H-2 UNIT PRICE ITEMS

Certain items are identified as "(Unit Price)" items in the bidding schedule and in the technical specifications. The total price for these items will be determined by multiplying the unit price by the quantity specified in the item. If work is done on less than the specified quantity, the contract price for such items will be determined by multiplying the unit price by the quantity actually used. The locations and quantities for all unit price items shall be approved by the Government's Technical Representative, in writing.

H-3 ACCIDENT PROTECTION

All work performed under this contract shall be in accordance with the requirements of the U.S. Army Corps of Engineers Safety Manual, EM 385-1-1 and other safety requirements specified herein and further identified in Technical Provision TP-4 STANDARDS.

a. Contractor Accident Prevention & Safety Program.

The page number will be provided in the Remarks section for each Item indicating where the item can be found in the APP. If a “No” is selected an explanation shall also be provided in the Remarks section. The program shall meet EM-385-1-1 and AHA requirements and be prepared and at a minimum shall address the following items:

1. EMPLOYEE SAFETY PLAN

A copy of company policy statement of accident prevention and any other guidance statements normally provided new employees.

2. CONTROL OF HAZARDOUS ENERGY (LOCKOUT/TAGOUT)

Before personnel perform any servicing or maintenance on a system where the unexpected energizing, start up, or release of kinetic or stored energy could occur and cause injury or damage, the system shall be isolated in accordance with the procedures contained in EM-385-1-1, and Engineer Regulation ER 385-1-31. After award of contract but not later than the pre-work conference, the Contractor shall submit his hazardous energy control plan to the Contracting Officer for acceptance. Locks and tags will be placed on circuit breakers, or other appropriate devices, to isolate and identify hazardous energy sources. A SAFE CLEARANCE LOG will be maintained in the Engine Control Room by the Contractor and the Engineer-on-Watch. Two logbooks shall be maintained – one (1) by the Contractor, “the primary” and one (1) by the engineer on watch “the secondary”.

Each logbook will have a lock/tag issue sheet and SAFE CLEARANCE REQUEST FORMS. Corps and Contractor designated authorities shall fully coordinate their control activities for the life of the Contract. Each shall inform the other of their energy control procedures, ensure that their own personnel understand and comply with rules and restrictions of the procedures, and ensure that all employees affected by the hazardous energy control activity are notified. All Contractor lockout/tagout shall have the engineer on watch accompanying Contracting personnel.

During each daily walk-through, safety inspection the logs will be checked for congruence. During this inspection the Contractor shall itemize all existing lockouts, all new lockouts, and all removed tags that morning or the previous day. The Government Safety Inspector or the Engineer of Watch will initial this itemized list. Submit a CONDITION REPORT to the Government’s Technical Representative on a weekly basis, the lists from the week’s inspections.

The Government’s review is intended to be limited to the functional aspects of the submittals with limited technical review of general cursory nature only.

The Contractor shall comply with the requirements of the design embodied in the contract. Where review, approval, classification or certification by ABS, USCG or other regulatory agency is a provision of the contract, Government review of Contractor submittals may not address the requirements of those agencies. The contractor shall take into account that the Government approval of submittals will be contingent upon satisfactory fulfillment of those requirements.

Submittals found to be completely acceptable to the COR without comment will be marked “ACCEPTED - Resubmittal Not Required”.

Submittals found to be generally acceptable to the COR with qualifying comments will be marked “ACCEPTED” but may or may not require resubmission depending on the COR’s assessment of the criticality of the comments.

“ACCEPTED” submittals being resubmitted will be reviewed only to ensure that the previous comments have been adequately incorporated. Resubmission requirements will be clearly listed in the reply letter.

Submittals unacceptable to the COR will be marked “NOT ACCEPTED”. Submittals not accepted will always require full and complete resubmittal. Such resubmittal will result in a full and thorough review as though it was a first submittal.

The Contractor shall insure that all review comments are incorporated in corrected submittal documents or are rebutted in separate correspondence. The contractor is encouraged to completely discuss all submittal comments with the author in order to insure complete and effective communication.

The Contractor will not use the drawing review or submittal process for contract deviations. Changes in equipment, materials, construction techniques or details must be the subject of separate, specific correspondence.

All requests made by the Contractor for deviations, variations or substitutions must be specific and clear as to what is contractually required, the proposed change, location and/or extent, benefits resulting from the change and effect on contract cost and delivery. Refer to Section H-7.

Submittals for review by the Government after award of the contract will generally be return mailed within 14 calendar days after receipt.

Submittals for review by the Government prior to Notice to Proceed will be reviewed with 72 hours of receipt.

Contractors shall plan their submittal schedules so as not to affect contract performance.

H-5 SUBCONTRACTING PLAN

A. SUBCONTRACTING

After receiving the Notice To Proceed, the contractor shall submit a Subcontracting Plan for the contract. This should not be confused with the SUBCONTRACTING PLAN required of Large Business as a part of their affirmative action responsibilities.

The Subcontracting Plan shall identify the areas or features of the contract or vessel which will be performed, all or in part by subcontractors. The plan shall identify the scope of work; subcontractor firm’s name, telephone number and point of contact; and reference to the subcontractor’s proposal or letter of intent.

The Subcontracting Plan shall specifically address the contractor’s plan for design and engineering.

Subletting by subcontractors is subject to these same requirements.

Two sets of black or blue line prints of all updated repair drawings.

One set of high quality (original) Mylar reproducibles of all updated repair drawings.

H-8 SUBSTITUTIONS

‘Substitution’ as used in this clause, is an administrative action, not resulting in a contract change of cost or time.

Prior to issuance of a NTP, the contractor shall prepare and submit a comprehensive list and analysis of any contractor proposed substitutions of the equipment and materials required in the contract.

The Substitution List shall be limited to equipment and materials specifically required by the contract. Equipment and Materials where the contractor has selection responsibility (i.e. ‘similar to’) need not be included in the list.

Each proposed substitution shall be accompanied with a detailed analysis and comparison of the equipment or materials specified and the equipment or materials proposed, including features, dimensions, performance characteristics, benefit to the Government, and the compelling reason why the substitution should be made.

In the absence of compelling reasons for making the substitution, the contractor’s proposal may be denied.

Should the substitution be accepted, the contractor shall be responsible for integrating the substitution into the design.

Such modifications to the design must be completed, submitted for approval, revised as necessary and approved by the COR prior to issuing a NTP.

The Contractor bears ultimate responsibility for satisfactory performance of all systems impacted or affected by an approved substitution as well as the operation of the completed vessel, as affected by the substitution.

Once a NTP has been issued, substitutions will not be considered.

H-9 MANUFACTURER OR SUBCONTRACTOR DRAWINGS AND MANUALS

Manufacturer’s or subcontractor’s drawings may be included in the manual but must be folded to page size.

Manufacturer’s or sub-contractor’s drawings not suitable for inclusion in the manuals must be considered as engineering and design drawings and shall be prepared and submitted in accordance with the requirements of Section

H-5, ENGINEERING.

At least 5 days prior to FINAL INSPECTION, one set of the manuals shall be submitted to the COR for review, comment and/or approval. This set of manuals will be returned to the contractor with approval or comments.

Final submittal of the manuals shall consist of three sets of the manuals and must be completed prior to

PROVISIONAL ACCEPTANCE.

If photocopies (Xerox or similar) of parts lists, text, diagrams, etc., are furnished, one of the sets shall be a “Master” and must be made up of all ‘original’ sheets and be clearly identified as the “Master” copy. Photocopies will be clear with high black/white contrast, sharp lines, full sheet reproduction, and no background shadow or clutter.

The Contractor will be permitted access to the dredge from the time of award until delivery of the vessel for the purpose of taking necessary measurements for the preparation of working drawings and to permit, to the maximum practicable extent, procurement, prefabrication and assembly of materials and equipment.

H-14 INSURANCE

Insurance shall be carried in the amount required by the Master Ship Repair Agreement.

The contractor shall file with the Contracting Officer an affidavit showing that he/she has such insurance. The Contractor shall submit evidence of the insurance level requirements by no later than seven calendar days after receipt of Notice of Award.

H-15 INDEMNIFICATION FOR ACCESS TO VESSELS

Notwithstanding any provision or any other clause of the contract, the Contractor agrees to allow officers, employees, and associates of the Government, or other prime Contractors with the Government and their Subcontractors, and officers, employees, and associates of offerers on other contemplated work, admission to the Contractor's facilities and access to the vessel without any further request for indemnification from any party, which has not been previously included in the contract price.

H-16 NON-SMOKING AREAS

Smoking will not be allowed onboard the vessel by contractor personnel.

H-17 FUELING AND POTABLE WATER

During the repair period, the contractor shall provide unencumbered access to permit fueling of McFARLAND by tanker barge, whether self-propelled or towed, or by truck.

The same applies to delivery of lubricating oil and potable water.

The time and date for fueling shall be mutually agreeable to the COR and the contractor. It is estimated that the refueling and delivery of lubricating oil will take a minimum of 16 hours to complete; this total estimate may be split into two separate intervals dependent on delivery schedule. The contractor shall schedule a ‘window’ of sufficient duration to allow the refueling and delivery of lubricating oil to occur. The contractor is also expected to schedule their work accordingly so any hot work is not delayed or disrupted by the fueling; any delays or disruptions to the schedule will be the sole responsibility of the contractor.

All safety rules and requirements regarding cessation of hot work, open lights, etc., by the contractor, fuel supplier and ship’s crew, shall be strictly adhered to.

H-18 SHIPYARD PERSONNEL

Shipyard personnel, outside of Lead Foremen and Shipyard Management, are not permitted in spaces where work is not being performed. The shipyard, during the morning progress meetings, shall inform the Government of all the spaces where shipyard workers will be located. Any workers found outside of the work areas will be required to leave the vessel immediately.

The contractor shall provide bathroom facilities (portable toilets) near each gangway onto the Dredge McFARLAND for use by shipyard personnel. The use of the heads and sinks onboard the vessel by shipyard personnel is prohibited.

The contractor shall also provide a suitable area or facilities off the vessel for shipyard personnel to eat their lunch and dinner meals. Eating anywhere onboard the vessel by shipyard personnel is prohibited.

H-19 SHIP’S CREW

The contractor shall note that the entire ship’s crew will remain aboard the vessel throughout the contract period, sleeping aboard and receiving 3 meals similar to normal dredging operations. The Government will provide all meals to the ship’s crew.

The majority of the crew will be on duty from 0800 to 1630 daily including Saturday and Sunday engaged in various repair and maintenance work on the dredge, with only a nominal ‘security watch’ from 1630 to 0800.

Work producing high levels of noise should be scheduled between the hours of 0700 and 1900, whenever possible.

The crew shall have access to a lit, secure parking facility within the contractor’s facility at all times. The crew shall also have access to pay telephones within the contractor’s facility at all times.
