SECTION M - EVALUATION FACTORS FOR AWARD

M.1 BASIS FOR AWARD

M.1.1 GENERAL The Government plans to award a firm fixed price, multiple award IDIQ type contract for the ACFT equipment program as a result of this solicitation. The Government reserves the right to choose not to award a contract if such action is in the Governments best interest.

M.1.1.1 There are two evaluation factors:

a. Technical Factor

b. Price Factor

M.1.1.2 It is the Governments intent to award up to two contracts for 18,304 ACFT sets each, but reserves the right to award only one contract for 36,608 ACFT sets. Award will be made using a Lowest Price Technically Acceptable (LPTA) process, where award will be made on the basis of the two lowest total evaluated priced proposals meeting the technical acceptability standards for minimum estimated quantity of 18,304 ACFT equipment sets each. The Government will follow the process set forth in Section M.3 below. Under this scenario, pricing under CLIN 0010AA is FFP. Pricing established for 36,608 ACFT sets under CLINs 0010AA, 0011, 0012, and 0013 in

Attachment 0001 rev1 will be used for price evaluation only in accordance with Section L.4.2.5.1.

M.1.1.2.1 In the event there is only one qualified offeror, the contractor will receive a delivery order award for the minimum 36,608

ACFT sets, in accordance with Sections L.4.1.1.2., L4.1.2.1, L.4.2.5.1, and F.3.2., totaling 36,608 sets. The offeror will be evaluated for the maximum estimated quantity of 50,000 sets. Under this scenario, pricing under CLINs 0010AA, 0011, 0012, and 0013 in Attachment

0001 rev1 are FFP.

M.1.1.3 Award without Discussions: In accordance with FAR 52.212-1(g), the Government intends to evaluate proposals and award a contract without discussions with offerors (this excludes clarifications as described in FAR 15.306(a) which the Government reserves the right to conduct in order to obtain information to support the Pricing and Administrative volumes but shall not be obtained to revise the offerors proposed price or to obtain essential information to determine acceptability of the Technical Volume). Therefore, the offerors initial proposal should contain the offerors best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If discussions are held, they will be conducted with all offerors included in the competitive range.

M.1.2 Eligibility for Award. Award will only be made to an offeror who is eligible for award. To be eligible for award:

a. The offeror must be registered in System for Award Management (SAM) (see provision 52.204-7); and

b. The offeror must be considered a small business in accordance with NAICS 339920; and

c. The offeror must be determined acceptable under the L.4.1 Technical Factor; and

d. The offeror must be determined responsible (See Section M.3.5); and

e. The offeror must be one of the two lowest evaluated prices in accordance with Section L.4.2 Price Factor.

M.2 REJECTION OF OFFERS

M.2.1 The Government may reject any proposal if doing so is in the Government's best interest. Examples include, but are not limited to, the following proposal conditions:

a. The proposal fails to meaningfully respond to the instructions in Section L of this solicitation (e.g.. fails to provide the required substantiating evidence outlined in Section L, fails to submit pricing attachment 0001 in accordance with the instructions; fails to follow key proposal instructions or format requirements in Section L; or fails to provide data and information required in Section L);

or

b. When an offerors proposal offers a product or service that does not meet all stated material requirements of the solicitation; or

c. The proposal proposes exceptions to the solicitation requirements, attachments, exhibits, enclosures, or solicitation terms and conditions; or

d. The proposal contains one or more OCIs that cannot be avoided or mitigated. Refer to Section L.3 of this solicitation, "Organizational Conflict of Interest."; or

e. The proposal is unbalanced as to price. See Section M.3.6; or

f. The proposals acceptance period does not meet the Governments required minimum acceptance period (Refer to Section L.1.2), or

g. The proposal does not meet the required delivery schedule in accordance with L.4.1.2.

M.3 EVALUATION CRITERIA AND PROCESS

16 18

Name of Offeror or Contractor:

PIIN/SIIN MOD/AMD

M.3.1 Compliance Review. After receipt of proposals, but prior to the evaluation process, the Government will perform a compliance review of the offerors proposal to determine the extent of compliance to the solicitation instructions, and whether the proposal meets any of the conditions listed in M.2, Rejection of Offerors. The burden of providing thorough, clear, and complete information rests with the offeror.

M.3.2 Price Review. Unless otherwise rejected, the Government will then conduct an evaluation of the Price volume in accordance with

L.4.2 to determine a Total Evaluated Price.

M.3.2.1 The Government will then conduct an assessment of price reasonableness and unbalanced pricing of the two lowest priced offerors.

The government will ensure that an offerors proposed price is fair and reasonable and includes all data necessary to support the proposed price. .

M.3.3 Technical Review. Each proposals Technical Volume will then be reviewed to be determined acceptable in accordance with L.4.1. An acceptable rating under this factor will clearly demonstrate an offerors capability to meet all technical requirements in the solicitation. Evaluation will determine the practicability of the proposed timeline and overall delivery approach. Evaluation will ensure a feasible approach to completing delivery of all equipment by the delivery date. Evaluation will assess the Offerors capability to provide all the specified equipment by description and item specification, and will validate that all equipment clearly meet all solicitation requirements.

M.3.4 Pursuant to 52.212-1, the Government reserves the right to conduct discussions at any time.

M.3.5 Awards may be made up to two offerors with the lowest Total Evaluated Price which was also rated Acceptable under the Technical

Factor, and is otherwise eligible for award.

M.3.6 Determination of Responsibility

Per FAR 9.103, a contract will be placed only with an offeror that the Contracting Officer determines to be responsible. Prospective offeror(s), in order to eligible for award for this acquisition, must be able to demonstrate that it meets standards of responsibility set forth in FAR 9.104. In addition, the Government may assess the offerors financial ability to meet the solicitation requirements. The

Government reserves the right to conduct a Pre-award Survey on any or all offerors (or its subcontractors) to aid the Contracting

Officer in the evaluation of each offerors proposal and ensure that a selected offeror is responsible. No award can be made to an offeror who has been determined not responsible by the Contracting Officer.
