About this file

This document contains an Alaska Department of Natural Resources case file abstract and plat map for land on Umnak Island, along with details of a related U.S. Army Corps of Engineers federal contract opportunity.

The case file abstract outlines the land conveyance history and 1780 acres transferred from the U.S. to Alaska in 1966 for the North Shore Airport on Umnak Island. It also references two associated case files for portions of the tract. The plat map depicts the airport property boundaries and notes runway locations are to be verified.

The federal contract opportunity is a $140 million sole source small business set-aside for environmental remediation services issued by the Army Corps of Engineers Alaska District. No further details are provided on required services, response dates, or contract terms. The solicitation number is W911KB19R0007 and it involves work at former defense sites, though the specific opportunity does not elaborate further.

Project Description

You propose to conduct multiple stream crossings daily with up to 4 ATVs to conduct site reconnaissance of Fort Glenn for future cleanup activities. The intended crossing location is at the above referenced coordinate, but conditions at this site are currently unknown. If crossing at this location is unsafe, alternative crossing locations will be explored using existing roads or trails and may be used. Activities are intended to occur during the month of August.

Anadromous Fish Act The unnamed stream has been specified as being important for the spawning, rearing, or migration of anadromous fishes pursuant to AS 16.05.871(a). The unnamed stream is known to support coho salmon and Dolly Varden.

ChemTrack Alaska, Inc. - 2 - ISSUED: July 21, 2017 FH 17-II-0112 EXPIRES: September 15, 2017

In accordance with AS 16.05.871(d), project approval is hereby given subject to the project description above and the following stipulations:

1. The stream crossings shall be made from bank-to-bank in a direction substantially perpendicular to the stream flow. Vehicles shall not be driven upstream or downstream below the ordinary high water (OHW) mark of the unnamed stream.

2. Vehicles and equipment shall not be fueled or serviced below the OHW mark of the unnamed stream; vehicles with fuel, oil, or hydraulic leaks shall not be operated or moved in the stream.

3. Crossings of the unnamed stream shall be avoided if adult salmon are observed migrating through the area and crossings shall not occur if salmon redds are present or spawning behavior is observed at the crossing location.

4. The streambed and streambanks shall not be altered or disturbed in any way to facilitate the crossing. Vehicles shall not be operated on vegetated streambanks or in a manner or location that induces erosion or sedimentation.

You are responsible for the actions of contractors, agents, or other persons who perform work to accomplish the approved project. For any activity that significantly deviates from the approved plan, you shall notify the Division of Habitat and obtain written approval in the form of a permit amendment before beginning the activity. Any action that increases the project's overall scope or that negates, alters, or minimizes the intent or effectiveness of any stipulation contained in this permit will be deemed a significant deviation from the approved plan. The final determination as to the significance of any deviation and the need for a permit amendment is the responsibility of the Division of Habitat. Therefore, it is recommended you consult the Division of Habitat immediately when a deviation from the approved plan is being considered.

For the purpose of inspecting or monitoring compliance with any condition of this permit, you shall give an authorized representative of the state free and unobstructed access, at safe and reasonable times, to the permit site. You shall furnish whatever assistance and information as the authorized representative reasonably requires for monitoring and inspection purposes.

This letter constitutes a permit issued under the authority of AS 16.05.871 and must be retained on site during project activities. Please be advised that this determination applies only to activities regulated by the Division of Habitat; other agencies also may have jurisdiction under their respective authorities. This determination does not relieve you of your responsibility to secure other permits; state, federal, or local. You are still required to comply with all other applicable laws.

In addition to the penalties provided by law, this permit may be terminated or revoked for failure to comply with its provisions or failure to comply with applicable statutes and regulations. The department reserves the right to require mitigation measures to correct disruption to fish and game created by the project and which was a direct result of the failure to comply with this permit or any applicable law.

ChemTrack Alaska, Inc. - 3 - ISSUED: July 21, 2017 FH 17-II-0112 EXPIRES: September 15, 2017

However, this provision has no effect if, and only if, the sole proximate cause of the injury is the department's negligence.

This permit decision may be appealed in accordance with the provisions of AS 44.62.330–630.

1. The issuance of permits for historic, prehistoric, and archaeological investigations on state lands is authorized under AS 41.35.080 and 11 AAC 16. 30-90. Paleontological resources ("fossils") are included by definition under AS 41.35.230(2). These statutes and regulations establish the legal framework within which permits are issued and regulated.

2. The permittee (applicant) is responsible for insuring that the terms of the permit are carried out, including reporting and stipulation requirements. Either the permittee or Field Supervisor must meet the qualification standards in 11 AAC 16.040. Fieldwork under the permit must be under the direct on-site supervision of a person who meets these standards.

Note that field projects undertaken in response to the National Historic Preservation Act (e.g., "Section 1 06 Projects") must be under the direct supervision of a qualified professional satisfying appropriate professional qualification standards established in 43 CFR 7.8 and the Secretary of the Interior's Standards and Guidelines, 48 FR 44738-44739. These federal standards are more stringent than those required under 11 AAC 16.040.

3. The permit is not transferable. If the Principal Investigator (permittee) for a project changes, OHA shall be notified and a new permit executed prior to any additional fieldwork. Each permittee is responsible for insuring that reporting requirements are met for work conducted during the terms of their permits.

4. Activities shall be conducted as described in the application packet submitted to and approved by OHA and the land manager.

5. Any subsurface excavations including test pits, auger tests, and soil probes constitute ground disturbing (obtrusive) activities, and must be considered as such for other permit stipulations.

6. Applications for work that includes any ground disturbing activities and/or the collection of archaeological or paleontological materials must be accompanied by a Provisional Curation Agreement signed by the University of Alaska Museum of the North, or by a written agreement from another repository approved by OHA. For archaeological materials, the permittee may only implement a "no collection" policy if the materials are left undisturbed in original context.

Artifacts collected from excavations, including test pits, auger tests, and soil probes must be collected and catalogued.

7. A permit may be amended, insofar as allowable by regulation, to adjust contiguous or minor spatial changes, or to extend the termination date of a permit.

8. The permittee will fully indemnifY the state land managing agency and the Office of History and Archaeology.

9. The permittee shall insure that AHRS records are submitted to OHA for sites investigated under the permit, including both newly discovered sites and known sites that were re-investigated.

AHRS records should be submitted in a format, such as MS WORD, that streamlines entry by OHA staff (i.e., staff must be able to "cut and paste"). When the preparation of large numbers of site records is anticipated, permittees will be authorized and encouraged to enter data directly into the OHA Integrated Business Suite via remote computer.

I 0. Test pits shall be backfilled at the completion of each investigation. For projects that entail large block excavations, a plan for surface restoration shall be included in the research design.

II. Reporting: Either an interim or final report is due within six months after the completion of fieldwork. For multi-year permits, annual reports are required in addition to a final report. In the event that an interim or annual report is submitted, the permittee should provide a timeline for submittal of the final report. Reports shall be consistent with the Secretary of the Interior's Standards and Guidelines for Archaeology and Historic Preservation (48 Federal Register 447I6-42, September 29, I983).
