About this file
This document is a Request for Information (RFI) regarding the upgrade of Central Power Plant 604 at West Point, New York. The RFI contains questions and responses related to the asbestos remediation, lead remediation, and other aspects of the project. Key details include:
The project requires all asbestos abatement to be performed in accordance with New York State Code Rule 56. The asbestos abatement plan must be prepared, signed, and sealed by a Private Qualified Person (PQP) who is a first-tier subcontractor. The project also involves lead remediation, for which OSHA Lead in Construction training will suffice for the competent person. The solicitation specifies that the offeror must have at least one past project of $30 million and 50,050 square feet. Subcontracting experience may be submitted for past performance. Overall, the RFI addresses technical requirements, clarifications, and past performance criteria for the renovation of the Central Power Plant 604 facility.

RFI Response – Upgrade of Central Power Plant 604.
31 July 2024
John Duncombe/Ranee Perricone – PM
RFI: Upgrade of Central Power Plant 604.
Questions:
13. 028200 Asbestos Remediation requires all abatement workers to be certified in the State of NY in accordance with ICR-56. Must all abatement be performed in accordance with NYS Code Rule 56? Yes, all abatement shall be performed in accordance with NYS Code Rule 56.
14. 028200 Asbestos Remediation part 1.4.9 Abatement Hazard Abatement Plan notes that the detailed plans including the asbestos abatement plan must be prepared, signed, and sealed by the PQP. Part 1.6.1 Private Qualified Person Documentation indicates that the PQP must be a first-tier subcontractor. The way the spec is written, the abatement contractor is not allowed to construct their own work plans etc and the information must be provided by the PQP. Please provide the work plan and any additional information that the PQP will dictate for the abatement contractor to formulate bids appropriately or remove this requirement from the spec. As per definition, the PQP is hired by the Contractor to perform the “herein listed tasks” including the preparation of the Asbestos Abatement Plan. Dewberry has provided asbestos sampling data and preliminary abatement design drawings for reference and use by the PQP for the development of their plan.
15. Is it the PQP's responsibility to provide a Table of contents for each abatement submittal required? Yes
16. Can the third-party site safety officer maintain a separate contract to oversee the abatement work or would this be a conflict of interest due to the company being required to report deficiencies on itself? The third-party site safety officer, by definition, cannot be hired by the Abatement Contractor. They must be hired by the prime contractor.
17. 028200 Asbestos Remediation part 3.2.10.1 Suspect Fire Doors suggests the abatement contractor remove the door and then open it up to expose the interior contents to determine if there are ACM components. Is this the actual intent or would you like the abatement contractor to just assume they are ACM if they have not been tested prior to abatement procedures? If it is the intent to test the doors midway through the abatement process, where should the abatement contractor store the doors due to their being no containment for this work? It is up to the Contractor whether or not to sample the interior insulation of the fire doors or just abate them as PACM. If they decide to sample, the location and process for sampling shall be included in their plan.
18. 028200 Asbestos Remediation part 3.2.10.2 Roof Materials speaks of air monitoring on the exterior roof. Is this referring to personal air monitoring or is it suggested there will be air monitoring provided by the project monitor which is above the standard requirements? As stated in 028200, “Conduct area monitoring of airborne fibers during the work shift at the designated limits of the asbestos work area and conduct personal samples of each worker engaged in the work. If the airborne fiber concentration of the workers or designated limits at any time exceeds background or 0.01 fibers per cubic centimeter, whichever is greater, stop work immediately and correct the situation.”
19. 028300 Lead Remediation - Is the intent of the project to permanently eliminate the lead hazards within the facility or to appropriately handle the materials that will be impacted through the course of the construction project? The spec is titled remediation, but the phrase abatement is presented numerous times. These terms are not synonymous and are governed by separate regulations. The intent of this project is to remediate the lead hazards with the facility that will be impacted through the course of the construction project only.
20. 028300 Lead Remediation part 1.6.1.1 Competent Person states "The competent person must be a licensed lead-based paint abatement Supervisor/Project Designed in the State of NY". The state of New York does not offer a specific certification that differs from the EPA Abatement Rule, EPA RRP Rule, or OSHA Lead in Construction. If the lead is only being impacted due to the construction project, then the OSHA Lead in construction training should suffice. Will that be accepted or what will be accepted? OSHA Lead in Construction Training will suffice.
21. 028300 Lead Remediation part 1.6.2.1 Competent Person (CP) Responsibilities subpart i. states "the CP must be certified pursuant to 40 CFR 745, Section 226." This section pertains to target housing and child occupied facilities. Can this part be removed from the spec considering neither of those situations apply to this project? See response to 20.
22. Must all contractors that impact or may incidentally impact the LBP have the required training/certifications for the project? Yes. See response to 20.
23. 028300 Lead Renovation part 1.6.2.5 Training lists many regulation codes for individuals who impact lead, from OSHA to EPA to unidentified state regulations. Will OSHA Lead in construction suffice due to the nature of the project? Yes. See response to 20.
24. 028300 Lead Renovation part 3.1.1.2 Lead Control Area indicates a physical boundary around the lead control area by roping it off or providing curtains or portable partitions or other enclosures to ensure that lead will not escape outside the control area. Part 3.1.1.4 Local Exhaust system indicates a local exhaust system must be provided in the lead control area at a rate of 4 air exchanges per hour. There is a conflict between these. If the containment area is set up via roping the area off to adequately prevent the spread of lead, how should they install the local exhaust system and manometer at -.02 inches on the water column? Delete Part 3.1.1.4.
25. 028300 Lead Renovations part 3.4.1.1 And Wipe Sampling and part 3.5.1.1 Clearance Certification: Air sampling performed by the project monitor and clearance swipe samples by the project monitor do not seem appropriate and unnecessarily drive-up costs of the project for the nature of this project as they apply to EPA Abatement Projects and EPA RRP projects for target housing and child occupied facilities. Wipe samples are required by specification unless Garrison will agree to remove this requirement.
26. 028300 Lead Remediations: What is the course of action if the clearance swipe samples are mandated for floors and other horizontal surfaces that have had lead leach into them over the course of years and cannot be extracted by washing them? Considering there have been no baseline swipe samples provided, the contractor should be provided with an acceptable alternate method prior to bid. Contractor shall collect baseline wipe samples unless Garrison will agree to remove this requirement.
27. 028300 Lead Renovations part 3.5.1.1 Clearance criteria lists multiple clearance levels that contradict each other and then another option where the sample must be certified to not be significantly greater than the initial test. If swipe samples are to be mandated, what is the clear criteria that the contractor can count on remaining constant? If required, clearance wipe sample results shall be compared to baseline wipe samples and shall not exceed baseline results.
28. Follow up for RFI3 Response from Amendment 1: The RFP stated that at least one project be $30 Million and of at least 50,050 SF. For past experience what is the size considered for the other projects?
The offeror shall include documentation regarding its relevant past performance as it directly relates to the work being procured under this solicitation.
29. Can we submit subcontracting experience for Past Performance?
The offeror shall provide documentation outlining the offeror’s past performance with contracts, as a prime or major subcontractor, which is the same or similar in size, time, scope, and complexity to the services being procured under this Solicitation.
