EPA TERMS

1.0 Economic Price Adjustment (EPA)

This paragraph details how Section 00 72 00, FAR 52.216-4 Economic Price Adjustment-Labor and Material applies to this contract. Applicable CLINs, commodities, applicable indices, processes, and limitations are outlined in the following paragraphs of this section. Paragraph 1.4 Establishing the Baseline must be completed as a part of contractor proposal

1.1 Applicability

The terms of these supplementary conditions will apply to the following CLINs.

1.2 Commodities and Indices

1.2.1 Stainless Steel Castings and Plates will utilize Bureau of Labor Statistics index WPU101508 to calculate EPA. This index can be found at https://beta.bls.gov/dataViewer/view/timeseries/WPU101508.

1.2.2 Steel (Cold Rolled and Standard Plate) will utilize Bureau of Labor Statistics index WPU101707 to calculate EPA. This index can be found at https://beta.bls.gov/dataViewer/view/timeseries/WPU101707.

1.2.3 Copper will utilize Bureau of Labor Statistics Index WPU102403 to calculate EPA. This index can be found at https://beta.bls.gov/dataViewer/view/timeseries/WPU102403.

1.3 Submission Process and Limitations

Economic Price Adjustments can result in both increases and decreases to the item price. The Contractor shall notify the Contracting Officer if, at any time during contract performance, the indices for material shown in paragraph

1.2 either increase or decrease to the extent that they could constitute a net change of at least 3 percent of the then-current unit price.

1.3.1 Submission Process

The Contractor shall furnish this notice within 60 days after the increase or decrease, or within any additional period that the Contracting Officer may approve in writing, but not later than the date of final payment under this contract. The notice shall include the Contractor's proposal for an adjustment in the contract unit prices to be negotiated, and shall include, in the form required by the Contracting Officer, proof of purchase, effective date, amount of the increase or decrease and the amount of the Contractor's adjustment proposal. When the EPA is determined to be warranted, a contract modification will be executed, and a pay activity will be added to the applicable CLIN to pay for the increase or decrease.

1.3.2 Limitations

There shall be no adjustment for any change in unit prices for material which would not result in a net change of at least 3 percent of the then-current total unit price. The aggregate of the increases in any contract unit price made under this clause shall not exceed 10 percent of the original unit price. There is no percentage limitation on the number of decreases that may be made under this clause.

Any adjustment shall be limited to the effect on unit prices of the increases or decreases in the unit prices for material shown in the Schedule. There shall be no adjustment for:
