Work hours must not vary unless otherwise approved by the Contracting Officer. No work or hauling shall take place on holidays without permission given by the Contracting Officer. Staging and access areas may have limited access beyond these hours of operation.
Refer also to paragraph TEMPORARY ACCESS AND STAGING in Section 01 50 00
TEMPORARY CONSTRUCTION FACILITIES AND CONTROLS.
1.5 SCRAP MATERIAL
Materials specified to be removed and become the property of the Contractor are designated as scrap, and the Contractor, by signing this contract, hereby acknowledges that he/she has made due allowance for value, if any, of such scrap in the contract price.
1.6 UTILITIES
Immediately notify the Contracting Officer in writing if utilities not shown on the Drawings and not visible as to the date of this contract are encountered within the construction limits of the entire project, and such utilities will interfere with construction operations, to enable a determination by the Contracting Officer as to the necessity for removal or relocation. If such utilities are removed or relocated as directed by the Contracting Officer, an equitable adjustment in the contract price must be made pursuant to the Contract Clause CHANGES to cover the cost of any additional pertinent work or delay.
1.7 PLANNED UTILITY OUTAGES AND STREET CLOSURES
All utility outages and street closures to be of as short a duration as possible and to be scheduled as far in advance as possible with the
SECTION 01 00 00 Page 3 March 2022
Contracting Officer, in no case less than 7 days before the outage or closure. Obtain from the Contracting Officer in writing a statement or schedule giving the permissible times of outages or closures for particular installations and the maximum time allowed for each. Strictly observe such schedules and the Contractor will be held responsible for any violations.
1.8 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER
This provision specifies the procedure for the determination of time extensions for unusually severe weather. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.
The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule will reflect these anticipated adverse weather delays in all weather dependent activities.
MONTHLY ANTICIPATED ADVERSE WEATHER DELAY
JAN FEB MAR APR MAY JUN JUL AUG SEP OCT NOV DEC
(07) (07) (06) (03) (02) (01) (00) (00) (01) (02) (04) (06)
Upon execution of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily Contractor Quality Control (CQC) report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day. Refer to ER 415-1-15 .
1.9 HAZARDOUS NOISE AREA
Provide adequate ear protection as may be required for Contractor's personnel at the job site.
1.10 BID ITEM OVERRUN
Throughout the contract (at a minimum, every two weeks), monitor placement or installation of unit price items (if any) with respect to the original estimated quantities shown in the contract. If placement or installation indicates a possible overrun with respect to the original estimated quantities shown in the contract, immediately provide written notification to the Contracting Officer with revised total estimated quantities.
1.11 NON CONTRACT WORK
Do not perform any work or erect any structure for third parties, landowners or otherwise, without prior approval of the Contracting Officer.
SECTION 01 00 00 Page 4 March 2022
1.12 DAMAGE TO ACCESS ROADS AND STAGING AREAS
Preserve and protect all existing private or project access or right-of-way roads, off-site staging area (if applicable), paved bike trails, and pedestrian pathways. At the completion of work and prior to the Contractor leaving the project, restore to pre-project conditions all such access roads, staging areas, paved bike trails, and pedestrian pathways. Repairs include replacement of base rock and/or surface treatment as required and as approved by the County of Sacramento, and removal and replacement of all paved bike trails used as haul routes.

e. Identification of public access and path of travel during various phases of construction.
1.13 ENVIRONMENTAL LITIGATION
a. If the performance of all or any part of the work is suspended, delayed, or interrupted due to an order of a court of competent jurisdiction as a result of environmental litigation, as defined below, the Contracting Officer, at the request of the Contractor, is to determine whether the order is due in any part to the acts or omissions of the Contractor or a subcontractor at any tier not required by the terms of this contract. If it is determined that the order is not due in any part to acts or omissions of the Contractor or a subcontractor at any tier other than as required by the terms of this contract, such suspension, delay, or interruption is to be considered as if ordered by the Contracting Officer in the
SECTION 01 00 00 Page 6 March 2022 administration of this contract under the terms of the SUSPENSION OF WORK clause of this contract. The period of such suspension, delay or interruption is unreasonable, and an adjustment is to be made for any increase in the cost of performance of this contract (excluding profit) as provided in that clause, subject to all the provisions thereof.
b. The term "environmental litigations" as used herein, means a lawsuit alleging that the work will have an adverse effect on the environment or that the Government has not duly considered, either substantively or procedurally, the effect of the work on the environment.
1.14 WORK IN THE FLOODPLAIN AND ACTIVE CHANNEL
The proposed work is located within the floodplain and active channel of the Lower American River. The entire site is subject to seasonal flooding by elevated-flow events. Construction of Site 2-2 and Site 2-3 will require work below water levels typically exceeded during the summer months. The table below provides 95% non-exceedance monthly water surface elevation (stage) computed from hourly stage data recorded at the H-Street stream gage between July 1995 and July 2020. It is the Contractor's responsibility to determine schedule and control of water, and dewatering needs at the project site. The Contractor shall make no claim for costs or damages incurred as a result of having to conduct construction activities during inundated or saturated site conditions for water levels below the monthly 95% non-exceedance values identified in the table below.

1.15 PHASING OF WORK
The proposed work will occur over two construction seasons to accommodate vegetation clearing, reduce parkway impacts, and accommodate other work completed subsequent or concurrent to the completion of Work under this Contract. Plan sheets and bid items labeled as "Year 1" are to be completed during the 2022 construction season (summer and fall 2022), while those labeled "Year 2" are to be completed during the 2023 construction season (summer and fall 2023). Clearing of vegetation in the "Year 2" footprint will not occur prior to "Year 1" work. Work completed in Year 1 will be revegetated under a separate contract in "Year 2." The Contractor must complete Work consistent with this phasing. No Work may begin within the "Year 2" footprint without approval from the Contracting Officer.
1.16 SURVEYING
All surveys for control of the construction and for measurement and payment purposes shall be performed by the Contractor and verified by the Contracting Officer's Representative. The Contractor shall provide unrestricted access to the areas to be surveyed. The Contractor shall be responsible for the preservation of project alignments and elevation benchmark reference points. Reference points damaged or destroyed by the operations of the Contractor will be replaced by the Government at the Contractor's expense. Unless authorized by the Contracting Officer, any work done without line and grade will be done at the Contractor's risk.
The Contractor shall perform all surveys using a Registered Civil Engineer or Licensed Land Surveyor, licensed to perform surveying in the State of California. The Contracting Officer's Representative shall perform quality assurance on the Contractor's surveys. Any discrepancies between the Contractor's survey and the Government's quality assurance will be resolved between the Contractor and the Contracting Officer. The Contracting Officer will make the final determination in the event a satisfactory resolution is not obtained. The survey intervals specified in this paragraph shall be reduced, or additional cross sections or data points shall be added, to document special features such as ramps or changes in grade or as needed to properly document the construction. The Contractor shall provide all survey data to the Contracting Officer's Representative no later than 24 hours after its collection, in an ASCII digital format. The format of the digital data shall be comma delineated as follows: point number, northing, easting, and elevation. The digital submittal shall include a "read me" file containing a description of where the data was taken (including project reach and stationing), the purpose of the survey (i.e., survey for measurement and payment, clearing and grubbing), and the date of the staking and/or data collection for each data file.
In addition to the digital file submittal, a cross section drawing at each station represented by the digital data file shall be submitted to the Contracting Officer's Representative no later than five (5) working days after the data collection. Each subsequent survey shall plot the additional information on the cross section drawing. The drawings shall identify the source data file(s) and date(s) when the survey was performed. The failure of the Contractor to submit the survey data within the time specified will jeopardize the Contracting Officer's Representative ability to evaluate the progress of the work for determining measurement and payment. In addition to the average end area calculations for payment, digital terrain models shall be submitted for
SECTION 01 00 00 Page 8 March 2022 all surveys used to generate construction quantities. All surveys performed for top of levee profiles and for quantity calculations shall be performed with conventional survey methods using total station survey equipment and by performing closed level loop surveys tying to established benchmarks. Cross sections used to quantify measurement and payment items shall extend 10 feet beyond the limits of work. The cross sections shall be tied into the baseline, and a reproducible plot of the section (one 1 inch = 5 feet vertical scale, 1 inch = 20 feet horizontal scale) shall be furnished to the Contracting Officer's Representative.
As a minimum, the Contractor shall furnish the following surveys:
