SECTION 00120 EVALUATIONS FACTORS FOR AWARD

1. GENERAL INFORMATION

1.1 ACQUISITION APPROACH. This is a competitive acquisition using the Lowest Price Technically Acceptable source selection process for the award of a firm fixed-price construction contract. This process will allow an award made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. This acquisition will use FAR Part 15 and is intended to minimize the complexity of the solicitation, the evaluation, and the source selection decision while maintaining a process designed to foster an impartial and comprehensive evaluation of the offerors’ proposals, leading to selection of the proposal representing the best value to the Government.

1.2 The primary NAICS code for work under this procurement is 238210 (Electrical Contractors and Other Wiring Installation Contractors) which has a size standard of fifteen million dollars ($15,000,000) in average annual receipts.

1.3 In accordance with FAR 19.705-2, the following actions were taken to determine whether a subcontracting plan is required for this acquisition: (a) determine if the proposed contractual action meets the dollar threshold ($1.5M for construction) at 19.702(a)(1); (b) determine if subcontracting possibilities exist by considering (1) if firms engaged in the business subcontract for performance or maintain sufficient in-house capabilities to perform work, and (2) likelihood for the need to prequalify products. A review of the requirements of the work indicates that subcontracting opportunities exist. This work requires a variety of disciplines to include structural, mechanical, electrical, controls, and equipment demolition and disposal. Based on this determination, if the offeror is a large business, a subcontracting plan is required to be submitted with the proposal.

1.4 As prescribed in FAR Part 19.708(b)(1), the solicitation includes FAR clause 52.219-9, Small Business Subcontracting Plan, Alternate II. The Small Business Subcontracting Plan is not a requirement for evaluation in source selection, but rather a requirement for award to a large business concern. The Subcontracting Plan will be incorporated into the resultant contract and the contractor’s implementation of the Subcontracting Plan will be evaluated as part of the project evaluation that will be completed in the Government’s Contractor Performance Assessment Reporting System (CPARS).

1.5 BASIS OF AWARD. Award will be made to the acceptable proposal meeting or exceeding the technical acceptability standards for non-cost factors and is the lowest price of all acceptable proposals. Tradeoffs are not permitted. Proposals are evaluated for acceptability but not ranked using non-cost/price factors.

1.6 EVALUATION OF THE TECHNICAL PROPOSAL. The Technical Proposal will be evaluated based on the criteria identified in the individual attachments for the Factors. Failure to demonstrate the minimum acceptability standards under ANY factor will result in an “UNACCEPTABLE” rating and elimination from further consideration for contract award.

1.7 EVALUATION OF THE PRICE PROPOSALS

1.7.1 Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. The proposed prices will be analyzed for reasonableness. They may also be analyzed to determine whether they are realistic for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the information provided by the Offeror. Additionally, all offers will be analyzed for unbalanced pricing.

1.7.2 The otherwise technically-acceptable, lowest-priced offeror may be required to confirm its price on a contract line (CLIN), element, or total price basis, and/or provide additional information in support of their price, prior to contract award.
