Refer also to paragraph TEMPORARY ACCESS AND STAGING in Section 01 50 00
TEMPORARY CONSTRUCTION FACILITIES AND CONTROLS.
1.5 SCRAP MATERIAL
Materials specified to be removed and become the property of the Contractor are designated as scrap, and the Contractor, by signing this contract, hereby acknowledges that he/she has made due allowance for value, if any, of such scrap in the contract price.
1.6 UTILITIES
Immediately notify the Contracting Officer in writing if utilities not shown on the Drawings and not visible as to the date of this contract are encountered within the construction limits of the entire project, and such utilities will interfere with construction operations, to enable a determination by the Contracting Officer as to the necessity for removal or relocation. If such utilities are removed or relocated as directed by the Contracting Officer, an equitable adjustment in the contract price must be made pursuant to the Contract Clause CHANGES to cover the cost of any additional pertinent work or delay.
1.7 PLANNED UTILITY OUTAGES AND STREET CLOSURES
All utility outages and street closures to be of as short a duration as possible and to be scheduled as far in advance as possible with the Contracting Officer, in no case less than 7 days before the outage or closure. Obtain from the Contracting Officer in writing a statement or schedule giving the permissible times of outages or closures for particular installations and the maximum time allowed for each. Strictly observe such schedules and the Contractor will be held responsible for any violations.
1.8 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER
This provision specifies the procedure for the determination of time extensions for unusually severe weather. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
SECTION 01 00 00 Page 3 January 27, 2022
a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.
The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule will reflect these anticipated adverse weather delays in all weather dependent activities.
MONTHLY ANTICIPATED ADVERSE WEATHER DELAY
JAN FEB MAR APR MAY JUN JUL AUG SEP OCT NOV DEC
(07) (07) (06) (03) (02) (01) (00) (00) (01) (02) (04) (06)
Upon execution of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily Contractor Quality Control (CQC) report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day. Refer to ER 415-1-15 .
1.9 HAZARDOUS NOISE AREA
Provide adequate ear protection as may be required for Contractor's personnel at the job site.
1.10 BID ITEM OVERRUN
Throughout the contract (at a minimum, every two weeks), monitor placement or installation of unit price items (if any) with respect to the original estimated quantities shown in the contract. If placement or installation indicates a possible overrun with respect to the original estimated quantities shown in the contract, immediately provide written notification to the Contracting Officer with revised total estimated quantities.
1.11 NON CONTRACT WORK
Do not perform any work or erect any structure for third parties, landowners or otherwise, without prior approval of the Contracting Officer.
1.12 DAMAGE TO ACCESS ROADS AND STAGING AREAS
Preserve and protect all existing private or project access or right-of-way roads, off-site staging area (if applicable), paved bike trails, and pedestrian pathways. At the completion of work and prior to the Contractor leaving the project, restore to pre-project conditions all such access roads, staging areas, paved bike trails, and pedestrian pathways. Repairs include replacement of base rock and/or surface treatment as required and as approved by the County of Sacramento, and removal and replacement of all paved bike trails used as haul routes.

1.12.3 Transient Population
The Contractor must assist the Government's public outreach program during that same period to post notifications as determined by the Government.
The City of Sacramento Police Department Impact Team will relocate the transient persons. Enforcement requests must be made to the Contracting Officer at the end of the notice period if the excluded phase work area is repopulated. The Contractor must not attempt to move members of the transient population remaining in or returning to work areas, which is the responsibility of local law enforcement or other authorized agencies or services.
The Contractor must be responsible for the safety of the public within the limits of construction during the course of construction. In particular, the project site is a known location of transient persons. Prior to the commencement of construction activities, submit a Transient Population Safety Plan depicting proposed phasing, signage, fencing, and other protective measures to provide for the safety of the public and transient community. e. Identification of public access and path of travel during various phases of construction.
1.13 ENVIRONMENTAL LITIGATION
a. If the performance of all or any part of the work is suspended, delayed, or interrupted due to an order of a court of competent jurisdiction as a result of environmental litigation, as defined below, the Contracting Officer, at the request of the Contractor, is to determine whether the order is due in any part to the acts or omissions of the Contractor or a subcontractor at any tier not required by the terms of this contract. If it is determined that the order is not due in any part to acts or omissions of the Contractor or a subcontractor at any tier other than as required by the terms of this contract, such suspension, delay, or interruption is to be considered as if ordered by the Contracting Officer in the administration of this contract under the terms of the SUSPENSION OF WORK clause of this contract. The period of such suspension, delay or interruption is unreasonable, and an adjustment is to be made for any increase in the cost of performance of this contract (excluding profit) as provided in that clause, subject to all the provisions thereof.
b. The term "environmental litigations" as used herein, means a lawsuit alleging that the work will have an adverse effect on the environment or that the Government has not duly considered, either substantively or procedurally, the effect of the work on the environment.

PART 1 GENERAL
1.1 WORK COVERED BY CONTRACT DOCUMENTS
1.1.1 Project Description
The work includes roughly 7,800 feet of stream bank protection and stabilization of the Lower American River (LAR) to protect critical infrastructure against the effects of erosion during large flood events.
The work involves, but is not limited to: clearing, grubbing, and stripping within the construction limits and areas designated in the Drawings and by the Contracting Officer; protecting-in-place vegetation, existing facilities, and structures not scheduled for removal; earthwork;
import of rock materials; import, export, and transfer of earthen materials; construction of stone protection structures shown on the Drawings, installation of planting benches, instream wood structures and willow cuttings; grass seeding and erosion control; maintenance of seeding to meet performance requirements through the Establishment Period as defined in these Specifications; replacement of existing infrastructure disturbed or relocated by construction, and all incidental related work.
1.1.2 Location
The work is located on the LAR within the American River Parkway in Sacramento, California. Sites 2-2 and 2-3 are located along the right (east) bank of the LAR. Site 2-2 is approximately 1,200 feet long and is located at the Howe Avenue Bridge. Site 2-3 is approximately 6,600 feet long and extends from the downstream side of the Campus Commons Golf Course upstream to the buried river pipe crossing of the Sacramento Regional County Sanitation District's two sewer force mains. The site locations are shown on the Drawings.
1.2 EXISTING WORK
In addition to FAR 52.236-9 Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements:
a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.
b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work must be in a condition equal to or better than that which existed before new work started.
1.3 LOCATION OF UNDERGROUND UTILITIES
Obtain digging permits prior to start of excavation. Contact local utility locating service a minimum of 48 hours prior to excavating, to mark utilities, and within sufficient time required if work occurs on a Monday or after a Holiday. Verify existing utility locations indicated on
SECTION 01 11 00 Page 2 January 27, 2022 contract drawings, within area of work.
Identify and mark all other utilities not managed and located by the local utility companies. Use electromagnetic, or sonic equipment, and mark the surface of the ground or paved surface where existing underground utilities are discovered. Verify the elevations of existing piping, utilities, and any type of underground or encased obstruction not indicated, or specified to be removed, that is indicated or discovered during scanning. Verify elevations before installing new work or other structure at which an adjustment in grade can be made.
