The Offeror shall identify any potential

OCI issues or appearance of any potential OCI the Offeror, (including all Teaming

Partners, subcontractors, subsidiaries, and legacy companies) may have with respect to the scope of effort as outlined in the PWS. OCIs may exist at least in the following three ways:

Unequal access to information- access to non-public information that gives a contractor an unfair competitive advantage.

Biased ground rules- when a contractor has in some sense set the ground rules for another procurement action creating the potential that the contractor may have tilted the playing field in the new competition (usually toward its own strengths and away from its weaknesses).

Impaired objectivity - when the contract requires exercise of judgment and the independence of its judgment may be affected (e.g., when the contractor may be required to evaluate its own work in a way that could be adverse to its economic interests).

b) If the Offeror (including all Teaming Partners, subcontractors, subsidiaries, and legacy companies) performed past/present cleanup related work at the sites for this ORC, a mitigation plan shall be submitted in Volume I, Contract Documentation Volume to show how the Offeror will either satisfactorily mitigate or eliminate any potential OCI issues or appearance of any potential OCI. If the Offeror, including all Teaming Partners, subcontractors, subsidiaries, and legacy companies, has not performed any work on the sites included as part of this requirement, then the Offeror must so state.

c) Any submitted OCI analysis and plan will not be evaluated unless the Offeror is considered the Apparent Successful Offeror under the evaluation Factors listed in this

RFP. If the OCI analysis and plan needs to be evaluated, the Government will determine if an OCI exists and whether adequate mitigation is proposed. If adequate mitigation is not proposed, the Government may engage in exchanges with the Apparent Successful

Offeror to determine if the problems with the mitigation plan may be resolved. If an OCI exists that cannot be adequately mitigated, the Government may seek waiver of the OCI issue or may award to another Offeror who does not have an OCI, or who has an OCI and has submitted a mitigation plan that is adequate or may be made so after exchanges between the Government and the Offeror.

3.7 Construction Bonding

1, Fiscal Year 2, Fiscal Year 3, etc. based on chronological milestone payment date).

Provide the bonding fee total and the bonding fee by year.

b) Provide assertion that the Prime Contractor can meet the bonding requirements of the contract (100% performance and payment bond) with respect to the proposed totals for construction by year. Provide proof of excess bonding capacity commensurate with the proposed amount for construction with bonding capability letters from an approved surety listed with the Department of Treasury. Letters must be notarized and signed by an authorized representative of the surety. Letters signed by agents are unacceptable unless accompanied by a Power of Attorney granting proper authority to the agent.

Bonding capability must be for the Prime only (stacking of Teaming

Partners/subcontractor bonds will not be accepted).

3.8 Exceptions to Solicitation Requirements

a) Offerors are required to meet all solicitation requirements, including all terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. Failure to meet a requirement or taking exception to a requirement may result in an offer being ineligible for award. Offerors shall clearly identify any exceptions to Terms and Conditions of the solicitation. Exceptions are strongly discouraged. Failure to comply with all terms and conditions of the solicitation may result in the Offeror being removed from consideration for award.

b) Each exception shall be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken.

c) Provide rationale in support of the exception and fully explain its impact, if any, on the performance, schedule, cost, and specific requirements of the solicitation.

Performance Table. The comprehensive technical approach shall describe how all the

Performance Objectives in the PWS and other applicable agreements will be met or exceeded, as well as identify and assess all risks of the proposed comprehensive technical approach and mitigation strategies and/or contingency plans. Risks include, but are not limited to, the potential for disruption of schedule, increased costs, degradation of performance, the need for increased

Government oversight, or the likelihood of unsuccessful contract performance. Classify each risk in accordance with DoD Source Selection Procedures Table 1, Technical Risk Rating.

Provide the rationale for each risk and its rating, including quantitative estimates of the impact on cost, schedule, and performance. Describe the impact of each identified risk in terms of its potential to interfere with or prevent the successful accomplishment of other contract requirements (for example: PWS or specification requirements), whether or not those requirements are identified as Factors. Propose realistic risk mitigations strategies and contingency plans that will eliminate or reduce risk(s) to an acceptable level. The risk evaluation shall include the decision logic, identified thresholds, and timing for implementation a mitigation strategy and/or contingency plan if the proposed approach proves incapable of meeting the

Performance Objectives within the Performance Periods.

Summary Table: The Offeror shall provide a summary table including the following information for each site listed in the PWS: Site ID, Performance Objective, Performance Period, Date of Achieving Performance Objective, Brief Description of the

Technical Approach. Site IDs should be copied from the PWS Table 1: Performance

Table. For proposal purposes, the Offeror may choose to group sites for which the

Offeror is proposing the same technical approach. However, where the Offeror chooses to do group sites with regards to same technical approaches, the Offeror may NOT group pricing information on the MPS for those or any other sites. The price information shall be provided on a per site basis only.

Offeror's proposal shall also include a Work Breakdown Structure (WBS), Integrated

Master Schedule (IMS) and a Milestone Payment Schedule (MPS) (without price information):

The WBS shall demonstrate a comprehensive understanding of the ORC process and work required to achieve each PO; this would be demonstrated by a thorough work decomposition of each task and effective application of a WBS structure.

The WBS shall align with the Contract Line Item Number (CLIN)/Sub-CLIN

Structure provided with the RFP, consistent with the Offeror’s proposed approach, and in accordance with the requirements in PWS Section 4.2 and supplemental guidance.

The IMS shall be built from the WBS above. At a minimum, the offeror’s IMS shall:

Present a realistic sequence and timing of all activities and documents necessary to demonstrate achievement of the PO within the PP.

Demonstrate logical incorporation of realistic Government and Regulatory review periods as defined in the PWS.

Identify timing of decision points addressing risk mitigation and/or contingency strategies.

The MPS (without price information) shall be built from the WBS above, consistent with the Offeror’s proposed approach and the IMS, and in accordance with the requirements in PWS Section 4.3. At a minimum, the offeror’s MPS

(without price information) shall:

Present and describe appropriate milestone payments considered integral and necessary to the achievement of the POs.

Include a reasonable number of milestone payments per CLIN/Sub-CLIN based on the scope and anticipated duration to achieve CLIN/Sub-CLIN objective and/or PO.

Excludes unacceptable milestone payments representing a “progress” payment or a monthly payment for level of effort expended as well as management or overhead type costs. Examples of unacceptable milestones include:

• Submittal of documents

• Site mobilization/demobilization (unless exempted by KO)

• Accomplishment of routine and reoccurring field activities

• Submittal of a monthly status

• Management and overhead type cost (e.g., program/project management, monthly reporting, etc.)

• Allocation of PMP, Basewide QPP, or other basewide costs to specific sites

Include milestone payment cost distribution by percentage for CLINs/Sub-

CLINs without pricing information (no dollar values)

Include final CLIN/Sub-CLIN milestone payments demonstrating achievement of the CLIN/Sub-CLIN objective which is a minimum of 20% of the total CLIN/Sub-CLIN value.

4.5 Factor 2: Corporate Experience

The Offeror shall submit a maximum of five (5) contract/task order (TO) summaries (narratives) demonstrating examples of relevant experience as it relates to the requirements of the PWS and this ORC. The Government will not consider experience on a contract/TO that concluded more than five (5) years prior to the date of this solicitation. For contracts/TOs that are actively being performed, performance must be substantially complete (minimum 50% complete as of the date of proposal submission) to be evaluated under this Factor 2. Contracts/TOs submitted by the

Offeror should be the most relevant in demonstrating their experience and capability to perform the proposed effort. At least three (3) of the five (5) example projects must be from the Prime

Contractor as the Prime Contractor or JV Partner. The Offeror shall also include the exact same contract/TO summaries in the volume for Factor 4, Past Performance.

Contract/TO Summary Submissions shall include the following:

If the project is currently ongoing, provide the percent complete (must be greater than or equal to 50%) at the time of proposal submission.

Original and final period of performance (start and end dates).

Current contract points of contact (POCs). Provide a current e-mail address and phone number. Provide a minimum of two Government POCs. Whenever possible, provide one from the technical or program management community and one from the contracting community. For commercial efforts, provide similar points of contact.

Whether the project was completed on-time, within budget, and whether or not the

Offeror encountered any performance issues or challenges. If performance issues or challenges did arise in meeting the requirements, provide information on how they were addressed by the Offeror.

4.6 Factor 3: Management Approach
