In as much as the proposal shall describe the capability of the Offeror to perform the resulting contract, the proposal shall be specific and complete in every detail as well as be prepared simply and economically, providing a straightforward and concise description of capabilities to satisfactorily perform the contract.

1.3 For the purposes of this solicitation, the Government will utilize a single phase process. The award will be a single firm-fixed price contract award.

2. GENERAL INSTRUCTIONS.

2.1 Firms formally organized as design-build entities, design firms and construction contractors that have associated specifically for this project, consortia of firms, or any other interested parties may submit proposals. 2.2 Contractor Team Arrangements. Contractor Team Arrangements are considered an arrangement in which (1) two or more companies form a partnership or joint venture to act as a potential prime contractor; or (2) a potential prime contractor agrees with one or more other companies to have them act as its subcontractors under a specified Government contract or acquisition program. The Offeror shall identify the major or critical aspects of the requirement to be performed by those identified in the Contractor Team Arrangement. 2.3 If applicable, the Offeror shall submit evidence from the Offeror’s SBA Servicing Agency that the Offeror has notified and discussed the proposed joint venture for this project with the appropriate SBA personnel.

2.4 Information submitted about any company other than the Offeror, whether a predecessor company, affiliated company, subsidiary (including wholly owned subsidiaries), subcontractors that will perform major or critical aspects of this requirement, or other associated business, will not be evaluated for any factor unless the proposal contains a detailed narrative explaining why this submitted information is relevant to this acquisition. The Government will consider the adequacy of this explanation in deciding the relevance and weight of the information to this procurement. Information about subcontractors may not be given much weight unless the proposal contains evidence that the subcontractor is committed to perform the work. If information about a subcontractor is properly submitted and given weight during the evaluation, the expectation is that this subcontractor will perform this work.

Before utilizing another subcontractor for this work, the Government must consent.

2.5 Offerors shall submit their proposal to the address shown in Block 7 of Standard Form 1442.

4. EVALUATION RATINGS.

4.1 Proposal Ratings: Factors. Factors 1, 3, 4 and 5 will be adjectivally rated. Factors 2 and 6 will be rated as risk ratings. Offerors submitting proposals for this project should limit submissions to data essential for the evaluation of proposals.

See paragraph 6 below for a discussion of the evaluation criteria applicable to these factors.

4.2 Technical Rating Definitions: The following rating definitions will be utilized in the evaluation of Factor 1 (Experience in Relevant Projects), Factor 3 (Subcontractor Experience), Factor 4 (Project Management Plan) and Factor 5, Small Business Participation Plan, and will be evaluated using the following adjectival assessment ratings:

EXCELLENT: The proposal has exceptional merit and reflects an excellent approach which will clearly result in the superior attainment of all requirements and objectives. This clearly achievable approach includes numerous strengths, and essentially no weaknesses, which can be expected to result in outstanding performance. The proposal provides solutions which are unquestionably feasible and practical. These solutions are further considered to be exceptionally clear and precise, fully supported, and demonstrate a clear understanding of the requirements. Risk Level: Very Low

GOOD: The proposal demonstrates a sound approach which is expected to meet all requirements and objectives. This sound approach includes strengths, and few relatively minor weaknesses, which collectively can be expected to result in good performance. The proposal provides solutions which are considered feasible and practical. These solutions are further considered to be clear and precise, supported, and demonstrate an understanding of the requirements. Risk Level: Low

ACCEPTABLE: The proposal demonstrates a sound approach which is capable of meeting all requirements and objectives. The approach includes both strengths and weaknesses, where the strengths are not outweighed by the weaknesses. Collectively, the strengths and weaknesses are likely to result in acceptable performance. The proposal solutions are generally feasible and practical. These solutions are further considered to be somewhat clear and precise, partially supported, and demonstrate a general understanding of the requirements. Risk Level: Moderate

MARGINAL: The proposal demonstrates an approach which may not be capable of meeting all requirements and objectives. The approach has weaknesses of substance and strengths, which if they exist, are outweighed by the weaknesses. Collectively, the strengths and weaknesses are not likely to result in acceptable performance. The proposal contains solutions which may not be feasible and practical. These solutions are further considered to lack clarity and precision, are generally unsupported, and do not demonstrate a complete understanding of the requirements. Risk Level: High

UNACCEPTABLE: The proposal demonstrates an approach which, based on a very high risk, will very likely not be capable of meeting all requirements and objectives. This approach has numerous weaknesses and strengths which, if they exist, are far outweighed by weaknesses. Collectively, the strengths and weaknesses will not result in acceptable performance. The proposal contains solutions which are not feasible and practical. The solutions are further considered to lack any clarity and precision, are unsupported, and do not demonstrate an understanding of the requirement. Risk Level: Very

High

4.3 Performance Risk Rating Definitions. Factor 1 Experience in Relevant Projects, Factors 2 (Past Performance on Relevant Projects), Factor 3 Subcontractor Experience and 6 (Past Performance in the Utilization of Small Business) will be evaluated using the following Performance Risk Levels:

VERY LOW – Essentially no doubt exists that the Offeror will successfully perform the required effort based on their past performance

LOW - Little doubt exists that the Offeror will successfully perform the required effort based on their performance record.

MODERATE - Some doubt exists that the Offeror will successfully perform the required effort based on their performance record.

HIGH - Significant doubt exists that the Offeror will successfully perform the required effort based on their performance record.

NEUTRAL – When an offeror is without a record of relevant past performance or for whom information on past performance is not available.

4.4 Ownership Disclosure Rating Definitions: The following rating definitions will be utilized in the evaluation of Factor 7 (Ownership Disclosure (FOCI)) and will be evaluated using the following adjectival assessment ratings:

ACCEPTABLE: A proposal that satisfies all of the Government’s requirements as specified in for the Ownership Disclosure Factor.

UNACCEPTABLE: A proposal that does not satisfy all of the Government’s requirements as specified in the Ownership Disclosure Factor.

SUSCEPTIBLE OF BEING MADE ACCEPTABLE: The proposal demonstrates an approach which, as initially proposed, cannot be rated Acceptable. If this rating is assigned, the Government will make a decision whether or not to enter into discussions. The Government may award a contract to an offeror that has a rating of “Susceptible of Being Made Acceptable.” This may mean that a mitigation plan may be required to be submitted and approved prior to a notice to proceed being issued. It may also mean that one of more of the individual contractors or subcontractors who submitted and SF328 has a FOCI concern.

Options to correct this may include the mitigation strategy or removal of the contractor or subcontractor from the team. Decisions made for this factor, and particularly this rating, are at the sole discretion of the Government.

4.5 Volume I Technical Proposal, Factors 1-4, of the proposals will be evaluated, by the Technical Evaluation Committee (TEC) as established by the Source Selection Authority (SSA), based upon the factors listed below.

Factors 1 through 4 will be adjectivally rated. Offerors submitting proposals for this project should limit submissions to data essential for the evaluation of proposals.

a. FACTOR 1 - Experience in Relevant Projects

b. FACTOR 2 - Past Performance on Relevant Projects

c. FACTOR 3 - Subcontractor Experience

d. FACTOR 4 - Project Management Plan

See section below for a discussion of the evaluation criteria applicable to these factors.

4.6 Volume II (Small Business Participation Plan, Factor 5 and Factor 6 Past Performance in the Utilization of Small Business) of the proposals will be evaluated, by Small Business Evaluation Committee (SBEC) using the submission requirements of paragraph 5 Submission Criteria. Factor 5 will be adjectivally rated under the Technical ratings and Factor 6 will be adjectivally rated und the Past Performance ratings. Offerors submitting proposals for this project should limit submissions to data essential for the evaluation of proposals.

4.7 Volume III (Price Proposal, Factor 8) of the proposal will be evaluated by a Price Evaluation Committee (PEC) established by the Source Selection Authority (SSA). Price will be evaluated for reasonableness, but will not be scored. Proposals will be evaluated using price analysis techniques. Prices in an Offeror’s proposal and breakdown are required to be reasonable for the work to be performed and consistent with relevant elements of the technical proposals.

4.8 Volume IV (Ownership Disclosure (FOCI)), Factor 7) of the proposal will be evaluated by the Security Evaluation Committee (SEC) established by the Source Selection Authority for compliance with DFARS 252.209- 7001, Disclosure of Ownership or Control by a the Government of a Terrorist Country, DFARS 252.209-7002, Disclosure of Ownership or Control by a Foreign Government and DFARS 252.2209-7004, Subcontracting with Firms that are Owned or Controlled by the Government of a Terrorist Country. Factor 7 will be adjectivally rated.

A contract will not be awarded to a firm or subsidiary of a firm if it is determined that the Government of a terrorist country has significant interest in the firm or subsidiary or if the firm is determined to be under foreign ownership, control or influence of countries (FOCI) that support terrorism or are considered critical intelligence threats.

Subcontractors identified in the proposal are subject to the same eligibility determination.

If the government determines there is or may be FOCI, the Government may seek clarification to make a final determination if the Offeror is eligible for award. If an Offeror is not determined to be free of FOCI issues, the Offeror may be required to submit a mitigation strategy via discussions that must be approved by the U.S.

Government, or the company may be ineligible for further award consideration. If FOCI concerns cannot be mitigated to the satisfaction of the Government that Offeror may be determined to be Unacceptable in this factor and render their entire proposal Unacceptable and therefore ineligible for award.

5. SUBMISSION CRITERIA.

5.1 VOLUME I – TECHNICAL VOLUME

For purposes of this Request for Proposal (RFP), an “Offeror” may include a group of two or more entities that have formed a “contractor team arrangement,” as that term is defined in the Federal Acquisition Regulation, Section

9.601. In the case of entities that have formed a contractor team arrangement, the experience and performance history of any member of the team, whether or not gained while working with the other member(s) of the currently-proposed contractor team arrangement, will be considered as a part of the evaluation of the Offeror’s proposal. In the case of contractor team arrangements involving a prime contractor and subcontractor(s), where the prime contractor submits the proposal in response to this RFP, the prime contractor must have completed at least 50% of the total number of projects submitted for Factor 1 for consideration in response to the experience requirements of this RFP. An Offeror that relies upon the experience and performance history of a member or members of a proposed contractor team arrangement will be expected to maintain that arrangement during performance of any contract awarded to that Offeror under this RFP. Any major subcontractors and outside associates or consultants required by the Contractor in the connection with the services covered by the contract will be limited to individuals or firms that were specifically identified in the Offeror’s proposal. The Contractor shall obtain the Contracting Officer's written consent before making any substitutions for these subcontractors, associates, or consultants. As a part of their proposal, the Offeror must provide a contractor team agreement signed by all parties, identifying the legal name(s) of all entities and describing the nature of each entity’s relationship (partnership, joint venture, prime/sub or mentor/protégé) and their role on this project. This documentation shall be provided at the beginning of the Offeror’s technical proposal and will not be included in the overall page count.

The following are to be used in determining the status of the Offeror for project submission:

In the case of contractor team arrangements involving a Prime Contractor and Subcontractor(s), where the Prime Contractor submits the proposal in response to this RFP, the Prime Contractor is considered the “Primary Offeror.”

In the case of joint ventures and mentor/protégé relationships, the “Primary Offeror” experience can come from any of the entities involved in the relationship.

In the case of additional projects submitted by subcontractors, the subcontractor must submit the final cost of their portion of the project along with the other required information.

For projects submitted under Factor 3, Subcontractor Experience (i.e. Mechanical, Electrical, and Commissioning) must have completed at least three of the projects submitted for consideration. The Subcontractor must submit the final cost of their portion of the project along with the other required information.
