Section A - Solicitation/Contract Form

DESCRIPTION

EXECUTIVE SUMMARY

1. The objective of this contract is to provide Environmental Remediation Services (ERS) in support of a wide range of customers serviced by the Alaska District. Military customers include the Army, Air Force, Air Force Space Command (AFSC), the Alaskan Command (ALCOM), and Army Medical Command (AMC).

Other customers include agencies outside the Department of Defense (DoD), such as the U.S. Forest Service (USFS), U.S. Coast Guard (USCG), Federal Aviation Administration (FAA), National Oceanic and Atmospheric Administration (NOAA), Environmental Protection Agency (EPA), and Bureau of Land Management (BLM). Environmental remediation work executed under the new ERS contracts will primarily include investigations, studies, engineering support, remedial designs, removal and remedial actions and operations and maintenance activities for our customers. The contract will support of the Alaska District’s Formerly Used Defense Sites (FUDS) program, Army and Air Force environmental programs and the environmental programs of other non-DoD customers. The Alaska District is part of USACE’s Pacific Ocean Division (POD) which encompasses all areas covered by the U.S. Pacific Command (USPACOM);

therefore some work under this contract may be performed outside of Alaska but within POD’s area of responsibility (AOR).

2. Multiple awards will be made from this solicitation. This requirement is being competed as a total small business set-aside under the North American Industry Classification System (NAICS) Code 562910, Remediation Services. The resultant contracts awarded from this solicitation will constitute Indefinite Delivery, Indefinite Quantity (ID/IQ) type contracts as defined in FAR 16.504. Task orders will be awarded against the basic ID/IQ contracts using the fair opportunity procedures discussed in FAR 16.5 in addition to the competitive source selection procedures identified in Section 803 of Public Law 107-107 implemented in DFARS 216.505- 70 and Public Law 110-181, Section 843. In accordance with FAR 16.505 and DFARS 216.505-70(c), all awardees in a MATOC pool will be afforded fair opportunity to be considered for award of each order exceeding $3000 unless an exception described in FAR 16.505(b)(2) applies. Task orders may be firm-fixed price (FFP), fixed price with economic price adjustment (FPEPA) or cost plus fixed fee completion form (CPFF-CF). Based on recent procurement experience, it is anticipated that approximately 40% of the task order efforts will be fixed price. This solicitation is for a 3 year base period, with a 2 year option to extend performance, against which task orders will be issued for services as described in Section C.

3. The Government contemplates awarding three (3) small business ID/IQ multiple award task order contracts (MATOC) for ERS, however it reserves the right to award more, less, or none at all. The capacity for the restricted small business MATOC is $180 Million. This MATOC capacity will be shared among all awardees in the restricted small business MATOC pool.

4. The ordering period shall commence upon the date of contract award and may continue for a base period of three (3) years and an additional period of 2 years if the option is exercised. Per FAR 52.216-19, Order

Limitations, a minimum order amount of $25,000 and maximum order amounts of $20M per single order and $50M in combined orders have been established for these small business MATOCs. When requests for proposal (RFPs) for task order requirements are issued, offerors must provide sufficient detail with regard to labor categories and hours, material, and travel to allow an evaluation of the proposed cost. Travel costs shall not exceed the amounts allowed under the Joint Travel Regulation. Profit is not allowable on travel costs.

5. The U.S. Army Engineering Corps of Engineers, Alaska District will remain the Procurement Contracting Office and no other agency can make changes to the base ID/IQ contracts.

6. The minimum guaranteed order amount for each MATOC awardee shall be $25,000 for the entire contract.

SECTION C

STATEMENT OF WORK

ENVIRONMENTAL REMEDIATION SERVICES (ERS) CONTRACT

PRIMARILY ALASKA (VARIOUS LOCATIONS)

1.0 INTRODUCTION

1.1 The objective of this Multiple Award Task Order Contract (MATOC) for Environmental Remediation Services (ERS) is to provide the U.S. Army Corps of Engineers (USACE) with the capability to execute a full range of environmental remediation services necessary for investigations, studies, engineering support, remedial designs, removal and remedial actions and operations and maintenance activities for our customers. Requirements may be under the Formerly Used Defense Sites (FUDS) program or executed for military or non-military customers to include the Army, Air Force, Air Force Space Command, Alaskan Command, U.S. Forest Service, U.S. Coast Guard, Federal Aviation Administration, National Oceanic and Atmospheric Administration, Environmental Protection Agency or Bureau of Land Management. The work and services under this contract will be performed for the Alaska District, USACE. The Alaska District is part of USACE’s Pacific Ocean Division (POD) which encompasses all areas covered by the U.S.

Pacific Command (USPACOM); therefore some work under this contract may be performed outside of Alaska but within POD’s area of responsibility (AOR). Task Orders (Tos) will be performance-based and may be issued as firm-fixed price (FFP), fixed price with economic price adjustment (FPEPA) or cost plus fixed fee-completion form (CPFF-CF).

1.2 The technical requirements specified in this statement of work are intended to provide requirements for execution of the contract and a general understanding of the functions that the contractor may be required to perform. Individual TOs will contain additional detailed requirements for each specific project. The contractor will receive from USACE a complete scope of work or plans and specifications for each individual TO. The contractor may also receive data that is available from prior investigations, designs or remedial actions such as preliminary assessments, site investigation, remedial investigation, risk assessment, and feasibility studies as appropriate.

1.3 The Contractor is required to furnish all plant, labor, materials and equipment to provide environmental support at hazardous waste sites. The Contractor shall provide environmental support as required by the TOs issued under this contract. The Contractor may be required to work at hazardous waste sites under the use, control or former use of the Federal Government or at which the Federal Government has been determined to be a generator or potentially responsible party. Further, the Contractor may be tasked to provide environmental support on non-Federally used or owned sites such as Formerly Used Defense Sites (FUDS) or Superfund National Priority List (NPL) sites.

1.4 Some TOs may include language that the contractor shall work directly with regulators on all aspects of their work. For these TOs, the contractor shall be responsible for establishing and maintaining a good working relationship with these agencies. The regulatory agencies have the authority to require any and all documents to be sent to the agency for work being performed under an individual TO. The USACE and its customers may also need to be given the opportunity to review and comment on documents prior to or concurrent with the submission to the regulatory agencies. The contractor shall notify USACE of any meetings with regulatory agencies. The Government shall be afforded the opportunity to attend the meeting. USACE may request copies of all correspondence between the contractor and the regulatory agencies.

1.5 Work issued under this contract will typically utilize service (Service Contract Act) wage rates. Depending on the scope of work, construction (Davis-Bacon) wage rates may be required and will be included in the individual task order as necessary.

1.6 For cost-reimbursement work, the contractor shall agree to a negotiated cap on any indirect, fringe, and/or general and administrative overhead rates to be applied to work by the prime contractor under this contract prior to or soon after contract award.

1.8 The Contractor shall comply with all provisions of the current edition of the U.S. Army Engineers Safety and Health Requirements Manual, EM 385-1-1. Contractor will find the manual at http://www.usace.army.mil/CESO/Pages/Home.aspx
