| Attachment 38 | Solicitation #: W900KK-20-R-0011 |
Rev Date: 7 Feb 2020
Relevant Definitions:
DoD System:
For the purposes of the EPOS procurement, the term “DoD system” pertains to all ACAT levels of Joint and Service programs, as well as any systems that have been designated as special interest by the DoD or any of its Service Components. Companies that develop and sell commercial products that have not been modified and/or developed specifically for DoD are not considered to be OEMs within the context of the EPOS procurement.
Original Equipment Manufacturer (OEM):
A company that, within the last five (5) years, has served or is serving as a prime or subcontractor in the development of a DoD system (includes hardware and software). In this case, there is potential that such a company could be placed in a position where it could evaluate its own product and/or its competitors' product, thereby creating an actual or perceived bias in the evaluation of system effectiveness, suitability, and survivability.
Non-OEM:
A company that, within the last five (5) years, has not served or is not serving as a prime or subcontractor in the development of a DoD system (includes hardware and software). In this case, there is little to no potential of placing that company in a position to evaluate its own product and/or its competitors' products, thereby likely eliminating any actual or perceived bias in the evaluation of system effectiveness, suitability, and survivability.
Self-Certification of OEM/Non-OEM Status I/We hereby certify that _____{Corporation/Company Name}_____ should be classified as an (…) Original Equipment Manufacturer / (…) Non-OEM as defined above, for the purposes of the National Cyber Range Complex (NCRC) Event Planning, Operations, and Support (EPOS) proposal evaluations.
I/We understand that an OEM classification for any member of multi-corporation proposals will cause the entire multi-corporation proposal to be considered an OEM proposal.
I/We understand that this classification may limit our eligibility to be considered for award of some Task Orders available for subsequent bid.
I/We understand that during the execution of NCRC EPOS contracts, any change to composition of multi-corporation teams will require re-certification of OEM/Non-OEM status and may affect team eligibility to be considered for award of some Task Orders available for subsequent bid.
I/We understand that this classification may be used to provide the Government the opportunity to direct conduct of NCRC events by a non-OEM Contractor, if conduct of these events by the OEM contractor may cause an actual or perceived OCI specifically in the case of formal DT/OT events in which US Code Title 10 Section 2399(d), Impartiality of Contractor Testing Personnel, must be adhered to.
