1.8 CONSTRUCTION LABOR STANDARDS

This paragraph applies to all onsite work. The Contractor and all subcontractors must comply with the following labor standards, statutes, and regulations: Davis-Bacon Act; Contract Work Hours and Safety Standards Act; Copeland Act; Secretary of Labor's regulations (Parts 3 and 5, Subtitle A, Title 29, Code of Federal Regulations). Submit a serial letter identifying the crafts and wage rates for all Prime and subcontractor employees to whom the Contract's construction wage rate requirements apply. The Government will review these crafts and rates for conformance with the wage determination.

1.8.1 Coverage

Contract provisions relating to wages, overtime, payroll deductions, and other labor standards requirements cover foremen, laborers, and mechanics, including owner-operators of other than hauling equipment and other individual enterprises performing the duties of a laborer or mechanic.

Bona fide owner-operators of hauling equipment, such as trucks, who are independent Contractors, are not covered, and the certified payrolls, including the names of such owner-operators, need not show hours worked nor rates paid, but only the notation "owner-operator".

1.8.2 Wages

Wages must be paid at least once a week and be computed at hourly rates not less than those set forth in the Contract wage schedule, as set by the Davis-Bacon Act wage determinations, for the particular classifications of work performed.

1.8.3 Overtime

Pay overtime for work in excess of 40 hours in any workweek at not less than one and a half times the basic rate of pay. Rates paid for fringe benefits are excluded in the computations of overtime.

1.8.4 Deductions

Deductions from wages earned may be only those that are permitted by the Copeland Act (Anti-Kickback) regulations.

1.8.5 Apprentices

Comply with the requirements of 29 CFR 5.5 (a)(4)(i) with respect to apprentices.

1.8.6 Payrolls

Prepare and submit correct Weekly Payrolls, including those of subcontractors. Incorrect and delinquent payrolls will delay processing of partial payment estimates.

1.8.7 Supply and Use of Electronic Software for Processing Wage Rate Requirements

a. The Contractor is encouraged to use a commercially-available electronic system to process and submit certified payrolls electronically to the Government. The requirements for preparing, SECTION 01 10 00.00 25 Page 5

R processing and providing certified labor payrolls are established by the Wage Rate Requirements statute.

b. If the Contractor uses an electronic payroll processing system, then the Contractor is responsible for obtaining and providing for all access, licenses, and other services required to provide for receipt, processing, certifying, electronically transmitting to the Government, and storing weekly payrolls and other data required to comply with the Wage Rate Requirements statute. When the Contractor uses an electronic payroll system, the electronic payroll service must be used by the Contractor to prepare, process, and maintain the relevant payrolls and basic records during all work under this Contract and the electronic payroll service must be capable of preserving these payrolls and related basic records for the required three years after Contract completion. If the Contractor chooses to use an electronic payroll system, then the Contractor must obtain and provide electronic system access to the Government, over the duration of this construction Contract. The access must include electronic review access by the Government to the electronic payroll processing system used by the Contractor.

c. Provision and use of an electronic payroll processing system must meet the following basic functional criteria:

(1) commercially available;

(2) compliant with appropriate Wage Rate Requirements statute payroll provisions in the Federal Acquisition Regulation (FAR);

(3) able to accommodate the required numbers of employees and subcontractors planned to be employed under the Contract;

(4) capable of producing an Excel spreadsheet-compatible electronic output of weekly payroll records for export in an Excel spreadsheet to be imported into the Contractor's Quality Control System (QCS) version of Resident Management System (RMS), that in turn must export payroll data to the Government's RMS;

(5) demonstrated security of data and data entry rights;

(6) ability to produce Contractor-certified electronic versions of weekly payroll data;

(7) ability to identify erroneous entries and track the date/time of all versions of the certified Wage Rate Requirements statute payrolls submitted to the Government over the life of the Contract;

(8) capable of generating a durable record copy, that is, a CD or DVD and PDF file record of data from the system database at end of the Contract closeout. This durable record copy of data from the electronic payroll processing system must be provided to the Government during Contract closeout.

d. All incurred costs related to the Contractor's provision and use of an electronic payroll processing service must be included in the Contractor's price for the overall work under the Contract. The costs for compliance with the Wage Rate Requirements statute by using electronic payroll processing services must not be a separately bid or reimbursed item under this Contract.

1.10 PARTNERING

a. The Government intends to encourage the foundation of a cohesive partnership with the Contractor and its subcontractors. This partnership will be structured to draw on the strengths of each organization to identify and achieve reciprocal goals. Among the objectives are effective and efficient Contract performance and are intended to achieve completion within budget, on schedule, and in accordance with the plans and specifications; and to develop a single cooperative management team focused on the success of the project to mutual benefit of all stakeholders. This partnership will be bilateral in makeup, and participation will be totally voluntary. Any cost associated with effectuating this partnership will be agreed to by both parties, and will be shared equally with no change to the Contract price. An integral aspect of partnering is the resolution of disputes in a timely, professional, and non-adversarial manner through the use of issue clarification and problem solving. Alternate Dispute Resolution (ADR) methodologies will be encouraged in place of the more formal dispute resolution procedures. ADR will assist in promoting and maintaining an amicable working relationship to preserve the

b. Contractor participation in partnering is mandatory, key on-site and home office management personnel will be required to attend a full day partnering session as directed by the Government with an outside facilitator. The cost of this facilitated session is anticipated to be around $5,000 and will be shared equally between the Contractor and the Government.

1.11 EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE

a. This special Contract requirement does not apply to terminations.

See FAR Part 49.

b. Allowable cost for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a Contractor or subcontractor at any tier must be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the Contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the Contractor's accounting records, costs for that equipment must be based upon the applicable provisions of EP 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region VIII. Working conditions must be considered to be average for determining equipment rates using the schedule unless specified otherwise by the Contracting Officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations must apply. For retroactive pricing, the schedule in effect at the time the work was performed must apply.

c. Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36, Rental Costs. Rates for equipment rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.

d. When actual equipment costs are proposed and the total amount of the pricing action exceeds the SAT, the Contracting Officer must request the Contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. The data must be submitted on Standard Form 1411, Contract Pricing Proposal Cover Sheet.

1.12 BASIS FOR SETTLEMENT OF PROPOSALS

a. Actual costs will be used to determine equipment costs for a settlement proposal submitted on the total cost basis.

b. In evaluating a termination settlement proposal using the total cost basis, the following principles will be applied to determine allowable equipment costs:

(1) Actual costs for each piece of equipment, or groups of similar serial or series equipment, need not be available in the Contractor's accounting records to determine total actual equipment costs.

(2) If equipment costs have been allocated to a Contract using predetermined rates, those charges will be adjusted to actual costs.

(3) Recorded job costs adjusted for unallowable expenses will be used to determine equipment operating expenses.

(4) Ownership costs (depreciation) will be determined using the Contractor's depreciation schedule (subject to the provisions of Federal Acquisition Regulation (FAR) 31.205-11).

(5) License, taxes, storage and insurance costs are normally recovered as an indirect expense and unless the Contractor charges these costs directly to Contracts, they will be recovered through the indirect expense rate.

a. De-water and prepare the unit for Contractor access (including installation of the work platform) after successful completion of 72 hour run in - 10 working days.

b. Removal of work platform, re-water, and prepare the unit for Commissioning - one week.

1.5 FIELD VERIFICATION OF SITE CONDITIONS

Field verify all elevations, dimensions, and coordinates of existing features indicated on the contract drawings that affect new construction.

Any deviations will be updated by the Contractor as per Section 01 78 39.00 25, PROJECT RECORD DOCUMENTS, paragraph WORKING AS-BUILT DRAWINGS.

1.6 GOVERNMENT ISSUED ITEMS

Return to the Government all items issued to the Contractor from the Government, including but not limited to the following: keys, ID and security badges, radios, pagers, and excess/unused Government Furnished Property/Equipment. Submit documentation signed by the Contractor and Contracting Officer (CO) indicating items have been returned or fully accounted for. Format of submittal will be discussed and agreed upon at the Pre-Work Meeting.

1.7 EQUIPMENT LIST

Furnish a complete list of all equipment to be used on the Project 30 days prior to commencement of on-site work. Submit a revised list in the event of change of equipment. Lists to include rented equipment as well as lease-purchase or sale-leaseback equipment. The initial list and the revised lists must indicate dates equipment is assigned to or removed from the Project and adequate identification or description of each item of equipment including manufacturer's name (abbreviated), model number, manufacturer's serial number, year of manufacture, and Contractor's assigned serial or record number.

1.8 TESTING OF EQUIPMENT

1.10 PROTECTION AND RESTORATION OF EXISTING FACILITIES

Protect all existing facilities whether or not shown on the drawings or referenced in the specifications. Upon completion of the work, all the existing facilities, not included as a portion of the work, must be left in a condition equal to the original condition prior to the Contract. Costs for repair and restoration of any facilities must be considered to be incidental to the work and included in the Contract price.

1.11 ASBESTOS

Asbestos Abatement will be performed by the Government. The Government performed an Asbestos Survey in 2022; this survey is included in Attachment A24. The Government anticipates Asbestos Work as follows:

a. General Conditions. Prior to work on each unit, the Government will perform extensive pre-disassembly wipe sampling for ACM. If the testing shows greater than or equal to 100,000 structures per square centimeter, the Government will have an abatement contractor clean the generator, air housing, and other affected areas to the best that can be accomplished prior to any disassembly. Additionally, for work during disassembly and removal of existing windings, disturbed areas containing ACM in amounts greater than or equal to 100,000 structures per square centimeter, the Government will have the areas abated.

b. Air Housing Wiring. Most of the units still contain Asbestos Wiring within the Air Housing. If the Unit selected for TRGR still contains Asbestos Wiring, the wiring will be removed prior to turning the unit over to the Contractor. The Government will remove the affected wiring and conduits in their entirety and will exercise the option for the Contractor to re-establish the circuits during TRGR.

c. Rotor and Stator. Bulk sampling has not revealed Asbestos in the Rotor and Stator. However, it is known that Asbestos Brake Pads were used for many years. The Government has determined it is a best practice to wipe down the rotor and stator once the unit has been disassembled. This will be completed by the Government. After disassembly, the Contractor must erect a containment structure around the rotor to facilitate the cleaning by the Government. The Contractor must also provide a safe working platform and overhead enclosure within the barrel for working on the stator. It is permissible to use the existing brake bracket as the working platform. The Contractor must include this work on their schedule with the duration described in 52.211-10. The Contractor must notify the Government at least 60 days in advance of the enclosures being ready.

d. Gaskets (Air Piping, Vacuum Breaker, Nose Cone). Most of the Asbestos gaskets have been removed and replaced, but the Government did not maintain detailed records. Unless tested otherwise, these gaskets should be assumed to be ACM. Provide a Notification for Gasket Removal at least 14 calendar days prior to breaking the connection. When the Contractor is ready to break the connection, Government Asbestos Workers will be made available to remove the gasket. If the Government can demonstrate the Gasket is not ACM, the Contractor will be responsible for removal in its entirety.

e. Water Piping. The Asbestos Survey shows existing water piping to have Asbestos in the insulation. The Contractor must develop and submit a Water Piping Removal Plan identifying what piping will be disturbed, the extent of insulation removal required, and when the insulation must be removed. The Government will remove the asbestos insulation. The Contractor will be responsible for providing new insulation upon re-establishment of the piping. Submit the plan at least 90 calendar days prior to planned date for water piping work.

1.12 PRE-WORK AND POST WORK SURVEYS

Conduct a pre-work survey for each definable feature of work prior to start of on-site work and a post-work survey during project closeout, with the CO Representative, of the Government facilities at the work areas. The results of the surveys must be documented by digital photographs and descriptive narrative reports. A color copy of the survey photographs and narrative reports must be submitted to the CO within five days after survey has been completed.

1.13 CARE OF DRAINS

Existing Powerhouse floor drains must not be used for disposal of any solid material or any liquids other than clear water. The Contractor must demonstrate that the pipes and drains are unobstructed when so directed.

1.14 PROTECTION OF POWERHOUSE FLOORS

a. Prevent damage to floors (tile and non-tile) and curbs within floor areas used for storing material for extended time. Protection must include a continuous layer of oil-impervious Kraft paper over the existing floor surface with joints of the Kraft paper joined with an appropriate tape. In addition, tongue and groove 3/4-inch-thick Oriented Strand Board (OSB) plywood must be installed over the Kraft paper at all work and storage areas. Plywood joints must be fastened to ensure edges of plywood sheets are, and remain, flush with each other and do not pose a tripping hazard during execution of this work.

Minimum 4-inch by 4-inch wood timbers must be installed along existing curb features within the contractor work areas and along perimeters of the work areas. Wood timbers used for curb protection must be secured in place without anchoring into the existing floors or curbs.

b. Pipe trenches to remain accessible even if covered. All designations relating to fire protection equipment that get covered must be remarked by the Contractor after covering. Provide additional blocking and timbers when required. Also suitably protect other surfaces of work. Damage to floors or curbs caused by Contractor's operation must be repaired at no additional cost to Government.

Repairs must match surrounding area in color, texture, and surface finish and are subject to approval. Work in the Powerhouse must not start until floor and curb protection is completed, as specified.

c. Do not exceed the floor design loads as listed below and shown on Contract Drawings JDP-8-0-0/33, JDP-8-0-0/37, and JDP-8-0-0/41, unless approved by the CO. Do not stage materials on, drive vehicles on, or otherwise load hatch covers.
