About this file
This document is an amendment to a solicitation for a firm-fixed price contract to provide preventive maintenance and repair services for heating and ventilation systems at the Yongsan Cluster in Korea. The amendment provides responses to questions from offerors on topics such as the on-call repair services requirement, construction business registration requirements, and key personnel qualifications. The solicitation uses a lowest price technically acceptable (LPTA) source selection approach, and requires offerors to submit technical, past performance, and price proposals. Key requirements include providing preventive maintenance, routine and emergency repairs, and maintaining an inventory and assessment of the heating and ventilation systems. The contractor must also provide a quality control plan, phase-in plan, and equipment plan. The period of performance includes a one-month transition period followed by a base year with four option years. Proposals are due by 13:00 local time on the closing date.

The following have been added by full text:
AMENDMENT 0001
a. The purpose of this amendment is to answer the questions from the offerors as shown below.
Q1: We found that CLIN 0003 (On-Call Repair Services) is a requirement portion CLIN consisting of 121 Jobs per year.
In accordance with PWS 5.1.5.1, in order for a Contractor to respond to an emergency within 2 hours, 24 hours and 7 days a week, regardless of holidays, a Contractor shall have at least two technicians for safety and a supervisor on standby in turns.
In addition, Service Call Receptionists shall take turns in order to handle and record service calls that may occur for 24 hours a day (PWS 5.1.5.3 Records of Service Calls).
Standby time after regular working hours inevitably incurs fixed labor costs.
We think that the Government does not consider the above-mentioned fixed labor costs to respond to an emergency within 2 hours, 24 hours and 7 days a week.
So CLIN 0003 merely consists of 121 Jobs, not monthly Firm-Fixed Priced CLIN.
As you well know, nobody can expect how many service calls will happen in the future.
It will result in extremely high-priced Oncall services considering the fixed labor costs.
A1: Government limits 121 of NTE (Not to Exceed) amount for the base and option years. CLIN 0001 and CLIN 0002 covers most of FFP labor requirements so Government fully considered FFP labor portion of the requirement. In addition to the FFP portion labor requirement, government does not know future on call repair service as well but limiting not to exceed 121 jobs per year. Believe the offeror did not understand difference between emergency repair service and on call repair service. In my analysis, I don’t see any reason to change CLIN 0003 from requirement to FFP.
Q2: Upon reviewing the solicitation thoroughly, it has come to my attention that on page 18, there is a requirement for proposal submission requesting the Prime Contractor's valid Construction Business Registration(건설업등록증) for the business item category of "Building/Facilities Maintenance"(시설물유지관리업) in accordance with Article 9 of the ROK Law "Framework Act on the Construction Industry."(건설산업기본법)
However, it is essential to note that as of December 31, 2023, the industry category of "Building/Facilities Maintenance business"(시설물유지관리업) was removed following the amendment of the Construction Industry Basic Act in 2020. This change was further supported by the Ministry of Land, Infrastructure and Transport Notice No. 2021-932, which was enforced on July 1, 2021. According to this notice, companies previously registered under Facility Maintenance and Management Business had the option to convert their registration to Comprehensive Construction Work Business(종합건설업), specifically Architectural Construction(건축공사업) or Civil Engineering Construction(토목공사업).
Given this legal amendment and industry conversion, I believe it would be prudent to request the submission of a comprehensive construction business registration that aligns with the current industry categorization. Specifically, I suggest requesting documentation related to Architectural Construction or Civil Engineering Construction
(종합건설업- 건축공사업 또는 토목공사업) instead of requiring a certificate for an industry that no longer exists, namely 'Building/Facilities Maintenance business' (시설물 유지관리업).
I kindly request that the solicitation be amended accordingly to reflect the current legal framework and industry standards. This adjustment will ensure clarity for potential proposers and align with the current regulatory environment.
For your reference, I have provided the link to the legal amendments mentioned earlier: [Ministry of Land, Infrastructure and Transport Notice No. 2021-932 - Detailed Standards for Industry Conversion of Facility Maintenance and Management Business] https://law.go.kr/LSW/admRulLsInfoP.do?admRulSeq=2100000202477
A2: The Addendum to FAR 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (OCT 2015) and FAR 52-212-2, EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021) are revised to reflect above changes, from i) Prime Contractor’s valid Construction Business Registration (건설업등록증) for the business item category of “Building/Facilities Maintenance” (시설물유지관리업) in accordance with the Article 9 of ROK Law “Framework Act on the Construction Industry” (건설산업기본법) to i) Prime Contractor’s valid Construction Business Registration (건설업등록증) for the business item category of “Architectural Construction(건축공사업)” or “Civil Engineering Construction(토목공사업)”. in accordance with the Article 9 of ROK Law “Framework Act on the Construction Industry” (건설산업기본법).
Q3: Key Personnel requirements and qualifications. Could you please clarify what key personnel standards should we follow to conduct a proposal? Seems like the solicitation and TE13 Contractor Qualification standards havedifferencwes.
-CM’s requirement: License/National Health insuranceService Certificate (pp.2) -ACM: The RFP does not indicate ACM as a keypersonnel, but the TE13 does. (pp.2) -Engineer for Heat Pump System: RFP asks minimum of three persons, but the TE13 asksminimum of one person (pp.2)
A3: The TE13, Contractor Qualification is deleted due to the duplicated content within PWS. The Addendum to FAR 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (OCT 2015) and
FAR 52-212-2, EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV
2021) are revised to correct the discrepancies in TE and PWS as follows:
