole circuit breaker in the main distribution panel/switchboard”. It appears that this requirement assumes that in the future additional load may be added to the facility. However, there is nothing in the RFP that tells us to upsize the service equipment or transformer in an anticipation of a future load addition. Is the service equipment and transformer to be upsized? Please clarify.
Answer: This requirement is deleted under Amendment 6.
4. Question: Section01 10 00 Section 6.5.2.6.12 required flat roof yet 6.5.2.6.4 requires eaves extent 3’-6” and implies roofing to be standing seam and 6.5.2.3.3 requires a combination flat roof and standing stand roof. We are assuming roof to be per 6.5.2.3.3 without any eaves. Please confirm.
Answer: Correct, roof shall match the requirements of 6.5.2.3.3 and the flat portions of the requirements of 6.5.2.6.12. Paragraph 6.5.2.6.4 shall be deleted under amendment 6.
5. Question: Section 01 10 00 6.5.2.3.5 required the designer to use the sliding snow calculator by CRREL. Please provide a link to obtain this calculator or confirm that the intent is to provide a cold roof as outlined in “Guidelines for Ventilating.
Answer: Reference Section 01 10 00 paragraph 6.5.2.3.3 requires that the roof shall not shed its snow load. The reference to CRREL snow sliding calculator will be deleted under Amendment 6.
On page 73 of 172 para. 6.11.2.1, HVAC system for Communications Room
6. Question: What is the projected BTU output of Government Supplied Equipment?
Also described is Self contained or Split type units. Because of the small space and load a 1/2 ton of cooling is the smallest unit that we know of in the industry. We have used single and multi- split systems on military bases in the past,(foreign made) but we are unable to find any that meet the "made in America clause". Please clarify.
Answer: This unit shall be sized during the design phase of the facility when the design loads are known.
Fire Station: Your gas line is not located where you indicate on your RFP dwg. The closest gas line for connection is at the south intersection of Tigris River (4th st and gas alley).
7. Question: Please confirm that the connection for the new fire station will be where it is indicated on the RFP drawing- (if being installed under another contract) or connection at the intersection indicated.
Answer: The gas line for the Fire Station has been confirmed and is located as shown on Drawing C-101.
8. Question: Reference: Appendix J drawing bay area and Army Standard For Fire Stations April 2009: There are many miscellaneous items such as work benches, PPE Storage lockers, bathroom lockers, safety cages, spare tools parts bins, hose rack storage unit, storage shelves etc. as listed in the room by room description of the standard, however, it is not clear whether these items are Contractor Furnished or Government furnished items. Please clarify and provide a list of items that are to be CFCI items and any specifications associated.
Answer: The PPE lockers, Ice Chest, and Hose Rack are shown on the conceptual drawings to ensure that space is allocated for them. They are GFGI. Furniture, unless otherwise noted, is GFGI. Note section 01 10 00, paragraph 6.5.2.3.7: The contractor is responsible for all ‘work station’ electric, data, and communication connections.
9. Question: There are two air compressors required for this project, one for SCBA air and one for the air brakes on the trucks. The RFP does not list sizing requirements for either. It is our understanding that previously installed SCBA compressors at Ft Drum required around a 15 hp, 3 phase, 19 cfm, with a 3 bottle fill station. This would need around a 12'x16' room which is larger then the room shown on the RFP drawing.
Please provide information required to size the SCBA compressor and verify if it is High or low Pressure and how many tanks they need to fill.
Answer: The SCBA compressor shall be GFGI.
10. Question: Regarding the fire station task order paragraph 3.6.2.3: Compressed Air:
there are no specifications or description for the size or requirement or usage for the compressed air system for the apparatus bay area? Is this system to be used for pneumatic tools, or air brakes, or other maintenance applications where a required cfm is needed. We need information in order to determine sizing. Please provide.
Answer: The compressor for the Apparatus Bay shall be a minimum of electric 2 stage air compressor, type 30, HP rating 7.5, air delivery 24 CFM, maximum pressure 175 psi, phase single, voltage rating 230 single phase, current rating 40 amps, tank capacity 80 gallons, rated ASME, with manual drain.
11. Question: Fire Station, pg 60, 6.5.2.3.4 exterior soffits: Is the Government requesting 3'6" wide overhangs?
Answer: Yes, for the Administrative and Dormitory portion of the building.
12. Question: Fire Station, pg 60, 6.5.2.3.5: "Exterior walkways accessing building entrances...etc." Is the government requesting covered walkways from the building to the parking lot[s]? Or just canopies at the entrances themselves?
Answer: Just canopies at the entrances are all that is required..
13. Question: What are the design submission requirements for both Child Development Center and Fire Station?
Answer: See Section: 01 33 16. Design After Award
14. Question: Could you provide the contact name and phone numbers for the utility providers (Electric, Water, Sewer, and Gas) at Fort Drum?
Answer: See amendment 5, “will be provided after award.” For TO: #0001 and TO# 0002, utilities (gas, water, electric, and sewer) on Ft Drum, NY, are still government owned.
15. Question: The color listed as a trim color (Grey Expectations) is an ICI color which no longer exists. Is there another paint color we should use to go by?
Answer: You will be required to match this color as indicated.
16. Question: The existing sanitary sewer is not located where it is indicated on the drawing in appendix J. It is currently show running west of Po Valley road. Our current survey information is indicating the closest connection point for sewer to the new building is running parallel on chapel drive. Please clarify where the connection point is for the new facility.
Answer: The existing sanitary sewer as shown on drawings in Appendix J C-102 and C-103 is correct.
17. Question: The Government answer to question #24 in Amendment 5 states that canopies are required on all exterior doors. Will the square footages of the areas covered by the canopies need to be counted as “One-Half Spaces” per 1302 of 1384, Appendix Q? If so, the maximum gross square footage would be exceeded.
Answer: Provide canopies as required.
18. Question: Is it safe to assume that the offsite storm drainage line under the railroad that came out in Amendment #5 will have to maintain clearances under the tracks consistent with CSX Railroad Design Standards (CSX has rail lines in the Fort Drum area). The requirement is to maintain 5.5 feet of clearance. We cannot maintain this clearance with the outlet elevation provided in Amendment #5. We may be able to drain to a lower elevation further from the site, however we cannot determine how much further from the information provided.
Answer: This project is Design-Build contract and the contractor/designer shall do what ever investigation they feel necessary to meet the requirements.
19. Question: Is the railroad owned by a railroad company or by the military? If owned by a railroad company, what is the width of the R/W? Can we get a contact information for someone to ask railroad encroachment questions?
Answer: This project is Design-Build contract and the contractor/designer shall do what ever investigation they feel necessary to meet the requirements.
20. Question: Could you provide the contact name and phone numbers for the utility providers (Electric, Water, Sewer, and Gas) at Fort Drum? The Answer was: This information will be provided after award.
Are we to assume there are no tap fees, etc. owed to these utilities and that, aside from extending the utilities as a part of our contract, no further costs are involved?
Answer: Correct for the two Fort Drum seed projects.
Reference Task Order 0002 Child Development Center:
21. Question: Section 01 10 00, Mandatory Criteria, page 19 and 20 of 260. There are conflicting descriptions of vision panels and view windows for the corridor. Under vision panels it states “vision panels must also be provided in corridor walls and shall extend from normal 6’-8”-7’-0” height to 54” above the finish floor.” Under view windows it reads “view windows are required to provide children the opportunity to look out of or into the activity room. View window shall extend from normal 6’-8”-7’-0” height to within 18” or 24” above the finished floor.” What is the correct sill height of windows in the corridor?
Answer: In the corridor, the activity rooms should have vision panels located above the cubbies, and a view window located past the cubbies. There will be a minimum of windows in the corridor wall as indicated in Attachments. In the active play room, since there are no cubbies, there will all view windows. The question indicates the correct sill heights for the windows.
22. Question: Section 01 10 00 Mandatory Criteria. View Windows: The RFP states view windows are required for children to look into or out of the activity room. There are not to be less than 3 view panels from the corridor into the activity room. On the floor plan in Attachment F, several view windows are shown between activity rooms and other spaces such as the lounge and training room. These view windows are not required per the standard design criteria. Is there a preference to have the view panels between activity rooms?
Answer: There is no preference to have view panels between the activity rooms and other rooms and there should be NO windows between the activity rooms and other types of spaces such as Training and Lounge. See Amendment 6 for correction to Attachment F.
23. Question: Section 01 10 00, paragraph 23 Space: Kitchen: Minimum wall construction/surface performance references employees’ dressing and locker areas. Are these areas included?
Answer: Paragraph 23 Space: Kitchen, Minimum Wall Construction/Surface Performance:
In addition to the Kitchen Area, the wall construction requirements applies to employee dressing and locker room, lounge areas, or any area in which food may be prepared. The areas identified in the “examples” are not necessarily identified within the kitchen, but may be in the facility. The floor plan governs area usage, wall lockers are a requirement in the Lounge area.
24. Question: Section 01 10 00, paragraph 31 Space: Corridor: Minimum ceiling construction is indicated to have an STC rating of 45. Ceilings usually are specified acoustically by CAC or NRC ratings, not STC. Is the intent to provide STC 45 rated walls?
Would the same acoustical criteria for the Training Room with STC 45 walls and CAC 40 ceiling apply here?
Answer: The minimum rating for the corridor ceiling is CAC 38.
Your gas line is not where it is shown on the dwg. The gas line is west of Po Valley road-approximately 950 feet from the building. Installation would require either a road bore or road cut of Po Valley for connection of the line.
25. Question: Please confirm that the connection for the gas line is correctly shown on the RFP drawing – if not will a road cut allowed for the installation of the gas line for connection to the existing?
Answer: The gas line shown on the drawings in Appendix J are correct.

WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division
U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
