Scope of Work

Howards Bay SND & GLLA Dredging Superior, Douglas, Wisconsin

Mobilize at Howards Bay. The work includes dredging approximately 52,000 CY of material from the Federal Navigation Channel and placing it in a Government Furnished Disposal Facility. The work also, includes environmental dredging to remove approximately 80,000 CY of contaminated sediment and debris from Howards Bay and disposing of it in the WI Point Landfill. Other activities include dewatering and stabilizing of contaminated dredged material, confirmation sampling, air and turbidity monitoring, collecting and treating return water, capping and grading of WI Point Landfill, and placing residuals cover material. Project also includes clean-up and demobilization.

Pre-screen candidates using E-Verify Program: "The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award." *When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative.

This Form will be provided to the Contracting Officer and shall become part of the official contract file.

SECURITY REQUIREMENTS

a. Conformance with Local Laws and Regulation: All personnel employed by the Contractor in the performance of the services specified in this agreement or any representative of the contractor entering the federal controlled facilities lands and any area off federal lands where inspections are conducted shall conform and comply with all applicable federal, state, and local statutes and regulations. It is the contractor's responsibility to be aware of the prevailing statutes and regulations of the work areas.

b. Security Checks. All contract employees must carry picture identification at all times. They must show I.D. upon request by City/State Government personnel. The Contractor’s employee must carry a copy of the contract requirements with them during the implementation of this contract.

Section 00 21 13 - Instructions to Bidders

INSTRUCTION TO BIDDERS

Bids: ALL RESPONSES TO THIS ANNOUNCEMENT SHALL BE SUBMITTED ELECTRONICALLY. Hand carried delivery or USPS/UPS/FEDEX delivery of hard copies and or CD- ROMs are not authorized. Facsimile submission is not authorized. Electronic Bids Submission is required through DOD SAFE (https://safe.apps.mil). The DOD SAFE Application is used to send large files to individuals that would normally be too large to send via email. There are no user accounts for SAFE. Authentication is handled via email. Anyone has access to DOD SAFE, and the application is available for use by anyone. The SAFE “Getting Started Guide” has information on how to utilize the system (https://safe.apps.mil/about.php). Instructions for uploading are as follows:

File Organization: Although hard copies are not accepted, each file shall be clearly indexed, and logically assembled. Font size shall be 10 or larger.

Upload Completion & Deadline: Interested parties shall submit responses no later than the date specified on the solicitation document. The time & date of bid receipt will be the upload completion / delivery time & date recorded within DOD SAFE site. Do not assume that electronic submission will occur instantaneously. Large files (e.g. 10MB or more) will take some time to upload. Offerors should time their upload effort with prudence by not waiting until the last few minutes—this will allow for unexpected delays in the transmittal process. Bid Bonds: Bid Bonds shall be submitted electronically through DOD SAFE no later than the response date specified on the solicitation. After bid opening, the apparent low bidder will be required to mail in its original bid amd the original bonds. If USACE personnel are not available to inspect the original bonds, the Contracting Office may call the bonding company to verify the information in the bond.

INTENT

The intent of this solicitation is to award one (1) firm fixed-price construction contract for the FY20 Howard Bay Remedial Dredging.

BASIS OF SELECTION OF AWARD

Award shall be made to the lowest priced bidder who is found to be responsive and responsible. See FAR Subpart 9.1, Responsible Prospective Contractors and FAR Provision 52.214-19, Contract Award—Sealed Bidding—Construction, for more information.

SITE VISIT

(a) As indicated in FAR Provision 52.236-27 SITE VISIT (CONSTRUCTION), visits to the project site can be scheduled on an individual basis. The Government’s Point of Contact for coordinating visits is identified in the FAR Clause 52.236-27 site visit.

(b) Prospective contractors are strongly encouraged to visit the project site prior to preparing and submitting any bid.

NOTICE OF PRE-BID CONFERENCE

(a) A public pre-bid conference will be conducted via teleconference on 09 June 2020 at 10:00 AM Eastern Standard time (EDT) for the purpose of clarifying terms and conditions contained in permits obtained by the Government and identifying permits known to the Government that may need to be obtained by the Contractor. The pre-bid conference will be broadcast via live audio telephone conference. Interested parties may access the conference by calling the following number and entering the access code when prompted. Callers may log into the conference up to 5 minutes before the stated time.

(b) Information provided at this conference will not alter the terms and conditions of the solicitation or the specifications. Only a formal amendment issued by a Contracting Officer can change the terms, conditions, or specifications of this solicitation.

(c) A typed record of the conference will be made available to all prospective bidders via the beta.sam.gov website.

The record will include minutes of the meeting, topics discussed, and clarifications issued. Bidders will be allowed to ask clarifying questions, however, the Government reserves the right to request that any question brought up during the pre-bid conference be submitted in writing in accordance with the request for information/questions instructions of the solicitation.

(d) Any question that a prospective bidder requires answered that affects the terms, conditions, or specifications must be submitted in writing, in accordance with the request for information/questions instructions of the solicitation and shall not be discussed during this conference.

REGISTRATION IN SAM

(a) The System for Award Management (SAM) is the Government’s online database of federal contractors. Contractors self-register in SAM at the website www.sam.gov . Registration is free to all users.

(b) In accordance with FAR Provision 52.204-7 SYSTEM FOR AWARD MANAGEMENT, a bidder must be registered in SAM when submitting an offer, and must continue to be registered until time of award, during performance, and through final payment of any contract.

(c) Bidders who are not currently registered in SAM with the NAICS Code that is indicated in Block 10, at the front of this Solicitation, are encouraged to start the registration process as soon as possible to ensure that it is complete prior to submission of any bid.

REQUESTS FOR INFORMATION

(a) Questions/Inquiries. All questions pertaining to this requirement shall be submitted in writing no later than, June 12, 2020, 10:00 A.M. EST. The offeror shall put the solicitation number located in Block 1 of the SF 1442 followed by QUESTIONS in the subject line of the email. All questions received after the above date and time WILL NOT BE ANSWERED.

(c) Once all inquiries are compiled and addressed, the questions and answers will be generated as an amendment and posted to the beta.sam.gov website for all interested parties to view/acknowledge to be sent in with their submission prior to the closing date. If additional time is needed for submission, this extension will be executed on the same amendment as the questions and answers amendment.

INSURANCE/BONDS:

BID GUARANTEE. In accordance with FAR 52.228-1, Bid Guarantee, the bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond (use Standard Form 24) supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier’s check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The bid guarantee amount shall be at least 20 percent of the bid price but shall not exceed $3,000,000.00. If using a Bid Bond, it must be submitted on SF 24. The SF 24 can be found at the GSA Forms Library at https://www.gsa.gov/forms.

The bidder whose bid is accepted will be required to comply with the following within the time established in the invitation for bid:

PERFORMANCE BONDS (SF 25A). Pursuant to FAR 52.228-15, Performance and Payment Bonds— Construction, the penal amount of the performance bond shall equal one hundred percent (100%) of the contract price. Bonds shall be received on a SF 25A within ten (10) calendar days after receipt of contract award. The SF 25A can be found at the GSA Forms Library at https://www.gsa.gov/forms.

PAYMENT BONDS (SF 25). Pursuant to FAR 52.228-15, Performance and Payment Bonds—Construction, the penal amount of the payment bond shall equal one hundred percent (100%) of the contract price. Bonds shall be received on a SF 25 within ten (10) calendar days after receipt of award. The SF 25 can be found at the GSA Forms Library at https://www.gsa.gov/forms.

SUBMISSION OF BIDS

(a) All Bidders are reminded to compete and submit with your bid all FAR and DFARS Provision related to Representations and Certifications.

(b) Bidders shall complete and submit any additional full text certifications that are included in the solicitation. An offeror may also complete the certifications at https://www.sam.gov in lieu of completing the representations and certifications in this solicitation provided that all the FAR and DFARS certifications contained in the solicitation have been completed on line.

(c) All Bidders shall be registered at https://www.sam.gov with the NAICS code that is shown on the front page of the solicitation.

(d) Remember to fill in and sign the Standard Form 1442, from the front of the Solicitation, before submitting your bid.

(e) Bids must be received at the address indicated in Block 8, at the front page of the Solicitation, by the date and time indicated in Block 13.

BID OPENING

A public Bid Opening will be conducted at the Contracting Office indicated in Box 7, at the date and time indicated for receipt of bids/offers in Box 13 of the Standard Form 1442 at the front of this solicitation. The Bid Opening will be broadcast via live audio telephone conference. Interested parties may access the conference by calling one of the following numbers and entering the access code when prompted. No one will be permitted to attend the public bid opening physically in-person except for the bid opening Government officials. A bid abstract of the names and total prices of all bids received and the total price of the Independent Government Estimate will be posted to Beta.Sam.Gov within two calendar days following the public bid opening.

52.204-7 SYSTEM FOR AWARD MANAGEMENT (OCT 2018)

(a) Definitions. As used in this provision--

Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

Registered in the System for Award Management (SAM) means that--

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into SAM;

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in SAM;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record ``Active''.

Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.

(b)(1) An Offeror is required to be registered in SAM when submitting an offer or quotation, and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address exactly as stated in the offer. The Offeror also shall enter its EFT indicator, if applicable. The unique entity identifier will be used by the Contracting Officer to verify that the Offeror is registered in SAM.

(c) If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for establishment of the unique entity identifier directly to obtain one. The Offeror should be prepared to provide the following information:

(1) Company legal business name.

(2) Tradestyle, doing business, or other name by which your entity is commonly recognized.

(3) Company physical street address, city, state, and Zip Code.

(4) Company mailing address, city, state and Zip Code (if separate from physical).

(5) Company telephone number.

(6) Date the company was started.

(7) Number of employees at your location.

(8) Chief executive officer/key manager.

(9) Line of business (industry).

(10) Company headquarters name and address (reporting relationship within your entity).

(d) Processing time should be taken into consideration when registering. Offerors who are not registered in SAM should consider applying for registration immediately upon receipt of this solicitation. See https://www.sam.gov for information on registration.

52.204-18 COMMERCIAL AND GOVERNMENT ENTITY CODE MAINTENANCE (JUL 2016)

(a) Definition. As used in this clause--

Commercial and Government Entity (CAGE) code means--

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity;

or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

(b) Contractors shall ensure that the CAGE code is maintained throughout the life of the contract. For contractors registered in the System for Award Management (SAM), the DLA Commercial and Government Entity (CAGE) Branch shall only modify data received from SAM in the CAGE master file if the contractor initiates those changes via update of its SAM registration. Contractors undergoing a novation or change-of-name agreement shall notify the contracting officer in accordance with subpart 42.12. The contractor shall communicate any change to the CAGE code to the contracting officer within 30 days after the change, so that a modification can be issued to update the CAGE code on the contract.

(c) Contractors located in the United States or its outlying areas that are not registered in SAM shall submit written change requests to the DLA Commercial and Government Entity (CAGE) Branch. Requests for changes shall be provided at https://cage.dla.mil. Change requests to the CAGE master file are accepted from the entity identified by the code.

(d) Contractors located outside the United States and its outlying areas that are not registered in SAM shall contact the appropriate National Codification Bureau (points of contact available at http://www.nato.int/structur/AC/135/main/links/contacts.htm) or NSPA at https://eportal.nspa.nato.int/AC135Public/scage/CageList.aspx to request CAGE changes.

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL

EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the --

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is Superior, Douglas, Wisconsin.

52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.

The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-

(c) The amount of the bid guarantee shall be 20% percent of the bid price or $3 million, whichever is less.-

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

52.233-2 SERVICE OF PROTEST (SEP 2006)

(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from

52.236-27 SITE VISIT (CONSTRUCTION) (FEB 1995)

(a) The clauses at 52.236-2, Differing Site Conditions, and 52.236-3, Site Investigations and Conditions Affecting the Work, will be included in any contract awarded as a result of this solicitation. 52.203-19 PROHIBITION ON REQUIRING CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS OR

STATEMENTS (JAN 2017)

(a) Definitions. As used in this clause-- Internal confidentiality agreement or statement means a confidentiality agreement or any other written statement that the contractor requires any of its employees or subcontractors to sign regarding nondisclosure of contractor information, except that it does not include confidentiality agreements arising out of civil litigation or confidentiality agreements that contractor employees or subcontractors sign at the behest of a Federal agency.

Subcontract means any contract as defined in subpart 2.1 entered into by a subcontractor to furnish supplies or services for performance of a prime contract or a subcontract. It includes but is not limited to purchase orders, and changes and modifications to purchase orders.

Subcontractor means any supplier, distributor, vendor, or firm (including a consultant) that furnishes supplies or services to or for a prime contractor or another subcontractor.

(b) The Contractor shall not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

(c) The Contractor shall notify current employees and subcontractors that prohibitions and restrictions of any preexisting internal confidentiality agreements or statements covered by this clause, to the extent that such prohibitions and restrictions are inconsistent with the prohibitions of this clause, are no longer in effect.

(d) The prohibition in paragraph (b) of this clause does not contravene requirements applicable to Standard Form 312 (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

(e) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015, (Pub. L. 113-235), and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions) use of funds appropriated (or otherwise made available) is prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause.

(f) The Contractor shall include the substance of this clause, including this paragraph (f), in subcontracts under such contracts.
