| Q&A for W9124R-24-R-0001 | |||||
| Question # | Subject / Discussion | Attachment or # RFP Section | Document Paragraph # | Question/Comment | Answer |
| Q.1 | Quantity/class of union employees receiving Lead Premium Pay. | ATCH-D Collective Bargaining Agreement | Article 12 Wages and Job Classification, Others | Please identify the number of personnel per lbor classification that are receiving Lead Premium pay. | Aircraft Lead Mechanic, Supply Lead, Aircraft Electronics (Avionics) Mechanic Lead, Tower Chief (Lead) receive lead premium pay. |
| Q.2 | Estimated hours and/or additional labor hour cost applicable to Crew Chief pay while serving aboard flight missions. | ATCH-D Collective Bargaining Agreement | Article 12 Wages and Job Classification, Others | Per the CBA, Crew Chiefs will be paid an additional fifteen ($15.00) dollars per hour during flight missions aboard an aircraft only. Is there estimated hours or percentage that we should include in our pricing? | Three crew chiefs and at an average each crew chief uses 30 hours per year for currency and missions when needed. |
ATCH E - Estimated Workload Data has been revised to include the crew chief premium estimated hours.
Q.3 Main Issue: Retrieving Resumes and Letters of Commitment for Key Personnel who work for the IAM (Union).
Sub Issues:
1) Bidders may receive any or no Resumes or Letters of Commitment for the key personnel (who are also Union employees), as the Union apparently, operates with no legal compulsion to make key employees available for resume-interviews and Letter of Commitment discussions with bidding contractors.
It is unclear how bidders are expected to retrieve and develop detailed resume information without direct access to key employees.
2) This restrictive engagement model by the Union effectively prohibits a bidder’s ability to submit a compliant and complete Proposal to the Government, thereby, providing competitive advantage to the incumbent contractor.
Explanation:
| A representative from the IAM contacted our firm following our previous discussion with a Union employee, requesting that we have no contact with them, but instead, direct our requests to the IAM, their bargaining agent. | ATCH-D Collective Bargaining Agreement | L.2.e Vol I Technical (2) Section 2 Subfactor b | Clarify, please how bidders should address the RFP section L requirement to deliver 1) Resumes and 2) Signed Letters of Commitment with the Proposal, given the cited constraints and limitations. | The Key Personnel have been reduced to the Program Manager and the Alternate Program Manager which are not members of the union. Therefore, the SCA does not apply to bona fide executive, administrative, or professional employees who meet the exemption criteria set forth in 29 CFR Part 541. In essence, Program Managers and key employees who qualify as executive, administrative, or professional employees under these criteria would not be covered by the SCA. | ||
