Red lines and outlines on the plan sheets indicate application coverage areas. Not all features listed and described within this contract are included on the plan sheets.
3.1.2 General Work Requirements
The contractor shall complete all work and apply all chemicals in a manner that does not cause general damage and protects all non-targeted areas and species from damage. The contractor shall be liable for all damage resulting from the misuse and application of chemicals not in accordance with applicable laws, regulations, the manufacturer’s instructions, and the requirements of this contract.
3.1.2 Coverage Areas
Identified area or length amounts subject to herbicide chemicals application are approximate and within a reasonable plus or minus of the stated amounts. The Contractor may perform field determinations of actual areas prior to chemical application. If there is a significant difference between the stated area and the field determined area, the area will either be adjusted in the field or a cost adjustment will be applied to the contract. The field method of determining the coverage area shall be approved by the Government prior to completing the field measurement.
3.1.3 Scheduling
Unless otherwise approved by the Government, chemical application shall be scheduled within the calendar limits identified within this contract. The Contractor shall plan, coordinate, schedule, and complete the chemical application at the earliest period within the calendar limits whereas the weather and site conditions are favorable for chemical application. This is necessary to avoid scheduled work towards the tail end of the available period not being completed because of unfavorable weather or unfavorable site conditions. Services rendered outside the specified calendar limits shall not be compensated unless specifically approved in writing by the Government. Unless otherwise noted, herbicide application services shall be performed during the daylight hours between the hours of 7:30 a.m. and 9:00 p.m. The Contractor shall submit the proposed schedules or changes to the schedule to the Government in advance of the work and as required by this contract.
3.1.4 Field Objects
The Contractor shall be responsible for removing and returning the original locations, without damage, all removable objects within the coverage area, such as picnic tables, necessary to facilitate herbicide chemical application.
3.1.5 Performance Requirements
Application performance requirements generally shall be as identified by the chemical manufacturer. In the absence of the performance requirements provided by the chemical manufacturer, an acceptable level of performance shall be 95% kill of all intended broadleaf and grass weeds and woody vegetation within each coverage area. Regardless of the manufacturer’s performance requirements, spot coverage shall be 100% kill of all intended broadleaf and grass weeds and woody vegetation unless otherwise approved by the Government.
3.1.6 Equipment
Equipment problems shall not relieve the Contractor of the responsibility of performing the work as specified. It shall be the responsibility of the contractor to assure applicable, sufficient, and reliable equipment and as necessary, sufficient alternative sources of equipment to be fully compliant and perform the services of this contract.
3.1.7 Weather and Site Conditions
In the event weather conditions interrupt performance of scheduled services, the services shall be resumed as soon as conditions permit, and work completed within the allotted timeframe(s) (as adjusted for weather delay).
