Attachment 10: Solicitation Question and Answers Foreign Affairs Counter-Terrorism Training - W900KK-21-R-0056

1. Question/Comment: Given this is an IDIQ, is there a contract ceiling value associated with this requirement?

1. Response: Yes, IAW with RFP W900KK-21-R-0056, the resultant contract will be an ID/IQ contract, which will have a quantity ceiling that will determine the contract ceiling value once the contract is awarded.

2. Question/Comment: Is this considered a new requirement or is there an incumbent contractor? If the latter, could you please provide the incumbent name and contract number?

2. Response: This is a new requirement and there is NOT an incumbent.

3. Question/Comment: Is this solicitation restricted to SDVOSB only and that VOSB are ineligible to submit bids.

3. Response: This solicitation is set-aside for Service Disabled Veteran Owned Small Business.

4. Question/Comment: Is this going to be a small business set aside [ay] $12M?

4. Response: This solicitation is set-aside for Service Disabled Veteran Owned Small Business.

5. Question/Comment: Will the government please require a Letter of Commitment from the facility to prevent bidders from falsely bidding a facility they do not have access to but presume they do.

5. Response: Paragraph L.4.4.1. Subfactor 1.1 - Training Approach, #3, is being revised to state the following:

The offeror shall substantiate their capacity and capability to perform all of the requirements stated in the PWS within two weeks after contract award. This may include commitment letters from proposed facilities, land and property lease agreements, property titles, etc.

6. Question/Comment: Attachment 6: Performance Risk Assessment Survey is not a fillable form. Will the government please provide a fillable form or allow a 100% MS Word document to be used in the same format without the grey boxes?

6. Response: Attachment 6: Performance Risk Assessment Survey has been revised with the capacity to be fillable.

Revision A

7. Question/Comment: Will the government please explain the concept of task orders under this IDIQ. Section B requires a unit price for each Task Order as delineated in B.1 of up to 14 iterations per year. However the cost workbook creates cost variations of 8- 15, 16-22 or 22-30 student class sizes in Tab 1 (per student cost) and Tab 6 (unknown qty).

7. Response: Assuming that the question’s reference to the unit pricing under Section B is associated with the Contract Line Item Numbers (CLINS) on pages 2-5 of the solicitation, the offeror is not required to input prices for each individual CLIN as these CLINs represent the ordering period of the ID/IQ base contract. For example, CLIN 0001 (page 2 of the solicitation) includes a period of performance from 2 March 2021 to 1 March 2022 (See Section F). With the issuance of task orders, the Government may order up to 14 iterations under the authorization of this CLIN, during the specific period of performance 2 March 2021 – 1 March 2022, which is under the base contract of the

ID/IQ.

The range pricing (8-15, 16-22 or 22-30) will be used to determine the price for each Task Order, based on the number of participants on each class.

8. Question/Comment: Is it the governments’ intent to issue task orders below the 22-30 student class size, therefore requiring the other cost variations to be provided? If this is correct recommend removing Tab 1 & 6 and replacing it with 2 other sample Task Orders similar to Tab 7 for an 8-15 an 16-22 student class size. This will require industry to provide all pricing in 3 sample task order scenarios based off class size (as shown in Tab 7 “Sample TO”) and provide a clear TO pricing breakdown for the government. This will prevent the workbook costs to be manipulated to show rates at bid that later will change based off no connection of cost workbook tabs. These 3 Sample TO Scenarios could then become fixed Task Order pricing models issued by the government for 8-15, 16-22 or 22-30 student class sizes, forcing industry to provide 3 Firm Fixed models that cannot be manipulated. This additionally could create government cost savings for TOs issued below the 22-30 student class size as the contracted requirements are less.

8. Response: The Range Pricing required in RFP Attachment 9, Pricing Workbook, Worksheet 1-Range Pricing, will provide the offeror’s pricing per CLIN, per price range and per year. In accordance with the solicitation, these prices will be incorporated into Section B of the contract. Sample Task Orders for an 8-15 and 16-22 student class size have been added to RFP Attachment 9, Pricing Workbook. The purpose of Worksheet 6 is for cost and price analysis only. Please refer to the “Instructions” worksheet.

9. Question/Comment: We are required to provide a single “unit price” for section B. Will the government please clarify if that is for an 8-15, 16-22 or 22-30 student class size as each one will be a different unit price and then create a different NET Amounts for the entire section B. Recommend that the government require all bidders to use a 22-30 maximum student class to represent the unit price. This will ensure all bidders provide equal pricing and allows the government to establish the contract ceiling rates based off NET amounts.

9. Response: See question/answer to #7.

10. Question/Comment: TAB 1 Range Pricing has a column Cost/Student are these amounts to include all consumable, non-consumable, facility, instructor labor, role player labor and all indirects/burdens (G&A/Fringe/OH/Material Handling Fee, etc) or is the government looking for some other cost here? Creating 3 Sample Task Orders removes this tab.

10. Response: The information required for the Cost/Student column in RFP Attachment 9, Pricing Workbook, Worksheet 1-Range Pricing, is the total cost less profit. Once the total cost and profit amounts are entered, the Total Price will be automatically be calculated. Please refer to the “Instructions” worksheet.

11. Question/Comment: TAB 5 Labor Hours column are we to put the total labor hours for an 8-15 or 16-22 or 22-30 student class as each one will be different based off instructor to student requirements. Recommend that the government require all bidders to use a 22-30 student class to represent the total number of labor worked for a full student load class, ensuring all bidders provide equal criteria amounts.

11. Response: Worksheet 5 - Labor Hours will be removed from RFP Attachment 9, Pricing Workbook.

12. Question/Comment: TAB 6 Cost Breakdown are the amounts to be placed in this sheet a per student or per course costs? Creating 3 Sample Task Orders removes this tab.

12. Response: Worksheet 6 - Cost Breakdown requires both, per student AND per training (course). Please refer to the “Instructions” worksheet.

13. Question/Comment: TAB 6 Cost Breakdown are the amounts to be placed in this sheet to include all consumable, non-consumable, facility, instructor labor, role player labor and all indirects/burdens (G&A/Fringe/OH/Material Handling Fee, etc). Creating 3 Sample Task Orders removes this tab.

13. Response: Worksheet 6 - Cost Breakdown must include all amounts listed less indirect rates.

14. Question/Comment: Facility costs are only captured in the Tab 6 but not in Tab 7.

Are we to use the ODC line of the Tab 7 - Sample TO too show the facility costs. If this is not represented or required in the sample TO then bidders can exclude it to create a lower Sample TO pricing model that is not reflective of the actual costs. Again if the removed Tab 1 & 6 and required 3 Sample TOs based off student class size this would remove the variances and provide a clear TO pricing breakdown for the government.

14. Response: Each sample task order must contain all associated cost. In accordance with the “Instructions” worksheet, “Formulas have already been constructed to compute the total price. If the structure of the worksheet differs from the Offeror's pricing structure, the Offeror may add to the worksheet to make the worksheet complete and accurate. However, any additions should not degrade the overall objective of this worksheet.” The “Instructions” worksheet has been edited to provide clarification.

15. Question/Comment: These task orders are stated to be Firm Fixed Price according to Section B.1 however the Cost Workbook requires information to be provided as if this were a Time & Material or Cost Type contract. Will the government please explain the requirements to provide this level of detail if the task orders will be firm fixed price?

Additionally how will the government use the information in various sections to create a TO pricing model for TOs issued for an 8-15 or 16-22 student class size. Creating 3 Sample Task Orders removes this confusion and provides a clear TO pricing model.

15. Response: Sample Task Orders for an 8-15 and 16-22 student class size have been added to RFP Attachment 9, Pricing Workbook. The Government is NOT requiring certified cost or pricing data. However, In accordance with Federal Acquisition Regulations (FAR) 15.403-3(b), “Adequate price competition. When adequate price competition exists (see 15.403-1(c)(1)), generally no additional data are necessary to determine the reasonableness of price. However, if there are unusual circumstances where it is concluded that additional data are necessary to determine the reasonableness of price, the contracting officer shall, to the maximum extent practicable, obtain the additional data from sources other than the offeror. In addition, the contracting officer should request data to determine the cost realism of competing offers or to evaluate competing approaches.”

In addition, FAR 15.404-1(a)(4) states “Cost analysis may also be used to evaluate data other than certified cost or pricing data to determine cost reasonableness or cost realism when a fair and reasonable price cannot be determined through price analysis alone for commercial or non-commercial items.”

In accordance with the solicitation, offerors are reminded that a failure to submit all the required documentation in exactly the manner (timeliness and format) specified in the solicitation may constitute a basis for the government to reject a proposal as non-compliant and therefore unacceptable, at the sole discretion of the source selection authority.
