SECTION 00800 - SPECIAL CONTRACT REQUIREMENTS
BEFORE STARTING CONSTRUCTION
Contractor’s Review of Contract Documents: Before undertaking each part of the Work, Contractor shall carefully study and compare the Contract Documents and check and verify pertinent figures therein and all applicable field measurements. Contractor shall promptly report in writing to the Contracting Officer's Representative (COR) any conflict, error, ambiguity, or discrepancy which the Contractor may discover and shall obtain a written interpretation or clarification from the KO before proceeding with any Work affected thereby.
Preliminary Schedule: Within ten calendar days after the Effective Date of the Contract, Contractor shall submit to the assigned Fort Knox Directorate of Public Works (DPW) - Engineering and Services Division (ESD) Inspector for its timely review:
1. A preliminary progress schedule indicating times for starting and completing the various stages of the Work, including Milestones specified in the Contract Documents.
2. A preliminary schedule of values for all of the Work which includes quantities and prices of items which when added together equal the Contract Price and subdivides the Work into component parts in sufficient detail to serve as a basis for progress payments during the performance of the Work. Such prices will include an appropriate amount of overhead and profit applicable to each item of the Work.
INITIAL ACCEPTANCE OF SCHEDULES
Unless otherwise provided in the Contract Documents, at least ten calendar days before submission of the first Application of Payment a conference attended by the Contractor, Project Manager and ESD Inspector, and others appropriate will be held to review acceptability of the Schedules. Contractor shall have an additional ten days to make corrections and adjustments to the Schedules and resubmit the Schedules. No progress payment will be approved by the ESD Inspector until acceptable schedules are submitted to the Inspector.
Such acceptance of the Schedules will not impose on the ESD Inspector responsibility for the progress schedule, for sequencing, scheduling, or progress of the Work nor interface with or relieve Contractor from Contractor’s full responsibility therefore.
Contractor’s schedule of values will be acceptable to the ESD Inspector as to form and substance if it provides a reasonable allocation of the Contract Price to component parts of the Work.
SCHEDULE OF VALUES
The schedule of values established in the above section "Before Starting Construction" will serve as a basis for the progress payments and will be incorporated into a form of Application for Payment acceptable to the ESD Inspector.
Progress payments on account of Unit Price Work will be based on the number of units completed.
PROGRESS PAYMENTS
Progress payments will be made in accordance with the approved Schedule of Values as established in paragraph 2, with a retainage of 20 percent of the assigned value of the assigned Work.
If payment is requested on the basis of material and equipment not incorporated in the Work but delivered and suitably stored at the Site, or at another location agreed to in writing, the Application for Payment shall also be accompanied by a bill of sale, invoice, or other documentation warranting that the material and equipment are free and clear of all Liens and evidence that the materials and equipment are covered by appropriate property insurance or other arrangements to protect the Government’s interest therein, all of which must be satisfactory to the ESD Inspector.
LIQUIDATED DAMAGES
The parties recognize that Government will suffer financial loss if the Work is not substantially completed with the Contract Time. They also recognize the delays, expense, and difficulty to both parties involved in proving or contesting the amounts of those losses. Instead of proof of those amounts, it is agreed that Contractor shall be liable for and will pay Government the following amounts under Occupant’s Damages, and DPW/ESD’s (Engineering Services Division) Damages, all as liquidated damages, and not as a penalty:
General Construction:
Occupant’s Damages: $ 0.00/day DPW/ESD Damages: $ 2,500.00/day Total Liquidated Damages: $ 2,500.00/day
Liquidated Damages will be assessed for the above listed amount(s) for each and every day the Work remains incomplete after the completion date.
Completion for the above listed item(s) will be defined as completely installed including all associated appurtenances, tested and ready for the intended service.
DAILY REPORTS
Contractor shall submit a “Daily Report” to the ESD Inspector on a daily basis.
This daily report shall contain names of Contractor’s Representative and Sub-Contractor’s names on site, site conditions, weather, etc. for each day of Work. A copy of a Daily Report format will be handed out by Inspections at the Pre-Construction meeting.
ENVIRONMENTAL ISSUES
The Contractor shall contact DPW/EMD (Environmental Management Division) regarding requirements for separation of materials for trash, recycling, and erosion control, etc.

c. Proposed frequency of QCI, which shall as a minimum provide for all interim inspections called for by the specification and submission of a construction contractor quality control report for each calendar day exclusive of weekends and holidays unless work was performed.
The job superintendent shall be required to call in or visit the contract inspection branch between 0730 – 0800 a.m., at 502-624-7188 or the basement of building 1109D. The superintendent shall also be required to complete daily quality control reports (copies furnished at Building 1109) and submit them to the inspector each day.
