About this file
This document provides a presolicitation notice for industry review of 95% design plans for the John Day Dam Turbine Runner Replacement and Generator Rewind Project. The U.S. Army Corps of Engineers, Northwestern Division, Portland District is seeking feedback on design documents for a potential hybrid design-build contract valued at over $500 million. The project scope involves replacing turbine runners and rehabilitating generators at John Day Dam to improve fish passage, power generation efficiency, and reliability over the next 15+ years. Interested contractors are invited to request a two-hour teleconference or web meeting by March 3rd to discuss capabilities and recommendations. The Army Corps will use information from these discussions to inform development of a final solicitation for a fixed-price C contract to be issued in June 2024, with performance stages from 2025-2040.

Execu ve Order (E.O.) 14063, Use of Project Labor Agreements (PLA) for Federal Construc on Projects requires a PLA for all large‐scale construc on projects valued at $35M or more unless one of the following excep ons apply. If applicable, the PLA will be required with your offer prior to the solicita on closing due date and me.
Excep ons (FAR 22.504 (d)):
(i) Requiring a project labor agreement on the project would not advance the Federal Government's interests in achieving economy and efficiency in Federal procurement. The excep on shall be based on one or more of the following factors:
(A) The project is of short duration and lacks operational complexity.
(B) The project will involve only one craft or trade.
(C) The project will involve specialized construc on work that is available from only a limited number of contractors or subcontractors.
(D) The agency's need for the project is of such an unusual and compelling urgency that a project labor agreement would be impracticable.
(ii) Market research indicates that requiring a project labor agreement on the project would substantially reduce the number of potential offerors to such a degree that adequate competition at a fair and reasonable price could not be achieved. (See 10.002(b)(1) and 36.104). A likely reduction in the number of potential offerors is not, by itself, sufficient to except a contract from coverage under this authority unless it is coupled with the finding that the reduction would not allow for adequate competition at a fair and reasonable price.
(iii) Requiring a project labor agreement on the project would otherwise be inconsistent with Federal statutes, regulations, Executive orders, or Presidential memoranda.
Excep ons must be approved by the senior procurement execu ve and reported to the Office of Management and Budget (OMB).
Unless an excep on applies, the TRGR project will require a PLA. Please provide wri en responses to the following ques ons via email to Aragon.N.Liebzeit@usace.army.mil on or before close of business on 13 March 2024.
1. Have you ever used a PLA? If so, please provide project informa on.
2. If this project requires a PLA, how likely are you to submit a proposal?
3. If this project requires a PLA, how do you an cipate this impac ng your pricing?
4. If this project requires a PLA, how do you an cipate this would impact your proposal submission meframe?
5. If this project requires a PLA, do you an cipate any increases in economy and efficiency and if so, how?
6. If this project requires a PLA, and no EPA clause for labor escala on is included, how will this affect your firm’s ability to mi gate cost risk in your proposal?
7. Please feel free to provide any other informa on regarding E.O. 14063.
