The offeror will identify the escalation rates used for materials, equipment, subcontracts, direct labor and indirect expenses. The offeror will describe the basis of the escalation rates.
(c) Compliance. Failure to comply with the RFP requirements for price information may result in an adverse assessment of an offeror’s proposal and reduce or eliminate its chance of being selected for award. Offerors will ensure that the information presented in this volume is consistent and correlates with the information contained in the other proposal volumes. Also, the offeror will ensure that the information submitted in this volume is consistent with and fully supports the amounts set forth in Attachment 0007 Cost/Price Workbook and any information proposed the SF33 and continuation sheets.
(d) General Instructions. In accordance with Federal Acquisition Regulation (FAR) 15.402, Pricing and 15.403-1, Prohibition on obtaining certified cost or pricing data, certified cost or pricing data are not required based on the fact that adequate competition is expected for this procurement. Information other than certified cost or pricing data may be provided in contractor format providing that sufficient information is made available. Information submitted will be prepared following the instruction in FAR 15.403-5 Instructions for submission of certified cost or pricing data and data other than certified cost or pricing data. If after receipt of proposals the Contracting Officer determines that there is insufficient information available to determine price reasonableness and none of the exceptions at FAR 15.403-1, Prohibition on obtaining certified cost or pricing data apply, the offeror may be required to submit cost or pricing data. Additionally, in the event that adequate competition is not obtained, the Contracting Officer may incorporate FAR 52.215-20, Requirements for Certified Cost or Pricing Data and Data Other Than Certified Cost or Pricing Data into the solicitation and request a Certificate of Current Cost or Pricing Data.
There are no page limitations for this volume. Proposal information included in this volume which is not directly related to Cost will be disregarded.
(v) VOLUME V– Past Performance (Evaluation Factor IV). The volume will be organized as follows:
The offeror will submit a past performance volume with its proposal, containing past performance information in accordance with the format contained in Attachment 0008 Past Performance Information:
This information is required on the offeror and all subcontractors, teaming partners, and/or joint venture partners who are proposed to perform 30% or more of the proposed effort based on the total proposed price or perform aspects of the effort the offeror considers critical to overall successful performance. The Government will use data provided by each offeror in this volume and data obtained from other sources in the evaluation of past performance. The offeror will submit with its proposal the applicable subcontractor, teaming partner, and/or joint venture partner letter(s) of consent allowing the Government to disclose the past performance to the offeror during negotiations.
The offeror will provide all past performance information pertaining to all proposed first- tier subcontractors with whom the offeror is teaming, as well as the offeror. The offeror will submit with its proposal the first-tier subcontractor’s letter(s) of consent allowing the Government to disclose the subcontractors' past performance to the offeror during negotiations.
1. Experience: The offeror will provide a description of up to five (5) current and past contracts as a prime or as a major subcontractor, over the past three (3) years, which are relevant to the efforts required by this solicitation. Relevant is defined as those contracts associated with environmental control systems, or other products similar to the effort required by this contract. Relevant contracts are also defined as those encompassing similar scope in the cost, complexity, Integrated Product Support (IPS)/logistics functions, configuration management, system engineering, and production requirements as this contract requires. The Government may choose to investigate contractors prior to the past three (3) years for the purpose of the evaluation, but not more than ten (10) years prior. In addition, any and all contracts terminated in whole or in part during the past five (5) years, to include those currently in the process of such termination are considered relevant and the offeror will provide past performance information for those contracts.
Information will include the following:
a. Role as prime or subcontractor
b. Place of performance, CAGE Code and Unique Entity Identification (UEI) number
c. Contracting activity, current address and telephone number.
d. Procuring Contracting Officer's name and current telephone number
e. Technical representative/COR name and current telephone number
f. Contract number
g. Contract type awarded cost/price
h. Final or projected final cost/price.
i. Original delivery schedule
j. Final or projected final, delivery schedule.
k. History of compliance with Government requirements for reports and responding to inquiries
l. Effectiveness of actions taken to resolve past and ongoing performance problems.
2. Performance: For each of the contracts described above, the offeror will describe the objectives achieved detailing how the effort is relevant to the systems engineering, design, production, and IPS/logistics requirements required by this contract. For any contracts, which did not/do not meet the original requirements with regard to original cost, schedule, or technical performance, the offeror will provide a brief explanation of the reason(s) for such shortcomings and any demonstrated corrective actions taken to avoid recurrence. The offeror will list each time the delivery schedule was revised and provide an explanation of why the revision was necessary. The offeror will also provide copies of Product Quality Deficiency Reports (PQDR), warranty claims, product deficiency complaints, Cure Notices, or Show Cause letters received on each contract listed; and provide a description of the corrective action taken and the extent to which the customer was satisfied with the response. For any terminated contracts, the offeror will indicate the type and reasons for the termination. The Government may choose to investigate contracts prior to the past three (3) years for the purpose of the evaluation, but not more than ten (10) years prior. In addition, any and all contracts terminated for cause in whole or in part during the past five (5) years, to include those currently in the process of such termination are considered relevant; therefore, the offeror will provide past performance information for those contracts. Since the Government may not necessarily interview all of the sources provided by the offerors, it is incumbent upon the offeror to explain the relevance of the data provided.
The Government reserves the right to use alternative resources to gather past performance information.
Other resources may include Contractor Past Performance Assessment Reporting System (CPARS); the Past Performance Information Retrieval System (PPIRS); PQDR databases; questionnaires; and interviews.
Offerors are reminded that while the Government may elect to consider data obtained from other resources, the burden of showing good past performance rests with the offeror.
3. Subcontractors: Offerors will provide an outline of how the effort required by the solicitation will be assigned for performance within the Contractor’s corporate entity and among the proposed subcontractor(s)/team members. Offerors will provide the above- required information for any proposed subcontractor who are proposed to perform 30% or more of the proposed effort based on the total proposed price or perform aspects of the effort the offeror considers critical to overall successful performance.
Offerors must specifically describe the work each subcontractor will perform. This information will be consistent with the allocation of the work discussed in other volumes of the proposal.
4. Past Performance Assessment Questionnaire: The offeror will send out Past Performance Assessment Questionnaires (Attachment 0009 ) to each of the Points of Contact (POCs) identified in the Past Performance Volume. The POCs will submit completed questionnaires directly to the Contracting Officer and Contracting Specialist (KS) identified above no later than the proposal submission deadline specified in the solicitation. The Subject Line of the emailed questionnaire submission will be: “PPQ: IECU Solicitation W911QY-24-R-0007 - (Offeror’s Company Name)” as specified in the questionnaire.
The offeror may add its own transmittal letter to provide an offeror representative name and telephone number; in case questions arise from the POC receiving the questionnaires.
Completed Past Performance Assessment Questionnaires (PPAQ's) are considered source selection sensitive and not releasable to anyone other than Government personnel and the contractor whose performance is being evaluated. Copies of the PPAQ's will not be included in the offeror’s proposal.
Preferred points of contact are, in order of descending preference: the program manager, Procurement Contracting Officer (PCO), or Administrative Contracting Officer (ACO). For work performed on a Government contract, questionnaires will be sent to a Government POC, regardless of the offeror’s participation in the referenced contract as a prime- or sub-contractor. For non-Government contracts, the suggested order of precedence is Contractor program or project manager followed by contract manager.
Offerors will include in the past performance volume a list of all the POCs who were sent questionnaires.
The POC list will be submitted in Table Format to include the following fields: Solicitation Number;
Offeror Company Name; Contract Number; Government Agency; Point of Contact Last Name, First Name;
Point of Contact Title; Point of Contact Telephone Number; Point of Contact e-mail address; date the questionnaire was e-mailed to Point of Contact (month/day), and an explanation of what aspects of the contracts are deemed relevant to the proposed effort, and to what part of the proposed effort they relate.
5. Organizational Structure Change History: Many companies have acquired, have been acquired by, or have otherwise merged with other companies, and/or reorganized their divisions, business groups, subsidiary companies, etc. In many cases, these changes may have taken place during the time of performance of relevant past efforts or between conclusion of recent past efforts and this source selection.
As a result, it is sometimes difficult to determine what past performance is relevant to this acquisition. To facilitate this relevancy determination, include in this proposal volume a “roadmap” describing all such changes in the organization of your company. A pamphlet or other commercial document describing such reorganizations may suffice. As part of this explanation, show how these changes impact the relevance of any efforts you identify for past performance evaluation/performance confidence assessment. Since the Government intends to consider past performance information provided by other sources as well as that provided by the offeror(s), your “roadmap” will be both specifically applicable to the efforts you identify and general enough to apply to efforts on which the Government receives information from other sources.
6. Subcontractor Consent/Client Authorization Letter: The offeror will submit, along with the past performance information required in this paragraph, a consent letter, executed by each subcontractor, teaming partner, and/or joint venture partner who are proposed to perform 30% or more of the proposed effort based on the total proposed price or perform aspects of the effort the offeror considers critical to overall successful performance. The consent/authorization will authorize release of adverse Past Performance Information to the offeror so the offeror can respond to such information. For each identified effort for a commercial customer, the offeror will also submit a client authorization letter, authorizing release to the Government of requested information on the offeror’s performance.
(vi) VOLUME VI – Small Business Participation Plan (Evaluation Factor VI). Throughout this document and all attachments, the definition of subcontractor for the purpose of Small Business Participation Plan includes both subcontractors and suppliers. The volume will be organized as follows:
FOR ALL BUSINESS TYPES: The Small Business Participation Plan is required from all offerors and will be evaluated in accordance with the guidance in DFARS 215.3, PGI 215.304(c)(i)(A) and the criteria listed in Sections L & M of this solicitation.
FOR LARGE BUSINESS/OTHER THAN SMALL BUSINESS ‘APPARENT SUCCESSFUL
OFFERORS’ ONLY: Subcontracting Plans (separate from the Small Business Participation Plan) will not be evaluated for source selection purposes. Other Than Small Business apparent successful offerors are required to submit a separate, acceptable Subcontracting Plan, in accordance with FAR Subpart 19.704, DFARS Subpart 219.704 and AFARS Appendix DD, prior to contract award. Subcontracting Plans will reflect and be consistent with the commitments offered in the Small Business Participation Plan.
The offeror will complete Attachment 0006, Small Business Subcontracting Worksheet:
demonstrate small business participation by detailing its proposed approach to meet the requirements under the Small Business Participation factor by addressing the following areas in its Small Business Participation Commitment Document:
Commitment to Small Business:
(a) Commitment to Small Business: Payment Procedures (applies to both Other Than Small Businesses and Small Businesses) and Compliance with Small Business Subcontracting Plans (applies to Other Than Small Businesses only).
(b) Proposed Small Business Participation Plan in performance of the potential contract (applies to both Other Than Small Businesses and Small Businesses).
(c) The Offeror will include a written statement of its established procedures to ensure timely payments to small business subcontractors in accordance with FAR 52.219-8, Utilization of Small Business Concerns (for those contracts under which it was required within the past three years from the closing date of this solicitation). If not required in any recent contracts, the Offeror will so state.
(d) For Other than Small Businesses ONLY. Compliance with terms and conditions of FAR 52.219-9, Small Business Subcontracting Plan (if required on recent contracts). The Other than Small Business Offeror will provide three Individual Subcontracting Reports (ISRs) for recent contracts (within the past three years from the closing date of this solicitation) that required a subcontracting plan. If not required in any recent contracts, the Offeror will so state.
