F-2 RETURN OF THE VESSEL

Contractor shall coordinate and complete the various items of work in sufficient time to allow for aligning and starting up the support systems needed for dock trials. The contract time shall include sufficient time

– up to 16 hours - for the vessel to take on approximately 150,000 gallons of fuel oil and 5,000 gallons of lube oil prior to dock trials. No hot work will be allowed while oil is being transferred. After all repairs and trials are completed, the Government shall accept return of the vessel at the sea buoy where the vessel was delivered to the contractor.

The time of returning the vessel to the Government shall be the closest hour after acceptance of the vessel by the Government.

F-3 DELIVERY SCHEDULE.

The work will be completed within one hundred and fifty (150) calendar days after delivery of the dredge to the Contractor.

F-4 COMMENCEMENT, EXECUTION AND COMPLETION

a. The Contractor shall be required to commence work under the Contract immediately upon delivery of the vessel to him, to execute the work with diligence and to complete the work, including dock and seas trials and deliver the vessel to the Government, within the time stated in the Contract.

b. Liquidated Damages. In case of failure on the part of the Contractor to complete work within the time fixed in the Contract or any extension thereof, the Contractor shall pay the Government liquidated damages at the rate of $17,735.98 for each calendar day of delay until the work is completed and accepted. For the purpose of assessing liquidated damages, the above rate is based on a 24-hour day.

F-5 SCHEDULE AND PROGRESS OF WORK

Each prospective Contractor shall submit a schedule with his bid a schedule for accomplishing all work.

The schedule shall include a bar chart for each item, including unit price items, and shall show start and completion date of all items, including dock trials. The chart shall indicate the order (Critical Path) in which the Contractor proposes to accomplish all work. Items shall be scheduled for earliest possible completion, commensurate with good ship repair practice and availability of materials.

After award, the contractor shall update the schedule weekly; reflecting actual progress attained (Percentage of work completed for each item) in comparison with the proposed schedule and identify the current Critical Path through the remaining work items. SUPPLEMENT each progress report with a comprehensive WRITTEN NARRATIVE describing (1) the amount of progress on major work items during the reporting period, (2) problem areas uncovered, (3) known or anticipated delays, and causes thereof, together with the impact on the work, and (4) corrective action taken or proposed in connection with the latter. Eight (8) copies of the weekly progress report shall be furnished to the Government's Technical Representative on the site.

Physically meet with the COR weekly to discuss progress, problems and forthcoming schedule requirements. If, in the opinion of the Contracting Officer, the Contractor falls behind the progress schedule, the Contractor shall take such steps as may be necessary to improve his progress and the Contracting Officer may require him to increase the number of shifts and/or overtime operations, days of work, and/or amount of plant and to submit such supplementary schedules in chart form as may be deemed necessary to demonstrate the manner in which the agreed rate of progress will be regained, all without additional cost to the Government.

Failure of the Contractor to comply with the requirements of the Contracting Officer under this provision may be grounds for determination by the Contracting Officer that the Contractor is not executing the work with such diligence as will insure completion within the time specified. Upon such determination, the Contracting Officer may terminate the Contractor's right to proceed with the work, or any separable part thereof, in accordance with DEFAULT Clause.

F-6 MATERIALS AND EQUIPMENT SCHEDULE

After Notice To Proceed, the contractor shall develop a schedule of all items, including major stock materials (excluding nuts, bolts, gaskets, consumables, etc.), to be used in the repair of the vessel. The schedule shall be prepared in ‘spread sheet’ format and contain the following information:

Component/equipment Quantity Vendor name and address Make, model and options Drawing references (if appropriate) Purchase Order or Contract Number Scheduled order date Actual order date Scheduled (promised) receipt at shipyard Actual receipt at shipyard

After submittal, review, revision and approval by the COR, the schedule shall be updated and submitted to the Government bi-weekly. Final submission to the COR shall include priced copies of all purchase orders, purchase specifications and receipts.

Upon written approval of the schedule by the COR, the contractor is authorized to proceed with procurement of all items and materials in the schedule.

At any time during the contract, the COR may request and the contractor shall furnish, priced copies of all purchase orders, purchase specifications and material receipts.

F-7 PROTECTION OF MATERIAL & WORK.

At the beginning of the contract period, a jointly conducted condition survey shall be made of the entire vessel, including all machinery, piping, decks, bulkheads, overheads, hopper areas, electrical wiring and fixtures, and the condition of all equipment and areas recorded in a written report submitted to the COR.

At the conclusion of the repair work and prior to dock trials, the joint condition survey will be conducted again and any damages or disturbed conditions noted on the vessel but not recorded on the initial survey will be repaired by the Contractor at his expense.

Prior to commencement of any work, all interior decks and bulkheads must be sufficiently covered as specified in Line Item H-103. The deck and bulkhead coverings must be sturdy and replaced or reinstalled whenever disturbed. The bulkhead coverings must extend a minimum of 6 feet above the deck. The coverings will be removed during dock trials and the decks and bulkheads cleaned of all dirt and grease.

Openings for all hatches removed shall be covered during non-working periods and during inclement weather. Temporary covers shall be constructed of plywood, marked “HOLE” and be strong enough to support 200 pounds without deflecting. Adequate measures shall be taken to insure a weathertight ship during inclement weather. Hatches which have been removed shall be hose tested at completion of repair period and proven watertight.

Shipyard personnel shall not use the vessel's lighting system for extension lights or portable tools. Vapor tight globes and guards on ship's lighting system shall not be removed. If additional lighting or power for tools is required, the Contractor shall provide necessary extension cords and receptacles.

At all times when the vessel is in the custody of the Contractor and the temperature is below 35 degrees F, the Contractor shall keep all pipelines, fixtures, traps, tanks, dredge pumps, all auxiliary pumps and other receptacles on the vessel from freezing and causing damage. This shall be done by either draining or heating the area. The Contractor shall keep working areas clean, and wash, paint and repaint as necessary to keep areas "as found" or better during the contract period. Work areas shall be cleaned prior to commencement of work so that work under these specifications can be safely accomplished.
