About this file

This document contains questions and answers related to solicitation number W911QY-19-R-0007-EEAAD from the Department of the Army Materiel Command Army Contracting Command Aberdeen Proving Ground. The solicitation seeks proposals for the Enhanced Electronic Automatic Activation Device (EEAAD). Questions from offerors clarify that separate emails should be submitted for each proposal volume and attachments to ensure receipt of all information. Additional questions ask for clarification on offering alternative line items and the government's interest in owning full data rights to the EEAAD technical data. Responses from the contracting officer indicate the government is only evaluating proposals based on criteria in the RFP and is not seeking alternate proposals. The government's interest in data rights is as specified in the RFP.

The purpose of this amendment is to incorporate three questions into this solicitation via the Question and Answers in Section J.

SUMMARY OF CHANGES

SECTION J - LIST OF DOCUMENTS, EXHIBITS AND OTHER ATTACHMENTS

The following have been added by full text:

EEAAD Solicitation Questions and Answers 25 April 2019

Question 1

Sometimes strict firewall settings will reject an email with too many attachments. Since there are quite a few documents to provide, do you recommend including all of them in one email, or would it be better to submit a separate email for each Volume and the corresponding attachments?

Answer

To ensure receipt of all proposal volumes, send a separate email for each Volume and the corresponding attachments.

Question 2

Because it is very important that we clearly understand what 52.204-22 ALTERNATIVE LINE ITEM PROPOSAL (JAN 2017) is stating / permitting, in the interest of offering a proposal(s) that is/are the most economical and administratively advantageous to the Government and the Offeror, however alternative to the RFP CLINS;

52.204-22 ALTERNATIVE LINE ITEM PROPOSAL (JAN 2017) states;

(a) The Government recognizes that the line items established in this solicitation may not conform to the Offeror's practices. Failure to correct these issues can result in difficulties in acceptance of deliverables and processing payments. Therefore, the Offeror is invited to propose alternative line items for which bids, proposals, or quotes are requested in this solicitation to ensure that the resulting contract is economically and administratively advantageous to the Government and the Offeror.

(b) The Offeror may submit one or more additional proposals with alternative line items, provided that alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation. However, acceptance of an alternative proposal is a unilateral decision made solely at the discretion of the Government. Offers that do not comply with the line items specified in this solicitation may be determined to be nonresponsive or unacceptable.

In the effort to propose the most “economically and administratively advantageous” options for the Government, we need to be able to offer additional / alternative CLINS which will allow the Government to choose the best balance of performance and cost.

Paragraph (a) indicates that offerors are “invited to propose alternative line items for which bids, proposals, or quotes are requested”. However W911QY-19-R-0007-0002 (1) answer #2 contradicts paragraph (a), stating, “The Government’s intent was not to request an alternate proposal, but to allow the Offeror the flexibility to propose a line item structure that matches its own system”.

a) So we understand correctly, we are not to offer additional / alternate CLINS that we feel would provide the Government all the options that the Offeror has to offer, and which would allow the Government to choose which would be the most economically and administratively advantageous to the Government?

b) If an offeror is allowed to offer an additional or alternate option CLIN, do we simply add them to section B and reference the alternate CLIN in the related proposal Volume?

W911QY19R0007

Paragraph (b) states, “Offeror may submit one or more additional proposals with alternative line items, provided that alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation”. However W911QY- 19-R-0007-0002 (1) answer #2 contradicts paragraph (a), stating, “The Government’s intent was not to request an alternate proposal, but to allow the Offeror the flexibility to propose a line item structure that matches its own system”.

Answer

a) The Government is not seeking alternate proposals. Proposals will only be evaluated based on the criteria specified in the RFP. FAR 52.204-22, Alternative Line Item Proposal offers flexibility to offerors in accordance with FAR Subpart 4.10, Uniform Use of Line Items

b) It is at the offeror’s discretion

Question 3

Given the level of technical involvement and oversight that the Government is requiring, in addition to obtaining the Technical Data at a “Government Purpose Rights” level. We feel that the most economically and administratively advantageous result for the Government and the Offeror would be for the Government to own the EEAAD Data Rights at an unrestricted level. This would allow the Government to have full ownership of the EEAAD (and other/future applications for it), eliminate the costs associated with an offeror being in the middle, and allow the government to negotiate directly with a manufacturer to get the best price.

a) Would the Government be interested in owning full unrestricted rights to the EEAAD Technical Data?

b) If the answer to question (a) is YES, then what is the desired manner to propose;

a. The government ownership of the EEAAD technical data

b. The offeror’s technical support of the Government owned EEAAD?

Answer

a) The Government’s interest is as specified in sections C-4.5.3.4, C-4.5.3.5, and C-4.5.3.6 of the RFP

b) N/A
