* In Section H.24 (Rates of Wages), please check the referenced wage rates. AL56 is Residential for Russell County and AL140 was withdrawn on 10/6/17. AL6 is correct.
Should AL91 (building) and AL120 (heavy) be included?
Gov’t Response: Please use the Unit Price Book which accounts for the latest Davis Bacon Wage rates. The contract award will reference the most recent Davis Bacon Wage rates.
* Section L mentions the SF 1442, but the SF 33 form is used in Section A. Should offerors should assume that the instructions for the SF 1442 apply to the SF 33?
Gov’t Response: The form will not change, please propose based on the instructions set forth in the RFP form SF33.
* Drawing C2 (civil- grading and drainage plan) in the Trial Proposal Drawing Set (Attachment J26) does not include any contours with elevations for site work. Typically, civil drawings for grading include both existing and designed/future surface elevation contours.
Can the Army provide a revised drawing that includes the existing and proposed site elevations so that offerors may use this information to develop their civil estimate?
Gov’t Response: The drawings for C2 has been revised and will be updated in a solicitation amendment.
* RFP paragraph L.6.1.1.1 requires offerors to reference 13CFR121.103h to determine whether their JV is eligible to submit a proposal. In 13CFR121.103h(3)(iii), it says that the SBA must approve JVs pursuant to 13CFR124.513. Does this mean that both JV partners must be small business, that the 8(a) must own at least 51% of the company, and that the 8(a) must perform at least 40% of the work performed by the JV?
Gov’t Response:
Both JV partners must be small businesses. IAW 13CFR124.513(a)(2)(b) A joint venture of at least one 8(a) Participant and one or more other business concerns may submit an offer as a small business for a competitive 8(a) procurement so long as each concern is small under the size standard corresponding to the NAICS code assigned to the contract.
The 8(a) must own at least 51% of the company.
The 8(a) must perform at least 40% of the work performed by the JV.
According to §124.513(d)(2)(ii), “The amount of work done by the partners will be aggregated and the work done by the 8(a) partner(s) must be at least 40% of the total done by all partners. In determining the amount of work done by a non-8(a) partner, all work done by the non-8(a) partner and any of its affiliates at any subcontracting tier will be counted.”
The above guidance substantiates the Army and SBA’s efforts to support meaningful Joint Ventures in the execution of this requirement where 8(a) concerns contribute resources and expertise to the JV arrangement, rather than it’s 8(a) status.
